Yeah, ripped news. You need advice, so you don't have come running, just as as can. Shooter's gonna help come man Dix, he is the Troubleshooter Show. Now Tom Martino. Hey, I'm Tom Martino. Welcome to the show. Three O three seven one three talk three all three seven one three eight two five five. As you can see, I got all my goons in the studio. Uh and uh, welcome goons. We got Chief Mark and uh, Kevin Caulkin, got Jeff Vic camera transmission and then

who's got their back to me? And I'm sorry, Deputy Doc, Deputy doc. Well, I was right what I said, goons, welcome. Hey, I got some interesting you since today is Car Friday, car Day, whatever you want to call a day. You don't have to call it just about cars, but you can call about cars and of course anything to do with cars. And I have something I found quite interesting that Stephanie found

on Facebook. And I do find it very interesting. I normally don't find anything interesting on Facebook, but it seems this person did some pretty good research. Now, maybe they're just reposting it, but I checked out with my professor Bing, Deputy Copilot Bing, and all of these facts are true. Listen to this kind of disappoints me. And they're not just against Tesla, but they're looking at electric cars. But they took one Tesla battery one and they analyzed it. By the way, give us a call. By the

way, if you have a problem, question, you can plan. I'll go right to your calls. Three h three seven to one to three talk. I digress when I just want to make sure you know that three h three seven one three eight two five five, and we'll talk about anything you want. Make sure you don't wait too long. If you have a problem, a question, or complain, it festers and it becomes worse. Now, the Tesla model Y battery. This guy took a look at this and

said it takes up all the space under the passenger compartment. Oh, that's not so bad. But this is what I find fascinating. Guys, listen to this. It takes twelve tons of rock for lithium to be extracted five tons of cobalt minerals. This is one battery, one battery. Most coalbalt is made as a byproduct of processing copper. Five tons of coalbalt minerals. Now listen, so three tons of nickel or twelve tons of copper ore.

You must move two hundred and fifty tons of soil to obtain the twenty six pounds of lithium, the thirty pounds of nickel, and the forty eight point five pounds of manganese, then and fifteen pounds of cobalt. To manufacture the batteries also requires four hundred and forty one pounds of aluminum, steel and plastic

one hundred twelve pounds of graphite. This is one battery. The caterpillar to move this earth is a nine to nine to four h a and by the way, that caterpillar consumes two hundred and sixty four gallons of diesel in the twelve hours it takes the bulk of necessary minerals for manufacturing the batteries come from China and Africa. Much of the labor in Africa is done by children. When you buy an electric car, China makes the most profit from these batteries.

The twenty twenty one Tesla model y OEM battery alone, which is the cheapest Tesla battery, is currently on sale for four nine hundred and ninety nine dollars, not including shipping and insallation. The battery weighs one thousand pounds and the cost of the Tesla batteries are as follows, and they go through It takes seven years for an electric car to reach net zero CO two seven years,

seven years because of one battery. The life expectancy of the battery is around ten years, so that gives you three years to reduce your carbon footprint. The net result, you are adding to pollute, You are adding to climate change. When you go to the Church of Climate Change this weekend, make sure when you kneel down at the altar and you pray to Al Roker and the rest of them, that you let them know that you're sinning.

So can you believe this? Now? The energy required to process all those raw materials we didn't even talk about that, and to haul the batteries to the US, all of this means that your electric car is actually, unfortunately adding to climate change. Well, even when you charge it, though tom out of New York and other places on the East Coast with heating oil, it costs more to create the electricity to charge it than what the emissions from

the gasoline would be. All good points. So why doesn't anyone look at this? Why aren't we woke to this? Why are we making electric cars the standard you are because you're going fast as hell and they drive themselves. I love, by the way, I should mention this. I love electric cars. I love regular car well, I hate all cars. Okay, first, let me say that, but if I had to hate less, I hate electric cars less or the least. I don't have an electric car,

but I wish you did. And that's only because of Kevin and Jeff. They just poisoned me. I was thinking having a luxury German car would be really cool, and these guys said, no, no, Tom, they last fifty or sixty thousand miles truly before you have major problems. You can get an American car to last longer, and you can get so I started thinking this oil thing, the seals, the all that crap. An electric motor, that's one thing. You don't have all that maintenance and all

that. But if you look at the carbon footprint of someone driving an electric car, one battery, now the rest of the stuff. Okay, it's like a regular car, right, almost a little lighter weight. But think about this. If you think you're helping the environment buying an electric car, you are actually hurting the environment. You're hurting the environment. Now. That disappoints me too. So what the hell are we going to do? Horse and buggy? But horses fart, that's methane gas like cow's do. Right,

That's why we're trying to do away with meat. And we're going to be eating chocolate crickets. Maybe we are going to be eating chocolate crickets on bicycles. Won't that be a Californian's dream? Think about that, crickets and bicycles. I'm gonna run on that platform, I really will. Mary. You have a problem here, Mary, what's going on? Mary? High? Hi, good morning. I'm grateful that people like you are here to help people like me who don't get hurt very much. What happened? I'm

I'm eighty years old. I'm a widow who just moved to Denver abound month ago to live closer to a family member and to my church home. Okay, I bought a house online from an open door agency. No wait a minute, you did it everything online without looking at it. I was in Saint Louis at the time. I was living in Saint Louis, so I could not come to Wow. I can't even there's a lot of stuff that

can go wrong doing a house totally online. Mark was looking at one time a vacation house online that looked perfect, and he said, it was a amazing when you actually get there. How things are just different. I mean, they're just different. So tell me about it, Mary, what's wrong with the house? Well, hold on, I should say this was it misrepresented? Oh? Yes? Oh yes, you did you use you said the online agency? Or not the or the agency? What's the name of

it? Open door? Open door? Yeah, they were in the news recently because just last year they were fined by the government sixty two dollars to return money to people who sold their homes. Tool did you know that before you got a hold of that? I did not know. And that is it called open door real estate? What is it called open door? Is the name of the comty? And how were they acting? Were they your agent? I don't understand. Now, That's what I'm trying to explain to

Hi Tom Martino, your troubleshooter three all three seven to one three talks seven one three eight two five five. Welcome to the show. Mary says, we have a I have a problem buying a house. I bought a house from Saint Louis and I bought it in Colorado. Recently widowed and went to Open Door real Estate. I'm looking at him online, and so Mary, I want to know something. If you you had friends here, you had people here. I want you to tell your story. But I want this

to be a cautionary tale for people listening. Never buy real estate or anything sight unseen ever ever, ever, So go ahead, tell your story. So you went online, you found this house. Continue, Okay, I don't have families, So my son in law, who lives here was one person I needed to be near, plus my church home. So I did put my house up for sale. It's sold very very quickly, and I had only a short window of time before the buyer wanted possession and I could

get moved over here. So open Door was the only listing that my agent could find. The other listings here were not available when she looked for them. They o their listings I picked. They did not provide what's called the seller's disclosure statement when I bought a house, and I was told by a number of realtors and attorneys I talked to here in Denver that Colorado law mandates a seller disclosure statement for every purchase. Well, first of all, that's

not completely true. Oh, but I want to I want to examine this. What was not disclosed to you. And first of all, where how did you close by? Did you close online? Yes? Okay? Now what I want to know is this, You closed online and there was not a property disclosure statement? Is that true? Yes? Okay? Did you have the house inspected? Yes? Okay? And what did you inspect? Your fine? Oh well he found eleven red flags and forty nine orange flags.

Well then, well then tell me why you bought the house. Then you had your own notice? Why did you buy the house? For one thing, I did not see the disclosure something in the email, but I have the Okay, Harry, forgive me. Forgive me for this, okay, And I understand your eighty which, in my opinion is not an excuse because and being a widow is not an excuse. However, I feel for you, I really do. And despite my demeanor on radio and TV many times people don't think I care, I do. But I have to tell

you something. You're painting yourself into a corner and you want someone to help you out. You bought a house sight unseen, you had it inspected, but you bought it anyway because you didn't see the inspection report. Well, what do you mean? Why did you have it inspected. If you weren't going to read the report because I did not have enough time, don't love. That doesn't matter Mary. If you have something inspected, tell me this he found? How many red flags? Oh eleven? You know what?

