My brother in law just passed way Sunday morning, and we're trying to get our hands around the financial Okay. So,
so sister and the husband owned a timeshare. Where is it? It's located in South Carolina? Okay? And he died. But who was on that? Were they both on it? That's what we're trying to find out right now. And you're meeting with an attorney on Wednesday, tomorrow morning to go over these things. But in case she is stuck with the bill is I'm trying to locate Well, let me explain something to you, okay, let me explain how it works, because there's a lot of misunderstanding as to
estates and timeshare. In fact, a lot of timeshare teams that what do you call them, timeshare relief or timeshare exit teams? A lot of them lie to you about strapping the estate with the obligation. Here's how it works. If one person dies and that person is on the contract only, okay, the contract dies with the person. The only thing the timeshare people can do when someone dies, if there are accumulated charges or ongoing charges, the
ongoing charges go away. They can't come after the estate. They can't come after the wife, they can't come after the kids. It's over if the husband was the only one on it. However, if there are accumulated expenses that have not been paid, timeshare can whoever owns the rights to that contract now, whether it's the original developer or a management company, they can come
after the estate for the accumulated bills. In other words, just like any bill, credit card, timeshare fees, hoa, anyone can come after the estate for the fees. Okay, So what they would do is put a claim in against the estate. That means before the husband or wife or kids or who's ever left distributes the assets of the estate, they first have to pay the accumulated expenses of any creditors who have a legitimate claim on the estate,
any creditors. Now, let me explain something. In all the years I've been doing this show, and in all the years my friends who have been in the timeshare business, I mean the exit business, none of them have ever seen a timeshare developer or creditor or management company go after an estate. So go ahead and with your story, Greg, So, what you first have to figure out is who is on the contract? Does she remember does your sister remember buying it with her husband? I will know that shortly
when I call her. So if they were together, If they were together, I would say ninety eight percent of the time, the timeshare people will not sign a contract with just one or the other of spouses. And what should we do if my sister is on the timeshare? Also? Okay, now that's a good question, Greg. My question to you is what obligations does she have? Is this timeshare being financed or is she just paying the maintenance fees? Just the maintenance fees? How much do they amount to?
She told me yesterday she thought it was six hundred dollars a year. Okay, most time shares to get out of them with a legal team. The minimum you're going to pay is five grand. Okay, that's the minimum. But you may say, at six hundred dollars a year it may not be worth it, And you have to figure that out for yourself, because I don't know of any that will do it less than five grand that are legit.
So that's eight years of paying six hundred dollars. So seventy three, she's seventy three years old, it may be best to let it ride. She may pass away before right, right, right, there's another option. Okay, it's not just the six hundred a year, but if there's a storm, or if they have to repay the parking lot or paint the buildings, there could be a capital assessment of several thousands of dollars. Okay, so she is likely on the hook for other than six hundred a year.
But I'm not suggesting you go out and spend five thousand dollars right now. But what I am saying is this, if she is seventy three, and by the way, you know I'm seventy so when you start talking about killing over any minute now, I get a little testing. But anyway, let me explain something, Craig, Let's talk about this. When you are looking at this, you have to understand she may not be in a position where
they can come after her anyway. What is her financial situation. She has very little bit money in the bank, but she's got about four hundred thousand infidelity And all right, what I was going to say, if she was, if she was judgment proof, she could tell them to stick okay, hundred a year. But that doesn't sound like a good plan for her. She owns she owns a home and has about one hundred and eighty thousand inequity in it. She still owns about a one hundred thousand plus she has four
hundred. Well, the one hundred thousand is protected, but not not more than that. Listen, what I'm saying is this, she if she if she owes a hundred plus one hundred, would be protected approximately. So I don't think they'll come after her home. But you say she has a fidelity account with four hundred in it. Yeah, it's pre tax. The money in the fidelity account is pre tax pretax, okay, meaning it's her tirement takes the money. Yeah, when she takes the money out, she has
to pay tax on it? Is it retire? Is it a four oh one k? What is it at IRA? What is it? It's a four oh one k at Fidelity? Who manages that for her? She has a manager at Fidelity managing it. Okay, here's a side note, people,
a side note. Please don't let someone at an investment house invest your money to find someone reputable and it is well worth the investment fee of one percent or one point five percent for someone I mean not anyone, not just anyone, but someone who truly truly invest your money and watches it for you. That's a side note. Now let's go back to your sister. What you need to do is U need to figure out if she's judgment proof With
that, I need to ask one of our attorneys. I'd like to get one of our bank I'm not saying she should go bankrupt, but I want to talk to one of my bankruptcy attorneys. All these time share exit companies. What they're doing is these resorts. When you just default on your time share and stop paying them within about six months, what they do is they have to send
you something that's called the deed in lure foreclosures. So instead of for closing on the timeshare, which they wouldn't do anyways, or else they'd be stuck in court all day chasing these people, they'll have you sign back over the time share to them, which releases you. Now your credit does get damaged, well, hold On. They don't always do that, not if you have not if you have means, Kyle, they don't always just let you
off. Well, I've never heard of them, not like you said, I've never heard of them actually going through and suing somebody for their time hold On. They do it all the time, Kyle, Kyle, they do it all the time. I'm not saying people should go out and spend five grand either. What I'm saying is this is that it's a gamble. If you have some assets, you're at risk of them coming after you. Many times You are correct, Kyle. All they want, they'll take the timeshare

So, Michael, I want to lay a scenario out to you. We have a woman who's seventy three. She owns a home with about as you said, Greg, about one hundred and eighty free of that, right? She owes a hundred and there's about one hundred and eighty inequity.
