It's amazing to me how the same story can be construed in two different ways. It's just amazing. Now I'm not saying by the way that I'm you know, I'm not trying to tell you how to believe. I'm just saying how amazing to me it is that people can take a stand. I just want to listen. This is just one news story, real quick. It's a news story about this

and the way it the way it really frames it frames it. Listen, listen. Here's what it says. Here's the headline. And this is from a one news agency. I don't even have to mention them. It's a news agency because there's both sides have their own headlines. This one says major setback for democracy and insurrectionist allowed to stay on ballot. Do you know I'd be fired if I ever. I mean when I used to work for newspapers, radio, TV, all of the news stations, all of the news

stuff for years and years along with consumer stuff. I did consumer news, of course, but man alive I was an advocate. I got a special a dispensation, I guess this or a special a break on that because I could give opinions when I found somebody who was ripping somebody off. But when we were in the news part of it, you couldn't take a stand like

this. This is a news story a news story, It says in here's the first paragraph in a major setback for democracy, the US Supreme Court and Trump versus Anderson that ruled that Congress, rather than the States, is responsible for enforcing the fourteenth Amendment. That really means Donald Trump is still eligible to appear on the Colorado ballot despite his role in the January sixth insurrection. Anyway,

We have real estate on our mind today too. Let's go right to right to Michael. Michael, what's going on with you with your car toys? What's happening Michael. We don't get a lot of good reports about car toys, but we haven't had complaints, to be fair, we haven't had complaints in a

while. So what's going on with you? Yeah? Tom, this is an issue I've been dealing with since October of twenty twenty three. What happened then? Uh, basically, there was an employee there. Did you take your car to them in October? Yes, sir? Okay? And what did you take it in for and I took it in to have a dash install, which were required them to adjust the steering component. And now, what do you mean you had a dash install? Do you mean what?

What? What exactly were you having done? I don't know what you mean you had a dash install? I had a digital dash install. So it's a it was an old plastic nineteen sixty six Chevy and Paula. You know, so wait a minute, they so they take out old analog and they'll put in digital gauges. Well they did, I mean I don't know was it a removing replace or were you upgrading or were you doing something custom? Uh? This was a custom upgrade? Oh? I didn't even know they

did that. And what kind of car? Was it? A? What year? This was a nineteen sixty six Chevy and Paula and you wanted to upgrade it to a digital dash? I did not know you could even do that. Yes, yes, sir, okay, well I'm learning something. And what happened when you took it in? I mean that's that's a daunting task. If you ask me whoa yes, they're so basically all right,

So then I mean that's kind of cool. So you have an older car, but you wanted to make it digital like some of these guys with airplanes are doing. They're putting digital gauges in. So what happened? So basically what ended up happening is the technician installed the dash, uh you know, and said everything was good to go. So I went to pick up the vehicle and uh, as I was driving home, I was maybe two or three blocks away from my home and I lost total control of the steering wheel.

Wait a minute, total, I don't even know how that has anything to do with it. I believe you one hundred percent, but wow, that's freaking weird. So what happened? What did you find out what it was finally or used to? I mean, this was in October or are you still having the problem. No, what ended up happening is, uh, thank god, you know, I didn't get in a serious accident or

anything like that. I was uh maybe going twenty five to thirty miles per hour, so I was able to at least slam on the brakes so I didn't run into anything. So the vehicle was told to Uh, Corvette shitty. Uh, this is an auto mechanics optic was work on. But this Okay, let let's skip forward. Why did you have a failure in your in your steering Uh? Basically what ended up happening is this technician that car toys did not seat the steering wheel component back correctly, which he admitted to

not doing. Okay, so how did all that? What are you calling about today? You didn't get in an accident? Right? No? Okay, So what are you calling about today? Michael? How can we help you? So? Basically what I'm calling about is, well, you know, when I took the vehicle back to the shop where I get my work done and had mechanic look at it, he showed me exactly what happened and

why it happened. So I had to pay to get this steering wheal component you know, fixed and put back in properly, which you know it cost me fifteen hundred dollars. Oh so you want them to pay that exactly? Well, they should pay it if they caused the damage. However, there's some there's some cautions here, and I'm going to explain this to you. And we have an attorney today. Although he's a real estate attorney, I say, although I mean he went to law school. Heinos about law Brad

