Good morning, peeps, and welcome to Okay f Daily with Meet your Girl Danielle Moody, recording from the Long Island Bunker. Folks, I hope that you had a RESTful and restorative weekend after the hellish week that we had last week. I have no idea what this Monday is going to bring for us, but I'm assuming that it's going to be a lot more of the same. Coming up in today is my conversation with our friend Glenn Kirshner, who you know.
I will say this, Glenn has been coming on this show consecutively for two years, every week without without fail um, unless I've been traveling or he's been traveling. He has dedicated his time to sharing with all of you and with me his hopefulness and his feelings about where the DOJ is going to go and whether or not we're going to finally indict those people that are responsible for trying to overthrow our government for mismanaging COVID nineteen, which
cost now over a million lives in this country. And I've always looked to Glenn for his hopefulness, for his you know wherewithal, especially when I'm in times of darkness and I will tell you that this conversation that you will hear is going to be very raw and very real.
And Glenn has moved into a space where after every bit of information that we keep getting that is leaked about the Supreme Courts, about Donald Trump and his documents about who knew what and when, and the fact that still still as I record this right now, there has been no movement to put criminal charges on Donald Trump or anybody associated with the Trump administration. And as time keeps ticking on and the Republicans continue to show their hand and show us exactly the type of country that
they want to turn America into. If we don't see immediate action by the Department of Justice before November, if we don't see immediate action by this administration right Biden with a series of executive orders before in November, our feeling now is one and the same that our democracy
is on life support. And when I say on life support, I mean that the midterms are going to be our last free and fair election if Republicans win, because they will dismantle everything that we know and have come to understand that separates the United States from many other nations, which is our democracy, our read of we the people when you are faced against a political party that wants to put women and people with uteruses back into the nineteen fifties, when we are seeing reports about not only
are they coming after Rob Wade and gleefully excited, and now their glee has turned into fear as cavan Haw and Thomas and others hide in their homes because of protesters that are showing up at their houses. Because guess what, abortion is personal. A woman's body is personal, and no government should have the ability to dictate and force you to have birth when they are not going to be picking up the expense for what it means to have a child in this country. They're not affording you the
ability to pay for childcare. They're not affording you the ability to have healthcare. They're not affording you the ability to have a good public education unless you're willing to pay the property taxes of where your child can get the best education. No, they're not doing any of those things. And so that being said, they're not stopping there, which is what I've been saying on wokef for the longest time.
Abortion is the beginning. It is the lowest hanging fruit, and particularly when you are doing it with an administration that just recently uttered. The word tells you exactly why it has been low hanging fruit, because we have always loved to say as Democrats, abortion should be safe, you know,
and rare. No, abortion should be safe and whenever the fuck you need it right, And it should be up to the person who is getting that abortion to make that decision, not their priest, not their rabbi, right, not their government, not their husband, not their what it should be up to the person. But now there are reports coming out folks where they're going after contraception. They're going after your birth control, not condoms, but your ability to take a pill and again dictate when, where and if
you become a mother, you become a parent. It's disgusting. And you know what I saw over the weekend. It was a New York Times article about the new excessive policies that the Taliban which is now in control of Afghanistan since we have pulled out in a historic disaster that of course we have long since forgot because now you know the world is in another war in Ukraine
with at the helm of Putin. But if you recall, as we were making this remarkable pullout from Afghanistan after twenty years, and watch this country, which America has been propping up but clearly not in the best way possible, collapse in a matter of weeks after twenty years. They're rolling out new rules for women pretty much every single week. First it was restrictions on your ability to work, no longer able to do that. Then it was on your restriction to be able to leave your home, to be
able to get an education for women. Now the latest that the New York Times is covering over the weekend is a full burka, the return to not just wearing a h job right, which again should be the choice of a woman to adhere to if in fact she
