Now in cases where people come back to complain and take their car back because he doesn't repair them by the way, he doesn't do what he says, But when you come back to
complain, in many of those cases, the cars end up stolen. The guy is I don't know how to put this a scumbag. If you don't do anything else, please do me a favor and at least get the word out. turned fifty in March, and for my fiftieth birthday is March twenty. I about myself a corvette and it was a cheap corvette, you know, I needed a transmission and stuff. So it was like, how'd you find him? How'd you find Tom? I was looking on Facebook for transmissions in it and a specific transmission I need. He has an AD or six or so ad on Facebook with different names and different cities like Birdtt and Johnstown in Loveland. What name is it? What name is this clown using? Now?
Well, he I can't remember exactly, but when I met him, he said that was his dog's name. It was a Xander with an X or something. Because then I called him Xander. He's like, no, my name is Jeff. That's my dog's name. I'm like, oh, did he say Jeff Jollis? Yeah? And what what's the name of the business you did business with? Come on, you must know, yeah, yes, it's Mountain View Transmissioning Gear for Mountain View Transmission and Gear. And then
what did you do when you called him? Did he sound good. Well, yeah, he was a silver tongue devil, so to speak. And he said, yeah, you know, I could do it in a day. And I was outcited because I didn't have my first corvette. And so Mountain viewed transmission and gear. Yeah, and it's that three fifty five Mountainview Road, Birch at Colorado, Okay, number fourteen Mountain View Road, Okay, number fifteen fourteen, sorry, fourteen, unit fourteen, got it.
It's a storage unit, right, Well, yeah, they're they're big, big rental. That's a big storage building. It's a it's at Atlas Roger and Storage at Gateway Park. Okay. And what did what did you do? Did you have to give him money up front? Yes? I so I spoke with him, and I and I had to take the transmission out of my car, and which I did. transmission, all right. And uh so I showed up there and I met him, and he sounded, you know, there's all kinds of transmission stuff in there. And what did you pay him? I gave him nine hundred cash and do you know he's and then what else did you give him? Plus the transmission and the transmission? Now, I want to tell you something. Do you know he has never completed a job yet. I have a
feeling. So what happened? When did you drop this off? Okay, so I dropped it off at the end of March, I'd say, like the twenty fifth or so, and he said, you know, it'll be a day. And it was two weeks before I got it back. And he said, oh wait, you did. Wait whoa, whoa, whoa, There is a miracle afoot here, ladies and gentlemen. You say, wait a minute, no, you just there might be a miracle. You said, you actually got it back. I did get it back. Hold
on, that alone is a miracle. A miracle. I mean, I am like flabbergasted that you actually got it back. The heavens are opening. What happened? Then? Well, there's a catch to it. He was supposed to get me a rebuilt port converter with it, and when I showed up to pick it up, finally he tells me he sends me to Denver. He says, go to see my guy in Denver and sends me to go buy my own and torqu converter. But was the transmission rebuilt? Well,
it was repainted. Let's say, do you know if it was rebuilt or not. Oh, he claims it it was, but I uh, after after drive put it in the car in the beginning of April and three weeks ago, three and a half weeks ago, you know, the gears went out in it. Oh, and it failed and it failed. It failed in how many weeks from I'd say March twenty eighth to May twentieth, May fifteenth th something. Okay, now here's what I want to know.
Don't ever take your car there with the failed transmission. If he says take bring your car on all to fix it, because then it'll be stolen. That's what that's what he told me to do. And I said no, thank god, because your car would have been stolen. Yes. I called him back and told him it failed, and he said bring it back. Something broke and it was no big deal to him. He's like, just pull it, like I have time. I'm a single dad the two boys. I run my own paint company. I'm like, ye, okay,
I don't have time to pull it. So I pulled it again and I took it to him. Tom and he said the same thing a day. Ok okay. So I dropped it off and I got it back last Saturday. So it was ten days and I put it in Saturday night and Sunday I drove it for nine minutes and all the gears are gone and it's full of sledge. Yeah. So I don't know. Twice and took it to him two times. Now what that's why I called him. I called him.