Brad, you know what I'm going to say that fifteen hundred dollars to fix his steering could be balked at by someone who did the damage because it's a sixty six Chevy and pala and they could argue, we're not putting new components in there, We'll only pay for rebils, right, I mean, what what is your take on when people pay for damages? You can look at it through replacement cost, or you can look at it through present

value, which is new. But isn't that really all you're all you're responsible for in a lawsuit? I mean, when you are overwhere the damages and somebody ruins your transmission with one hundred and fifty thousand miles on it, you can't get a new transmission. Yeah, you get the value of whatever it was that was damaged. So if you have to buy something new, because that's the only way you can do it, you would apply a depreciation factor

against that. How many miles on this card, Michael, roughly sixty thousand? You know it's a rebuilt motor. But okay, so hold on, I'm the steering and all that linkage. How old is all that? Oh? The steering and all the linkage. I would say, because all that stuff was installed brand newly, So I would say, no more than three or four years old. You all of those were new parts. Correct. Yeah, I've reached. I've reached toward the whole car. I get it.

So what was replay? What was done for fifteen hundred bucks? Quickly? What was done for fifteen hundred bucks? Basically? Like I said, you know, it was labor, but they had to obviously take all the Was it only labor? It was only labor? Correct? Okay, then they should pay every penny of it in my opinion, unless there was something else, if they upgraded or did more for you than just that, that was it. It was just a labor that, you know, like I

said, just took correct hold on. So one hundred percent of that labor cost of fifteen hundred dollars was just to fix what Car Toys did. Absolutely, I don't see how they get around it. What are they balking at? What are they saying? Well, basically, what had been going on is I talked to the store manager. Yeah, I don't want to know the process, I want to know the end result. What did they say? Basically, they sent me to corporate headquarters, which I ever heard from.

For the headquarters they told me to So no one, are they ignoring you? Or did they say no, or did they say we'll give you part of it? Give me the result? The result is they just left me high and dry. Nobody's responded to me. They didn't even reject your claim. Well they claimed corporate rejected it, but I was never told that. Okay, okay, so you're you're basically this is the worst thing that can ever happen, Honest to goodness, the worst thing you could that can

ever happen is being ignored. So here's the deal, Michael. We can have someone call for you, and we should, but I think this will be a slam dunk in small claims court. It's going to be a slam dunk. I have a debilitating spine and I've fallen and I have two prosthetic hips. And so when you say paraplegic,

you have feeling and stuff, but you can't walk. Is that what you're saying. No, I don't have any feeling in my feet, and I don't have any feeling in both of my arms and fingertips. Arms and fingertips. What about your legs? You have feeling in your legs. I do have some feeling in my legs. Okay, that's not important. By the way, I was just curious more than anything. So what's going on

with first Light? Okay? So the young lady that takes care of me on Tuesdays and Thursdays dreams to really care about me, and I trust her, you know, and she does everything. You know. Well, if I get worse, I called in and asked if I could help help on Saturdays. So they so you only have right now two days a week, and I extended it to a third day. Okay. And a young lady that I've seen for the first time came to my apartment on the twenty fourth

last Saturday. Okay, what happened last Saturday? Well, shek she took her on me that day. We had a nice, nice couple hours and she expressed interest on my car that I have listed on Facebook for thirteen thousand, five hundred dollars. Okay. So this has nothing to do with first Light. car to this young woman? Yes? Okay, Now what kind of okay? You sold sold car for thirteen and you sold it to one of the workers. Yes, okay, and but did you sell it out? Okay? And what happened? Well, she brought her father back. You know, we had a time of all conversation two or three times, and she she's been going to bring money. Okay, Wait a minute, did you let her have the car before paying for it? I think, you know, I think something that vary has happened. Charles. I'm going to ask