You actually you actually hurt yourself by having an inspection. You see, a disclosure statement is technically required. However, the form of this seller disclosure statement is not standard or universal. And the problem is if you don't demand it and then you have your own inspection done, they can claim that you were in fact informed. So, in other words, if you did not read your own report, what good would have a disclosure statement have made to you?

They're going to make all kinds of arguments. And here's what I need to know right now, because you did so many mistakes that we can't I can't. We can't possibly go after those people. I mean unless you talk to an attorney, and they're going to tell you the same thing. And it's way A disclosure is so expensive it's almost better to fix the thing. So we need to go to the real problem. What's wrong with the house? Well, I have seven pages of work orders that were supposed to have

been done by Open Door choose a before I bought it. Now that's different, that's a that's a misrepresentative. So they agreed in contract to do seven pages of repairs. No, it's been in house work order seven pages of work orders in house at Well, what does this mean? Was it a contract? In other words? Mary, did they promise you they were going

to do seven pages of repairs? No? Did they present this is important, Mary, Did they present those those seven pages of repairs to you before you bought it, saying, by the way, we had these done. No? Then how did you find out about those seven pages of repairs? The agents at open Door? Evidently my agent asked for a full disclosure and that the work order. Well, Mary, if open Door has bad employees and screwed themselves, and if they said they did a thousand repairs and did

not do any that's not a misrepresentation to you. You didn't rely on those That wasn't detrimental reliance. They didn't say to Mary. And this is after the fact, you're saying, after the fact you found out they were supposed to have done seven repairs or seven pages of repairs and they did none of them. So what they never promised you? They were going to do them. They didn't promise anyone. In fact, they never told your agent they

did them. I'm I'm hitting you with some truth here so you don't waste time and money. What I want to know is this, Is there anything they told you that was a lie? Is there anything that your inspector did not find that they knew about and that could be something? Was there anything that they knew about that your inspector did not Yes, I believe. So give me the biggest thing. The roof leaks. Okay, the roof leaks. How do you know they knew that because there was a stain on the

carpet that I even asked, said, why didn't your inspector? Why didn't your inspector see it? Wait, you don't even let me finish this sentence. Okay, go ahead, go ahead. There was a stain on the carpet. Go ahead, stain on the carpet when I saw the video tour that my agent created and I asked about it and she did not know the source. And when on this last Friday, Saturday and Sunday when it was

raining so much here, that was exactly where the roof was leaking. And okay, Mary, I know you think you need to finish this, but I heard enough. There's a spot on the rug. Here's why I heard enough. You saw that spot in a video. Your agent and your inspector did not go further. You again screwed yourself by seeing it. You actually saw the spot. The roof leaked. They didn't tell you. Now, your agent didn't know the roof leaked. You didn't know the roof leaked.

Your inspector didn't know the roof leaked. And I asked, why should the seller know the roof leaked? And you said, because there was a stain on the carpet. But that very same stain your own agent didn't call to your attention. Your own inspector didn't say the roof might be leaking. But you expect the seller to know that. Do you have any records that the seller tried to fix it and failed? You know you might go, And I fully expect your I fully expect you're gonna hang up the phone and hate

me. But I'm gonna tell you something. Those who are truly listening will know what I'm trying to do, and that is get to the essence. Because you have nothing right now, all I hear is you your agent and your home inspector were negligent. Negligent, and now you want to go back and try to hook the cellar. Now, this seller might be a scumbag, I don't doubt it. However, you walked right into the trap and let them rip you off. You had an inspection with eleven red flags.

You had a spot on the carpet that you brought up to your agent, and your agent didn't have the sense to have your roof inspected. Neither did your inspector. And now you're saying they should have told you the roofleet. Please tell me Mary that you understand that you have a very difficult uphill battle. Actually you're not correct in your conclusion. Go ahead, tell me where I'm incorrect. Go ahead. A quarter included some of the work orders which

I only received very recently a couple of days ago. Included clean that stain from the roof flake and repair the steam lane from the roof flake. And that was open doors awareness well before the stamp. Okay, how much will it cost to fix the roof? Someone just did that the other day and I have not been built for it. Okay, Yeah, so that is one thing that you can prove they knew about that they did not disclose. So let's go after them for that repair. Oh, there are a number

of other things. There are many more items town that they had known about that they did not correct, and they include live wires, electrical problems, plumbing problems. Get up all your repairs. What will they come to? Do you think, Well, I've already spent over ten thousand dollars on this move in the first place, what I've spent here, So Mary, I need to know specifically the repairs you had to make that they knew about and

did not disclose. I have it on a document I can email it to if you went good reason, tell me the ones where you can prove they knew and you had those repairs to make. Those are something that will work if you can prove that they knew about them and did not tell you. However, I'm going to tell you what their defense is going to be. You had noticed. In fact, that means that even though they didn't tell

you, you had an inspector who told you. If those problems that you say they knew about and did not tell you about are his inspection report, you will have a very difficult time going after them. For example, if they if they knew about a foundation problem and did not tell you, and your inspector has that in the report, then they could they could make the claim that even though they did not disclose it, you were in fact disclosed

in fact, and it's your fault you didn't pay attention. So here's what I need. The inspection report and then the things they knew about that you can prove that they knew about and withheld. If any of those two things match, then you're out of luck. If your inspector knew about him, that means you knew about him, and even though they didn't tell you about him, you still knew about him. So you're not allowed to walk into

a trap and get injured and say they never told you about it. If you knew the trap was there, If you knew a dangerous condition exists and were injured, you can't go back to the person who created the dangerous thing and say you should have never done that. It's a very it's a very

delicate matter, but it's not as easy as you think. The point I'm trying to make is this, I am looking for something solid we can go after open Door for for an eighty year old widow, because I do want to help you, but you got to be able to show us something that we can nail them on, and you say you have it, so I'm going to wait until you send it to us. Here's what I need. The inspection report and the stuff that you say they knew about that they did

not tell you about. Okay, and we'll match them up. And if you were uninformed of any of those, then I think we can call open door and say, listen, you listed this home and did not do this. I don't know what else to say, and I hope people listening understand the point I'm try trying to make with this call. It is this. If you if you claim someone did not inform you but you knew about it,

you're screwed. So you need to go after the people that did not tell you about something that there was no way for you to know about. More coming up. There's many things I couldn't have known about. More coming up. Go with a sure thing Denver's Best Roofer Excel roofing dot com.

Hi Tom Martino, you're a troubleshooter. Three all

three seven one three talks seven one three eight two five five. Welcome to the show. We are here to help you solve problems, answer questions, and take complaints. And I want, I want your opinion on this real estate deal? Mark, were you listening? Anybody listening? That is this thing working? Three all three seven one three talk. I guess they're not, like, no, we got you. Okay, what's going on? What's going on? What did you think of the real estate deal? What

did I think of it? I think she's screwed. Okay, Now can we get that information? And let's go over it. I mean I can't what could we possibly change. Let's look at it from that standpoint. Let's put it this way. Let's say something. Let's say there was a problem that her inspector did not see. And let's say it was a serious problem. And let's say that they lie on the objection or the inspection objection or whatever they knew about it. Let's say they knew about it and they didn't

disclose it. I think we can go after them for that one issue, or two issues or three issues. She says there are multiple ones. So remember, these have to be problems that she did not know about it. I want to see, let's get her to send the disclosure. There was no disclosure mark out. Oh my god, that's the point. But see, here's the point. Even if there's not a disclosure, technically, if you knew about it on your own, if the inspector brought it up,

that's still a defense. I know that sounds crazy, but it's still because she hired someone to go out there and look at it. Right. So if an inspector goes out to a house and says, you have a bad sewer and a bad foundation, and let's just say those two things, let's see your inspector writes that in there, or there's a serious red flag for the foundation and a red flag for the sewer system or the septic let's just say that. Now you go through a closing and you don't get a disclosure

statement, and you find out you didn't read your report. Now you find out you have a problem with the sewer and the foundation, and you go after the real estate company saying you never told us. If she hadn't had an inspection, that would be a really legitimate argument. But they can make the defense as crazy as this sounds, Yes, we did not tell you. We missed it. We did not tell you. We're sorry. However, it's in your own inspection report, so you did know about it.

