A Constitution-less America

I'm shaking my head for those of you that are just listening to the audio, but if you are a subscriber on Patreon, you're watching the video so you can see me. But where do I want to begin? First off, I want to start with the Supreme Court. Fuck them, like honestly I can and not even begin to state how fucking done I am with this Roberts Court. I would say that they would go down in history as the worst Supreme Court, but I'm sure that book would

be banned. But the reality is is that the Roberts Court is hell bent on rolling back any bit of progress that was made in the twentieth century and bringing America back into the nineteenth century by giving full rein to the NRA, by giving you full bodily autonomy over to men to dictate and jurisdic how women can move, whether or not we have children, how we have children,

all of those things. But this latest slate of bullshit around Alito's wife and the flying of these flags that are in reverence to January sixth, that are wholly anti American right, anti constitutional. What do I mean by anti constitutional? Let me just say, because I just literally made that up. You're anti the Constitution. You don't believe in the values the laws that dictate this country, right, Like, if you're flying a flag that is an upside down American flag,

you don't believe in American values. So but somehow you're sitting on the Supreme Court telling the rest of us what is right and what is wrong, what is law and order when you don't believe in the tenants of the Constitution. And for Alito's response to be like, oh, well, my wife likes flying flags, Well, apparently women can have power, but only the power that Alito gives them, and it's

only one woman his wife go to fucking hell. And then, as of the time of this recording, breaking news came out that, uh, just John Roberts, who's being called before the Senate Judiciary says, yeah, I'm not coming because there needs to be a separation of power. Are you fucking dumb? So my response to the Senate Judiciary is, like, this actually was not an invitation to a party that you

get to turn down. Like we're actually going to hold you in contempt, right, Like we are ordering you to come to sit before this body and explain to us how you have two incredibly unethical, fucking justices on your court that you're doing nothing about. I want to bring something to folks' attention. And this is an op ed that was written by former guest of the show, representative Jamie Raskin in the New York Times. It's entitled how to force Justices Alito and Thomas to recuse themselves in

the January sixth case? Right, Because here's the thing. Not only is fucking Alito's wife flying insurrectionist flags at their homes, but we know that Clarence Thomas's wife, Ginny, was actively a part of trying to discredit our votes and overturn the election of twenty twenty. Of course, Merrick Garland and his spineless fucking ass has not hauled in Ginny Thomas, right, has not brought charges against her because oh, we don't

want to be seen as a political entity. Well here's a fucking tip, regardless of whether or not you follow the rule of law, which would have you look at Ginny Thomas, look into her spending her money, because you know she's literally in bed with the Supreme Court justice. There are actual rules right that should be followed, that are dictated. But for Republican I guess it's just you know, a please ken you not necessary because they live above

the law. So here's what Jamie Raskin wrote, quote. Many people have gloomily accepted the conventional wisdom that because there is no binding Supreme Court ethics code, there is no way to force Associate Justices Samuel Alito and Clarence Thomas to recuse themselves from the January sixth cases that are before the Court. Justice's alitos, Alito and Thomas are probably making the same assumption, but all of them are wrong.

It seems unfathomable that two justices could get away with deciding for themselves whether they can be impartial in ruling on cases affecting Donald Trump's liability for crimes he is accused of committing on January sixth. Justice Thomas's wife, Ginny Thomas, was deeply involved in the January six Stop the Steel movement.

Above the Virginia home of Justice Alito and his wife, Martha and Alito flew an upside down American flag, a strong political statement among the people who stormed the capital. Above Alito's beach home in New Jersey flew another flag that has been adopted by groups opposed to President Biden.

