about that. Today We're gonna be talking a little bit about taxes because we have a few days to file. Of course, we can also do an extension. I imagine a lot of people do extensions. What is on your mind? Well, here's the deal we have Steve Saysik with us from Larson Tax Relief. I don't know if it's safe to call them a tax attorney, but that's his area of specialties. Wouldn't that be what you call Steve?

What you call yourself? Yeah, I mean I work with I am an attorney, and I work with Larson as an enrolled agent for their collections. Some things that man nature. But I also have an attorney yeah, and so you have handled tax cases and you negotiate with the irs, and what's the most common issue collection for us? The stuff that Larson handles is typically nine forty one, which is the wage and withholding return. Oh that one. Yeah, that's that's for at least for me and myself. That

what does that mean? Nine forty one? So when you're in business, you file at nine forty one? What every quarter? Is it? Yeah? You file those every quarter for that It tells you how many employees and how much you pay, and then they tell you how much you owe.

Right, so you're supposed to take money out of your employees paycheck and you tell them that, right, Plus don't you have to match it or what do there's a portion of that you have a corporate portion, you have a matching portion as an employer, and that's called the part you put into that fund then or you collect as a trust exactly correct, And that's held in

trust for the state, seld and trust for the employee. Right right, then you pass it on data day rs that amount that you say, I'm going to pay you fifty bucks, but you're only getting thirty six because I'm going to hold this for your taxes. Now, if you in the past, we've had Don Iiley, this guy, it was the famous case. I know you guys took a lot of their cases and helped people. But what happened was Don Ailey was famous. He made this famous. What he

did was he would get nine forty one reports from his clients. So he's an accountant, right, So his clients ABC and X y Z would report the accurate number of employees, the accurate number of withholdings, and they would forward to check to his trust account right, and they expected or they'd give him access to their own accounts and stay with from market. He was in charge of making the nine forty ones for his clients. That's not unusual to

have an accountant do a nine forty one for your business. Sure, payroll companies do it all the time. So he, in essence was a payroll company for the kind of you. So he would do all the legal stuff. But so what he would do is take company ABC or XYZ who reported all of the accurate stuff and report that they had no employees or few employees, sure, and pay into the IRS on the nine forty one what appeared to be the correct amount for what he reported correct, So there was levels

of fraud there. So it was really so there was no way for the irs to know that there was any fraud going on because the CPA is filing saying, here's how many employees, here's what we owe, here's the check. Right then the employer would not know because they're never going to get a notice of any deficiency. Sure so, and the employer as seeing the money come out of their bank account. Okay now, and I should get it on a wide shot here since you're talking. So here's what I want to

know, Steve. How does that come crumbling down? I forgot how we I don't know Mark. Are you there right now? I don't know if Mark is there. I don't see his camera. But how does that come crumbling down? Somewhere along the line, Company ABC found out they had inaccurate nine forty one if I remember correctly, it was an audit of Company ABC. And so when they turn over their p and L and their books,

they say, we have X amount of employees we've been deducted. And then they look at the nine forty one say, well, that's not what you've been paying exactly, and they said, oh, yes, it is here are the checks we wrote two our accountant and they trace that back and then they go to the accountant and say, wait a minute, mister accountant company ABC wrote you a check for one hundred grand. You wrote the IRS a check for fifteen right, and you kept eighty five exactly. He's in jail.

I don't know if he's actually still in jail. He was in jail. They don't keep people in jail a long time for this kind of crime. And then we figured he had about twenty million dollars that he pilford from people. Now I don't know what happens in these cases. Does he have to pay that back eventually? Because he'll never pay it back? Yeah, I mean there's did he stash it? Do they look where he put it? I mean, I'm always fascinated by fraud because I think in some cases

fraud can pay because you go to jail. Mark and I used to bat this around. Would you go to jail for X amount of dollars for so many millions of dollars a year? So when you come out you have a stash somewhere. I don't know, I mean, I don't even know. Do they make reimbursement part of it. So disgorgement is a part of the

judgment. I would assume I haven't looked at the touch against him, right, But you know, at the end of the day, the irises can say, you have a fine enough X amount of dollars and you're gonna pay it for you know, the rest of the results life. But if he has got Allion Camans or nick a Arraguar or whatever they're doing these things, and if he was fairly intelligent about it, which sounds like he was, I think that it's it's not a victims victims crime. He's you know,

he's killed all the businesses. And then maybe it was responsible for what when a company, When a company has not paid well, when a company did pay their accountant everything they owed, then the I R S up makes it makes a claim so that employee. Does that employee have to pay again if wages, I don't think they do. If it was withheld, doesn't the I R S hold them harmlessly? Right? The IRIS is not going to hold an innocent employee because they in fact, what did happen to the companies

that came to you for help? Did they have to pay again? Yeah? They were obligated Oh, because they're the ones. The onus is on the taxpayer, not so the fiduciary who screwed them. That was because they found the fiduciary, so they're responsible. Yeah, But had they not found it, the company still on the hook for those taxes because those taxes were due. Regardless of whether that's CPA paid or not, it's sexually for the employee, they weren't due. So does the employer have to pay their match

only or does the employer have to pay everything? So the employer is on the hook for the corporate their own portion and then the matching if the company fails in a lot of cases, but what if they what if they passed on the client's money which was stolen, Do they have to make up that client's money that was paid to the government or not. When you say the

client is, well that excuse me. The employee. Sure, So if i'm with if a thousand dollars is withheld from me and the company matches that, I don't know if it's fifty to fifty portion, Well, so the company matches, and now we're busted. You're saying the employees held harmless. They don't have to pay another thousand. But do I have to pay their portion because I squandered it or I sent it to a bad accountant. If the company fails, the portion that is the owners are going to be liable

for is the employee's portion. Oh, the company will die and there's no I know. But in this case, if the company's lived on after don Eiley, are they responsible for both portions? Are they holy? So this could ruin a company. In fact, it it ye company And to note follow their own other than the fact that this guy defrauded them, and it's

unfortunate and we were able to negotiate things in those particular circumstances. Are there then tips we give to companies right now, People, if you're in business and you're using a professional employment group or HR group or someone to administer your HR, someone to do your paychecks, to do your nine to forty one, is it wise every now and then to check and reconcile with the irs.