you some straight questions. I need straight answers. Did she take the car before paying for it? Yes? Okay? Was the agreement she would take the car and sign the paperwork later? No? Did she sign the paperwork and take the car with an agreement she would pay you later? What was the agreement? Because I can't think if she didn't agree to pay you later, and she didn't pay you, you gave it to her, right, it was a gift, you know. So she came to my house with

cash, got it. And what happened? And that frightened me. You know, I'm going to have thirteen thousand and five you should have taken it. But anyway, then what happened? Right then? What happened? So her father start counting out one hundred dollar bills and he counted thirteen hundred and five dollars. Okay. Then when he had it and he handed it to me sitting on a table, and I thought I had twelve more thousand dollars

coming, And what happened then? I don't really know. Okay, Okay, Charles, this happened, Charles. Wait, let me get it straight. She and her dad are there. He counts out thirteen hundred dollars. Yes, After he counted out thirteen hundred, did you say, by the way, you owe me more money. We had a big argument. Why did you have an argument? Did he say, no, you were only asking thirteen hundred. How do you have an argument? It's your car?

So what I need to know is what happened during the argument. What was their side of the argument. The very side of the argument is that I told her that I wanted thirteen hundred and five dollars forth of vehicle. Okay, even if you did say that, Even if you did, you could change your mind. It wouldn't matter. You didn't have a contract with them. So what did you say? Did you say, okay, you can have it for thirteen hundred or what what happened? Oh? Not at all?

We argued about it, Okay, then what we're target about it and close It's just a blur to me. Okay, got it. So you had an argument and at some point did you deliver the car to them? Did they take the car? And did you sign the paperwork? They have the car right now, they have the title. Did you sign it over to them? Yes? Yes, the paper Then they took it advantage of a person at risk. You don't even know what happened. They intimidated you. Why did you sign it? Were you afraid or you say you don't

that's not enough. There was an argument, and he says he doesn't remember what happened after that, but they took the car and he signed the title. that out. But I George, I swear to God, I just want to lay that out to you. A seventy nine year old man, paraplegic a year and a half ago, decides to sell his car. It is listed. It is listed for thirteen thousand, five hundred. A healthcare worker says, I'll buy it. The healthcare worker takes her dad to his house. They counted out thirteen hundred dollars. He said, no, it's not thirteen hundred and five dollars. It's thirteen thousand, he said. Now,

I don't know if this is true. He says, Tom, I don't know what happened. I was afraid it's fuzzy. I think something wrong happened. But they took the car, and he said he ended up signing the title. I just want to know, on the surface, what does this sound like to you. Well, one, it sounds completely unethical, which

is separate from whether or not it's a violation of a state statute. But for anyone who's in a position of trust, like a healthcare worker with someone who's a senior who clearly needs help, that's why they have the relationship to begin with, there should be some pretty clear bright lines that you can't engage in any business dealings ever. Make them cookies, sure, sell them your car. Never. None of that makes any sense to me at all. Now, the problem here is you can consent to any deal, even a

bad one. And while our gut reaction is, hey, if this is a thirty nine year old guy, we say, yeah, yeah, we don't know why he did it, but it sounds like a horrible deal. Seventy nine year old guy who's in this position, and we say, what

went on to get him to put his name on that title? And therein lies the problem if he's unclear as to what happened, If he does have a threat he can point to or even menacing actions, you know, like this guy came in and he was brooding and he was over me and leering or what even if he can't give any of those things. I get why law enforcement feels a bit steiny as to what to do, because they're like, well, what are we accusing these folks up? Now. It doesn't

mean they can't have the conversation with the other folks. But my guess is the other folks are like, yeah, we came in and he liked my daughter and I was just helping going to go. Doesn't it sound like too much of a coincidence? George, Like taking advantage of a person I trust, if it's listed prior to them even getting there. For thirteen thousand,

five hundred and they buy it to thirteen hundred five dollars. Yeah, it sounds like an absolute coincidence that is likely premised on something untoward that happened. But remember with only three people in the room, and one of them says, I can't explain what happened. There aren't a lot of good, good outcomes for right. Please see what you're saying, George, I think this is a This is a call for me tom to the AG's office. If the Denver police don't want to take action, and I get why they don't,