I called him again and he said, he tells me to pull it again a third time, and he said, I said, I don't have time and I don't want to pull it. He said, my guy will pull it for five hundred bucks. What is this guy? Where does it stand right now? Right now? It stands that I told him that he needs to refund my money completely. He won't, And now you can take in the small claims court, but he doesn't care and there's nothing to collect. The guy is a crook. In fact, does he have a phone
number we can call? We need to bombard this ass and get him out of business. We got to get him out of business. I have two phone numbers for him, and they both work as of yesterday. They did. Okay, Now these are probably new of okay, numbers, I want them. What are they? him guilt. So once again, I think an acquittal is possible. But god, there's probably one more on in the twelve but maybe not. Maybe they all are honest. We're gonna find out. I would hope in the next couple of days. Get this man back on, get him back on the campaign trail. It is unbelievable that one side, one side of our political party is going after the biggest composition who's leading in the polls. And then how about this Robert de Niro freak out. Oh my god, the

Man, he was calling him a punk and a gangster and oh my god, Hitler basically, oh, I mean god, it was nuts. Man. change shoplifting. Why did they do that in California because it was racing and Walgreens, Walmart, all these restaurants. Everybody closes up. I don't know what's left. You get the point, though, isn't it insulting blacks to say to them, yes, if we don't take they're starting to realize that. Yeah, they're saying to you, well, you know, I know you black people aren't going to change your behavior, so we're going to have
to decriminalize things so we don't penalize you too much because it's racist. I swear to god, I wish I don't know if to leave's on, I'd love to hear his perspective. She wants to decriminalize theft and about ten other crimes and have absolutely no pease action on any of these things. It is so scary tom

But you're saying it's impossible he couldn't yet he and his mom don't even get along. Plus he has a string of misdemeanors, some of them violent. So I don't know, Gilbert. Let me ask you something. What kind of do you know? What kind of evidence they have or anything? What did the
news say they haven't released anything? Mark? Are you reading the story? Yeah? I believe so. The last name starts with Vias and Victor, right yeah, Vermillion, yeah, Vermilion. It basically says this an adult man. Oh go ahead, Mark, go ahead, an adult man died after a shooting and aroar of Friday night in a suspect is in custody. Officers were called to report shots fired. When they arrived, they saw an
adult man leaving the scene in a vehicle. The car then crashed nearby, and the suspect, identified as Gilbert Vermillion, forty three years of age, was taken to a nearby hospital for injuries received from falling out of the vehicle when it was wait and was in police custody. So that's it. There's nothing else, man, I see that right now. Yeah. So he was seen leaving the scene of the murder and then he eluded. Why I'm just asking this guy. We don't know what happened, we weren't there,
but just what can you imagine? He goes back to this house for the third time, there's gunshots fired. Then he's absconding from the house, eluding the cops until they chase him down and basically pitt maneuver or do whatever, and he jumps out of the car, falls out of the car. Then he's arrested. Why would he be eluding? Did it say he was being chased? Yes, an adult man died after Yes, it says he was being chased. They saw an adult man leaving the scene in a vehicle.
According to police, the car then crashed nearby. Yeah, but they didn't say they were chasing him, right, well, okay, I would assume they were, But no, I didn't get that. I'm sorry. I just meant, did it say that? It said his moving Oh wait, attempting to flee the scene, according to police. Anyway, So listen, this is you know, James, I mean, this is terrible, James. And then all of a sudden boom. Now, so James's brother Gilbert is in jail facing first degree murder charges, and he says
it couldn't have been him. Then Mark pulls up the news stories where he was seen fleeing the scene where he had been given furniture, and they were going to sell the furniture. They had made a couple of loads already, and Gilbert went back for another load. That's all you knew, right, James. He went back for another load. Now, yes, that's all I know right now, fancy me this. If he goes back for another load and he's the only one who encounters this couple and this one guy ends

getting started. They found a couple that wanted to give away furniture and they made a couple loads. James said, his brother Gilbert went back to get another load without him, and then his brother disappears and find he finds out, James finds out his brother was later arrested for first degree m murder of the guy giving away furniture. Now, he says, it's impossible my brother
could not have done this. And meanwhile, while we're discussing this case, as often happens with this show because it has such a vast audience, we hear from Tim, who says I am the dad of the victim. Tim, my heart goes out to you. No matter who did this, My God, I just can't even imagine your grief, Jesus. But anyway, what's going on? Oh my god, what's going on? Okay? in Colorado for sixty years, have been gone for seven. So I drove out Sunday morning straight out here. But I talked to my son's girlfriend yesterday and her daughter showed up. It belonged to my son's girlfriend's relative and they want to sell the place, so they were moving out.
So they had this free thing you know, whether it was on Facebook or whatever. So, yeah, him and the brother they come to get stuff and then this George Familion comes back by himself and of the time, here's the situation that they're leaving out. This is not going to sugarcoat anything. This guy him into the house and he starts making this young girl.