It's and what dollar figure are we talking about? Did you crank dad out of her? Yeah, we went over all that marchy. How much does it? Here's the bottom line, she said, thousands of dollars. The point is this, Well, my point is a lawsuit if it came up to that could be way more than thousands of dollars. Well, she's hoping not to have a lawsuit. She's hoping we can help her get the money,

and we probably can. If if there was a if there was a serious problem that they did not disclose, that her inspector did not find. I can't say that enough. I'll give another analogy if I tell you if there is a sinkhole in my backyard and I am or in the backyard or in the street or somewhere, there's a sinkhole, and your inspector says there's a sinkhole there, don't go near it. But you don't read that report

and you get injured in that sinkhole. You can't go back after the people for not telling you about the sinkhole if your own inspector told you about it, because you yourself were negligent. My point is Mary, her agent, and her inspector were all negligent. They have a shared responsibility, and I hope she understands that. That's the point I'm trying to make. And I emphasize this and can't emphasize it enough because people, you must take responsibility.

I know that's a bad word in today's world, responsibility. And people say, well, my god, Tom, I thought you were a consumer expert. How dare you talk about responsibility? How dare you? Well, that's just life, and this show is about helping people, real help, not pretend help. Oh you, poor dear. They should have done this, They should have done that, They should have should have, should have, should have, should have, should have. No, you should have done

some stuff too, Brian. What's going on, Brian? Welcome to the show, Brian. What's happening? Yes, how's it going on? Mister Martinez, how are you doing today? What's happening? Man? Oh? Well, I just wanted to give a kudos in a shout out to a contractor that you previously mentioned on your show, Steve the star Peener, and it's star Quality Painting. I really appreciate you taking the time to let us know. We

I read your email here, missy, so pretty much to tell your story. I'm sorry I couldn't hear you. I did read your email, Oh perfect, Thank you. So Basically, what I don't understand is this You hired this company right, and you should only have to pay your deductible. Why do you have more to pay? Can you explain that part? So?

I got an email from page crumbly saying that they he and his supervisor read the insurance papers wrong and that I would owe an additional four thousand plus out of pocket because of it. But what do they mean they read it wrong? What does that mean? It was the depreciation costs? Oh? They did? Okay, hold on a second. Your insurance policy, no matter who you had as a roofer, would not pay anything. But what they call ACV. Now, I got to make sure that's correct. But

do you have an ACB only policy? Yeah? Hold on. Then then this is a very special problem and it might not be their problem. He gives you a free analysis if you decide to ever list in the future, he'd love to help you. One of the best people, most productive agents in the country. Three oh three nine two zero

sixteen twenty two. Franc around the real estate man dot com. All right, so listen, Mitzi said she hired a roofer, and I looked at the email extensively, and I'm going to tell you and then Mitsy's going to finish her story. She said she was assured she only had to pay her

deductible and they took a thirteen thousand dollars check from the insurance. Now it turns out that her deductible is way more than she thought because she only has an actual cash value policy, which means her deductiles is going to be a lot of money, a lot of money. In fact, she's only going to be covered for ACV that's actual cash value. Now that's not the roofers problem because technically they told her the truth. She's only responsible for her deductible.

In this case, her deductible is going to be a lot of money because they're only covering actual cash value. So they should just get If she doesn't want to get the roof done because she can't afford it with the coverage she had, then she should send that check back to the insurance company and say I can't get the roof done, or at least take the money and then deal with it in the future. But they shouldn't keep her money for nothing. That's for sure. Now tell me what part of the story I

missed or did I get it wrong from your email, missie. So at this point, you know, when he came back to me with the additional four thousand dollars plus, I wanted to cancel my contract. Sure, and they I left a message no reply. I had a friend of mine who's a lawyer, send a letter saying they weren't abiding by the contract. Ho, ho, hold on, now, hold on. I need to know this. How did this attorney figure they're not abiding by the contract because I

sent him a copy of everything. What did What did the attorney think they were not abiding by it? I would guess, I would guess because they didn't realize Tom it was an ACV policy. It said they're going to do it forever the proceeds of the insurance company. Like, oh, oh, so they wait a minute. So they did sign a contract saying whatever the insurance pays, we're gonna do it for exactly. Oh, then they screwed themselves because they agreed to take the lower of it. No, they screwed

her because they have her thirteen thousand dollars. No, I know, and I have a roof. No she needs to get that back either. I agree with her attorney friend, she needs to get her money back. Now. Listen, had they put down in there, had they put down a price for the roof and she's responsible for whatever the insurance doesn't pay, then then they'd be golden. But you're telling me the contract says they will do

it for whatever the insurance pays. Then they either have to do the roof for whatever the insurance pays, or they need to give your money back. But you understand, go ahead, miscy. Well here's the other thing. So I them the letter to cancel. They wouldn't reply. I finally got a hold of the VP of sales. She said that we'll be an additional charge of thirty five percent to cancel my contract. No, there won't, not if they breached the contract. Well exactly and well in my contract that

I signed, there is nothing about a thirty five percent charge. When I asked her for all in for all paperwork with my signature on it, she provided me a paper that I'd never seen before. Can I ask you something on Mitzi, This is really important, This is really important. Are you sure Mark? We don't have a copy of the contract, do we Mark, No I am, I am taking her at her word. She said it. So yeah, missy, Mitzi, the contract that you signed with

them, Are you sure? The contract said that they would complete the roof for insurance proceeds. This agreement does not obligate the owner or Orange Elephant in any way unless the damage is approved by your insurance company and accepted by Orange Elephant. The contract price by this sign contract owner authorizes Orange Elephant to pursue owner's best interests of roofs, citing windows and other gutter replacement that not repair. That's not missi. MISSI, hold on letter, keep reading. I

think I want to get a copy of a mark. It's not going to tell us everything because either they agreed to do it for insurance proceeds or they didn't. Well, it says, it says the insurance. It says at a price agreeable to the insurance company and Orange Elephant, with new additional cost to the homeowner except for the insurance deductible. There you are, okay. That is okay, MITSI. Your insurance deductible in your policy is whatever the

insurance doesn't pay. You think, technically that's right, That's how that would be read in the in the contractual language. Mark on her policy, on her ACV policy, that's exactly the way it's written, that they will cover the roof cost according to actual cash value, and she's responsible for the balance. No, I understand that. What I'm saying is she probably has a deductible as well. So let's say her deductible is one thousand dollars or whatever

it is. I don't know if you can make the leap that the actual that the depreciation is part of the deductible. Oh no, No, I don't think, And I think they should hold her the contract. I think it's messy enough they need to give her money back. But MISSI, do you understand this is something I really need to get across to you. Do you understand that no matter who you get to do your roof, you're gonna have way more to pay then? And I'm okay with that. I just

don't want them doing it, and I agree with you. You know what, Mark, did you call Orange Elephant during the break? Yeah? Unfortunately they're based out of Illinois. I did leave a message, but I mean they're probably out of this statement. They're based out of Taxes. Well, you know, Mitzi, why did you hire them. It was they were recommended by a friend of mine and I had from the day one. They were not listened to any questions I had. I think, I think,

you know what, MITSI. They need to just refund your money so you can go somewhere else. But they won't've been trying to do. They won't. They will not answer my phone call, they will not answer my email anything. Well, we need to hound them. We need someone and honest to goodness, we need to hound them. They need to give your money back. You know, I could see that cancelation, Mitzi. I could see them charging you the cancelation if you simply changed your mind or were willy

nilly. But this is this is a real issue that that contract is muddy. It's saying you're deductible. It's saying you're deductible. And I did not realize that your ACV policy not only is an ACV policy, but also has a deductible. So they were kind of screwing themselves. They were saying, we're going to do it for whatever the insurance pays, and all you have to pay is your deductible. You're going to make the argument that you're paying

way more than your deductible because of the ACV they won't accept. Now, if they agreed to accept the ACV, then you would gladly pay your deductible, right exactly? Uh huh? So how much did you say you're deductible? Was? My deductible was twenty five hundred and you would gladly pay that. What you won't pay is the additional money. Now, MISSI, do you have the contract? You can send us? We need to see it. Yeah, all right, good, Hey, we need to assign this

someone to go kick their ass and to try to get this money. They're not going to win this. They're not going to win this. I mean, I don't see how they win it if they if they wrote an ambiguous contract. And by the way, way, did you get a three day right to rescind in that contract? Yes? They did? Okay, and did you? But you didn't. You never signed anything at all on that contract that says they can keep a cancelation fee. No, And I'll bet

you that contract. Does that contract have an exact cost of the roof? They're not allowed to put in that contract at a price agreeable to everyone that they According to Colorado state law, they have to have a price in that contract and they don't do they They do not see Mark in every way, every way, shape or form. They did not comply to law in Colorado. I agree one hundred percent. All I'm saying is they don't care.