I'd go. I'd call the AG's office, the consumer protection folks and get them involved. They are super sensitive to two big issues, consumer fraud and elder abuse good and they could be super aggressive in trying to analyze what happened here. Make some phone calls and try to get to the right George, what if a what if a civil case which is different than criminal? What if someone brought what if someone represented Charles and brought a civil case?

Do you see that? Is that a different level of proof there? Would that? Would that change things a bit? I think it would change things quite a bit, because, as you know, the standard gets reduced down to preponderance of the evidence. Now it's involving a contract for goods. You know, he would be a genius at this time. Our buddy Dan, our buddy Danny Kaplis, would know this thing inside and out. And I'm not committing him to anything, but I understand I'm gonna call him here ago.

I'm going to just to get his opinion on this. This is the kind of thing that you might even at thirteen thousand bucks. I can't remember what the threshold this time. You might not this, but you might even be able to launch this thing in small claims or county court. Yes, seventy five hundred is the limit for small claims that I think ten thousand for

county so for out in the district. Well, but then you got to wonder how invested in having this sweetheart dealer these folks going to be when they get that summons? You know, yeah, that's true. How excited are they going to be about it? And I'm not in no way am I

saying engaged in law? Heare, but this feels ridiculously underhanded. You can't explain it as anything other than either this guy fell in love with that healthcare worker and said I'll take ten percent of what this vehicle is worth, or something bad happened. And let me ask you something, George, George, what would be your opinion on the healthcare the agency itself and their responsibility if

a civil case was brought. Yeah, I think they'd have to They could potentially be on the hook, especially if they have a pattern and practice of this with either this employee or others. And you bring up a great point about this two times. How does this healthcare company not intervene and say WHOA? My guess is they have personnel rules, and those personal rules prescribe the relationship that has to take place between them and the person that they're taking care

of their client. If they don't have something on the books that says you can't engage in transactions with them, I mean, my god, what if this girl showed up in his will? Wouldn't that be weird? Wouldn't we say hang up? No, of course, or of course we're not going to allow people to do that. So my guess is there may be some personnel rules at play here. He may want to reach out to the employer. I don't know if he has or he hasn't, But this feels super

underhanded. I think in a civil case. A civil case, since I've been involved in so many, I can tell you when they depose you or they put you on the stand, jury's are very keen to listen to credibility. And when they start being questioned on why was thirteen hundred dollars and he and they said, well, he just wanted he wanted to help us or whatever. And he knew her for one day, one day literally. But George, thank you very much for weighing in and best to you on all

They're going to be a pretty irate when they hear about this. What is it actually is? So back in early October, my mother in law went in in the middle of the night to get a donated kidney. She was there for a few hours. They came in said, we've been working on this kidney for a few hours and

unfortunately it's not viable. It's been our home. A few weeks later, fortunately she went in, had a viable kidney, went through a successful transplant. She's doing great. She inquired, kind of just out of curiosity with the with her doctor team, what makes the kidney viable and so not. What they replied with was one of the most disturbing things I've ever heard.

They said that since nine eleven, which you know, almost twenty for years now, organs are no longer allowed to be in the cabin of the aircraft with the pilot. They ride with the luggage. And they said about half become too damaged during transport to be used. They told me, no, wait a minute. And they used to go in the cockpit with someone holding it like like a a you know, I don't know, a messenger. I don't know if someone accompanied them or if it was just in the container.