is devout. Now it is not a choice. It's highly recommended from this abusive terrorist government that a woman cover in a burka with just a lace lace over her eyes, that there is no showing of a figure or form or anything, and that if she does not adhere to those things, and the government goes to her home and speaks to the man in charge and he refuses to adhere to that, there is jail time and other penalties. Now we read these articles in the United States and
we think, oh, my god, how dare they? How archaic? You tell me what the difference is between what is happening in the United States, what is starting in the United States as a way to control women and people with uteruses, and what the Taliban is doing in Afghanistan. Now, I don't love I don't like it when people refer to the Republican Party. It's like, oh, the American Taliban. No, no, no,
you don't need to invoke them. But what I'm saying is for an organization that Republicans has always jeered against right and said we're archaic and this, that and the other thing, and we got to stand up. What is the difference between the way that the Taliban men want to control the women in Afghanistan and the way that the radical, radicalized Republican white supremacist party wants to control
women and people with uteruses. There is no difference. And it starts with abortion, then it goes to birth control, and then maybe they will begin to repeal workplace equity laws that were put in place. Maybe they go after Lily led Better, Maybe they go there. Right, you remember that major case that was one that then allowed for women to be able to sue their employers. Maybe the Supreme Court says, well, that hinders you know, CEOs and shareholders ability to make money, and that's a part of
regulations that corporations shouldn't have to deal with. So maybe they decide to rescind that. Maybe they go so far as to rescind the ability of you know, into racial couples to marry. We know definitely that they're coming for
LGBTQ people. So what's next? And Hillary Clinton, in an interview that she did recently and I did a TikTok on a couple of days ago, was very clear she essentially offered the modernization of Martin Neo Mueller's poem first they for She goes, if you're looking at what is happening right now, and you say that I'm not a woman and I don't care, I'm not black and I don't care, understand that when you allow this type of extremism to begin to take hold, that there is no
telling and no stopping them from rolling over every single other. Right, people like Hillary Clinton, Barack Obama, people like myself who are speaking out against the government. Do you think that these people will not have to be forced to flee in a matter of years. You think, folks, that what I'm saying seems extreme, that this could not possibly happen
in your United States. And what I'm saying is that the first half of your life that you understood what this country was, what it stood for, what you have been indoctrinated to understand, is no longer going to be the norm. We have already been on a downward slope, a descent over the last several years under Donald Trump. The things that we would have never accepted America has
rolled over for we Now. You heard reports over the weekend as well in Mark Esper's new fucking book, because everybody's got a fucking book to hawk so that they can put money in their pockets, but didn't give a shit about democracy or what their responsibility and their quote
unquote sacred oath was to our constitution. Mark Esper, former Secretary of Defense under Trump, wants you to believe that he stayed in office because he had a duty and a responsibility to be the grown up in the room so that Donald Trump wouldn't launch missiles into Mexico and then cover it up. He was in the room when he decided to order the hit on Solomony in Iran. These people are unhinged, They are draconian, they are vicious, and they are violent, and they are being led by
a fucking egomaniac. And everybody that had a responsibility to say something with all of the leaks that we saw coming out of the Trump administration, Mark Esper decided to hold that information as we were headed into the twenty twenty election and wait, wait until it was going to be worth a pretty penny that then he could sell and then try and sell us the lie that he cares as a way to scrub his reputation. Do not
allow him to scrub his reputation. He is shady, he is dirty, just like the rest of Trump's acolytes, just like the rest of the accomplices to the destruction of democracy that continues, continues to go on without anyone trying to intervene. I ask every fucking week where is the Department of Justice? Once again we see that the First Lady has made a trip to the Ukraine, which I think is great. I am very happy that our brilliant doctor Jill Biden went to Ukraine to go and visit
with and speak with the First Lady there. I'm very happy about the ways in which the United States has wanted to step up in order to preserve the democracy that is slipping through the Ukrainian people's grasps as Russia closes in and now Marapole is under Soviet rule, appearance with statues erected and Russian signs put up everywhere. I wish that this administration would take their tough talk and the force that they have been using and direct that
to the opponents of our democracy here. But we keep believing that somehow we're getting another by that the apple when we lose midterms, that all this is just all normal. It's not fucking normal. It's not normal to have a Supreme Court that just disavows precedent. It's not normal for Supreme Court justices to lie during their confirmation hearings under oath.
