I had worked with his family over the years and had a really good experience. They've done a lot of good work for us. Oh, so it's not blind. And you met with him at the first Yeah, we met with him several different times. But first you did it in you did it in twenty twenty two? Did you say it was twenty twenty three? Twenty
three? Okay? And what did you sign a contract? We signed a contract in December of twenty three. Okay, go ahead with your story then, so sign the contract in December twenty twenty three? Do the AH transfers for the deposit? How much was the deposit? Eighty eight thousand, five hundred and seventy dollars. Why would anyone ever pay, ever pay eighty eight
thousand dollars up front? Is the contract called No, I'm not talking about what it called for, but why What goes through your mind when you dish out eighty eight grand? What are you I'm thinking this person has no wherewithal to start anything without eighty eight thousand. That's a big problem anyway, and I would agree. So the contract called for what eighty eight Yeah? So there it required for two different invoices to have a deposit on them. One
covered the plans and permits, and one covered material order. Okay, so hold on the one that covered the plans of permits. How much was that? All? That whole invoice was nineteen thousand, six hundred and eighty And did you get the plans and all of that for the nineteen grand? No? So you paid for that and didn't get it. Okay, So the materials that you ordered, the balance adding up to eighty eight grand, did you get materials? No? Okay, So again you paid for air,
you paid for nothing. You're exactly right, and I'm not, by the way, just so you know this, Debbie, the way the show works is I'm trying to talk to other people who are listening, not you. I'm not scolding you. So so Debbie, Debbie paid for plans. Now, if you actually get plans and architectural reviews and engineering stamps and all of that, and yeah, it's all right to pay as you go. Then materials are ordered if you can call the place and make sure they're ordered in
your name. So this guy goes out of business. They delivered the stuff, or it is delivered. Nothing wrong with paying for materials, but to pay for air you get into a problem. But in any case, under the contractors trust egg, that doesn't mean somebody can rip you off. So what happened with this? Ada? Keep going with your story. So you give a de posit of eighty eight thousand dollars in twenty three? Then what at the end of twenty three? Now we're here, Now we're here in
twenty four. What happened? So I kept in touch with him, asking where the drawings were? Had he applied to Elbert County for his contractors because Elbert County had started a contractor licensing process. And so let me ask you something. Is he out of Elbert County? He is in Douglas County? Well, now I find out he's kind of in a black Forest area, but family in Elbert County, Okay? And when was construction supposed to start
mid February? Package? The package was supposed to be here the first of February, and construction was to start in mid February. Okay, So where do we stand? We got nothing. February twenty eighteen twentieth he finally came clean that he had spent the money on something out on other a jets and I'm looking at his text, Tom, Well, then he's going to go to jail. Spent is what he said. The money was spent. That's what the guy told you. And what so does he admit he owes you
the money or not? Yeah? So how's this guy going to make up? Does he own a house? I mean you got to start going after him? Well, I tried, what do you mean you to? Well? Hold on? What does that mean? Tried? What does that mean? Okay? I filed with Olbert County on February twenty filed what charge seleny churches? Uh? Okay, But did you also do a civil lawsuit against him to put a freeze on all of his assets and stop any transfer of
assets? Well? I did retain an attorney, and the attorney has postponed doing the civil until he thinks we have a better shot getting our money back if Albert County files the polony charges. Okay, you mark that guy as a moron, because what you need to do is stop transfer of assets or transfers to evade judgment. And the only way you can prove that is by
filing a civil action. Okay, I don't mean you have to prosecute the civil action, but you have to have it hanging out there, so if the guy makes any moves, you can prove it was to evade this. What were you going to say, sir? I mean my understanding is that he admitted to Elbert County authorities that he stole the money, and they're not taking it. They're not pressing charges. So this sleez bucket, this piece of crap. Is he still in business? Yeah? Wait a minute,

Text says it was spent, but I have some funding that is in processing that will replenish it all in
some it should be about two weeks for it to come through. When did he text that you've got the date on there? I don't sorry, I'm reading the one that says I had to push the schedule. Your project would now start mid late April, and I said that doesn't work right. What do the authorities in Albert County say other than that they are overwhelmed that they have chart they have cases with human life and children involved, and those take

I've also called the DA's office trying to the fraud hotline asking and you get a recording. I leave a message and that was a week ago, and nobody has called me back. going an off, shut up. Now, what's the problem. It's not that. What's the problem. Yeah, Well the problem comes from that is we contacted them. They said it wasn't under one tea because there was more than a year. Yeah, we got our third third party builder out and we had a contact for them to repair things. And then I learned about Sidara. I sent a CedarA letter to the building. What a cidara you're going to teach? You said, the facts? Say, what is the
Colorado defects and repairs at something like that. Okay, basically, yeah, that got their attention. They came out with the roofer. They looked at it. They said, yes, this is our fault. We'll fix everything. And I said, well, I'm under contract and they said, you know, for fixing the inside part. And they said, well, find this the receipts. We'll pay all of that. The roofer fixed the roof.