They're not even in this state. They're either an Illinois or Texas. So we got to figure out a way to let people know about it and to get pressure on that. What's that that I gave you? That the number that it gave you, Katie Gribbin, were you able to to get a hold of her? I did not call that number. Okay, let's try that. And who should be give this to? Really we should kick their

butts on this, that they can't just keep her money. Well, I already left him a message, so we'll see if we get a call back. Okay, I'm gonna I'm gonna put Mark's nighting down on this for now, and then if we have to go further, we'll see. But really, we're with you on this one. I mean, this is a bad one, and goodness gracious, from now on, don't go by what a

friend recommends, go by who we recommend. Please, I'm serious. You should have called Excel Roofing and in fact, if you went to their website technically right now, you could go to excel Roofing right now and put your address in you will get the price of that roof as to what it really should cost. You should do that for fun. Excelroofing dot com. You really should you go there and then put your address in there and then put down the kind of roof you have, and you'll get a price, so

you'll know then what that should be costing you. And that's a real deal. Let's talk and see what we can do for you. Okay, So Lively Day today is card day, though we still have our people on so so we want to talk about that. So guys, as far as the discussion in the beginning about electric cars, and by the way, we have some lines open three oh three seven to one three talks seven one three eight two five out before you switch gear in there. I wanted to read something to you I found on that first call with the lady that bought the house

sight unseen. Yeah, she actually sent over listened to this, uh Colorado's disclosure law and it says, and this is right from my guess, Colorado dot gov. Colorado State statues require that sellers of residential property disclose the following

to buyers. Okay, ready, right. The property might be in a special taxing district, the property is part of a common interest community, you know, like in HOA, if the property has been used as a meth lab, the home source of drinking water, poddible or what it has, any exposed transportation projects such as light rail or something that's coming into the neighborhood. And that's pretty much it. It doesn't really say they have to disclose

anything else that I'm reading directly from Colorado State. Isn't that strange? Mark That's what I said before when I said that there's a mixed bag here on disclosures. A disclosure statement is required, but there is no standard form. And Frank Durant told me that one time that if it's not in the disclosure statement, then it's not in there, and if it is, it is. But they don't have to disclose what's not in there. Now they're supposed

to by law, but not the disclosure statement. But mark On, let me explain this to you. She wrote over some of the things she discovered. Now, now listen to what would be a problem with this. She said, no landscaping. Okay, now now it was rocks. Now now tell me this would would would wouldn't her people be able to see that. It's called zero escaping. But but even it doesn't matter if it was nothing,

if it was mud. If you have the house sitting out there with no lawn, why do they have to disclose to you there's no lawn. That's what I'm getting at Mark, is that she has all kinds of things here that are just common sense. Refrigerators do not have water line. Well, I don't think that would be in a disclosure form anywhere. No matter what she said, shed roof was not replaced, shed gutter was not fastened. Well, she had a home inspector. She is believing this home should

be in perfect condition. I'm sorry, I really don't. I think she bought a pig and a poke. That's what she bought. She says on their refrigerator too small. That's crazy exactly. She's not going to be able to do anything about this. I mean, I don't know what to tell her. Vince. I listened to this one vent's not painted the same color. I mean, how where would you disclose that? I know it. I know it. It's just ridiculous. It's just ridiculous. Weeds in backyard.

She'd have a hell of a time in my house. Let's just sell it back to open house. Okay. Interior floors were not mopped, Honest to god, you want what? Who are you putting on this? Did he drop dead? I know I know what you're saying. I udrey appliances were removed rather than cleaned. I don't even know what that means. Counter's not cleaned. Counters. No, I know she's expecting perfection here. She's

expecting a brand new house. That's what she's expecting. I don't even have them for you be a dead horse who I'm going to give you some updates? Yeah, yeah, go ahead, Okay, uh you remember the only dead horse in that studio is you. By the way, I know, all right, Just for that, I'm doubling my salary. Hey, Tom, Okay, So Steve, Steve called up. He was a forty five year old vet who had some work done, canceled it, and he was

owed to one thousand dollars from a contractor named ben or Tees. So we got ben Ortez on the phone yesterday and he said that he's waiting for his credit card company to approve it and he will send Steve a check on Tuesday. Hey, oh, excellent, Hold on, doc, doc, Hold on one second, I need to say something. I'm thinking of this other one in a different way. Now here's my understanding after reading this. She bought this house using open door. Open Door said they would do all this

stuff before she moved in. That is a true gripe if that's true, contract Mark, Yes, I already talked to her about this when you guys were there speaking among yourselves and didn't listen that we're doing a different show. Listen that list that they said they would do. That was an internal list that open door was supposed to do. That was not given to her before she bought the place. She happened to see a sheet that is that open

door was supposed to hire people. She happened to cross this. They never told her they were going to do it. Never. That was not part of the sale though. That list of things, that's what she said. And open Door didn't do a list of seven pages that they were supposed to do. Well, who said they were supposed to do? Did they tell your real estate agent by the way that agent she should know, whoever it is. I'd like to put them on the sleeves brigade, because that buyer's

agent did her no favors on anything. But in any case, that internal document mark is between open door and whoever was supposed to do that stuff. That wasn't a representation to the buyer man. You know, it doesn't matter what I promised to do to myself or for myself before I put something on the market. If I made a note make sure I get the house painted before I sell it, and I sell it and somebody sees that note to myself, I mean, what difference does that make? It doesn't matter what

they wanted to do. I thought she entered into an agreement with No, she didn't. And that was the whole point. She did not open it to the agreement. And and that's the biggest problem of all. Geez, three oh three seven to one three talk. Okay, we got tom. Now what other follow ups do you have? Okay, so, uh, this is goes back. Well, Jackie had a problem with Traylon Holmes and her floors. Wait a minute, Wait a minute, I think I remember that. Yeah, I'm looking for it, but go ahead what happened.

So apparently there was a problem with her floors, and she had them come out literally four or five times. And now they've thrown up their hands and said, look, we're just not going to deal with this. We tried, we can't match your floors. She wants to know if we can get somebody out there to Okay, but hold on a second. What exactly Jackie was complaining about her floors, But I don't understand. Wasn't that something about

them not fit, not matching? Yeah, what happened was there was some a brand new home and I think she said that the LVP was damage, it was wharping. But they replaced the entire house full of the They did the whole thing. And then she said, after five months the floor started waving again. They replaced it again, and they attempted to fix it three times, and now the warranty company says they're done. Now what I want to know is this is she being unreasonable? Well, that's why she wants

someone. I thought, maybe simply flows go out take a look at it. But it's in Loveland. It's in Loveland. I'm not sure simply Floors is going to drive to Loveland for this. Okay, well that was all. That was what I told us. I don't know what else we can do. Well, here's what we can. She needs to hire a floor inspector. Really, we can't send Simply Floors can't run up there. Okay, I will tell her that. And it's not that expensive to have a

floor inspector. There are and and Buddy and Karen Mitchell over at Simply Floors, Inc. I think they would have an idea of who she could hire and then figure out. If it's not up to standards, then I think that they should uh. I think they should be able to do something right. And she says that when they when they replaced the whopped you know, uh boards, that it didn't match. And she said, it's a new

house. She wants everything to match. So I will tell her to call Simply Flaws, get a floor inspecter, and we'll we'll take it from there. Yeah, okod We got more coming up on the Troubleshooter Show three O three seven one three eight two five five Go with a sure Thing Denver's Best Roofer Excel roofing dot com. You'll think you're his only customer when you choose Frank durand the real estate man dot com to list your home with Remax Alliance three oh three nine two zero sixteen twenty two. You know. Three, I'm hey Kevin Golver and kick his ass for me? Please?

Can you do that? Or Jeff just go over there, just just give him a whack upside the head. Three three. I'm putting a poll up right now on our Facebook. All right, I'm sorry, look at me. I'm acting like an old man on our YouTube channel. So people should go join in and vote whether they think Tom leans to the left. That's exactly how I'm gonna phrase it. Okay, Now here's the deal. You really believe you really believe that I demonstrate liberal tendencies on this show.