I think it's not a bad idea. And then also you have to sign these returns and so you know, we believe that I had it where he would had like a stamp or something he was doing. Oh, so like it's the levels of see the returns as file. You can even actually have them sent them to you get transcripts from the IRS on what was filed on your company. Right, it's simple bookkeeping, but it does take out time and effort to do it. We have a lot of business people who

monitor this show, so that's a lesson to be learned. Let's talk to Ulysses. Ulysses, Okay, what's going on? Man? What's happening? Yeah? Can you hear me? Yes? Now is it Ulysses or Ulysses? What? Well, it's Lisas Okay, cool, what's going on? Releases? So I just recently purchased a home and I, well, that's kind of good news, I hope. Right, Yeah, it's good news. But I decided to remodel the bathroom and as I was tearing it out, I noticed there was a bunch of mold everywhere. Yeah, and so

I contacted the cellar and say they were aware of the mold. They said they weren't, but there was a new carpet installed, and I pulled back the carpet and well, even if even if they were, was that was that? I don't I'm not aware was was mold on your disclosure statement? Yeah? So anytime there's mold, they have to disclose it. Well on yeah, I think if it's on the disclosure statement. I'm not sure if mold is covered by statute, but in any case, it was on the

disclosure statement. And what did they say on that disclosure statement. They weren't aware of any mold. That's what they said. Now, unfortunately, and here's what we really need to talk about. What are your damages? You would have to say that had I known about the mold, I would have either paid less or I wouldn't have purchased the property. But is that true? Where there are multiple offers? Would you have bought it anyway? And did they know about it? You'd have to prove it. Here's what I'm

getting at. Most of the time, unless we're talking about a major defect, most of the time this disclosure issue is not worth going after. I'm not saying you shouldn't. I'm saying unless you can negotiate or settle something, it's almost never worth going after. Okay, because of the level of proof, how would you prove you're using lot? You're saying, well, if they did the bad the floor, they would have had to have seen it,

right, isn't that what you're saying? Yeah, what if they say, well, our contractor never mentioned it, then what In other words, I'm asking you. I'm not challenging you. I'm asking you, how would you prove they knew it. I called Home DEEPO yesterday because they're the ones that installed the carpet and they have pictures where it looks like there's mold, and I asked them what's their policy on mold? Right, like, what

happens if they find mold when they're going to install carpet. They said they're supposed to report it, and UH, all right, so you have to get it, so you have, but okay, you have to prove. Okay, that doesn't matter. If their policy, the homeowner can simply say this ulysses. I've never ulysses. I've never ever heard anything about mold. I didn't know it was there. If that guy found it, he never said anything to me. You literally have to prove it. What I'm asking

you is how much extra did it cost you because of this mold? Well, I haven't taken care of it. Yeah, I'm trying to get it. How much? Mediator? Okay, don't get someone who's going to rip you off and take advantage of you. And because a lot of them are going to tell you, for God's sake, some of them want you to rebuild the whole house. Yeah, so just be careful on that. I would call American Restoration twenty four to seven. I would call him. He's

honest, he'll do mold tests. He'll do the most cost efficient way to get rid of it for you. Did you already call a mold mitigator. We got a guy coming to give us a quote and just to see how bad it is and what kind of mold it is, how long it's been there, but we have a pointment. Okay, good. Would you also do me a favor? Then? Would you also call his nickname's Rock.

He's over at American Restoration twenty four to seven. Really, I'd like you to talk to him because he'll do mold testing and do some real stuff and give you a real price. He's not one of these people that go in and exploit. I don't want you to be exploited. I don't want your fear to make you These companies. A lot of these mitigation companies scare the hell out of you, So at least get a second opinion. Okay, yeah, I'll do that, and then I want you to call me back

because we're not done yet. If it's so obvious, maybe we do go after the buyer the seller. So what happened? Well, I call them up. The reason my life it so much was because it showed they have a page on there that I sent you that says key features. And now what did you find? What? Excuse me? What what vehicle was it? I'm not looking at your ad right now. I will look at it, but what what was

it? There was a Santa Cruz xlt A Santa Cruz says, okay, and what was the feature? You really liked? But it had the telepackage okay, and a lot of them don't. And I'm I'm disabled, So I was thinking of putting all those you know, scooter carriers on the back of my vehicle. Anyway, I called them up, ready to buy this thing, and I said, I just wanted to check it that you had it on hand and everything and the advertise for thirty seven seven and it has you know, And they said, oh, no, no, no,

no, no, no, it's okay. I'm looking at the I'm looking at it right now and the ad I'm looking at it. So I see what you sent here today? What's that, sir? It says on the website today it says thirty seven seven. No, no, I'm not looking at today I'm looking at what you sent me and I'm trying to find where it says toe package. But anyway, anyway, go ahead. I mean it says key features. Oh, I see it, key features, the AWD blah blah blah, and then toe package. Okay, So okay.