It is not normal to have a Supreme Court justice that had a wife that was closely associated with the insurrection and on the hot line with the then chief of Staff being one of the many voices to say that we have to do whatever to hold onto power. And again, no investigation to Clarence Thomas. But Chief Justice Roberts wants to have an investigation because of the leak that allowed us to see who these people are. And now you want to be fearful and making up Oh
my god, it's Antifa that's coming for us. No, it's not. You have to deal with the consequences of destroying our democracy because if you think that people are going to be going silently into the night, I got another fucking
story to tell you. Because as much as I like to say that people are asleep at the wheel, and I think that a majority of people are, because I think that they're too busy dealing with the fact that they don't know if they're going to be able to afford their mortgages or their rent, or making choices between what kind of groceries were getting because of inflation and the gas fucking prices. This is the climate that Hitler was able to covet and murder six million people without
the world fucking blinking. So when this Republican party that owns the courts, that owns the state legislatures start to institute their own version of Jim Crow two point zero and apartheid, and then they say that everything that they're doing is legal because they own all the lovers of power understand that all of the things, the horrific things that we have studied and learned in school, were all
legal at the time that they were happening. So unless this administration decides to wake the fuck up and see that this is not the Republican Party of your father's time, or your mother's time, or your grandparents' time, these people are radicalized. They are a cult, They are dangerous, and they want to inflict as much pain and violence as possible. In Esper's book, he talks about Donald Trump wanting the ability to shoot protesters in the leg can't we just
shoot them? All you need is somebody that had the ability to say, sure, we could shoot him. We'll say that they all had guns. We'll say that they were a militia. Put out that ship to Fox News. Let it spread like wildfire. No one will be the wiser because they control everything, and we'll watch our prisons fill up with political prisoners. This is where this shit is heading. I wish that I had some solve, some balm to
offer you as you ease into this week. But the reality is I need to rip the band aid off. We all do. I tell us to rest I tell us to restore, I tell us to get joy find joy every single day, because each and every day is getting darker and darker, and people keep asking what is the recourse, and what is the recourse and what is the recourse? Well, I really appreciate the people that are
standing on in front of Breta's house. I really appreciate the people that are standing out in front of Alito's house, in Roberts's house. I want them to live with the same type of fear and discomfort that the women trying to walk into planned parenthoods feel when they are being heckled and shamed. I don't want a Republican to be able to walk into a fucking restaurant. I don't want them to be able to walk into their fucking front door. That's where we're headed, and that is exactly what needs
to happen. They think that they are going to roll back our constitution and use it as toilet paper, and I am saying, let me tell you something. There is a lot that I am willing to do, and I think that many people are willing to do in order to fight back, and they need to be prepared to deal with the consequences of the choices that they are making. I have said any times before, things in this country
are going to get bloodier before they get better. And I don't even know what better looks like, but I do know that folks need to buckle the fuck up because this country is going on a ride that we have only ever seen in quote unquote developing nations, because that's what we have become. Coming up next, my conversation with our friend MSNBC Legal analysts and the host of
Justice Matters, Glenn Kirshner. Folks, As always, you know that when I have the ability each week to sit down with our friend Glenn Kirshner, host of Justice Matters and MSNBC Legal analyst, it is never a good time. We never have anything good to discuss, Glenn, not in the last two years. But this week, this past week was probably I think the worst that we have seen thus far. So I just want to get your reactions to our
constitutional crisis that we are now in. That Justice Alito's draft, and I put that in quotation marks draft opinion of the Mississippi abortion case pretty much single signals to America, to everyone that everything is on the table and that these justices in this six to three court are the ones that get to decide what is foundational to America. I just want your reactions from what you saw, how you were feeling, and then we'll go from there. Yeah.
So the phrase that continues to come to mind for me is we created this monster. And people really get angry when I say we created this monster because the first thing people say, understandably is I didn't vote for any of these Republicans. I certainly didn't vote for Supreme Court justices. Nobody did. But you know what, we all voted for the politicians who have been in office in recent years who allowed this to happen. The Republicans were
fighting for it. The Democrats may have been fighting against it around the edges, but we can see now that they were not fighting effectively. I maintain they've never taken both gloves off. And we created this monster. How did we create this monster when? And I definitely want to get to what you what you opened with, which is
everything is on the table, because that's hugely important. But we created this monster when we let Mitch McConnell act unconstitutionally to deprive Merrick Garland of his confirmation hearing and of vote, and instead of doing what I maintain we should have done which would have been a gloves off approach.