But it was allowed to ride in the cabin with the pilot. But for the last twenty three years it now goes with the luggage. And they the doctor said to her that almost half of the organs that come to them through aircraft transportation are not viable. They can't. Oh my gosh, So okay. Kidney that she got that was very viable was luckily came from a local enough donor that it was transported by car and so last month I reached out to my senators. I live in Wyoming. Senator Barasso is a former

doctor, and he was wonderful. He responded, so let me know that. In June of twenty three, Senator Can't Well out of Washington introduced a bill Senate bill in nineteen thirty nine called the FAA Reauthorization Act of twenty twenty three. Part of that bill establishes a new process for the commercial airlines requiring the safe, untimely transportation of an organ in the cabin of the aircraft. This legislation still awaits consideration by the Senate Committee on Commerce, Science, and

Transportation. I found a list of the senators serving on that committee, and I reached out to every single one of them, like this deserves more treatment than a quick phone called Michelle. So anyway, she was doing all the writing, and on this document it says that I sold the golf for four hundred dollars.

That's for tax, reasons. That's why she did that probably, And also, you know, I couldn't really see her name on air, so I don't know her name, you know. But back to the thirteen hundred dollars. You know, all I remember is he counted out the thirteen o five and then when we had the argument, I don't really know what I said. You know, it wasn't a heated argument. It was just that I was maintaining that I want you know, I had it posted for thirteen

So really, the management company did not do that, So the buye Okay Peachwood. This community is considered two communities, Peachwood one and Peachwood two. Peachwood one has been built for forty seven years. Peachwood two, which I live

in, has been built for thirty years. This November our age way is going to be effective March for its four hundred and eighty Peachwood one is two hundred and sixty five. All homeowners at Peachwood two is to comply with the governing documents, that is, the by laws of Peachwood One. Within those by laws clearly states that there is an annual increase which cannot exceed twelve percent in so far as we were paying two fifty a month and the current increase

should not exceed thirty dollars. Now you're saying that, according to buy laws HOA, fees cannot be increased more than a certain amount every year. Is that right correct? What let me ask you something, Jamie, What if that becomes untenable. Let's say there's just not enough money to pay the new insurance premiums which by the way, some of them have doubled and tripled, and other fees. What if it becomes untenable? Are you saying the HOA,

which is made up of homeowners, what do they do? Do they simply say to the vendors, we're not going to pay the bill because we can increase our dues. Because I think you're talking about this HOA as if it's a third entity and it's not. Those buy laws are made up of homeowners. So what if homeowners made a law that was untenable? What would happen? And I'm not trying to trick you, I honest to God want this discussion with you. What would happen if by raising it only thirty dollars

it would be impossible for the hu way to pay bills? What would happen? I wouldn't be able to answer that question, unfortunately. But they increased it by ninety two percent. I get it, Jamie, I'm not But what if? And again, there's a lot of possibilities here. There's three possibilities. One, they absolutely need the money to pay bills. Number two, the management company is getting all of that money and you didn't really need to increase it at all. Or number three, someone is lying and cheating

and stealing money. Which one do you think it is? I swear to you, Jamie, it's only one of those three options. What do you think it is? I from Okay, from my experience living here this November would be thirty years. For the last seven years we have paid two hundred and fifty dollars a month and nothing gets done in the community the decks. The reason why they're just maybe they don't have the money. The reason why they're justifying why they're going to increase the HA from two fifty to four hundred and eighty is they're going to replace the decks and the fence around the small picket fence yard we've had we have. I of home health care provided by first Light. People come in three days a week. A young woman I just met, Nay, comes in. She starts talking about not having a car. I say, I have a car for sale. He said. He showed her the ad on Facebook marketplace and it was listed for thirteen