He thinks she's twenty one, she's fifteen. He starts he holds her hand and stuff, and he's saying things like the cartel blah blah blah, looking into my eyes, this is what I got from the girl that lives there. Anyway, my brother had an or my son had enough of this, and he asked the guy to leave because there was nothing else left here. Now was this was he flirting? Was he making these obnoxious overtures to your son's girlfriend, Oh, to her daughter, who is no, it's a
fifteen year old girl. Let him just okay? So then the fifteen year old girls trying to come on to that. And supposedly this guy is married with three kids or something. But anyway, my son realizes what's going on and asks the guy to leave. Well, my son actually forcibly threw him out of the house, and my son will not take crap from anybody, and so they end up outside swinging it out and this guy finally realizes he can't beat this guy to a fair fistfight. And the last words my son
said is what are you gonna do about it? And he pulls out a gun and he shoots him in the forehead and then he splits and he runs and he falls out of his car. That's why this guy, Georgie, ended up in the hospital. And while he was in the hospital, he assaults a nurse. So this guy has a rap record, which I'm waiting now, Tim, which is very tim. Tim. I got to ask you something. So both the girlfriend and the daughter witnessed the murder. The
girlfriend did not because she was in the bathtub. She didn't even she didn't even hear it. She said she was in the bathtub, and the girl was still in the house because she was freaking out. So my son, but there was others. Then how do you know? How do you know what happened? You're describing something as if it was seen, because I'm telling you the part that I seen, not that I seen the girl. That was that he was making very uncomfortable and how the fight that's how this whole
fight thing uh came out. And these are all statements made to the REPO. No, Tim, Tim, all I need to ask is I'm not challenging you. I'm asking you this. You said, you said that your son said, what are you going to do about it? And the guy pulls out a gun and shoots him. So did someone report that to the sheriff's apartment? And if so, was it an eyewitness? Yes, but I don't know who the eyewitness was. Okay, it wasn't the fifteen year old daughter. No, she was still in the house. Okay, but
somebody apparently he was in the garage. But somebody apparently somebody neighbors out that heard the come and there was apparently three other witnesses out. Okay, that's what I wanted to know. Thank you, Tim. And now there's a protection order on five more people from this guy. So okay, now do you mind listen to him? Okay, God, this is so so. When you were listening to this and James was saying, there's no way my
brother could have done this, you're thinking he doesn't know his brother. I'm sure Hitler's mom thought he wouldn't have done what he did either, So what happens now? What did police say happens? Now? Well, the guy's supposedly on no bond or it's a million dollar bond or something, but he's still I don't know when his court or any of that thing is. But right now we're doing preparation for my son's services. In fact, I'm here
to pick up some clothes right now. But I heard this on the radio coming down and I just had to get on because this guy is no saint and it's too bad about whatever as as they had. But I don't know if it's going to be furniture by murder or what you know? Now, Tim, Tim the daughter, the fifteen year old girl, what did she say or what did your your his girlfriend say? What started this flirtatious kind of obnoxious behavior. He just started eyeing on her and just coming on tour.
And I don't know how long they run the house that I don't have any of that statistic, but apparently just long enough. And he kneeled down to her. This is what she told me yesterday. He kneeled down, he held her hand, and she was getting She was trying to withdraw, but she was afraid to and he's saying to look into my eyes, and he's telling her stuff about the cartails and blah blah blah. He's a you know, don't mess with the cars with me because I'm part of the cartailer
or something like this. And so that's what I got from her yesterday. Okay, okay, And like I said, he's defense and then this is not his child, but it's his girlfriend's daughter. And my son is very protective of family and friends, and so he asked the guy to leave, and then he physically had to put him out, and then so the fight ensued. And then when the guy has a gun. Yeah, Now does your I just need to ask this. Does your son have a criminal record?
Yes? He does, Okay, and is somebody who's been on the right track. I know, Jim, I'm not I'm not Jim. I'm not trying to you know. I know anything. I've listened to you for you. So does he did he have any violence in his background? Your son? Yes? Because I'm thinking that this guy, he's not a perpetrator. He's not a perpetrator. Though most of the stuff my son has done has only always just affected him. Just stupid, stupid, choices and stuff,
but he doesn't go out and pick fights with people on that. No, No, I understand. I don't even know what the relevance he would be. He's the guy with the bullet on his head. Mark am I am? I am? I? I am trying to tell Tim that the only defense this other guy is going to have if there were eyewitnesses, is that he was trying to defend himself from someone, and they're going to dig into his son's background.