So then they changed the ad or corrected it after you contacted, and because they said to you that would be an extra thousand bucks dollars, but so would they would they not sell it? Let me ask you this, would they sell it to you for thirty seven oh seven? No? What did they say? It would cost an extra eight hundred? Uh? They they said it wouldn't have the tow package, but they got down to thirty eight

two hundred and seven dollars. I believe in that area. You mean, if you wanted the tow package, Yes, I needed I get it. What I'm saying is and that would have been doctor the manager over there, and he tells me, well, the tow package just means that the wiring is pre wired to the back of the truck, so that if you decide to add the trailer hitch a tow package way, you don't have to run the wire and all the way to the front of the truck, which is

bull Well, it depends. I mean, I don't know what their definition of a toe package is. I mean it's on those sheets there. There is a chat for the Hyundai Motor Company. Okay, Tim, Tim, let's just skip. Let's just cut right to the chase. And it wouldn't matter what car you're buying and where you're buying it. This is called a misrepresentation of a material fact. Now, if this was a damage thing,

if this cost you damage, it's considered bait and switch. It is not considered bait and switch if it's a mistake, or if it's an oversight or a misunderstanding. If they did it once, if they did it on a dozen vehicles, or month after month after month, even after it was brought to their attention, it would be considered egregious or what's called bait and switch. That's what the f the Federal Trade Commission says. Here is a mistake a lot of us make. Now I'm not saying you made a mistake.

I'm saying a mistake and impression. We think that when something is advertised, they must deliver it, and that's not true. Only if there was civil damages that you relied on, you flew out there, you made special arrangements, you lost another deal, whatever, whatever, whatever. But that's only if it wasn't a mistake. The Federal Trade Commission and the state attorney general, all the authorities for the fifty years I've been doing this for consumers.

What they do is they give you a break if it's a mistake, and they look at your pattern. If you have a pattern of doing this, a pattern of deceit, if you have a track record of tricking people into coming to the dealership, then there could be a problem. Now that's the law part of it. I don't mean the law part. I mean the enforcement part of it. Now, let's talk about the practical part of it. In my opinion, they should have just given it to you and and

it should have been a really good good will thing, you know. Yeah, now what I thought that? Now? Mark? Are you there? Is Mark on today? He just texted me, is he honor off? So right now we're a little shorter on accesses. So he's going to come on a little bit later, okay, because he said something about an experience with a planet. So Tom, yeah, I want to tell you that

Almost? Will they almost guarantee you that they won't sell it to you for thirty seven seven oh seven. Well, then if they can keep doing that, that would be a problem. But here's the deal. You'd have to show this that it is a pattern. So here's what I'd like to know if they would

sell it for that. But here's another thing. Just because the toe package is considered one thing from corporate, they could consider I mean, I don't know where you get a definition of the toe package at Planet Hyundai. I don't know, because when I didn't, I got it from Hyundai's motor their corporate. Well, no, I get that. I get that. But for example, I got on a tap with it with a fellow. No, I get that, But they weren't from Planet Hyundai. They weren't.

Did you ask Planet Hyundai before you made an offer and went out there what the toe package entailed? I when I checked to make sure that it had one, I was going to do the deal at thirty eight something, and I think we should have somebody call over there and clarify this. And he said, no, that tow package means that it's just pre wired. Well okay, but listen, what I'm what I'm getting at is if that truly is what it is to them. I mean, I don't know what it

means to them. Now. When I, for example, buy a truck, or used to buy a truck with a toe package, it would include the wiring, and it would include the receiver on the back, or at least the receiver, sometimes not the wiring. And so was there a receiver on this one? No? Okay, there should be at least if it's a toe package, I don't buy it with the wiring. There needs to

be at least a receiver on the back. It doesn't have to have the ball that goes into the but it should at least have that receiver installed. Well, yeah, I was. I didn't assume that it would have the ball or I don't need the ball, okay, because you would just stick it in the receiver. Here's what I'd like to do. I'd like to call over there. We got to give this to somebody. No, and

if they still have it on there and they won't sell it. Did you call to find out if they would sell it for that price for seven seven yeah no no, no for the new for the new price seven seven yeah no, I haven't. Would you do that please and we'll get Please do that. I mean, I really want you to do that because if they because then they could say it was a mistake, we corrected it, and then they'd be right. But if they still won't sell it for that,

just on IRS dot goes. It doesn't require signature, but you do have to have an account with IRS in order to do that, So you have to create your online account three IRS dot goes. But your accountant can then file it without going without having you sign it. Yeah, your accountant can do that for you. Don't need a doc you sign or anything. No, and just ask for them to send you a copy of that A transcript to the fact that they filed it, because just if they tell you that

So so they paid money that you would put down. Uh, they had paid money ode on the final payment for the project that they're trying to we hel out of. Oh I see, Tom, it's

a dinger call. Yeah, it is a dinger call. Now since you handled it, do you remember the details, chopper? Yes, what happened is there's like a big subcontractor out there at d I A and there's a middle one that was kind of screwing this guy over. Well that's wrong, and I contacted the big guy and said, come on help the little guy out and they did. It's a ten thousand dollars dinger. Wow, that is pretty cool. Yeah, I remember that guy got That guy got paid.