Greg, is that it? I don't know if he's still there. Yes, So the house is two eighty. She owes one hundred, yes, sir, okay, So she has about one hundred and eighty inequity and some of that's going to be protected. Then she has on Ameritrade account or whatever, a stock account. Where did you say this stock account? Was her Fidelity? Oh? I'm sorry Fidelity? And how much is in that? About four hundred? Yes? But it's a qualified account, is that right?
Yeah? It's pre tax she has to pay tax on And I understand that. I understand that. What I'm saying is it's literally a qualified retirement account. Is that right? Yes? So my question to Michael Wink are qualified retirement accounts like IRA's four O one k's and those kinds of things protected from judgments Michael or or garnishments? Michael? Absolutely? They are, yes, really qualified Riside retirement Clarlon k Ira pension, all that stuff, four
or three b's all that is one hundred percent protected from garnishment. So if her husband die, her husband did die, and she's facing this time shared dilemma. And what I'm asking is, do you think that one hundred and eighty thousand inequity is attractive? Is that an easy target? Or what of that is protected? Right? So that's a little more complicated. If it in Colorado, she's over sixty, that equity is protected from garnishment. But
what often happens is if you get sued by an unsecured creditor. So let's say say you possess the timeshare and then they're saying there's a deficiency balance due and they sue her for that. They can file a judgment lean on her home. They can't forepose, but if she ever goes to sound there refinance, it's likely that the title company handling that transaction would simply pay it.
So the home equity thing is a little tricky because they could put that lean out there, they just can't fore clothes on it, and you have to get pretty aggressive with them. I talked to one of the salesmen when I bought the stuff, and I asked about the guarantee, and they said it would depend on what
kind of treatment I kept up with it. I said, so I have to take up the track all the time and go down there and clean and saying it And they said yes, So that's so. Basically basically what they're saying is it's treated with stain up front when you install it, but you have to maintain it correct. That's what the settleman told me. I bought like five thousand dollars worth of it. And so what do you do to keep it up? Richard? I'm half your age, I'm sixty five.
So I said, I'm going to have under the deck. I'm going to help you. When you add up what the car was purchased for, When you add up all those little things you were doing, what does the total come to the grand total? She witnessed city trash pickup workers or worker throwing poisoned meat over the at least one fence because a dog that lived there was occasionally harassing them when they picked up the garbage. This is rife. The city is rife. Okay, hold on this. So if we call the Haunta, will they admit they're poisoning cats? Of course not. But we have city council testimony, we have videos. Okay, how do I get a hold of the new mayor publicly said he wants to get rid of all the cats.