Now, anyone with two eyes can see that. For God's sakes, when somebody is killed and there's a fight, the guy's gonna say I felt my life was in danger. I doubt he's going to say I felt like killing someone. So that's why I'm asking about the other guy, because the defense attorney is going to try to tear the other guy apart. So Tim just be ready for that. Slow because the only defense, if there are eyewitnesses, the only defense. What is he gonna say. He's gonna say I

I haven't talked to the journey yet. Okay, So listen, James. So you're calling because your brother's not getting medical care, yes, and he's doing really bad, and I can hear in his voice it's not good. Now, James, did anything change in your opinion though, based on what you heard from Tim and supposedly eyewitnesses. No, not at all. You don't think so. people, there's two sides. We don't know what's going on. The police will let us know, but they don't have my brother's statement. Everybody at that house was drinking, and Aaron was high, and I know he was high because he had gotten high when I was there, and he had said that he would trade for KHC or quick. Anybody that's
been on the street knows quick means nothing, better means. I told him No, I'm eight months in recovery, James. No, James, So your take on this is that they're making this whole story up about your brother, Yes, but what reason would they do that? Because I know my brother wouldn't do anything. No, that's not what I'm asking. I'm asking what motive would they have to make up a story about your brother and then
kill him? Wait, you got that wrong. I'm sorry. No, no, hold on attempt to kill him where he had to defend himself, That's what I meant. So my brother told me that he was trying to leave. I don't know what went down between Aaron and my brother, but my brother told me he was trying to leave, and he's saying that he
was defending himself. So so he Okay, that's what I'm asking. Why would if he's there to pick up furniture, why would they Why would they all of a sudden want him dead or hurt him or why would they tell me? What? Why do you think they did that? He went over there to pick up the furniture and they were over there having a little party. Was he a selling by the way, was your brother is your He
said it was not. He said it was misdemeanors only. Originally, I don't know if that's true or not, but that's what he said, Mark. He said he was a misdemeanors only. But James, yes, man, that's why they have courts of law. That's why they have cross examination of witnesses. That's why they have Your brother will be heard. As far as medical care, his defense attorney has to make a motion for that if he's not getting care. Now, listen, it's not the first time.
It's really not the first time these claims have been made. I'm not saying you're it's not true, but but listen, you know this, this is a this is a procedure, and I know that people in jail deserve medical care. He has to stand trial. All of that has to happen. We all want that to happen, you know. Now, here's the thing though, It's going to be an uphill battle with three eye witnesses. James, I know. not worried. I believe my brother when he says it was self defense. I believe that the three eyed witnesses, Well, what's it called, they'll say the same thing. Yes, Okay, so do you What you're saying is what you're saying, James, what you're saying is these people were a bunch of tweakers and they
were getting violent with your brother. Your brother tried to leave and he defended himself. Not everybody there, Okay, I know a d was on some bowl. But here's what I want to know, James, why would your brother go to a house to pick up furniture carrying a gun? Well, they say he took their gun. furniture, getting into a fight and killing a guy. Now there's three eyewitnesses, but James says his brother was defending himself and that the guy that he killed was a tweaker doing drugs, high violent. The dad called in and talking about his son who was murdered, and the dad said, I'm here making funeral arrangements, and eyewitnesses simply say that his son was sticking up for a fifteen year old girl that this guy Gilbert was hitting on and being obnoxious
to. He threw him out of the house, and then the guy, after having a fistfight, shoots him. Now someone else, Tom, don't you think it's going to be critical to find out whose gun it was? I mean, yeah, yeah, of course. Now, Deputy Doc, we have another person though involved, Aliyah. I want to get to right now. Then we'll make come Eliyahu. You are in close contact with who Eliah? His name is Aaron Baffler. Oh my god. So your your your dad is the one that was killed. Yes, so you can imagine my shock, you know, our grief, our pain, the things that we're dealing with, and then hearing this story that this other person is saying about you know, my father. I The witnesses are my father's girlfriend and her daughter, so kind of like a sister to me. Well well yeah, but they didn't witness the murder. They said they just they they were a
witness to why it started. But apparently they did not witness the murder, right or did they? They didn't witness the exact shooting because it happened. Everything happened in about five minutes. It was very But did anyone, Aliah, did anyone witness the murder? I believe there were some neighbors. There