The general got paid right, but the sub but he didn't but our guy here didn't correct Yep, I remember that. Cool. Thank you for that follow up, Man's that made me feel good more. relief with US eight four or four lars in tax? Steve says it an attorney at law who works there as an Enrold agent and he does long also, but for himself, and I mean for his firm. Now I want to ask Steve a question. So, even though you're filing an extension, you still have to pay, right, people need to know that, Yeah,

it's an extension of file not to pay. So if you feel like you're going to owe, then you need to either pay one hundred percent of what you owed the previous year or ninety percent of what you think you're going to whichever's greater. Now, what if you don't and you want an installment. Isn't there an automatic thing you can do, like just send in a

payment saying I want an installment or how does that work? So if you do file the return and there's a balance on there and it's below a certain amount, you can actually file a form with the returns saying hey, I'd like to go ahead and pay installments on that And on that form, does it tell you what payments they're going to be? Like, does it have a schedule for what you owe and what the payments? Typically it does, and it's got like a calculator that UCB it can help you out with.

Or there's even instructions on there as to what they'll accept and what they want to accept then and what form? Do you know what formula? I think it's a nine four or five three? Don't quote me on that, Okay, Now it's similar to that you can look at up. So basically there's a form for an extension with installment, but that's only up to a certain amount. Right, If it's over that amount, they don't even you cannot

get an installment you can get in a selven agreement. You have to either you have to negotiate with the automated collections and is that what an enrolled agent does too? Is that what you can know? Yeah, yeah, Larsen that's one of the best things that Larsen is very good at. Actually, it was one of the best things. We're good at it, whether you

it's a personal liability a business liability trust fund? Is negotiating. Is we negotiate when it gets to a point where you can't do it yourself or you don't want to sit on four hours, you know, on hold with the irs and have some idiot pick up the phone and tell you that you know you're the wrong person. Were the people that can handle that? You can take that brain damage off off your desk for you. That's important to know

because I think that is one of the areas where we get intimidated. Does that mean you have to sit on We don't have a lot of time, But do you have to sit on the phone or do you have special numbers to call for them? We have it, We have special numbers. Lead

Now, you don't actually do the returns, but you give them counseling or do you do the returns in those cases? What do you do in those cases? So Larson actually

does have a separate branch. It's independent of Larsen, but it's still got the Larsen so you they will do that. Okay, good, So you can person you can help get someone back into the system. Yeah, and it's kind of nice too because you can just call one person and we can you know, they can forge you to the return Preparation unit. They can get that done. Who can then communicate with the services unit, you know,

where we can represent you based on what youo. So it can kind of be a one stop shop if you've got things that are fairly straightforward as far as getting those returns done. If you need a more complicated and in complex the you know, a series of returns. We have CPA references as

well. Okay, Now, earlier, we had a guy call up and he said, I saw online an ad and it was for a Hundai on Planet Hyundai's website, and I said tow package and it was listed for a certain price, and I called and I wanted to buy it, and they said, no, no, no, no, that doesn't have the toe package. Like you think that's just some wiring and stuff. He says, no, no, no, Hyundai says, a tow package is a tow package. Now, usually a tow package in my experience with Chevy and trucks,

there's a receiver on it. Sometimes there's wiring. I don't know if you've ever bought a tow package, but usually it's that now like you buy our vs have tow packages. Pickup trucks have tow packages. So anyway, so then Tim said, but they, and I said, as far as bait and switch, bait and switch is a very difficult thing to prove civilly and a lot of people automatically assume if something is advertised that they must sell it to you for that amount, and they think they have some legal right,

and really it isn't automatic. But the Federal Trade Commission does look down on companies and will enforce certain laws and penal and penalized companies who do true bait and switch. A true bait and switch is where they won't correct it, or they keep it going, or they know there's a problem, but that it's bringing a lot of people in, so yeah, let's do it.

True mistakes are not considered bait and switch. Now. Having said that, Tim said they did change the ad after I complained about that thirty six thousand some odd dollars and they changed it to thirty seven some odd dollars. And I said, I said, listen, uh see if you can buy it for that, And if you can, then they did make a mistake and they corrected it. So I asked them to call them before we got involved, because if they're now advertising it instead of instead of thirty six seven

h seven, what is it advertised at? Tim? What was that? What is it now advertised that thirty seven seven seven? Okay? And at thirty seven seven another thousand bucks at that price. They added a thousand bucks to it acknowledging their mistakes. So theoretically you should be able to buy it with the toe package for that. So won't say no, it's thirty eight. Thirty eight to two oh seven is their bottom dollar. And it they are still saying that the tow package is just the pre wiring, uh in

case you want to put on a tow package. See, that's where we have to figure out we really do. I'm going to look at there like, like, what is the definition of a tow package? Now before tim, I understand? No, I get it, I get it. I'm going to say that Hyundai or Hyundai in their chat with you told you it was w go ahead, I'd have to pull it up just a second. I've got it real close. Yeah, I'm just curious what they say it

is. Okay, they already Teaver made him. They said, the tow package for the twenty twenty four CENTA Cruz includes a Class four hitch receiver, a wiring harness, and a trailer hits ball. The maximum toy capast is okay, got it? So? And you did that on a chat right, yes, with the corporate website. Did you tell that to Planet Hyundai? Oh? Yeah, and what did they say? They said, no, no, no, that's not what it means. They said, it's just a wiring pre wiring back to the back of the trucks. You don't

have to run the wiring all the way. Now, here's my case, you want to put in an AFT market. Here's my question for people listening Planet Hyundai as a dealer. They're an independent dealer. I mean they are, They're not owned by Hyundai. Are they allowed to have their own definition of a toe package? I mean? And is it disclosed anywhere? Because to me, saying toe package means more than wiring, you know, So I want to know what people think. So did you say to them that

you talked? Oh you didn't tell them. So who are you talking to over at Planet Hyundai. Well, I've been talking everyway. I've talked to the general manager, the sales MANA okay, So the general manager did talk to you. He was a general manager day with John something? Was it the general sales manager? What was the general sales manager or the general manager? Do you know? He said he was a general manager? Nice? All right, here's what I want to do. Here's what I want to

tell me. That's who they are. I don't know whether they're really I get it, I get it. I just meant general. There's a lot of people say they're the general sales manager and we hear general manager. But here's what I want to do. I think there's something going on here. I would like to talk to someone over there about this case. Specifically. I acknowledge that they change the price accordingly. That's good. They said, Hey, we made a mistake, so now it's not thirty seven it's now

or because it's not thirty six something, it's thirty seven something. But even when you call it thirty seven something, they won't sell it at that price. Or are you saying they will sell it at that price? But the toe package is the wiring only is that would be because they will sell it at thirty seven. So now it comes down to the definition of toe package.