I just said I think you lean to the left. That's what I've said. I'd actually you know what, I'd like to believe I lean according to the issue. Well I'll find out. Let me tell you polls are never wrong. That's true. You know I lean according to the issue. First of all, if do you understand something, you can lean a certain way without agreeing with it. Let me explain this to you. Let me explain this to you. My personal feelings about social issues, in my opinion,

have nothing to do with my political stance on social issues. Here's what I mean. I believe everyone should live the life they want to live if it doesn't hurt anyone else, and we have no business telling them how to live. That's what I believe. Now. I might depart from that when it comes to certain sub issues of the issue. For example, this big, the big controversy right now, transgender movement. Okay, I don't care if somebody wants to be a he or sheet I mark, do you really care?

Could care less? I don't care. I mean I always say, okay, I'll hire on, hold on, you ask me a question. There's times I really care. There's times in women's sports I think it's marked. That's right, because I'm not talking about that now. I was talking about the general Then I said there were sub issues. The sub issues I agree with you on. I don't believe you should if you're one hundred percent mail, no matter what you think you are, you should do that.

I agree with you on that. And what about prisons? Do you know a man who has had his junk his entire life and has had sex with women his entire life, five minutes before he is sentenced or before he's sent into prison, can declare he is a woman and go into a woman's suit in Texas or Florida. Well, okay, but what I'm getting at is there are general sub there are general issues, and then subsets of those issues. So in general, though you don't care if someone calls themselves a man

or a woman, right, I care less? Right, I know you don't care. In general, I want people to live the life they want to live. But there are issues. I was I saw for it, you supported us. I appreciate that. I thought we should throw them the coming out party between them. The have enough loop for a long time. Now here's the deal. Don't get don't get vulgar. I think on social issues, where are too hell bent on Some people are too help bent on

telling people how to live, and I don't think it matters. But in general I skew more conservative with economic issues for example, I do not believe you can control outcomes, nor should you try. However, I do believe you should have one equal opportunity. Then if someone squanders the opportunity, just say you're a libertarian. And that's exactly what you're promulgating. I don't know. I don't know what you call I don't like labels, but Mark,

I disagree with you that I skew liberal. I mean, I don't even understand what that means. Well you just do. Oh, come on, that is so ridiculous. And you put up a poll on Facebook, I mean, excuse me on YouTube, and that's really told to give me an example where I skew liberal. Go ahead, give me an example. Everybody should get free college. Okay, did you just hear what I said about about opportunity. He asked me a question. I answer it. Now he's

asking me another question. Yes, I did hear that. I just said everyone should have one d per equal opportunity. They should not have one hundred percent equal outcome. And let me explain something about college. It has no nothing to do with poor people or liberal or conservative. Here's what it has

to do with the Colleges are great ripoffs. In this country any surprise, you don't see that they have tax free endowments that grow tax free, that are supposedly charities, and they pay their professors and administrators out the nose. They have enough money, do you understand the security just on basic securities? They could invest those endowments and they could support one hundred percent free tuition for the rest of their existence. It's way worse than that. That is a

great point to bring up, and you brought it up before. But in New York right now, the cops getting rid of all these protesters from hell, these pieces of crap that are wishing Jewish people dead, these people that shouldn't be doing what they're doing. Guess who's paying for the police? The taxpayers there, because those and the colleges should pay property taxes. No,

these colleges are the great American ripoff. You know what I find funny about liberals who say that rich people don't pay taxes, they should start taxing these colleges. These colleges have endowments of billions and billions and billions of dollars and don't pay a penny of tax on them, and then turn around and try to influence social issues and students' minds, and that is not their Well,

actually, they can influence anything they want, if the kids wanted. But what I'm getting at is this is that they are They are the biggest ripoffs in history. So here's what's amazing to me. They talk about diversity right now. They could have one hundred percent free tuition for everyone, everyone, for the rest of their existence and never ever need a dime from outside help. Yet they still beg for money. They are greedy, money hungry billionaires.

That's what they are. And that's why I say free college mark because and here's another reason I say it. Okay, let's just say there is an underprivileged person living in the projects somewhere who would make a brilliant surgeon. We may never know it because they can never afford it. And I think everyone should be given the opportunity. We've talked about this, and I love everything you're saying, But the problem is a lot of those people don't grow

up with two parents. They don't grow up with enough food to even mature their mind properly for that amount. So to actually say it should be fair, at one point, it's never gonna be fair because your kids and my kids are gonna there's no doubt they have more of an opportunity. I agree with would it would take a lot, You're right, it would take time.

But I think it's a shame. For example, when some kids grow up never even thinking, never even thinking about college because they think it's impossive. Isn't it their damn parent fall for never planning to see it or telling them anything. Of course, fix that, you don't. You don't fix that by sacking take you. It'll take time to free it, fixes by fixing their damn bears mark, it'll take time to fix it. It doesn't

mean it's impossible to fix. What I'm saying is if over time we believed it was possible to go to college, we may strive to learn a different career or something if we knew it was possible. If you're from the projects and you don't even think it is in the realm of possibility, you may not shoot your goal there. You may not make it a goal. That's all I'm getting at is that it should be easier for kids to attain a goal that they shoot for. And you're right, you are absolutely right.

If they said to people, you know what if you can do the work, you can have the education. It would take maybe a generation for that to sink in where people actually start believing it that it would. But we got to do something to change what it is because all they will do this

these these I don't even know how I refer to. I guess the legist is a good way to look at it, because if let's just say community college was the first step and it became free, it wouldn't matter because that would just be another extension of high school and people would still drop out. Its just the whole thing has to change in a different way anything. The difference is with community college they can drop out. When it comes to public

schools, they just push them through the system. Well, then, I also, doc, I got to look at it this way, like there's plumbers and hvac guys and kids like my kid that make great money and they never went to college. But no, no, but let me finish this now, when we talk about letting everybody in college, and the hell pays for that, My kid that never took advantage of it, Me that never took advantage of it, and he could have zam that never took advantage of

it. Mak that's the point he could have if he wanted to. Yeah, sometimes some people could not. But but you're forcing me to pay for somebody else. Doc Well, Mark, just like Mark Helthmar in this state, Mark Colorado. Mark, can you stop making your speech right now. All I'm saying is this. It's not going to be easy, but there I think in the long run, we literally would save money if we had

an educated mass. Now, those who want to be into trades, you see what's going on in these colleges right now, are by a lot of them. We're shut down these universities you're talking about, Mark, I'm not talking about radical students. I'm talking about people who want to learn. You always go to the extreme. All I'm saying is this, if someone wants to learn and truly wants to do the work, they should be allowed to be able to do that, and there should be a way a path for

them to do that. And if someone wants to go into trades, there should be a path for people to do that. But I'll bet you that fix it or plumbline or any of those never hear from a kid in the projects who doesn't even know there's a possibility. We got to change. We got to start giving people a vision of opportunity, that's all, so they have something to strive for. I don't believe a lot of people have anything

to strive for. Your kids growing up, Mark, they saw a vision of people who worked hard to kids, not all kids programming from public schools, is my point. It's that's just it. They don't care. Their only drive is to make our kids lefties. I'll say it for what it is, and if you extend that another year, it's going to do nothing else. That's my point. They indoctrinate our children. That's what they do.

Well, of course they do, and I'm proposing that we try to change it to a point where kids know that they can take a path and there won't be roadblocks. We haven't had much car discussion, and that's because Jeff Vick and Kevin Colkin are sitting there and not volunteering anything. They're just sitting there like bumps on a log. Uh. That's uh shared in autotech and camera transmission. Let's talk about this.