were some neighbors. We haven't gotten did names of the neighbors, because it's still an ongoing trial, you know, and I'm pretty sure they're being you know, protected, But from what we know, there were some neighbors. Oh, Ron, do you think it was I think it was Gilbert's gun because I have a brother. His name is Demetrius. He's in a band, and in that band. It was just this random coincidence. One of Gilbert's brothers. I don't think the brother that called, but I think a
younger brother was in this band with my brother and my brother. The day of the shooting, my brother goes to his band and he's venting and he's telling them and he's like, you're kidding. And it turns out that one of the bandmates is brothers to Gilbert Vermilion and he tells, my brother, I am so very sorry for your loss. I'm so very sorry what happened. My brother is a drug addict. He is an alcoholic. He has a long wreck or. He's very aggressive with people. I've gotten into several
fights with him. And just two weeks ago, he broke into our mom's house and stole our guns because because Aliah was your dad. Was your dad a meth head? No he was not. And that's why I'm calling It makes me so angry because people are trashing his name. You know. Yeah, that guy was trying to say he's a tweaker. Yeah no, yeah, no, he was defending a fifteen year old girl. He was always
a very strong, loving, hard working family man. And if and if he sells furniture to this man and this man is a tweaker and keeps coming back every single day, he's gonna he's gonna get angry and kicking. Now, Aliah, Aliyah, the guy went back because there was more furniture, right, No, he ended the My dad kicked him out because he was hitting on the girl. And Gilbert said that he left his keys and he and instead of kindly asking for his keys or asking the police to escort him.
After my dad had stated he didn't want him on his property, he went in and he broke down their garage door. He kicked their door in. Jeez, really got it. Yeah, my dad was on My dad was unarmed. He has no possession of a gun, no possession of anything. All he had was a small, cheap famboo stick to try. Was your dad was your well, was your dad pulling a stick on him? No? It was it was like a I don't know how to explain it. The guy's you know, the guy apparently is hitting on a fifteen year
old girl in his house. He wants to get him the hell out of there, and apparently the guy won't leave. I might have or a gun, Aliyah, your dad doesn't get high and wasn't drunk or anything like that. No, he's at the corners and they already they already did that. They already did his report and everything, the toxicology. Toxicology came back clean. I'm pretty sure. Yeah, Aliyah, I'm so sorry. I'm so sorry that this happened to you. Do you have any siblings to my dad?
No, it's just me. Now. He has a lot of nieces and nephews though, and were people shocked. I mean, what this guy is saying it was self defense, his life was in danger. What does that mean? That's a good question. Well, are you paid by the hour, by the salary or by commission salary? Just straight salary based on a forty hour week? Correct? Okay? Was there an hourly rate attached to it? Or a flat rate? No? Flat rates? Okay? What was your Okay? But I had these seventy one hours of PTO? Right, so they paid me for my work days? But oh okay, but what as far as you out? Okay, So this just concerned your PTO? Correct? Okay, go ahead? Sure? So
I asked that question, what do you mean by funds are available? And it said they said, we will pay sendy one hours of PO as funds are available at this time, I do not have a state for PTO to be paid. Can I ask you something? So PTO at your company works this way. If you don't take it, you get paid for it anyway. So if you if you leave the job, if you get laid off, or even if you quit you're owed whatever PTO you've accrued. Yeah that state law time. Okay, thank you, thank you, Marco, go

What I've looked at in the statue is I can put in a formal request for them to to pay that money and then then go to trouble then go to trouble damages. Right,
so you can do that. You can make you can make a notice right now, just make it, get it on record, and then after that, if they don't come through with your pay, you can sue them for treble damages. And will that be in small claims court with your triple the amount of PTO? No, probably it would be over seventy five hundred right for that many hours, yeah, probably, So you can't go to small claims court for it, So you'd have to go to an attorney or you'd
have to get the labor departments to try to enforce it. But that would light a fire under them. He's a liar, okay, and we have had so many complaints it can't be a coincidence. And then we've had several others where when he they take it back for warranty work, the vehicle is stolen. thousand and three Toyota Corolla for ten years. It's been a great car, but I've had an intermittent starting problem with it, and now it's become more more predominant, and now you've had the problem for the whole time. Yes, it's a five speed and so when you go to start it, you have to push in the clutch because there's a switch on the clutch. And sometimes it wouldn't start. You just go click and then you'd let off the clutch and push you back in and then it would start, no problem.