I send them the receipts. They kept coming up with excuses and excuses about why they couldn't pay it or whatever, and it got to the end of the basically with Saidari, you have seventy five days before you can follow the lawsuit. And when it got just before that, I said, I'm filowing the lawsuit on Monday. And they finally said, okay, here's the money. You know, that's amazing because I don't believe that act would cover you in this situation. But keep going. But I mean, okay,
I mean that's okay. You bluffed them. You bluffed them, and you want so are they they six so much. I didn't because it got to the end and they said, here's the money, but you have to sign this agreement, and then I got stupid and I signed it. Well, what was the agreement. It was a settlement agreement, and in it there's a close that said, we're waiving any future issues. Well how much? How much did they pay you for the for the damage? About six thousand
dollars It was the right amount. Okay, so what are you concerned about now? Wow? And then immediately that was in June of last year. In July of August, everything else on the house started having problems. There's big soil, everybody in the neighborhood having home. Well, no, no, no, no, are you telling Wait a minute, you're telling me when you took this six grand for repairs. Yes, you didn't just wave your rights to go after them for that? I did? And no no
wait wait I didn't ask my question yet. Oh sorry, did you wave going after them for anything on the house anywhere in the house? Yes? Oh yeah, Like I said, it was really stupid. But I think you're misunderstanding the whole what you called s door, I never heard of that. I did. I did hear of the Colorado Defect Reform Act and or Construction Defect Reform Act. And I think that I think you missed. I don't think you have I don't think you did yourself. You don't. You
didn't have men. The house was out of warranty. So what difference does it make? You said that? What tell me what the community is going through right now? Yeah, there's major soils settling issues. You know, how's the builder going to be responsible for that? Tell me where you're going with this. Well, too many people believe. Here's the thing. Too many people believe that a builder is responsible for things they may not be responsible
for. So did they do something negligent? Is that what you're saying? Well, I I don't know for sure. I know I brought up these issues. They sent someone out. They said, yes, our subcontractor, there was the window wells all rusted out. There's major settling issues beyond normal, major cracks. Our front door woit and opened at all. They did fix that. See, let's just say there, let's just say there was something legit and there was something covered. They're not going to exclude you if
they're doing the whole neighborhood. Do you think, uh, well, that's what they told us. Do you understand that the whole Sidhora Act? Do you know the reason for it? What do you think the reason was? By the way, probably because of situations like this. No, no, it was exactly the opposite. Oh over the builders. Yeah, yeah, it's to limit legisl to limit litigation. I mean hotel, I mean see, I never mind. People hear about something, write letters and thinks that's
why you confused me when you it's out of warranty. What does your community think they're going to do well? Right now? I know there's the lawyer, there's a lawyer representing three other houses and mine, But what does that mean you can still a ham sandwich older. Yeah, the builder turned it over. The builder fought the insurance claims, and we asked because they said, we're not giving you anything because of this agreement you signed. But they
did agree to follow an insurance claim. And so right now the insurance company is negotiating with all of these other houseowners on the street. And just this week they came back to us and said, we won't offer you a settlement because you signed that agreement. Okay, I get it. Yeah, but they're dealing with everyone else. They're fixing things on other people's rights. Because
here's the thing I'm looking more into this law. This law has to give them the opportunity to fix or to pay, and part of the opportunity is settlement. And that's what you did. But you did it prematurely, Yes, and you truly did. I mean, however, there I don't know. I don't see any exception here. Now there is a limit to what you can get under Sedara. But this builder sounds like what happens is this. If builders have a reasonable offer to fix, you can't sue just for
the hell of it. So that's what they're doing. And they pulled in their insurance company. And there must be a significant defect for this to happen. Their insurance would never cover them. So they must have screwed up. They must have. Yes, but you did a wrong thing by signing that. If you're asking me, if you're just flat out asking, can I get out of that? You'd have to talk to an attorney. But here's my gut. No. Yeah, that's the two attorneys and that's basically what
they've said. Yeah, because you signed it, so you're screwed. But how bad let's ask this part. How bad is your house? How bad is we've got everything? As of today, there's someone fixing the last bit. We've got everything fixed for about forty thousand dollars. You're lucky, man, You're luck Hopefully nothing else happened, right, So now the patio's cool now though, right right? And you got reimbursed for that, so your net out of pocket forty yes, okay, that's what it costs you to

keep going. So I called and I explained to them that I had the pictures. They said, okay, just send the pictures, give it. But you don't know hear what I'm saying. It's not Exfinity's problem. It's between you and your shipper. Why would Exfinity care if you sent the phones out in perfect condition and they arrived with a crack, why would they know? They said that they would pick that. So they said they would accept your pictures as proof that it was fine, and they would take responsibility for
the break. Yeah, they actually said, do you have any proof of that, because then we'll get you your money. Well, I have lots of ticket I've been calling. This happened in July of last year. Okay, so did they ever? Where where does it stand today? Then apparently they're not coming through right. Well, then they said after they could improve that the phone was broken or whatever, they turned around and said, I didn't have it shipped within the twenty one days that it needs to be shipped.