Jeff, I do have a question for you. What do you think about that electric car discussion we had and the carbon footprint actually being ten times more with an electric car? In electuality, those of us that live inside this world of automotive been talking about this for years. We're more than aware of

it. But have you ever seen it put to pay pencil and paper like this guy did, actually not see not just the electrical part of it, the recharging part of it, but the manufacturer of batteries and something I never thought of in mining the cobalt and all of the stuff needed, the lithium and all of that for uh, these batteries. You now have diesels that these these are not electric earth movers, they're diesel earth movers, actually contributing

more pollution to the environment. Kevin Jeffinite thought about that part of it, not to mention some of the pollutants of the byproducts of actually making it. Some of the leasing fields where they have wet fields down in South America, we're literally just destroying the lands and destroying the water possibility. A How do people justify it? No, seriously, does it just make them feel good or what all they see is the end result. They're not contributing to that

that cat out there mining up the ground. They're not seeing the kids that are being forced into slave labor actually going out and doing this stuff. They're not inside the areas where all these toxic chemicals are just being dumped and laid out outside. Yeah, I think that. I don't know, Chandra. Let's go to her. She wants to talk about scleare therapy, or at least that's what I think. She's talking about. Sclerotherapy our injections in the

legs to try to get rid of aerico's veins. But there is also a more more detailed, not more in detail, more invasive therapy, which is more of an oblasion of of They destroy the oor, inject into the veins and actually make them go away. A lot of women, contrary to what Mark things, a lot of women like this procedure. They love this procedure for appearances, and it also helps if you have tired legs and all of that. And a lot of men suffer from this but don't go and have

anything done about it. So what's going on? What is your question, Chandra? Mark, Mark's trying to make fun of me saying we shouldn't discuss vein therapy. It sounds like, Oh, I just loveased it. Coming into this hour, I thought, yes, I took notes, Deputy Doc. It's not just an old persons disease, is it. He's not listening literally. Okay, well, of course he's not. In fact, why

don't you would you do me a favorite? Mark, do me a favor, seriously, Have a mirror near him so we can always check to see if he's fogging it and then and then if he's not fogging the mirror. Have some defibrillators around. We should have those next to him at all times. Okay, Chondra, what questions did you have? Well, this is Chandra, a common woman want to be and I've got come on in. I would love to come in. Are you kidding me? Have lesson?

You know? Same old mine orever. I would love to come in there and meet you guys. I'd hold the mirror for deputy doc if I if I could, so anyway, what is your question that? So? I've got bad Verko's veins. They used to be really heavy and they're really unpleasant. I don't know what Mark's got against the therapy, but I'd like to get rid of them. And I just don't want to cold call a bunch of plastic surgeons. I didn't know if you knew anything about it or yeah,

I do. I know people, I know people who know people. I'm just gonna I'm gonna cut right through it. Colorado's skinning vein. Doctor verbally, how does it work? Well, there's tooth therapy, but Doc, you should is he? Is he awake? Or I'm fine? Tom? I think they just inject the a sclerosing agent into the vein, and what does it do to the vein? It just closes it up and then it just gradually dies and gets reabsorbed. Yeah, but then there's a more

invasive therapy where they go deep inside the vein. Is that more of an oblasion or what? I'm not sure about that, Tom. There's two different levels. Let's say there's one for just the surface kind of stuff and then there's one for deeper problems and they do ultrasound to find them. Do you have chondra? Do you have weakness in the legs or tiredness as well as an appearance or is it mostly for appearance? It's a vanity thing. My legs are fine. I work out all the time that I just don't like

to do it. They look they're lumpy. Well, lumpy is a lot different than just that vainy look like when you look at your legs, do you see those little spider veins? Or do you actually see rope type stuff coming through the you know, bulging from the surface. Yeah, that's a vil Tom. Yeah, well there, but some of them are some of them doc are They don't actually come out and swell out there. You can just see them through the skin a bit. I have both, so I'm

more interested in the lumpy ones to get both. Yeah, that's the more that's the more invasive. Now they used to do I'm stripping. You don't need to do that anymore. They have some really good therapy. I truly, I truly would check out Colorado Skin listen. I want to tell you something. They're not sponsors here, nor are they on the referral list. We don't have any Vain clinic on the referral list yet, nor do we have sponsors. However, Colorado Skin in Vain truly is. I don't want

to get into why, but I know that they work. Okay, I don't want to violate anything. Go through the internet. What's that sounds good? Now? Now, if you need the number, I'm just I'm looking at their website right now. Here's the number. Three zero three six' eight three thirty two thirty five. Do any forms of insurance pay for that. You know, I don't know. Actually I don't know that. I

don't know. I think I don't know. I think if that it was medically necessary, they would if they think it's cosmetic, I don't think they would, DAC. Is it ever medically necessary? Not that I can think of off the top of my head. Well, you know somebody who does that might be. I'm telling you that there are a lot of problems attributed to that. Don't fully, they don't get I mean it is good for your health. I mean because it could lead to blood clots and other things

in the future. It could lead to other problems. But again, here's the deal. No matter what, he'll have an answer for I have an answer for it. And that's great. Let me explain something to you. And this is nothing against Colorado Skin in Vain or anyone else who does this. But I'm just going to tell you something. Most of these clinics that do skin in Vain, they do a lot of cosmetic stuff and sometimes a lot of you know what's crass skin esthetician stuff. No, but don't just

say some of them sell like that cold therapy and stuff like that. Okay, you you took the words out of my mouth. What we're getting at is this, there's a lot of up selling in this business. Okay, so be aware of that. I'm not telling you what to do, but they're and I'm not even telling you about this clinic because i don't know that much about it. I don't know a lot of them. Yeah, they have a lot of these clinics have all kinds of stuff like that, Okay,

And I just want to warn you that what's that is it? Even the regular dermatolicists when you go in, it's trying to sell you every skin product under the sun. Oh No, Dermatologists nowadays have become hustlers to ropractors are man, there's some good ones. I don't want to get everybody. That's true too. That's true too. You have some that do that. You also, look, man, I'm telling you that that it is a

hustle there. Doc. I don't know if you know this or not, but there is a lot of companion therapy is going on with these clinics. Whether they're skin or vein, or whether they're dermatologists or there's all kinds and you know, plastic surgery. They have all kinds of upselling going on they call them companion therapies or I call them up selling. Anyway, Thanks for calling, good discussion. Tom Martino Here, let's go to Deputy Marvel, who has a follow up.

Yo, Deputy Marvel, you have an update on sub subcontractor issue. Who was the caller on that one that was one Lopez and one said he was owed money and had not been paid. Is that right? That is correct? He had an initial proposal for a basement finish that included framing and drywall, plumbing and electrical work, just all this work. The initial proposal was five thousand, with change orders totaling three thousand. Jorge Sanchez is a

homeowner who hired one oh okay and half dollars in January. So I called Hoorgey to follow up. I left a message on Tuesday, Wednesday, and actually he answered yesterday, late afternoon, and as soon as I identified myself, he promptly hung up on me. Damn it. So Jorge is also a contractor, even though this work was being done on his personal basement. Right, No, Horaey is not a contractor. Jorge Sanchez is a homeowner. Okay. I thought jan said he was a subcontractor for Hoorgey, who

was the contract Okay I misunderstood. So so Wan basically did work, can't get paid. I told him to do a lean have did you talk to him about that? I have not called one back, okay, because I was just you know, I just had the experience yesterday of getting hung up on Yeah, welcome to the team. I was I have to be in your boulder today. I was speaking of nice dropped in on his business. But I be careful. Okay, Now listen, here's the deal. I

think I think he needs. It might be too late for him to put a lien on that property. What is it marks? Four months? Four months? Well, depending on if it was labor or parts, it's either ninety or one hundred and twenty days. I think the one hundred and twenty is labor. If it's just materials, I think ninety a year ago. Uh see, that's expired. Okay, so he's out of luck. He's out of luck for a lean. But he can take him to small claims

court for let's see, it was five plus three for eight. He can take him for seventy five hundred dollars at least most of it to small claims court. But let's see if you have any luck. I mean, Jorgey did wait wait wait, he already hung up on you once. So he's not going to talk to us, is he? Probably not? He hung up on me. He didn't even listen to what you had to say. No, no, I just identified myself and you promptly hung up? How do you identify yourself? Did it go something like this, Hey, Slee's

bag, I'm with Tom Martine Click? Was it like that? But because I left two previous messages, yeah, previous messages of saying who I was. So I was with Tom Martino show he promptly hung up on me. So but he has a tax and accounting business in Boulder. Well, well that's right, that's right. You know what, maybe you should say hi to him. But but Genie, just be careful, Genie, you know, just in a nice way, say we're just figuring out what we should

do. Should he you know, I don't know if you if you feel like doing that, just be careful, like I know, I'm not sure the guys that I don't think the guys are mad man and it's a public business. Maybe, but I don't know. I think I think we got you know, the good news is Deputy Marvel or Jeanie, here's the good part. The good part is because he's public like that, he's going to