Once in a while it would do that. Then it became well it won't start, but if I roll it a little bit and you know, pop the clutch and then we'll start. Well that's because yeah, that's just popping it. You have a Microsoft switch problem. Yeah, And so I've replaced the starter, the starter relay, the clutch starts switch, and the battery. And when you say the start switch, you mean that little micro switch
that talks about that sees where the position of a clutch is. Yes, okay, so when you depress the clutch pedal, it lets it know you can start right and you've replaced it with hoping maybe one of your service guys you might be able to recommend someone who can look into electrical issue. It's not an easy issue because I'm a mechanical Well, the good part is that Sheridan Autotech does both clutches, and they do electrical and they do cars in
general, and they do foreign cars. So so how often does it happen every single time you try to start? No, it does now, but I mean over the last No, that's what I mean. But now you but right now, if you go to start it, it will not start. No. I actually roll it down the hillpop to clutch it. It runs and it runs well once you're started. Oh yeah yeah, and then if you turn it and if you turn it off, you can't start it again. No, Well, it's got to be. It's got to be
in that clutch sensor. It's got to be. I replaced it. It was a forty five switch from Toyota. Yeah, yeah, I understand that. But the wiring to the switch. The switch is not made. Huh. Nothing I've never had, I've never modeled. But it's obvious. And here's here's how you can tell. You can take the switch out completely and put those two wires together. Just twist them together. Okay, so it's always on. Then try to start it in neutral. Obviously, if it
doesn't start, that circuit is the one that's bad. There's no other way it could be. It's that circuit. That's the only thing that makes sense because it starts and it runs. And if it's that circuit, Kevin Caulkin can trace Itvin, Okay, Kevin over at Sheridan Auto Tech. Let me just give you the number. You know what, We don't have to spend I don't want to waste your time trying to get him on the air. He truly confessed. But you want to twist those together and see what happens.
Now, obviously you already replaced the switch, but that would take out the switch completely, and it would absolutely tell you that circuit is not working. Because if that circuit's together, it should start. There's nothing else that I can see that wouldn't make it start. Now, your starter, by
the way, you already replaced that it could be a grounding issue. But then again before you said it was intermittent, meaning well, I guess it could be a ground problem going to the starter or not getting a voltage and for that, see Kevin can do that voltage check. He can go and see I can't do that part. So forget what I said about that micro stage, because they could be in the starter circuit. It really could be. When you're talking intermittent, it could be anything. So here's what you
do now. Now, before though, when you used to get it to start, when it was intermittent, how did you get it to start? Well, if you moved the car a little bit and you know, pushed in the clutch, moved the car a little bit, let out the clutch, you know, and then started like normal, it would work. This contractor claimed that Darren cried poor mouth to him and got the contractor to build a house. I do remember that, okay, and then fat okay, he actually had some money. No, it's not that he had money, not at all. He said that Darren claimed to be poor and couldn't afford a house, and and so the contractor
gave him a special discount. Now the contract says no, nothing about that. There is nothing in writing except the price of the house. Now, Darren stood to make a profit on this house when he sold it, and the contractor was pissed off because the contractor said, if I knew you were going to sell it for a profit, I would have charged you more. Now, Darren, I don't care what that lying's thieving contractor told you. I never called that contractor and told him to sue you. Never did I
say that. So Darren, you're free to sell your house. This contractor doesn't have a leg to stand on. Why the hell would you think that a contractor who's been paid in full would have some kind of hold over you selling your house. You know, I knew you were going to say that, because I knew he was lying when he said that he called him back. There was no reason to call him. There was no reason to call

I've asked the law firm that is really, who's wait a minute, man, who's suing you? They sold it to a collection agency? Who's they? Who's they who sold it to? So you're telling me, you're telling me you had a PayPal credit card, right, And did you
use the credit card? Never? I never touched the credit card. And why were you sending him seventy five dollars? That good question, why are you sending? Yeah? I assumed it was a Roku or you know, a reoccurring bill that it was just paying. And you have no idea really how it got there, but you made payments on it for seventy five bucks a month.
Apparently while you were making those seventy five dollars payments, it was not enough to keep up with it. And now you have a lump sum do that they're suing you for? How much is lump sum? Four thousand? Did you say? Yeah? Three four and eighty two. And this is the biggest problem is every connection I've had with the folks who are now trying to collect the debt, I've asked them, how did this start. You know what was John, Here's what I want to know. Why don't you know?