There is no overpayment. If you don't ask for the price and compare it with others, you can't complain about it. It's really amazing how many people approve work and then complain about it. Demand the price up front in writing, and then compare it. Shop around. If you like the price, do it. If you don't, don't. There are
summers. There are some plumbers who believe this is the price, no matter what, because we do quality work and we do it the right way and we do it honestly. Well, that's fine. But if you find other people that do it honestly the right way for less money, you can go with them too. It's all about shopping around, nothing wrong with it. Now Paul says he thinks he's being scammed by mechanics. He said he took
his Audi in for oil change and tune up. I want to bring up Paul, and I want to bring up Kevin Culkin from Sheridan Auto Tech. But Paul's story is he has an Audi Turbo Quatro with one hundred seventy six thousand miles on it. It's that Pueblo Imports. He's only owned it for a little while. He wanted to tune up and an oil change, but they're telling him he needs a whole bunch of other things. And I want Kevin to hear those things to see if it's logical, because it might be
at one hundred and seventy six thousand miles. Paul, why do you suspect they might be scamming you? What is your first clue? A red flag? When they had it for three weeks, When they had it for three weeks, and they did the job entirely the first time, and they didn't get it right, and they wanted to take it back to do it all over again a second time, but not charge you a second time. Direct ignition, coil, spark plug, the oil, the oil filter, water pump, coupling, water pump, thermostat, coolant timing cover, brake rotor,
brake pads, brake pad set. I did do some brakework on it later when they noticed that it needed some rear calipers, two rear calipers. But this is all the stuff they did. How much are you being charged? The whole thing amounted to seven thousand with taxes seven thousand, three hundred and four and twenty seven cents. My done the additional costs for the calipers, you know. And I told them to go ahead and do it, of course, and I didn't shop them, that was my mistake, two hundred
and eighty eight dollars each. So that was a total of seventy five hundred oh eight eight thousand dollars. Okay, And now they want to charge me. They just told me today I need another part that's going to cost me one thousand and fifty and they won't charge me any labor on it. And that's the cost of the part. And what's that? Nothing to do with the cam head feel or something? Okay, I don't I don't know exactly. I have a list of everything else because they were already paid received.

He even in the funeral business for many years in Denver in the Colorado Heran and mcconnaughty a well known, respected name. I've come to you year after year for opinions on things
having to do with funerals and with all kinds of funeral issues. Now, recently they discovered several bodies that were on earthed or something at a funeral home, and then the lawmakers got really excited and says, we need to regulate this industry, and they came up with a bill. Now, let me tell you what shocks me. John, I respect you very very much, and I still do. And I respect Jim, I mean mister Cohen over at Feldman's and and I know I know you people are reputa well. Yet
I heard that you guys. I thought you would be in support of these regulations to license people in the funeral business, and I understand that you guys are kind of not in favor of it. Can you explain that to me? Sure, Tom, As you know, we've known each other for a
lot of years. Yes, I support licensure, and I believe Jim Cohen does as well, but I think it needs to be responsible and and by that I mean that, first of all, I think we agree that it's that this is important, and you know there are there are some bad operators in this state and we need more regulation right now. Now we all agree on We all agree on that. But you said this goes too far because you believe certain people absolutely needs they need licensing, but others do not,
and you're shutting out a lot of good people. Well that's exactly right, Tom, because if they're they're making a distinction in this bill so that embalmers are will be required to go to Mortuary Science School and pass the National Exam. Okay, I get that they provide care for the seas and mortuary science school is mostly about teaching people to embolve and care for the deceased. I
guess that got it. But funeral directors, people who are for the most part, event planners, for them to go to mortuary science to expect them to go to mortuary Science school and learn how to embalm when they will never have contact with the deceased. It's so clearly not. Their interest is completely
unrealistic. And I would a scientific I've I've done a little homework, and I think it's a fairly good scientific estimate that there are more than four hundred individuals in Colorado who are doing a wonderful job of taking care of families. They're compassionate, they're professional, they have high integrity, and yet the likelihood that they would go to mortuary science school. No, No, Now, the ones who are already who are already doing this could be grandfathered in.