thousand, five hundred. She said she would call or no, she called later on saying can I come tomorrow. She came on Sunday with her dad, Richard, And according to Charles, they came in and the dad counted out thirteen thousand and five and put it on the table and he said that's not enough, and there was an argument. But this is where Charles' argument gets weak. He says, I don't know what happened, but he did sign a bill of sale for four hundred dollars and he signed over the title,

so basically he sold the car for a tenth of the value. And he's claiming he I really didn't know what he was doing and he blacked out or has a memory lapse or whatever. Anthony, the dad wants to accuse me, Dick Richard. The dad wants to come on and say, he said, look, you're not giving the other side of the story. Of course we're not if you don't come on, but we'll say anything that you tell us. And we did. And I want to make this clear,

so I don't mislead Richard. When a home healthcare worker comes and does business with a client, it is considered unethical. I looked it up on every website I could find. Home healthcare workers are not allowed to do business with their clients. However, that doesn't mean that the transaction itself was illegal. According to First Light, which has no problem with this, and according to Nay, the police investigated and there was no crime. So does that make

it right or wrong? I think it's wrong ethically, But is the transaction itself wrong? Civilly? Maybe did they take advantage of Charles? Charles says they did. First of all, when you guys first call my daughter, the guy was very intimidating and being a bully and making false activation to my daughter before even investigating. And that made my daughter feel uncomfortable about talking to him or you guys about the situation because before he even investigating, you already made a decision when you first initially did to contact with us. Okay, with my daughter. Now, before I forget,

I want to tell you this. When you asked Charles about about the post, did she see the post? Did you show her the post? He said yes. But what he didn't tell you was when she and I got the post. She got the post first when we left Charles's apartment after the whole transaction was done, and by the way, after the transaction was done, he still invited us there. We were there for about another thirty forty five minutes because he invited me in his bedroom, showed me his collection of

clothes and hats and this and that. After I paid him the money and count out the money in front of him, he said, let's go to the table now to find the title. So I don't understand because we know at that time we didn't know anything about thirteen thousand. Initially, when he first brought it up to my daughter, and my daughter brought it up to me. My daughter went, look, my daughter would not listen to this man say hey, my car, I'm selling a car for thirteen thousand,

five hundred. And then it come to me and say, dad, he signed it for one thousand, three hundred. Okay. So wherever the mis communication came in at I don't know because when I went there, very intelligent man, he's very intact with reality, very smart, can hold a conversation just as well as any normal person. He brought up dementia. That's not true that they will not. I find it very hard to believe that they would leave a man with dementia in a normal apartment up the steps in a

wheelchair with nothing to block the stairs. He can he can forget their stairs there, and just wrote right down him if he had dementia and he didn't know what he was doing. He also had a stove where he can cook, just like a normal person. If he had the dementia, he can cook, beget he's cooking, and burn down. The hope put everybody's life in danger. So I doubt there's dementia in play here. And if I felt that there was dementia in play here, that would have been a hole.

But let me just tell you something. I'm a very good man. I'm an honest man. And he also about I'm sorry I'm skipping here. So about the about the post, Charles text that after we left, I followed my daughter. She was in in the car the copee he just purchased. I was in my vehicle. I followed her see me. We were going home nating. I know. My daughter called me and said, hey, Charles just called me and said he want us to bring him another twelve

thousand dollars. And I'm just boffing. I'm like, what, what do you gotta be kidding me? You're just joking, right, She said, no, No, he just told me said he want another twelve thousand dollars. And I'm like, he gotta be crazy. That's crazy. This doesn't We just staid over there for about hour and a half plus of two hours dealing with this, and you know, and everything was fine, and then all of a sudden, she goes, oh, he just sent me a

text too of the posts. So that's the first time my daughter or I ever even seeing the posts, okay, because he texted to her after we left, so no one ever knew that he had a post out there for thirteen thousand, five hundred dollars. Sure, okay. And when you get on the air and you make accusation telling them about you're going to get on air what somebody told you and make it make it ring true? Is it just beyond me? Because not Richard, that was that was a joke.