Why don't you know? I because I don't remember using the card, that's the But you apparently, Okay, then that's stupid. If you don't remember using a card. I would never send seventy five dollars a month for years to a card I never used. Well, there, I agree with that. I have to plead stupidity. There, it's just that. But all of a sudden. But when I'm going apparently, let's start at the beginning. Joe, Apparently you did apply for a PayPal credit card. Oh
yeah, why why? Just just real quick answers. Why? Why it's been so long? I don't remember why I How long ago was it? That's what I want to know. How long ago was it? I'm guessing at least five years ago, at least okay, at least five okay, because if it was six years ago that you stopped paying, if it was six years ago that this bill was incurred, they can't get a joejudgment. It's against the statute limitations, it's beyond the statute. Okay, So that's
one thing to keep in mind. And they but but if you were making seventy five dollars a month payments, you were keeping it alive. So when did you stop? Well, I stopped when they sold the debt to the collection. When now I don't know when I'm asking you, when okay, ten, ten twenty three with the last bill, okay, then it's probably it's probably alive. And well, you have a balance due that you don't agree with or you don't know how it came up with. So here's what
you do. You tell them that without documentation, you will not pay the debt, and they're going to take you to court and they're going to have to show the court documentation and if they can't, you don't have to pay it. They don't get to just collect from you unless they get a judgment. And the only way they get a judgment is proving that you owe the money and the only way to prove you owe the money is with an account transcript. That's it. You win if you don't have that bill o'ed.
Here's the big problem is I don't know, and this is why I'm The crux of the reason I've called is if there's somebody in the debt collection business that knows that when they buy this debt because that's how they get a hold of them. Right, they put pennies on the dollar to buy my debts. Right, you only have twelve months of accounting that they've sent me three times now because every time I've dealt with these folks who are trying to get
the money, I said, just show me where this started. But they don't have to show you. They don't have to. They don't have to show you. They don't have to show you where it started. What they have to show you is the time when you kept paying on it. It is assumed you acknowledge the debt. All they have to show you is what the balance was at that time and what it accumulated to after you stopped paying. You are under the impression they have to go back to the beginning of
time. Well, that is the what started this whole thing is the beginning of the debt. I have been a victim of identity sept multiple times. You were making pay you Okay, whether whether you like it or not, you confirmed the debt. Okay. That's that you're never going to go back. You're never going to go back and say it wasn't my debt. You confirmed it. You made payments for how many years? How many years? I have no idea. Okay, I started that, I think, Joe,
Joe, it's your debt. Okay, it's your debt. But they do have to show you did have a You did open an account with PayPal, but you admit that, so you did you open the account. Now there could have been fraudulent charge on there. There could have been. Maybe you didn't make any of those charges, but you just pay your bills every month, and that was one of them. But because you did it for so long, you can't contest them. Now it's too late. It's too
late. You confirmed. What don't you understand, Joe? What do you not? What do you not understand? What do we understand? What I don't understand is we we know Synchrony has in their computers every friggin transaction I made. Why can't they spit them out and show them, Joe, to both the people who are suing me and me, because they hold let me try something. When they sold that debt, the person that sold it, Sacrony Bank, agreed that they were done with it. They washed their hands
of it. They won't get involved in it in anything else. We mean you have such an odd Oh my god, I'm going to hang myself if you don't go on, Tom, It's never ending. Joe, Joe, listen what you're saying. You're not listening, Joe. You're close. Well, well, Joe, you keep saying the same thing over and over. You want to know when they sold that debt. They It's very likely they got rid of their records. It's very likely they sold it. They don't
care about it. They wrote it off. They sold it, and whatever they sold it for they wrote against the debt and the rest of it's gone. Now the debt, the new guy that took over the debt. What you're saying is because they can't go back from the beginning of time, they're going to have a tard time proving it was yours to begin with. Well, if you claimed it was identity theft, you never opened the account, or the chargers were fraudulent, that would have worked had you not paid on
it for years. Okay, okay. Now, so the time they took over that debt to the time you stopped making payment, they only go back to where you stop making payments. You had a legitimate debt you were paying on for years. You stop making payments. That's why they're going back twelve months. Now you can argue your argument. I'm not saying it won't work. You can go when they sue you, and they will, but wait for them to sue you. They have to sue you to get a judgment.