be easy to serve at his office for Small Claims Court. So okay, so I well I just tell this that, you know, tell jan you know, we don't have any official power to make the guy to make the guy call us. So here's the deal. It's going to ask you something, Jeanie. Why isn't this guy going down to where this guy is working. Why isn't he shown up and fighting for himself and saying, hey, I want my money. Brother. That's what I wonder, because that's exactly

what I would do. Of course you would. Well, yeah, I mean that's what I'm saying. What's wrong with this guy? I am? I'll call him and ask him, Yeah, Mark, and ask him if what's wrong with Small Claims Court. We can give him the legitistical advice on that. So he did so. This Horge sent him a letter, I think on March seventh of twenty twenty three, saying that he was going to make payments of three hundred and fifty dollars every three or four weeks. But

he only made one payment. So he's he has a signed letter from this guy. Oh that's good, he's and he was pleased with the work. It starts to cut problem. Yeah, no issues and no problems with one's work. Wow, Okay, continue with giving Let's just tell him to do try this Small Claims Court thing man, that would be good. Okay, and thank you. Do you have anything else? I know that's it. Okay, we're going to start stacking you up with more stuff and make a

note of this. She likes confronting people, now, I'm just kidding. Three all three seven one three talks seven one three and two five five. Robert, what's going on with you? Robert? Welcome to the show. Thank you, sir. How you doing? I'm doing good man. What's going on with this scam? Is somebody stealing from your personal data? Well, they're not only stealing data, but they're stealing from checking accounts. They're stealing other people's money from other people at the same time. Well, yeah,

I mean there's a lot of scam like that going on. Are you talking about anything specific that you know about. Yes, this is a scam that happened to me just over the last couple of days. Who is it? What happened? Tell your story? All right? Well, at any rate, I was in touch with one of my friends off of Facebook that says, hey, I heard about your problems me being a single parent with

two kids. He claimed that he knows my situation because I've talked to him in the past about it, and he said that, yeah, you know, you should get in touch with this guy and he can help you help your situation out. Well, well, first of all, what is he talking about your situation? Were you on Facebook talking about a particular problem. I was talking about the fact that I'm a single parent and two kids and the fact that my ex left me for some drug addiction and the way that

she left and this and that and other thing. I get it at any Yeah, and he was like, well, I know you need help because you had to quit your job, you don't have any income, You've got two kids. You're about ready to be a victied. That got it the other thing. And then and what this, what this Facebook friend saw was a pigeon waiting to be plucked exactly. But get this, the person that I was talking to that I thought was my actual friend apparently the guy that

does this scamming. He apparently did something to this friend of mine's Facebook account to where he either mirrored it or he copied it or something. But basically, I was talking to this the scam artist himself the whole time instead of talking to my friend about the actual situation. Well, let me ask you that how do you really know it? How do you know your friend wasn't the scammer? Well, it's because of the simple fact I've known this guy

for quite some time. Did you know him personally or only on Facebook? No, I've known him personally. We hung out in long mind. Okay, okay, good, okay. Did you ever talk to him, Robert? When you say you talked, you mean you texted? Right? No? No, Doc, he's saying this is a friend he's known before. When he said he talked to him about his problem, he texted him. He didn't ever talk to him. It was on Facebook, right, Doc?

Right? Facebook chatting? Yeah? Okay, yes, Well, at any rate, this scammer decided to copy one of my friends' sofile off of Facebook and he pretended to be my friend. So the whole time I was telling my story, I get it. Oh so, so anyway, tell us rather than telling us you know how you got scam? What was the scam? What did he do? Well? The scam was that he went ahead and claimed that if I gave him all this information, he would guarantee

that I was going to win one hundred and fifty thousand dollars. Well, why did you believe that. Now, I didn't necessarily believe it. I trusted myself that it was a scam all the way back to back. But then again, you've got to remember, I'm a single parent, I'm in the what does that? Okay? So what did you do? Did you enter? Tell me what you did? Complete the story? Go ahead,

okay, So this is what I ended up doing. He kept after constant, you know, conversation with my my so called who I thought was my friend and the gentleman. I went ahead and gave him my whole life story. I told him what my situation was, and he says, well, if you do this and this and this, I can guarantee that you're going to go ahead and have at least twenty thousand in your bank account by tomorrow. So what did what did you do? Continue? What did you do?

Okay? Okay? I went ahead, and I screwed up because I gave him all of my information. I gave him my address. Yeah, but what did it? I gave him my Yeah, we're not hearing the scam yet. You gave him your information. But then what happened? Okay, Well then is what happened is he started to ask me if I could come up with one thousand dollars, and if I gave him one thousand dollars, I had a chance of winning one hundred and fifty thousand dollars. Well,

every casino in the world does the same thing. So I mean, what happened? Did you give him one thousand dollars for instance? So exactly, so I did that. He guaranteed that I would get twenty thousand dollars in my account the next day. Unfortunately that never happened. Well, carset didn't or you wouldn't be Robert. So how much cash and total are you

out right? Now? Well, it gets even worse than this. Upon my giving him the thousand dollars, I made a deal with another person with some car parts that I was trying to purchase online through Facebook, and I went ahead and sent that person some of the Apple game cards. That's payment, because you can. I don't believe them anymore. There's no no offense, man, I find it hard to believe you're that stupid. Yeah, that that Robert. You know. We don't mean to insult you. We

don't know you from anywhere, but it does sound pretty stupid. Now, now tell me these gifts, Robert hold on a second, These gift cards just came into the conversation. What do you mean gift cards? Did this scammer send you gift cards? No? When I was trying to buy the parts from this other person, they told me that if I go to the store and get a gift card for the amount that I owed. So you were ripped off. You were ripped off by two different is a whole other

deal. That's why I'm saying this is really hard. Robert, you were scammed twice? Is that what you're saying? I'm sure there's a third time coming up? Quick? Mark? Hold on, yes, right, it is Robert. Hold on, Robert, Robert, hold on. Please. The first guy you paid a thousand with the assurance you were going to make one hundred and fifty thousand. The second guy for the auto parts? How much did you pay the second guy? I paid him twenty one hundred dollars

with gift cards. With gift cards? How do you know it wasn't the same guy. It wasn't because it's a total different profile different. Oh okay, now hold on, So then you you paid a second guy twenty one hundred dollars for car parts? Was there a third guy. No, not okay business no, so right now, let me just get this straight before we go to break right now, the total you're out right now is thirty one hundred. Yes, okay, hold on and we'll come right back to

you. Please. I feel bad for you. I'm hoping. I don't know. Let's figure it out right after that, go with a sure thing Denver's best roofer Excel Roofing dot com. Hi Tom Martino, you're troubleshooter three oh three seven to one three talk three three seven one three eight two five five. All right now, Strobert has been the victim of two scams back to back. Poor guy man, a single dad. Is his wife left him? Hey, Robert, how

many kids do you have I have two? How old are they? One is two, one is five? And may I ask your your wife just left? Yeah, she's a reoccurring drug user. We've had a lot of problems in the past, restraining order, we were filing a divorce. She Yeah, it's a long story, domestic violence, there was child abuse, there was whole nine yards, that's a whole You're just too trusting, are

you? You're just too trusting, very trusting, very very And I hate myself for it, and I I don't know how to deal with it. And I just like I said, I was not thinking of the money at the time, because at the time I had a lot of money. But obviously now I look back on it and I thank god. I really was stupid. How could I possibly fall even even a small amount for this scam? I'm still dealing with it today. It is. It is bad. So when did all this scamming happen? This all happened within the last like

three weeks. So what do you what were you hoping you could do? You bought these gift cards, and you you gave the guy the number over the phone, right or excuse me, over the internet right over? Yes, over Facebook? So that I could pay for the parts because you can take your car. You're once you once they're redeemed, they're untraceable. Yeah, I know. And the other one, the one that I was doing the deal with the car parks, was legit. I mean they phoned me

on the phone, they sent me multiple pictures. I mean they was legit. Why are you calling, Robert? Yeah, if they were legit, did you get your car parts? Then? No? Well hold on because like I said, there's more. You guys are jumping way ahead of me. Radio. Okay, go ahead, Robert, all right, tell us more rate. Okay. So I sent the guy for the car parks, I sent him gift cards. He was going to take the gift cards and transfer them into his bank account or his game, whatever he does with him.