When Mitch McConnell said, I, as one man, will rewrite the Constitution, and I will say there will be no advice and consent hearing by the Senate, which the Constitution provides for, and I will not give you a vote on your nominee. What the Obama administration should have done, and this is not a criticism, because you know, I
embrace the progress we made under President Obama's administration. But what it should have done is instead of giving into that political terrorism, they should have said, you have thirty days, Senator McConnell to hold a hearing and give the nominee of a a vote. If you don't, I will deem that you have waived your constitutional prerogative to give advice and consent, and I will tell Merrick Garland to take his place
on the Supreme Court. Then Mitch McConnell Danielle would have had to have run into Federal Court and convinced the judges that he had a right to rewrite the Constitution as one man. He would have gone down in flames. And what would have happened, in my opinion, is the judges would have basically issued a writ of man, damis, do your job, Mitch McConnell, hold a hearing in a vote. Maybe he would have been confirmed, maybe he would not have been confirmed, but we would not have given in
to the political terrorism. But we did. We allowed it to happen. We let cavitall lie his flipping way through his confirmation hearing, and we did nothing about it. We created this monster, right, We let Clarence Thomas involve him self been deeply unethical, perhaps illegal conduct of sitting in a case where he was trying to bury deeply damaging information about his insurrectionist wife. We created this monster. What are we gonna do about it? Now? Dan Yell? Are
we gonna keep beating the monster? Or are we going to starve the monster? Because look at the confirmation hearing testimony of Alito, Gorsuch, Cavanaugh, and Amy Coney, Barrett, Barrett right, every one of them communicated Roe v. Wade settled law, starry decisive, entitled to respect. What is the opening paragraph of Alito's own draft opinion. It Roe versus Wade was egregiously wrong the day it was decided, and it must be overruled well that puts the lie to your confirmation.
Here testimony, you used party words, you were evasive, you were a flippin' weasel. Oh, I don't want to say flipping, but I'm gonna keep saying flipping. You were a flippin' weasel. And now you are proving yourself to be a liar. Danielle, What are we gonna do about it? Are we gonna keep feeding the monster? Or are we going to say this is illegitimate? You old justices cannot dictate that women must carry a pregnancy to term against their will, against
their decision, against their autonomy rights as human beings. Are we gonna let that stand? Are we going to keep feeding the monster? Or are we gonna say no, It's time for the rule of law to assert itself. And too, I don't know forty five hundred citizen tips with derogatory information about Brett cabitalf sitting at the White House where they were delivered by the FBI. Are we going to keep feeding the monster? And if we are, well, then
we will not keep our republic period. With respect to everything being on the table, Danielle, Once you say Americans have no constitutionally protected privacy, interests. Not only will the right of a woman to decide for herself what happens inside her own body go away, the right of gay marriage will go away, the right to contraception will go away, the right let me tell you, get ready, because segregation is on the table. Ye if you don't think they're
gonna say round versus Board of Education wrongly decided. Let's go back to the you know, framers of the Constitution. What did they have in mind about equal rights for minorities? Huh? I mean it's all on the table. We are being dragged by five flipping justices back into the dark ages. And are we going to let it happen? Are we going to keep feeding the monster, that's the only question, or are we going to decide that the rule of law must be asserted. I'm telling you right now, Glenn,
that we do not have This is my opinion. We do not have the right president and the right administration for this moment. We did not elect warriors. We elected a moderate. We elected somebody who we thought had a collegial relationship with Republicans and was going to be able to somehow coerce them back into their twentieth century mentality when decisions were made in corner rooms with a glass of scotch and a pat on the back. That is the world that Joe Biden came from. It the world
that he thought that he was going back to. And it is the world that, in our desperation in the election of twenty twenty, in our desperation, at the height of the pandemic, with no vaccine, with nothing in sight to give us any type of relief, we said, okay. It was not a resounding yes, that's my guy. It was a okay, this is the best that we can do to beat the beast that we see. And then come to pass, he elects, he appoints an attorney general
that should have been on the Supreme Court. Because the man, again is not a fighter. He's a deliberator. He's not a fighter. He's not somebody that was going to go toe to toe with these criminals. And so here we sit because and I'm happy that you said it, because here's the thing. I love Barack Obama. I love the Obama administration. It will go down as a footnote on
the very short golden period in our country, right. But the reality is is that they assumed that they were dealing with a rational opposition, a rational opposition that believed in the rule of law, that shared the moral fabric in understanding of our democracy. They do not. They are thieves, They are liars. And so your question is, right, what are we going to do about it? Because I'm telling you right now, there is not a voice in this
administration that is saying this ends now. They keep thinking that they're going to get another bite at the apple. And I'm saying to people this midterm election that is coming up in six months, this is the last free and fair election. Republicans take back Congress. We are done. There is no what if, what about? We are done. And so for me, Glenn, the question is, without action from this Department of Justice, what are our legal alternatives?