They picked another excuse. We proved them wrong on that. So every time I've been calling, I get it. So they come up. So what's their latest excuse? Nothing? They keep on saying it's fixed, it's fixed. But then two days later I get an email I'm a message from them saying your ticket is how much did it cost you? How much did it cost you? The phone itself cost eight hundred. No, I'm asking
about what did you lose by not getting this trade? Well, I was with AT and T and I wouldn't have gotten No, no, I'm not In other words, how much difference did this trade make? I'm not asking about going to Exfinity or not going to Exfinity. You were expecting to pay a certain amount or to be discounted a certain amount by giving this How much did it cost you? Well, it's twenty five dollars a month. I've discussed. No, okay, I'm not getting this across. Let me explain
this to you. Okay. You decided to go to Exfinity for what reason? Because my care get the phones for two hundred dollars? Okay? Hold on. You decided to go to Exfinity because you could get an iPhone for two hundred dollars if you traded in an old iPhone? Was that the deal? Yeah? Okay, Now instead of getting that iPhone now for two hundred, how much was it? Okay? So it cost you then six hundred dollars by not having that phone be accepted. Right, Okay, I think
there's something you might be able to do. I don't think by the way I think Exfinity. If they got the phone broken and you sent it perfect, it's still not their problem. It's your problem or your shipper's problem. I understand it wasn't your fault and you don't feel like you should bear the brunt of it. But they don't want to either. And I understand they're playing games with you. I get it. That's because they're trying to get rid of you. That's what they're doing. They're just saying, look,
no one should have promised. We're going to take this phone into the crack, tell her it was sent into late, and if that doesn't stop her, they'll come up with something else. Linda, you're playing a game that's never going to win. They're not going to pay you for the broken phone. I know you're saying, but it's not my fault. I get all of that. I get it. But you can't blame them for breaking it either, and I don't think they would make it up. But what I do think is you could probably get your six hundred dollars if you sued them in small claims court. And the reason I say this every now and then is because Mark has had extraordinary luck, no not luck, extraordinary results in small claims court. So I could see Mark. I had normal aging of the eyes in my lenses, so I had to squint to see something or wear glasses right,
There was no two ways about it. I did not have cataracts, but I went and had both lenses replaced anyway with cataract surgery, and I did what was called a clear lens exchange. What that means is they get rid of your clear lens and put another one in, so they're getting rid of the lens God gave me, even though I didn't have cataracts. They were just getting old. I tossed them out and got new ones. The new ones I got are multifocal lenses. So now at my age when I
had it done, I might have had it done at sixty. I'm seventy. Now I was. I was able to see perfectly near and far and in between. So if you have the chance to upgrade, do that. Okay, I do. I'm you know, I'm interested in having better vision than you know. Just the basic medicare lens I would do in some research there's it looks like there's trifocal lenses, a bunch of other ones. I don't need anything fancy, but it sounds like, no, you do want
something fancy. If you're gonna do it and go through the pain and misery, get the best. Yes, do you know anything about the trifocal lenses. I wouldn't get them. I would get the multi multi multi mine mine or not, just try. I can look anywhere at any distance. There there I think the one I have is I think I have symphony. I could have crystallins. But now there's so many new ones. Really, so what you need is to find the latest and greatest. Why would you settle
for a trifocal why I I don't know. Like I say, I'm just looking at the web page that has a list of the mirror and I know absolutely nothing about it. Where are you having it done? There are many eye places that say they do a lot, and they mean their surgical center does a lot, but the surgical center serves eye doctors from all over. I'm not putting them down. And the reason I asked who you have? Your provider should have all kinds of suggestions for you, and they should know the latest and greatest and the best. Yeah, I have I have an appointment with them on Friday to talk about this in detail. The last appointment was just when they when I had a regular eye exam and they told me that I had cataracts and