case. And so you paid five hundred dollars for what for ninety for basically to be able for the ability to grow nine marijuana plants, okay, And that's called a cultivator's license or card. Yes, yes, sir, okay, good, okay. So I get this card, and because I had been growing, I already have the holes there. So it was it was just easy, you know, I mean it was, yeah, I get it, so you could grow ninety nine plants. And then what happened in

the middle of the year the state cut the count into fifty. But you know, okay, they never gave me a refund. That's one thing. Wait a minute, so hold on the state that said from now on, cultivator cards are only good for fifty plans. Yeah, well at that time, this is in twenty seventeen, because if this is this is this is I have been through a hell in back with this is marijuana thing, because I've been convicted of two felonies because of this. And okay, that's right.

Back in two seventeen is when you paid that yes sir, yes, or to a license position on the license to I get it. I get it, and then they cut When did they cut the plants? I know it was. I just believe it was like in the middle. It was in the middle of my bow year, so it would be like, so wait, in the same year you bought the card, yes, okay, and all all of our grow anybody that grows there, because we have a card, your your grow is governed. I mean that, I get it.

I get it. Okay, so when they cut the number of plants, when they cut the number of plants to fifty, did you did you cut the number of plants you grew? Well, yes, I did, well I cut them down. But they also don't give up notices in the mail or anything like that. You have to do. So, why were you arrested on a felony? Okay? Well, no, nowhere at that time that year did it stay in any any any of the government's literatures or

statues or anything like that. How much one marijuana seed could yield? Okay, well, the way I was taught to grow. Well, I'm to go, terry, Terry, you're getting You're getting a note pun intended too much into the weed. I need to know, Well, I need to know why were you arrested. I don't need to know a lesson on growing. Why were you arrested? What was the charge? Well, it's not

it's not a lesson I'm growing. It's about the weight that I had on me because at that's a property, because it's sold another There's been a lot of people coming in from all over the world to be able to grow here in Colorado at that time. And like I said, no, where do there's the state how much one marijuana seed could yield at that type either. And I was taught to go one one time proceeed. So I had fifty pounds left. I obviously they all didn't come out right, but I changed

thirty pounds in marijuana. Was a ninety nine plant card that was cut in half, and I had to go move it. That went to the ranch. I got, I got, I got to the rack, I put on my trunk, back to the car and I covered it up. I was by myself. I go back to my house and I got stuck at the at the bottom of the

gate. I couldn't get through the gate, but off through. The sheriff passes by me, and he knows my old bo. He knows my boss. Say hey, this guy, is that when you were Is that when you were charged back? What year was that? Yes? Yes, yes, yes, yes yes, Alison. What year was that? What year was that? Terry? It was July first, twenty eighteen. Okay, so hold on, So in July after in July or July first, on July first, two thy eighteen? Right? Uh? Huh you were charged

with what? But first it was possession with the intention distribute? And uh I was they said it was growing solvit devorium. Uh were you? I don't even know what the hell that is. I don't think I had like, well, it's it's it's just it's it's a drug. Explain it, I think. Isn't that the one they call ecstasy? Ecstasy? Maybe? I don't know, Well, I don't know. I just thought I personally sure have never seen that grown here in Colorado personally, Well was it in

was it in your in your bundle? There was it in there? No? Oh no, no, no no, everything that was in my bundle was U was Why did they come up with Salvador? Why did they come up with that other drug? I have? You know what this is where it's gonna get really good, because you know, now we're going to go into the politics of this situation because bye bye law in Uh, there's there's

just a you know, attatue or whatever. There's something assignments One One one is how they can't they been left me with absolutely no medicine at all. They okay everything that I do, But how did the charges come out? Because of the weight? They said it was the way they searched the car. Well how did it come out? Did you get did you get?