Justices Alito and Thomas face a ground swell of appeals beseeching them not to participate in the Trump v. United States, the case that will decide whether or not mister Trump enjoys absolute immunity from criminal prosecution, and Fisher v. United States, which will decide whether January sixth insurrectionists and mister Trump can be charged under a statute that criminalizes corruptly obstructing

an official proceeding. Justice Alito said on Wednesday that he would not refuse himself from the January sixth related cases. Everyone assumes. Jamie goes on to write that nothing can be done about the recusal situation because the highest court in the land has the lowest ethical standards. Each justice decides for him or herself whether he or she can be impartial. Of course, Justice Alito and Thomas could choose

to recuse themselves. Wouldn't that be nice? But begging them to do right the right thing misses a far more

effective course of action. This is the part that I want all of you to pay attention to the US Department of Justice, including the US Attorney for the District of Columbia and appointed US Special Counsel, and the Solicitor General General, all of whom were involved in different ways in the criminal prosecutions underlying these cases and are opposing mister Trump's constitutional statutory claims, can petition the other seven justices to require Justices Alito and Thomas to recuse themselves,

not as a matter of grace, but as a matter of law. The Justice Department and Attorney General Merrick Garland, you all know how I fucking feel about him, can invoke two powerful textual authorities of this motion, the Constitution of the United States, specifically the due process Clause and the Federal statute mandating judicial disqualification for questionable impartiality twenty

eight usc. Section four fifty five. The Constitution has come into play in several recent Supreme Court decisions striking down rulings by stubborn judges in lower courts whose political impartiality has been reasonably questioned, but who threw caution to the win to hear cases anyway. You see, folks, we actually have laws. It is not up to these justices to decide for themselves what cases they can or cannot be

impartial on. Because I want to tell you what if Sonia saw to mayor or any of the other justices were to be flying a flag that was, I don't know, maybe said black Lives Matter, maybe it's said Latino Heritage Month should be every month. Whenever the fucking case was, you can guarantee that it would be fodder for right wing media, that the pressure would mount, and that Democrats would probably fucking join with the Republicans in kicking them

off the bench. So how is it that we have these cases that are sitting before these justices whose wives have been absolutely and thoroughly involved with trying to overturn an election and airing their desire for I don't know, a constitutional less America, and they're allowed to consider whether or not Donald Trump should have absolute immunity. It doesn't make any sense, and we we should stop acting like

these justices are above the law. Fucking Roberts doesn't want to show up at the Senate Judiciary, then I don't know, hold him in contempt. Figure out with other constitutional lawyers how you compel this man that is running a rogue, right wing weaponized Supreme Court to show up, right that you force him to, because I'm pretty sure that if it was on the Democrats side, we wouldn't even be

having this conversation. I want Democrats to stop acting as if their hands are tied behind their backs, and that we are betting on the better angels of people that are heartless, that have no angels. We need to stop assuming the best in people that continue to show us the worst. It just doesn't make any fucking sense speaking of people showing us their worst. I would be remiss if I did not also bring us back to the horrific fucking images of Nicki Haley in fucking Israel signing

bombs that have ripped babies. Apart to say that Nicki Haley is depraved, I think would be too fucking kind. She is a fucking poor excuse of a human being. She is disgusting. Her actions this week should disqualify her from ever being able to run for office, let alone hold any office. And the fact that she would use what every country right is beginning to see and refer to as a genocide as her VP fucking rehearsal is

some bullshit. Any bit of consciousness that we thought that Nikki Haley could muster because she decided to go toe to toe with Donald Trump, we know now was nothing more than political theater. That she is willing to go above and beyond her as actually, to the fucking gutter, to the sewers, in order to be considered a VP

pick for Trump. She is fucking disgusting. You know, I can remember when screams or four hundred dollars haircuts could get you booted out of the political sphere, But somehow signing bombs or shooting dogs another Republican woman favorite pastime is okay. What folks need to understand is that this Republican Party embraces violence. They love it. It is their energy boosts, It is what drives this party now. Their desire to cause harm, to cause grief, to cause trauma