Now, John, I understand exactly what you're saying, So let me get this clear. Does this new proposed legislation for regulating the funeral industry does it call for everyone at the funeral home to go to embalming school and pass an exam and be licensed, even the people who are just there as greeters and funeral directors, well, not not greetors, but people who are funeral directors who are sitting with families and taking information to process a death certificate and and
to create an obituary and to organize a service. The the this bill is advocating that that those individuals have to go to mortroy Science School. Uh, it's it's it's a two year process. Tom, I have to tell you, well, I think it's I think it's ridiculous. It's totally ridiculous. If I mean, if they're in a separate category, it's I mean, it would be like having a clinic, and and and and telling your your people who intake patients or or admit people into a hospital that they have to
be m d's. It doesn't it really doesn't make sense, Tom, and and and I'm fighting it, and I I appreciate the opportunity. So what you're saying is you want you want regulation where there should be regulation. Correct. Well, okay, so why don't they just amend it or something. Well, I'm hoping so, Tom, I'm hoping so can people. Okay, let's say a lot of good people might be ased out of the industry
that have been in it. And you're saying, look, there's no reason for these people who are in essence, as you say, event planners to be ased out of an industry if all of their workers touching the corpse or the people the deceased, I should say, if they are licensed. So how do people just tell their lawmakers? I mean, is this a Colorado
thing or a national thing. This is Colorado, right, It's a Colorado thing, and increasingly nationwide we're seeing we're seeing this distinction being made where the funeral directors UH serve an apprenticeship and take a state test that proves that they understand state laws and regulations and UH and then then they become licensed funeral director. Like I said, I that's and there's nothing wrong with that. There's
nothing wrong with licensed funeral directors. But but you're saying they shouldn't have to go to mortuary science school as an embalmer. Right now in Colorado, are embalmers required to go to a mortuary science school right now? No? No,
right now, they are not required. And so it comes down to, you know, companies like like mine that that that by policy require people who are embalming to either be apprenticing under the supervision of an embalmer or someone who has been to mortuary science school and and has has learned not not learned this entirely, you know, because it's important to understand there are a lot of there are a lot of aspects of embalming that that are difficult to just
teach from person to person, and mortuary science school covers Uh, so you're in favor, you're in favor of the actual embalmbers being licensed by having education. Okay, I am. I think that part makes sense to me. But after January one of twenty twenty six, this is going to have a tremendous chilling effect on our ability. Has it been approved it has it been passed? No? No, no, it's just been Then people need to
let their leg their lawmakers know. I know, it's not something on the top of everyone's you know, it's not a law that a lot of people are going to care about, but they don't realize the impact that a lot of good people could be ased out of this industry, and so they should let their lawmakers know. I mean again, like I said, it's not something a lot of people think about. John, thank you for taking the time today to come on the show, and sure I'm going to encourage people
to at least let their lawmakers know. Again, this is a consumer issue, right. You don't want shlock in the industry, but at the same time, you don't want to ace out good people, and you should have the licensing where the licensing is apropos. They dragged the runway at fifteen hundred feet over the departure in they do a ninety degree turn that keeps the within a mile of the runway, and that also allows them to drop five to six hundred feet down the pattern altitude and that's where they fly. The regular pattern is after that. That was explained to me with an instructor who was a military But as far as his questions go, or you know, or he should call the FAA, they're
the ones that would answer the questions for that's true. That's true. They would have. And I wonder if they get other complaints. If they do, maybe they would say something about it. I mean, I wouldn't put a pass a pilot or two to play around a little. But I don't think it's a regular thing. And thank you for calling Robert. What's going on in your life? Robert? What's happening? him as a dependent, period. But he can't take himself as a dependent. But he he has to file taxes if he makes a certain amount. Okay. So if he's a single filer under sixty five, it's twelve thousand, five hundred okay, so he's well underneath that. He doesn't have to file, okay, But and you can claim him. You can claim him even if he does file. Do you understand that? Yeah? I understand
that. But it was then also read that if he paid more than his half, which is about forty four dollars, then then I can't claim him. Wait more than his half of what what are you talking about? I don't know. That's what it says on line. No, no, no, if he pays no, listen, listen, this is what it means, not half of his income, Robert, if he pays for more than
half of his own support, yes, well he doesn't. I mean, it doesn't mean if he pays half of his income, he can make one hundred grand, for God's sakes, But if you pay for all of his support in your home, you can claim him. Okay, it's I can claim him and then he doesn't have to file, right. Well, that has nothing to do with it. His file is a totally separate issue. Okay. His filing depends on income for him twelve thousand, five hundred and
fifty or below. You do not file, Okay, Okay. Now, even if he did file, it has nothing to do with whether or not he is your dependent. Okay. Here's what determines if he's a dependent if you are paying for more than half of his keep. Robert's got a question on taxes, and I did consult our tax expert, and I do have some answers for Robert. You want to know, I know where you got that forty four hundred. Okay. Now, people can claim anyone as a dependent. You can claim a child, you can claim a relative. And when I say anyone, but here's here's what it is. A relative doesn't even have to be technically a relative, but there
are different qualifications. If it's a child of yours, which is a child or a stepchild, or a foster child, or a sibling or a step sibling if you even want to take care of one of your siblings, okay, or a descendant of those. They have to be under the age of nineteen. Okay, So they can be eighteen and a half. They can be that once they reach nineteen. They can't be a dependent unless they're a full time student that goes up to age twenty four. Okay. Okay.
Now, so here's the deal. They have to be nineteen or they have to be under nineteen, and they and they must live with you at least half of the year or one day past half of the year okay, for more than half a year, and you have to support them more than half okay, and you the child cannot file a joint tax return with anyone, okay. So that's the easy part right there. That's a child for you.