Is that what they're saying or are they saying what's that? They won't sell it to me at thirty seven seven if you wanted it the way it's equipped in that ad with their definitions, would they sell it for thirty seven? Yes, they would. They won't sell it with the hitch that you want for thirty They won't sell it without the hitch for thirty seven seven oh seven. They won't it as is for thirty seven seven O seven it's thirty eight too, then why is it advertised for thirty seven? I don't know.

Come on, Tim, are you joshing me? Bro? You just called them to the guy Tom. Their site says it's a six hundred and fifty dollars and it's wiring and receiver. Really, yes, sir, really, so they define it as toe package being a receiver and wiring. You found it on their website. I found it on a Google on the Hyundai shop website. So they're saying, well, we're not sure we can sell it for that that Now that that is pissing me off because now it was thirty six seven oh seven, right right right, they added a grand to it and say they still can't sell it. Yeah right, you know what, there's something going on here. I don't like this at all. I don't like this, Hey, chopper, go ahead, call them.

Get this specific. Although here's another thing that's against the They have to have a unit number. Did you know that they're required to have a unit number on this ad? They have a stock number under the first heading. Okay, so if I go back, there's a stock number here, hold on three d's in dog. Okay, call them. Here's what I want you, Chopper, Here's what I want you to do. I want you to call them. I don't want to get into the nonsense about it once

They said, well, this one's got running boards, so it's really not that price. It's another thousand bucks or whatever, and I'm thinking, huh.

I didn't know quite what to make of that, but I'm like, oh, okay. So then I call back because I'm looking further on it, and I talked to someone else and they say, well, that vehicle's not even available. So at this point I'm going, what the hell's going on? So I end up going down there, and basically I threw a fit. I was like, it's not even close to the price you were advertising. Even if you add in the running boat, it wasn't even there.

Made the math made no sense whatsoever. So finally I just said, listen, you know this is outrageous. I don't understand where you guys are getting this pricing. And the salesman are you still there? Mark? I can't call you here. He's only been on the radio. I don't know how many years with men. You got me so flustered thinking about these guys. But here's what I would do on the tow package. I've been listening. Check it out, man, look at one of the Santa Fees or one

of the palacines. It says toe package, and call up someone else, call up not whoever is calling up right now, and say, hey, I'm interested in the palisade. Do you have any with the toe package? And then say does that include the receiver? What does that include and see what they say. My guess is they're going to say, well, yeah, of course it includes that. I think they just make stuff up when you call them. I don't trust them, man, although I did buy

a vehicle from them. Now hold on because Raymond wants to comment on this. Go ahead, Raymond, what is your conservation? I was listening to your program, Tom so I decided to call Planet Hundi myself and we were discussing the tow package that the definition of the tow package should include include the receiver hit. And he told the sales manager told me that if corporates definition includes the receiver hit and the wiring, that they would give it to the

gentleman. If he proves that corporate definition of tow package includes both of those. I'd never heard about it. Go ahead, let me say something about this coeitching. I need to say this listening to you talk about it on the air. No offense, but it seems ridiculous. There is no vehicle I have ever bought in my life that says it comes with the toe package and it doesn't include the receiver I am wiring. I have never heard of anything like it in my life. If just the wiring's there, where the hell's the wiring in that, it doesn't even make sense. The wiring generally ends at the toehitch. I know, it's ridiculous. I mean, I just don't understand that. Is it on your proper line or their proper line? It's between both of our houses. Is it right on the property line? really old property, fence lines are not on the property. They're either on one side or the other. They belong to one side or the other. Are you telling me this one is right on the property line? I'm that I don't know. I mean the house so back in ninety six, I think then probably it is. But anyway, what's going on the fence is damaged and you want to get the neighbor to chip in. Yeah, well

the property management company. So I reached out to I talked with the neighbors, told them what was going on. They said they reach out to the property management company. They did, They gave me the phone number. I reached out with an email them back and forth and send them pictures, send them invoices, everything in such, you know, share fence. I'm responsible for half the hopefully they'll pay the other half. But I have not been

able to you know that. You know there's no law that says that, right, Yeah, I guess more, you know, just common curtices. I I've not seen it, but maybe a neighbor suit a neighbor one time for a joint fence, and one that would make it a precedent, which they call common law. But I don't know right off hand. fence, let's chip in. So what's going on now? So this is in se September. I have probably the past I've reached out to three or four times the email. I have not got a response back. You have to go out and do a few more touch ups today, okay, because you only have four months from the time the work stops. I'm not giving you legal advice. I'm not giving you tricky advice. I'm just saying I am sure you can find some touch up work that needs to be done, okay.