What do we do Without an activated Department of Justice to say, you know what, Brett Kavanaugh, you are an illegitimate justice. Forty five hundred messages to the FBI and they put it in a desk, They handed it over to the president. The former president twice impeached, who is an egregious liar. But this administration has that information, no movement, no movement. So without the Department of Justice, Glenn, what alternatives do we have to fight against this beast? You
know our options are limited, Danielle. You know I'm actually in the process of, together with some very hard working interns, putting together a list of the states that allow for citizens to request and in some cases, insist upon, grand jury investigations of corrupt public officials. I'm also looking into, and I don't want people to, you know, read too much into it, citizen laws that permit citizen arrests of
crimes that have gone unaddressed by the government. I don't pretend any of this is viable, but this is what we are left with. And as much as I like, how can you not like Joe Biden? How can you not respect you know, much of what he did and what he stands for? But I wanted to week, I mean literally when I heard him say, after this draft Supreme Court opinion was leaked, what are they gonna do next? Because the MAGA crew is the most extreme, you know,
political movement we've ever had. Why would you ask the question what are they going to do next? Because isn't that at least tacitly giving them permission for what they did last? Instead of saying they will do nothing next, because we will not let them claw back the constitutional privacy rights of women, period. And we're already hard at work at making sure the constitutional privacy rights of women are not revoked. Not what are they gonna do next?
What the heck kind of a presidential statement is that I have no idea? Maybe I literally have no idea, because I watched it and I said, oh my god, this must be the most feckless president I have ever seen in my entire life. You have tough words for Putin. For Putin, they are puffing their chest and beating their chest. But for the Republicans that are at war with our content, this was a declaration of war. Glenn, I am somebody who has been saying this for years on this show.
Watch this Republican party, see them for who they are. And I have been told that I am hyperbolic. I have been told that I am crazy, and I'm saying if folks do not remember. In amy Cony Barrett's confirmation hearing, she was asked a question about Brown versus the Board of Education. I didn't like her answer. Her answer was akin to what they've all said with regard to Rove Wade, and when I tell people that you don't care about abortion, okay, do you care about same sex marriage? Do you care
about public schools? Do you care about the environment, do you care about social security? Do you care about voting? Because all of those things now are going to be decided by five people who get to tell you that this is not deeply rooted in who America is. Well, neither was my life as three fifths of a human being. So if you don't think that all of those things
are on the table, then you're not paying attention. And so you know, if if you look into these things that you just laid out, I mean, in all honesty, Glenn, here is a really no recourse without action from the Department of Justice. We as citizens right can only do
so much. Am I wrong? I can't bring a class We can't organize and bring a class action of three hundred and thirty million Americans to do what Now there is absent the rule of law entering the fray being asserted by the people who have the power to investigate, indict, and prosecute people like Brett Kavanaugh, people like Clarence Thomas if it is determined he committed a crime and not just one of the most horrendous ethical breaches ever of
the Biosupreme Court Justice. You know, then we really don't have any hope. Then the Department of Justice and the Biden administration is just giving us over to the monster. And you're absolutely right. They thought they could negotiate and cajole and appease the monster and tame the monster. That's not how you deal with the monster. You starve the monster, You fight the monster, and figuratively speaking, you kill the monster that is trying to deprive you of your rights
as an American. You can't appease or tame the monster. And you know, I think we talk every week, Danielle, and I think we are at a loss why the Biden administration and the Department of Justice will not open their eyes to the fact that the monster is trying to kill our rights and they're responding again with more purty words and a hope that they can change the monster's minds. You're not going to change the monster's mind
and you're also not going to shame the shameless. Because this is the thing too, is that in every statement that is made, whether it is from Joe Biden, whether it's from Nancy Pelosi or Chuck Schumer. It is nothing more than a finger wag. It is nothing more than how dare that? Listen to the Vice president of the United States? How dare they? How dare they? How dare you?