I don't know. I didn't care. I just was trying to figure out the best way to pay him for the parts, so that I could get my parts and he could get his money at any rate. This other guy, this agent, told me that once he found out that I because he had access to my checking account, which was I know totally. I don't know. Now, Hold I was the first guy you're talking about.

He found out you were ripped off by the second guy. Yeah, but like I said, there was there was gift cards exchange for the car parts. Okay. Well, while I exchanged the gift cards to the other guy with the car cards, the guy who was this scammer, the agent, he went ahead and told me that, hey, this other guy that you're buying these car parts from is a scammer. You need to send me the cards. So is what I did is I went ahead and copied the picture

of the cards to the agent and he internally cashed him in. Now, the guy with the car parts says that only two of the cards worked and they were only good for one thousand dollars. Okay, Robert, agents, Robert, stop everything, Robert, stop everything. Yeah, both of them were ripoffs. You must understand this. Both of them are ripoffs. Okay. The second thing you must understand you must shut down that bank account, immediately open a bank account in another bank, not even in the same bank.

Do you understand that? And then get off of Facebook completely, please, And Robert, I swear to God, Robert, if you do not follow my directions, I don't care about getting off of Facebook. However, just don't communicate with people about your personal crap and about money. You're never gonna win anything, and you're not gonna buy stuff with gift cards. I'm telling you right now. Both of them were ripping you off. The first

guy was upset the second guy or they're working together. All I'm going to tell you is this, do not Did you close that bank account? I closed it after I found out that there was somebody hacked my checking account and they stole another fifteen hundred dollars from me. So wait a minute. I asked you if hold on, I asked you, if thirty one hundred dollars was all you're out? But you lost another how much? Another fifteen hundred? And that's not even the end of it. Wait a minute, So

now you lost thirty Let me get straight. You lost thirty one hundred plus another fifteen hundred. Hello, Yes, so that brings us to a total of forty six hundred. Now what I need to know is this is there any more? Is there any more? Sure? Is? Tell me what happened? Oh, give him a minute, he's got to hold on. Just hold on, Robert. If nothing else, you're helping other people who hear this. But I swear to God I you better make sure you're not

But I want to hear this now. This forty six hundred dollars so far you've been ripped off? Is there more to it? Were you ripped off for even more than that. Yeah, because when the first auto part deal fell through, I went ahead, and you know, it's a matter of who can you trust and who can you not. There's no

guarantee either way. So I went ahead and figured, well, hey, if one fell through, I would go ahead and try and grab something from somebody else. That's what I did. I mean, I, like you said, I'm too trusting. What do you mean that's what you did? What? What do you mean that? What did you do? I tried to buy the same part from somebody else? I love Professor Bing, Deputy Bing. Here's the deal. The Beatles sold albums worldwide two hundred thirty six million, five hundred seventy four

thousand and nine hundred twenty two albums. The Monkey sold eighteen million. Wah, so Mark, so I was trying to tease me about I don't want to get into it anyway, so we're I want to. I want to talk about this though, the the guy that called about the aluminum wiring. There are specialists marks that do illuminum wiring, and I think they might be able to do it cheaper if you called like plumbline or fix it. I mean, there's nothing wrong with those companies are good companies, but I don't

think they're set out to do that. And by the way, George just said yes they do electrical for sure, they do, because somebody was inquiring. I think they do regularly cass Electric for sure. Yeah, I think they called still wrong number. Yeah, at least three seven one three talks seven one three eight two five five. Okay, now I do have a

text or two about cars. Let me see right here, Okay, as far as overheating, overheating, the possible cause is outside of they had the cool and flushed, They had their thermostat checked and in fact replaced, what would and a water pump. I think they're water pump checked as well. What would cause overheating outside of those things? That to me sounds impossible. But what do you guys think? They they changed the coolant, they have

a new thermostat, and he said the water pump was checked. Whatever that means. What do you think? Well, the only thing didn't miss is their circulation, you know, fans or anything like that. So tell me what would happen if you had circulation of all the liquid and coolants. You still need the fan, right, because that's what's cooling the coolant or the car moving one of the two. Yeah, what about if the line from okay, so oh yeah, what about if the line from the water pump

is crimpt or the radiator could be blocked? It could be only going halfway through the radio thing. So there's all kinds of things that have I mean, I didn't think overheating would be such a mystery. Now there's a lot that goes into it. Because the car is the parts and part they're smaller or smaller every year, so they got to be more efficient. One guy said, this is a coincidence to two texts about cooling. Somebody said that

their car runs cool all the time. Is that a problem? Well, yeah, you're definitely gonna get lesser fuel economy if it's running too cool. This is going to change your actual mixture. Usually, when they're running too cool, you've got a thermostat to stay and stuck open. Oh so you mean to tell me actually running cool is not good. No, they try to heat that engine up, and I mean the same thing for the transmission. They want to get them up to operating temperatures so that they can work

at their optimum levels. Okay, so there's an ideal temperature range. You don't want to go too hot, but you definitely don't want to stay cool. Correct. Okay, we have a comment on aluminum wiring from ron Ron. Go ahead, Hello, mister Martino, I had to sell. I sold my apartment building and I had I gave him one hundred fifty dollars per outlet because their insurance company wanted pigtails. So you can find independent companies that do it. How long ago was that? Man? Excuse me? How

long ago was that? Run? Twenty twenty one? And did you find one that specialized? Yeah, it's just it was an independent electrical company. That's all they did. I don't remember the name of them. But the other thing is they had to excel. Had to come to my house to do something outside on my box. And when the guy was working on it, I said, is that aluminum wiring? He says, yeah, that's all we use. They use aluma wiring from the power box to the breaker

box on the house. They don't use cobber. That sounds so backwards, even Holmes. Wait a minute, so even homes that have a copper wiring still have aluminum going to the service. Yes, now, my house was built in seventy oh, it was built in I think eighty two. Listen to this. What do you think the average I just looked up this. What do you think the average rewiring job costs? They say only six grand? This guy. This guy was saying one hundred grand. He's sadly exaggerating.

They say the most. These specialists say they can do most houses for twelve thousand dollars. I mean for not to exceed twelve thousand dollars. Yeah. Yeah, And that's what happened. When I sold my apartment building. Their insurance company said, well, you you got to have pigtails. And I said that's BF And then I wait a minute, wait a minute, long with it. And I had a quote from an electrician that I had worked with before, and he's I'll do it for one hundred and twenty five

dollars a box. Yeah, yeah, yeah, but we're talking about pigtailing. There are not a lot of companies they're insurance now. Brian Burns, a Compass insurance group, said most companies want complete rewiring. They do not want pigtails. I'm sorry, but that's bogus. Well, I think Compass would know. I mean they're a major insurance broker. Huh, Well, Compass Insurance would know if that's true or not true. But the carriers he's dealing with don't want to do it. There's twenty six of them of all

the major carriers. Yeah, but the caller said the same thing. He's having trouble finding it. I realize that, but you're just gonna have to look. Well, okay, you can't ensure a house in the mountains now with all of the normal companies. They've all walked away from it. So you have to look and find somebody that will. And you can get pigtails. Pigtails are fine, there's nothing wrong. And listen. Okay, that's good. I'm going to tell my insurance company that Ron says pigtails are fine,

so don't cancel my insurance. We got more coming up on the Troubleshooter Show. Three O three seven one three eight two five five. Go with a sure thing Denver's best roofer Excel Roofing dot com. Hope they brought Ray up. Ray. I don't want to talk to Ray right now. Please just get me jammed. I'll talk to Ray. He's called raised, called three times. Jan. What's going on? So the Lincoln I was in Florida a week ago. My friend owns

the car. He has the trunk where you push a button and it opens automatically and it will close automatically, okay, And I threw my backpack in the trunk when I was standing back there, and he was pushing the button to close the trunk, and I didn't know that, so I just grabbed the trunk and closed it like a normal car. And after that, the automatic open all the way, close all the way button no longer works.

It doesn't work at all. It would pop the trunk, but you know, kind of like the liftgates on the SUVs today, they open it. You know, you push a button that opens automatically, it would do The trunk would do that. But all I did was grab the trunk close it and then it quit. It quit doing that. Hey, guys, guys, let me take a guess at this, because I had something else automated that worked similar to that, and when I forced it by hand, the

limitters were moved. I know that they were mechanical limiters that caused it not to work, but it really was still working. It just was limited. Does that make sense to any of you.