In fact, if it would be better, yeah, yeah, yeah, if you had yep, if you go out there and maybe your wife snaps a picture of you working on it today. Okay, because you only have four months now, once you finish the job, you have four months to do that. Lean. What I would do first is you have to do a ten day notice that will get you paid. Yeah, in the past I have I use Turbo tax have been a very simple act situation, and I've done it mostly and I owe about five K to the I R S in the past when I vowed more than a couple thousand dollars. When I get done with Turbo tax, it tells me, oh, you have to make estimated payments, which is fine. The question I have is I worked on my taxes we ago. Since I found that I'm a big chunk of change, I've changed withholding online in my wife's taxes

in order to not have such a shortfall next year. Okay, I ignore those estimated tax payments and that going to be a problem. What are you talking about estimated I don't even know what you talk about estimated tax. It's going to tell me actimate quarterly estimated tax. Well, you do if you're self employed or something like that. But you said you change the deduction.

So do you two both have regular W two salaries? Yes? Well, yeah, I mean if you under tom, if you underpay, regardless of you've got withholding or not, the IRIS is going to want you to make estimateds on top of that. Come on, yep, even if you're a W two, even if you're a W two, But what if you just

increase your deduction? So he's he's actually had a gut or decreases. And to his question, if you feel that you're increased with holdings is going to address that five thousand dollars shortfall next year, then you don't have to make those estimated tax deposits. But if you're off and you owe again, you're going to be penalized for that. Now, the rule is you have to pay at least ninety percent of the previous year. Is that what it is

or ninety percent of current or what what is the rule on us? It's one hundred percent of what you owe the previous year or ninety percent of what you think you're going to owe, whichever is greater. Okay, Okay, So it's five So for example, in his case, you'd have to have five thousand estimated tax deposits to be composed. So when you make those adjustments to your deductions, will you guys pay in another five grand? Yes? Okay, then you should be fine. Yeah, but you don't have any

self employment at all? No? No, how are you off that much? Do you have a lot of interest income and stuff? Well, to tell you the truth, my wife's son social Security. She's retired, so that that didn't withheld withhold anything. And can you choose to withhold with social or not? It depends. I mean I don't know that Tony. Can you choose to withhold with a Social Security that I'm familiar with? Yeah? I think you have to elect into it. It's not like an easy process.

So you just have to know that you're not getting any Okay, So where does it stand that the it doesn't the quarterly payments? Let me explain this to you. They're never required. They're only required if you want to. It's not a violation of the law not to do them. Is what

I'm saying is it's not like you have to pay tax. But theoretically you don't have to make estimated payments as long as you pay your tax if you're not going to owe, and if you don't care about penalty, and so the answer is, of course, you can adjust any way you want and then make sure and then hope that it works out. So I moved the dash cover and come to find out the VIN number that's supposed to be in the windshield is gone. Oh why was it ever? I mean, is there a ven number elsewhere on the car? There there is. I found the two, the one in the door

and the one underneath the hood, but I wasn't too sure. You know, somebody stole outan Where is that usually? Is that usually standard? Front? Left? Is it? Yes? So it's from the outside you can see it, right? Is that what they usually look down at the bottom right of the windshield when you're standing outside bottom left river side? And I ended this morning. There's no linemen out there, there's no tree service. How many people are affected? Well, my whole household. They did get the power grun across the street, and the neighbors over the other street, everything else nine

has all the power restored, but still nothing in our homes. I've had had heat for three days, no hot water and being spongebats and it is this crazy. I mean, I didn't realize there are people still. Now you say you don't know how many people are really affected. Well, my household, it's five people, a tortoise making No, I'm talking about like, is it the neighborhood. to owe money. So is there a real consequence to not filing right on time? For that particular one depends on the type of entity. If it's an eleven twenty year and eleven twenty ess and what the hell does that mean? I mean like it's an LLC. If it's an LLC and it's going to be attached to their ten forty, which is called a schedule. See the necessarily you don't have to report on there if there wasn't any you know, expenses, you don't it's a standalone LLC with partners or not partners,

but other well, yeah, other members. Like so let's say there's three members. That's what this guy is saying. I know the company three members LLC. They didn't have much business and they don't have no profit. They have no profit, no tax do but they just didn't get around of filing. Yeah, so they're going to get penalized. They need to file, you know. I thought it's penalty based on what you owe. It's no,

not necessarily you still have to file the return. It's an informational return, you know, So especially if there's partners, what would they what would they penalize? You do? You know there is a penalty per partner really like ten thousand dollars. It can be if there's you know, enough partners. So isn't it shouldn't They just put in any kind of extension and that would have ship. But I thought they I thought entities were a month earlier

than Yeah, at this point they're late. They should file something. And if this is their first return and they haven't had a previous return that was owed, they can actually file to get those penalties waived. So just file it, and there's a farm eight forty three. You can just file it and say, you know, first time at batement's what it's called, and they'll wave those penalties for the first one and then moving forward, just file

it even if you don't anything. You know, typically you want to file on personal taxes, the penalty is tied to exactly what you oh, exactly, So there are no penalties if you don't. Oh no, not on

the personal tax. But if you don't file because you think you don't owe and you keep doing that, then they can file for you and they may assume you all right, Well, at that point they just throw the book at you because you get no deductions, you get no expenses, you get none of the you know, the things that would make it so that you don't know, So just file it. Substitute return for you. Oh yeah, they will. And what is that based on? Well, how do

they estimate incomes and stuff? So essentially the irs is going to get a bunch of documentation from people that are two two's anything the mortgage company sends them, you know, all sorts of things, and then they're going to look at that and then they're going to generate a return based upon their perceived income that you've received. Now there's an age old problem I want to send I want to talk to you about, and that's called matching ten ninety nine Again,

I know you love this one. There are companies that keep track of income religiously and they report their income. Now the ten ninety nine are separate, but they're included in that amount. So let's say you have ten ten ninety nine's at one hundred bucks eats, right, so you have one thousand dollars of income. Now you report on SCHEDULECEE or wherever wherever you report it, you report the thousand dollars income, but you report it as ABC LLC

or ABC tom Right doing business whatever. So you include the ten ninety ninees or not? You include them, right if you have them. But do you say on that schedule somewhere that these ten ninety nine are incorporating into that amount you need too or else? Do you have to go line by line? Yeah? So they want to. It sucks. I mean, really, what do you do if you have a The way that Dais looks at it is they say, okay, well there's one thousand dollars of income.