How dare you do nothing? How dare you tell us that you need our votes and our money and we do so in the midst of a pandemic to save our own lives. And then you say, what will they do next? How dare them? History will remember? History won't remember them, you know why, because they're gonna burn the books. That's right, That's right. History won't remember this. So I mean I am I am truly Glenn this week, I
am truly at a loss. I am truly at a loss because I examined for myself and again I'm not a lawyer, but you brought up one one instance of the not fighting back. Three hundred and sixty some odd days Mitch McConnell held Merritt Garland seat hostage. There was no court case, there was no threat of taking you to court, there was no recess appointment, there was nothing.
You just let this. You tell us that the courts are important, and then you let this man hold a Supreme Court seat hostage as if they come open every year. That was mistake number two. The first mistake, which I have said, was the late Justice Ruth Bader Ginsburg twenty thirteen. Twenty thirteen, Barack Obama says, you should retire at the ripe age of eighty. I am not for telling women what to do, right. We don't ask men to retire. But I will tell you this. He could have appointed
a woman half her age Kavanaugh, Barrett, they're fifty. We're talking about thirty maybe forty years of a lifetime appointment. I just I, Glenn, I know that I ask you this before. If this is this a banana republic? Have we lost? Is this? Are we done? Is my question? Because I we have no constant. If the Supreme Court rips apart our constitution, are we not already inside of a banana republic? Is there a way out? Is there
a way out? You know? I think the aperture, that's the right word for the thing on the camera that begins to close. The aperture is closing. And I think there may still be enough room for us to wiggle out. But I'm not optimistic that we will because the way for us to wiggle out before the aperture closes completely, is for the rule of law to be robustly asserted and deployed by the people who are in a position
to do it. And why would wouldn't you? And I be kind of foolish to think that is about to happen, because it sure hadn't happened yet. And when I see the Supreme Court prepared to revoke the constitutional rights of women, and I hear the President say, oh my goodness, what will they do next? I'm not optimistic that the rule of law will now come roaring in like a lion and start to hold these constitutional cannibals accountable. I'm not optimistic. Where do we go from here? Glenn? That's my last
question for you today. Where do we go from here? Because I'm telling you I have relied on you for the past two years for hope. People know me. I'm a realist. I haven't had hope in a long time. I had hope in the twenty twenty election. I said, Okay, we did it. Then I watched the insurrection and I said, oh, they're not going to allow this. What I think that Justice Alito and this Supreme court's done, is provided a license for violence. Because I don't see where else this
is headed. You tell me, I don't have a good answer, you know, where where do we go? It would really be nice if we could actually organize and march ten million strong to send at least a preliminary signal that we will not stand for this. There's something that I want to say that I hesitate to say because I'll probably live to regret it, but maybe I'll soft pedal it. Everybody, everybody else in screams about how if Donald Trump is prosecuted,
his supporters will take to the streets in violence. I don't entirely believe that because his supporters, at their core are many of them are are weak human beings. I mean, when you know you can only feel strong when you have a big, old semi automatic weapons strapped across your belly and your your Confederate flag on your chest. That
tells me you're not a strong human being. You couldn't be weaker, right, So, I actually don't believe his supporters will put themselves in harm's way because they're soft and they're weak. But if you take our democracy away, I'm not going quietly. I know that's right. I'm not going you know what, we're all gonna go. We're all gonna
go on what terms. I'm not going to go now. Please, that's not a call to violence or a call to arms, but what I'm not going to go quietly into some Supreme court Hell's escape where women's rights are taken away, where you're right to marry is taken away, where you're right to contraception is taken away, where you're right to something other than separate but equal accommodations is taken away.
I'm not. I'm not going that way. I'm not. I'm not so that maybe all we have left, we organized, we march, we let it be known that we're not going that way. Oh Glenn, I mean I will say this, Um, you're one hundred percent right, because I have been saying I will. I I will be right alongside you. Because I refuse to go quietly into this good night and allow these people to drag me back to nineteen fifty two.
I refuse, I absolutely refuse. And to me, it is going to take a mass demonstration of people to say I'm not going to work, I'm not going to school, I'm not going anywhere but into the street until our democracy is recognized, until these people understand that no minority rule is not going to happen here, not again.