I have a courting date, Jane twentieth. I have to appear, and when you show up. You did apply for this policy. You did apply for not not on May twenty seconds of this year. I did not, no, no, no, I understand that you applied for it back when a year year and a half ago okay, and when you applied for it, they could never draft
a payment. But had your bank account not been hijacked back then, you would have had a policy with them. Is that correct? I would have back then. Okay, I get it, I get it. That's all I'm asking. I'm not trying to hook you. So you would have had a policy back then, but because you could not authorize payment because you had a new account and could never get through to them, it was never put through. So therefore, somehow this agent or whoever you were in contact with
was contacted finally by the car. They're finally getting around to you saying we never activated this policy, and I know what happened. The guy filled it out again with a new with a new date and sent it to you. What are you supposed to do with this? Does it ask you to sign it? What does it ask you to do? It wants me to sign for receipt of a policy. And then what who's paying for it? And who's paying for it? I'm supposed to be paying for it? But they
don't have drafts from but they have nothing. They have nothing to draft payments from. Right, Okay, Doug, I suspect listen, you may not like what I'm saying, but if what you're telling me is correct, just because you did not let them draft the premium doesn't mean you're not obligated to
a contract. Let me give you an example. If I signed a cont tract for an annuity, for a license excuse me, for insurance, or for a car, and I was supposed to supply bank account information, I did, and I did not, and I dropped the ball or forgot about it or they didn't answer their phone. No matter what the reason was, I could still be liable for the contract you promised to pay. You have
a contract. The fact that they never drafted your account makes it an account do not free unless the contract said it's only it's only official if you make your first payment or whatever it could be that you are obligated to pay because you do have a contract. Now they haven't tried to collect yet. And you may think I'm not signing for receipt of this. I don't have a contract. If they show you an active contract that you signed back a year
and a half ago, they cannot only get you for that contract. But if they claimed you were insured the whole time, they can get you for back premiums if you have a contract. Well, in the initial thirty day preview window when they mailed me the policy, I canceled the policy at that time and mailed it back tome. Okay, and do you have proof? Hold on, do you have proof you canceled it? That's like a photocopy of the page. No, any I mean you said you canceled it.
So so back then you say you had a thirty day review period for a policy. Yeah, when they mailed to me the policy the first time, and they say what do they tell you to do? That says if we do not hear back from you in thirty days from the original date, that okas you approve of Okay, did hear back from me? Because I also got a call for an attempted call from the woman that works in this agents. Okay, so you have you have that original letter from them that says
you have thirty days to contact them. Sure, yes, it's in the file. Good. Well, then you have nothing to worry about. You don't have a contract, but they think you do, just so you know, starting a week ago, I think what's happening is that's somebody Yeah, yeah, that's what I think they're doing now. I'm not saying they're going to be successful, and that's why you should, you know, make sure they don't have your policies or anything. But don't be surprised if after this
a bill shows up for a premium. I mean, I'm not saying you have to pay it. Bro. There are all kinds of weird people in this world. You had a contract, and I think what happened is no one acknowledged that you canceled it, and somebody put a new date on it and sent it to you saying the hell with this, you know, we'll just start it again this year. And does it say on this new one
that you have to notify them within thirty days? Yeah? The cover letter inside this has the same form letter good that you have thirty days and what do they say? You have thirty days to say no, or thirty days if you don't contact them. It's automatically because they're not allowed to really send you an automatic activation. It says, if we do not hear back from you within thirty days from the date of this letter, we will assume that
you approve of and accept the policy as received. You know what, That's exactly what they're doing. They're giving you the original letter back they never heard from you back. Then they're claiming they never heard from you. So they're doing it again. You better make What I would do is make some kind of documentation they're going by the original contact. I would. I would. This is a hell a boy of doing business, but just to protect yourself,
you better contact them. I would Doug send him a certified receipt you live. Do you live in the old ages? Do they even do that anymore? Yeah? But this way he has proof that they received it. Tom, Well, do they even do certified mail? I'm serious when I'm asking you. I've never heard of it anymore. Oh. Absolutely, But the important thing is return receipt requested, so that proves that they got it and then. But I would do more than that. I would also call
an email and keep a trail. Yeah. Yeah, I didn't realize that. This one says, if they don't hear from you, it's automatic. What balls do they have? Man? Is in the state, Well, it's hold on. They have to have a previously existing relationship for it to be legal, or that's the way it used to be. I don't know the new laws on it. For example, they're not just allowed to send you something like a magazine and say to you, if you don't send it
back, you have a subscription. They're not allowed to do anything like that. But with a pre existing relationship on insurance and all of that, normally they still do the negative decline. They don't do the automatic assumption. But but that's why I'm saying, I've never heard of such a thing. It just doesn't sound legit. Did you look up this insurance company? How legit are they? How did you find them? To begin with? I called? Who did I call? A year ago? You got to call?