We're gonna go ahead and accept his his you know, voluntary reporting on that. We see all these other income components that he hasn't listed. Okay, I have a neighbor whose house has been on the market for about seven months, and I've come to

learn that they have had ten offers on their house. But the lady that's in charge of the arc committee or architectural committee apparently has been interviewing the buyers and feeding them a bunch of information, and all ten offers have been withdrawn because of HOA issues. Now, what do you mean do you know why they were withdrawn? After talking to who what what is her position of the arts committee? Hold on the Are you saying ARC our ARC the stand for

architectural committee? Okay, like the ones who enforced covenants? Yeah, uh huh okay, I don't understand. Why would she even interview them? I don't get it. Well I don't either. I don't think they have any right to butt in between the buyer and the seller of a of a property. Well, what I don't understand is like, for example, how does the how does the are the the Architectural Review Board even know that there is an offer on the house? How do they contact the buyer? How does

this happen? I doubt I'm not sure. Well, see, Brad, I need all of this information to see if it's tortious interference or if they're doing what's called a fiduciary or a potential fiduciary a favor. I mean, there's really that much leeway. Are they doing something out of duty or are they interfering? What do you think? I mean, what did the neighbor tell you? Well, apparently some of the perspective buyers have contacted the HOA just I guess just to talk about it. Well, you know what that's

a good thing. Most buyers or their agents should contact the HOA, and when they do, they say something like this, I'm thinking of buying the house at one two three Mulberry Street, and I'd like to know the condition of the HOA or whatever. And the HOA then says, well, let's meet with you, or they talk to them on the phone or what. But yeah, unfortunately I don't have a lot of Well see that's what I

mean, Brad. I mean, I don't chastise you for calling. That's fine, but I don't know I even have enough information to go on. So is it something like this, the house has some architectural problems that have to be fixed to come up to covedence? What do you think is being said? Has anyone shared with you what's being said? Not specifically? Okay, Well then then I can't help you. You suspect though, that the HOA is interfering, and I can say this, hold on, there is

no interference. If someone buying a house calls the HOA and the HOA renders opinions, now I just don't know unless unless they're giving editorials. I don't know, So can we, Brad? So what do I do. I only got so he's claiming they're not giving him as his tax credit because he already had gotten it, but he didn't get it. And I'm not a caller or texter, I'm not exact exactly sure. How can I verify the fifteen hundred was sent and where it went? So let's talk about that in general. If payments were sent and hijacked or whatever, what do you do? Does the IRS keep track of where they sent it and when they sent it? Well, I guess the first

step was to see if they sent it. So that's when you call the taxpayer transcript Okay, call the advocant. Well, yes, well if they sent if they're if they proved on the transcript, or they have record that the IRIS sent the check, so it'll say on the transcript fifteen hundred dollars refund or whatever it is. And you didn't receive it, that's when you didn't need to connect with the advocates. Say hey, and I have never received it. He got a letter saying you got an advanced childcare credit and

he's not childcare. But what if they actually call it it's a child tax credit, which again I never heard of. But I mean, that's just it's it below the line credit. Now, what is a small business optimism Index. What is it? What it is is a perception of what small businesses think of the economy and their outlook. It's not necessarily something that has happened. It's not a

lagging indicator. It's more of a leading indicator, right, because this is if they believe that there must be a reason, or you could consider it a lagging indicator, meaning what has been going on leads them to believe this. However, it doesn't matter. But it is the research foundation for the Small Business Economic Trends Council. Here's the thing. There's an organization that put this together called n FIB, and NFIB is what they call themselves is the

Voice of Small Businessiness. And they put together this Optimism Index, and it's usually for small business. So here's what they measure. Your plans to increase employment. That's an indicator, that's a leading indicator. And they say eleven percent, meaning eleven percent will that's a small number, all right? Then they give that a score. Plans to make capital outlays only twenty percent, really bad right for small business. Listen to this one. Plans to increase

inventories negative seven percent? I mean that now, listen to this. Do you expect the economy to improve negative thirty six percent. Now, let me tell you something. Even though they call these percent indexes, when does perception become reality. Well, let's put it this way. If they don't believe the economy is going to be good, they're going to hedge. They're going

to protect themselves, right, They're not going to spend as much. They're not going to make big capital investments, and they're not going to hire. They're going to what I call be in a defensive position. In a defensive position, then you have them spending less, hiring less, and you have it leading into the market. If several small businesses do that, do they

expect sales to go up? No? Eighteen percent. Here's what they figure, a negative eighteen percent in sales, that's the average on this survey. They also believe current job openings right now are way less than what the administration is reporting. They say only thirty seven percent of small businesses are even looking to hire. Negative eight percent. Is on whether whether or not you expect good credit conditions. Is it a good time to expand four percent of the

businesses say no, I mean yes, yes, only four percent. Ninety six percent say not. A good time to expand next earnings trends. What are their actual earning trends. They're downward negative. Twenty nine percent believe that's that's how bad they believe the perception is for earning trends. So that's a big problem. And that and perception a lot of times can dictate how businesses operate. Well, it dictates how people spend money. I mean, it's

it really is a real thing. When people believe. For example, a guy who feels he may be laid off. He's not, but he feels he might be, he might put off a car purchase. If he puts off a car purchase, that's going to affect the manufacturers, dealers, salespeople, AH support staff, sure gasoline, and anecdotally, I mean, I have these conversations a lot because it is tax season, and I have a lot of business owners calling me and saying, well, I owe all these

taxes. You know, well, how can I pay all these the economy is going to be so bad. But then you look at their p and L and their taxes. There's a reason why they owe so much taxes because they had a banner year. And the perception and reality are two different things. It's it's something that these business owners have to get their head wrapped around. It's like, yes, I know that there's pessimism in the economy right now, but if you actually look at your books, you're doing really well.