Now, if you had a relative living with you, or they have to live with you for all of the year okay, and they have to have an income of less than forty four hundred dollars okay, So that's what you're thinking about. That's for an adult or someone living with you, like
grandparents or your mom or dad. They either have to live with you all year or be a member of your household and relate it to you in some way, okay, either or, and they have to have an income of under forty four hundred and you have to provide for more than half of their support. So that's why you heard that there's a limit of income. And since your son made eight grand, you didn't think that he would qualify, but he does, okay. Yeah, he's seventeen, a full time student
and he lives with me. So all right, thank you so much. So you have you have it knocked right now, and again always you know you can always ask tax experts. So to be honest, it was over a thousand bucks a night.
The second we land and check into this place. Before we even go to the room, see the room, check out the property. The timeshare people are on you like stink on craft man. It's crazy. It's really irritated. It's like a carnival. Yeah, well, yeah, it is like a carnival. The property's gorgeous, so I really don't want to take away from the property. But why they do this timeshare stuff in five seconds when
you land is crazy when you're spending that kind of money. If I'm spending fifty bucks a night, okay, I guess I'm going to get hit up with that stuff left and right. But it's a whole different deal. So that kind of set the tone. So a couple of nights that we're there, we're having a good time. The food's good, the resort's nice, and we have okay, I'll tell you what they call him. They call him a butler. So we have a butler that can do everything for us
and set up the massages and all this stuff. And he was great. But in part of the package we paid for We also got a lot of excursions and stuff that were included in the price, so you basically prepay them. That was a total hassle because they try to upgrade you and send you back through the timeshare channel again. So I'm getting more and more irritating. Wait, wait, when you can you say through the time share channel? What do you mean? You mean what? They call it the vacation club.
So if we want to schedule a massage that once again we already paid for, you got to go through the quote vacation club to schedule it. Most of the people okay, yeah, so that you know, they're like, oh well, if you want to upgrade to a two hour massage, you know you can go listen to somebody try to pitch you a town share. And it's just NonStop. So so finally I'm getting a little sick and tired of the timeshare stuff. And we're walking down for dinner and I see
this young couple and then I see this family. They look like they were from India because she had the garbine in the whole bit. And I'm walking by and I'm going, they're trying to suck these people in. They just probably arrived It's about four or five o'clock in the afternoon, and I finally looked at Susanne and I said, I'm done. I'm going to warn them because they started bringing out the paper. You know how they do it. They say, how much do you think all this is worth? And you
write down, you know, eight dollars or whatever you write down. They go, oh, no, no, no, we'll do it for four So they were at the park where everybody's scribbling on paper with this family, and I finally said, I'm going to do it. In fact, I'm going to go live on it. So I go live and I walk up to two different families and I interrupted, and both of them don't end up
buying. Now how do I know that? I know that because about fifteen minutes later, as we're walking to the restaurant, the freaking timeshare mafioso walks up to me and they're like, what's your name? What room are you in? It's illegal to film people in Mexico. We're gonna call the policio. We got we gotta get them. Hold on, Mark, just wait, just wait, oh go go go, okay, hold on, just hey, hold on, just don't say that I'm bad all right, now
now are we back? Okay, okay, now keep going, but really watching now go ahead, I know, I know, so the mafios so police come up and you know, sure enough, they're trying to shake me down. What room number are you in and all this, and next thing I know, there's three or four of them. So I walk away from them, and a couple of them are pretty big guys. You can see them in the video. Man. I mean we're talking like they could kick
my butt. I'm not even like play in that game. So but then I start walking away and they're like, they're like, oh, we'll figure out who you are and we'll come get you. And I said, you know what, the worst thing I can do right now is just walk away because they probably will. So I went live again, and you can find that on our YouTube. two minutes. But here's the deal, man. So finally I walked back up to them. Then they start playing stupid. When I got the camera in their face, They're like, oh, we're just here to make sure you're having a good time. Right after they threatened to call the cops and throw me in jail. So at that point did you stop actually people from getting suckered. Two people, yeah, two families for sure. One, like I said, they were in the part where they were writing on paper.
The other ones just got up. I could tell the husband. You can tell in the video. He's laughing. He's like he can tell, like I was his out. I don't think they would have bought, but he felt like he had to sit there and listen, and you don't. It's not one of these deals where you get a discount on a buffet or something to sit down. She came from very poor, but I came from somewhat you know, middle class if you will. And it's you think, okay, we finally are own our own house, and like oh, but then you get used to it.