then they needed to have surgery. And the people, the people that you're positive that, the people that are doing your examination and the people that you've been going there have their own ophthalmologists and it's their operation and they're not just farming it out to the surgical center. Yeah. The doctors actually called Colorado I consultants and they have their own surgeons that do the cataracts. Are good, They're not finding it out good good. If that's the case. Good
Again. I'm not saying there's anything wrong with them at all. All I'm saying is you want people who do tons of them and not at a surgical center. Their surgeons do it. Now, their surgeons can be at a medical center. But you don't want subcontractors. I'm telling you that, and you want that. someone dies for most assets, like, for example, their house. If they own a house and they die and leave the house to their spouse, or they're not they're just their spouse. Actually, maybe batting their children. Their children would get the date of death valuation. Is that right? Yeah, that's right. And what about artwork? Same thing, yep. And uh what about stocks? Yeah, I mean really, I mean everything that goes up in value. I think the capital games is going to step up.
The only thing that can really cause confusion about it is whether or not it was like placed in some sort of your vocal trust, which is not very common honestly these days. But the OKA text so I so okay, but otherwise, yeah, you're going to get a step up in basis. Okay, you'll get a step up in basis. Then then there was where the confusion was was with the step up in basis and the valuation of an
estate. Maybe there maybe were mistaken two terms. But somebody texted me and said, I thought that when you value an estate, you can either do it on the date of death or you can alternatively do it six months later. What does that mean? Yeah, So there's a couple of different contexts in which you have to value the estate, and one is if you are going up on a state tax return, and there are various reasons to do that. Even when an a state taxes in two and one is to record
the value of assets, and yes, you get to choose. You have nine months to do it. After someone passes away, you can get a six month extension on that. Ads. There's a lot of dates being thrown around here, but usually the date of death value is the valuation you're going to use on that estate tax return. But your texture is right that there
is you can alternatively decide to six months later. So if you alternative decide alternatively decide to do six months later, does that include the house basis as well or the and everything in the estate. Yes, yep. Okay. So if I don't want to take the date of death value and I know the house is going to go up even more, I can wait six months. Yes. What if I wait six months and it goes down? Can I go back to the date of death? I mean at some point, yes, you have to. I mean, like I said, you have
nine months. Okay, So if I wait, If I wait six months and the house went down, I can say excuse me? Or went yeah, went down, I can say never mind, I'm going to take the date of death value because I'm still within the nine months, correct okay, But so do you do a state valuations like that even if there is no estate tax do there can be reasons, said, yeah, and this is one of them, right, So I mean, okay, tick one.
Actually it's between spouses. You probably have heard that spouses can now use the unused portions. So when somebody dies and hasn't given away any gifts big enough to do a gift tax return, these the surviving spouse can but they're unused taxes and pull them into their estate and give up to more than twenty six
million dollars away now. But if you want to do that, you have to file a tax return saying I'm grabbing that unused portion even if no estate taxes do so, there's reasons to file on a state tax return even when there's no tax to okay, and so then this is very interesting. So basically then somebody else wanted to know since you were on yesterday. I always get this reaction after you leave. But one of them was when on the date of death you inherit a the stepped up basis, or when someone dies
and leaves you something. But what if somebody gifts you something during their life? Yeah, yeah, that's the problem with that is that that does not qualify for a step basis, and sometimes you will do that, like right at the end of life, they're gifting stuff and it's like, oh, don't do that. Hold on, okay, So if they give stuff,
they could really screw people. So we were well, I know we said that about quit claim deeds and houses, but we're taught talking about really truly, we're also talking about anything that you gift out you get the original basis, yeah, okay, and then what about this is the stepped up basis for the home for a vacation home, a rental, a primary residence,