If you look at real a coincidental current indicators, there's not many bad ones. Right. No, they're doing very well now. But that doesn't mean that in three months. They know you do that very well. But why, I wonder why? And listen, I'm not a big fan. I'm not a big critic. I don't want to get into the politics of Biden. But he has not gotten credit for anything, even the positive indicators. But they do blame them for the inflation and for rising gas and for

other things. Now, I'm not saying, you know, let's all get on byden Society's a great guy. But truly, the indicators of the economy do not indicate how bad. People think. It is exactly right, exactly right, and so they're preparing for this eventual what they're worried about so crazy, which is a crazy thing could happen. A lot of these positive things

can turn negative because people expect them to God speak them into existence. Right, So yeah, I think the negative connotations in the economy right now are not reflective of the economy, but that doesn't mean that it may not lead to that because of the way that people are perceiving it, which is interesting. It doesn't follow any current economic theory. That for me, it's hard to track because I would like people's opinions on that, even my YouTube morons.

summons. I got that last night after Okay, see, you were under the impression they have to do every month. They don't, so they did it the right way. You got a notice, and now they filed for an eviction court action and you have to be in court when in seventeenth of what this month? Okay, so a what's that? No, it doesn't matter that April was applied. See that's the problem. You can apply it to April, but no matter, or you can apply it to February.

You can apply it, but no matter where you apply it, you're still two months behind. Will they give you any kind did you try to negotiate a repayment schedule for those two months? Oh? Not yet, something, I have to do it on the seventeenth. Well, and the seventeenth you go to court, right, and most likely all the judge does is validate that there's a lease and that it's a legit charge. The judge is not

going to work out a payment plan, nor even suggest one. You need to meet with them before you go to court, because once they go to court, you're gonna get an eviction order and then they're going to move you out. All right. Somebody telling me once they accepted April rent that they got to start the eviction over. No they don't, No, they don't. Okay, in the eviction notice, the thing you're calling a notice, did they ask for payment they have? Yeah, they said I have thirty

days to come up with the payment. Why didn't you? What's that? Why didn't you? I didn't have it? Oh, I see, okay, how much is your rent? How much is your rent? So you owe? You owe twenty nine hundred dollars for those two months, right right? Yes? Plus you owe probably legal fees. So what's the total you'd have to pay to get out of eviction? Is there an amount they will take? No, I haven't talked to nobody yet. Nobody. I haven't talked to nobody. No. No, they usually do want to talk.

They usually do want to settle. They don't want to go to court. If they don't have to, you have time to call them. But what difference does it? Well? No, no, it does make a difference. If you ask for a payment schedule, I will call them and talk to my learn who work with me. If you listen, would you call call us back if you can't? But the first thing I would do is all say you know, I got behind because blah blah blah, and then I want to make up the back rent. Can you give me a payment

schedule on top of my regular rent? That's what I would do, But don't don't go in their half cock thinking they can't evict you because you paid your rent. Once you're late on rent, they can start the eviction process until it's paid. They don't have to file every time you're late. You don't get a notice. Okay. I also was sold that they had to give me a summons to go to cart with you ten days I think after the eviction, after the thirty days up. So there is no no see

you look it. I don't know the exact process. I always I always get hung up on it. But here's here's what I want you to know. They probably have a right to do what they're doing, and to fight the process, says is stupid. And here's why. Here's why. It just starts the process again. Even if you were right, and you're not. But even if you were, it would start the process again. You would gain nothing. They're still going to evict you. Oh yeah, tell

I wanted to know, will they sell it for that? What did they say? The problem, they said was the webmaster had put in the wrong amounts. I give it. That's okay. That would be the second time

he put in the wrong amount. Then okay, But this thing really just got weird. I talked to the sales manager. He says, they will sell them for the price that they had showed thirty seven. Uh no, actually they wanted thirty eight two oh seven. When I talked to him, right that was on the website. Right. However, just now the price of that car has dropped down to thirty five seven oh seven. Why, I just looked at it, and he says he will sell it for that

price. However, the trailer, hitch and installed everything will be an additional eight hundred and fifty eight dollars. But eight hundred and fifty eight and thirty five seven oh seven is just about what that tim wanted. So I want to call it right, and it is what he wanted. But see, here's the problem with these people. They advertise I see it now, it's now thirty five seven, but they still have the damn toe package listed as

an option, when really that's an extra eight hundred dollars. That's true, but let me tell you what they say. The toe package on the Santa Cruz is only the wiring from let's say, the tail light to the receiver. It doesn't hook up to the receiver. So when you look on for what a but does it have a receiver? No, okay, that's not part of it. It's just the wiring that would go down to the receiver. Then then is that is that is that proper to call it a toe

package? I know that's not such a big deal. But is it proper to call it a toe package? I would call it a wiring package. Yeah, I mean, you know this is a great price.