without any accountability is their goal. And if given the opportunity, because folks want to sit around and talk about, they're going to protest the vote because you think that throwing away your vote to some bullshit third party this time around of all fucking elections, when our democracy is hanging on,

is what you want to do. Tell me how that is going to help the people in Gaza and Rafa When you have the potential VP signing bombs and the rest of the Republicans saying bulldoze it, finish them off. How do you think your third party fucking vote is going to line up with this shit. We don't always get to do the things that we want to do. That's called adulthood, right. Some decisions that we make fucking suck, but we make them nonetheless because we have to, because

we are adulting. We have to pay bills, we have to pay taxes, we have to go to work, and we also have to vote to save our democracy. And that does not mean throwing away your vote on fucking RFK Junior or Cornell fucking West. I can't express to people how fucking stupid that is, and not only stupid, but dangerous. And you know I'm not one that likes to talk down to people because I'm like, oh, you

can make whatever decision that you want. Yeah, you can make whatever decision that you want when it was the primaries. Not when we're entering into the general election. No, you cannot. I am so sorry for you, because if you think that I find any joy or I'm out here rocking a Biden T shirt, I am not. But I know that as a black, queer woman, child of immigrants in this fucking country, I am not about to fucking put more fuel and ammunition into trump Ism by throwing my

vote away, even if I live in New York. So for you all that are finding these days tough, I want you to multiply that times a million, because that is what it will be like under a Trump regime that will never leave, that will arrest democratic members of Congress, political opponents, throw them in jail. Oh, where is their trial? We're considering them terrorists. They don't need a trial. That's what will happen. Oh, we can't possibly happen here. Give

me a fucking break. It will happen so fast it will make our head spin. So we have one opportunity in November to get rid of Donald Trump. As everybody is waiting around and by the time that this show airs, you know, there may finally be a verdict. But what does that actually mean? If Donald Trump is found guilty. Do you think that he's going to be hauled off there and thrown in jail. No, because he has the money and the lawyers to appeal, appeal, appeal, appeal, like

he has done in every other fucking case. He's not going to be remanded into the prison. Right, you can await your appeal there. If only Donald Trump would be treated like anybody else. But well, you know that that's

not the case. So I'm not holding my breath on this case or any of the other ones that are pending, because the most important case is whether or not the American people in November are going to decide that they want to see this project we call democracy through that they want to give generations of young Americans the opportunity to do a better job than the older generations have in destroying our environment, in destroying women's access to bodily autonomy,

in destroying affirmative action. Right. But if Donald Trump becomes president for life, and then there's a Trump dynasty and it's passed down to fucking Eric and Ivanka and this person and that person. It can't happen here, it has happened in other countries. Dictators are always elected democratically and then they tear down the very institution that got them. Folks, the times are hard, they are dark, and they're not

getting better. But what is happening is that people are becoming more conscious, people are becoming more woke, and that matters. I wish that it didn't take the deaths of fifty thousand Palestinians for people to recognize that Israel is running in apartheid state. I wish that it didn't take babies being ripped apart the images of children watching their parents lay burnt on the ground for the world to recognize that something is wrong here, and not just here, but

almost everywhere in every corner of this planet. America is no innocent. America is the biggest perpetuator of violence around the world. But we have an opportunity to push this president because in a second term, Biden is not going to be facing another election, so we honestly has nothing left to lose except his legacy, which I actually believe

that he cares about. So I would rather continue to fight for the expansion of freedom with a Biden in adminished in place, then be fighting for my life with a Trump regime installed. Those are the decisions that we have to make. Those are the tough pills that I continue to say that we are going to swallow because what is at stakes too much for me to sit idly by and tell you vote your conscience. Fuck that, vote for justice, vote for freedom, vote for bodily autonomy, vote

for clean air, vote for clean water. And there is only one candidate out of this bullshit two choices that we have that believes in any of that. It is not just one issue that is going to lead this election. It is every fucking issue that is at stake. Vote accordingly, dear friends.