No? No? I end up. Okay. I go to part and they want me to sign a p agreement immediately, and I'm like, I'm not going to take the pay agrement because I didn't do what they're saying I did. I fired four public defenders because none of them gave me crap about what was going on with the elector brought that they had a window in their office. You know what, I went pro sae and the judge let me go pro say and you know what, I was convicted by jury of a

judge I got. I got the transcripts. I should have gone the transcripts for free. What are you calling about today that they okay that they're using my signature to purchase Uh it was a non non non negotiable surety bonds and take business entity names and using my signature for us, using the signature he got in court to buy stuff in your name. She is, she is, she is, and they all know about it. My provision officer because they revoked my okay. If I get convicted, I go to jail.

She didn't give me a bond, even on the transfers, it says I pard in court. According to c JC, the jail here, I did not. I was never even transferred from the jail and the okay. And I said, yeah, that's a lie. Hold on, you're giving me way too much. So the main call today, Terry, let me just sum it up, is that someone you believe is using your name to perpetrate fraud. Is that a short version? They tried to kill me too.

As soon as I got out of jail. Ten hours later, I was slammed on my wayter Monument to clean my boss's house at seventy five miles an hour. Lady slammed me in the back of my car and wrote, my ma, wait wait, wait, you think that was a plot to kill you? Oh yeah, oh yeah, okay, but hold on about the driver? Well what about the driver of that car? Wouldn't they be hurt too? But yeah, oh yeah. I believe that either she owed somebody or that she was sent her to do that. But I and she volunteered

to hurt herself. Was she hurt in this accident. Oh no, oh no, she was not hurt at all, but she came across three lanes and avoiding a black car that was never proven Terry, Terry, this all sounds crazy. Well yeah, well they also just replicated my probation and Reis stated it to the same way. Why were you taking medical marijuana? What was the underlying cause? Well, I have and that's a that's a disease

in my eyes. Yeah, and I also have been have terrible PTSD from being bit I used to be its work at animal control should be so hold on, hold on ding, hold on PTSD right? You have PTSD? Right, Terry? Yes? Are you on any other medications other than marijuana? Uh no, I take xanags for anxiety, but that's it. Don't take it. I don't think it. Has anyone ever talked to you about

possibly having a paranoid condition. With your PTSD combined with everything else, you might have a paranoid kind of problem. You might have some kind of bipolar problem. I don't know, but you should see a psychiatrist or a psychologist. Did you tell them about the judge using your name and all of that, Yes, sir, I've been telling mister Low about this since Dave. Well, I mean, we know bullying's not going to go away anytime soon, but we're at a point of bullying that I don't know who to reach out to you to help to ask now usually now, usually these schools go overboard with bullying. So I have no idea. Why talk about this, Sherry? Tell me what do you mean by bullying exactly? What's going on? Well, there's this little girl at my granddaughter's school that has decided that. You know, she keeps asking her, do you want to fight?

And my granddaughter's like, no, I thought we were friends. So it just started get escalating where she was pushing her, having her older sister in high school, or her older sister that's twenty one, you know, walk by and you know, say these little snide comments to her. So I approached the school and I was like, well, you guys need to they do it, not what's called no contact order, like we're no contact

order for now, which of course isn't legal. It just tells the children that they sign this agreement that they won't talk to each other, okay until they're in you know, in the mindset to talk and solve the problem, right. You know, we're not going to point at each other. We're not going to do any of that. Well, it's escalated to the point where the little girl has everybody pointing and laughing at her. She posted a picture of her on TikTok and talked about how ugly she was. She had

some little other friends, you know that my granddaughter thought were friends. They were supposed address the same for Valentine's Day, and then she showed up wearing what they were supposed to wear, and they're all laughing at her because she wore the wrong day. You know, how old is your granddaughter? Twelve? And then she was at school on the twenty eighth, and she got up to go to the bathroom and these six little girls ran out of class

and followed her. She was stuck in the stall for ten minutes. At least ten minutes. She had to call out because nobody noticed those seven little girls were missing. We know she was stuck there for ten minutes, which called out to my other daughter and my daughter who called me, and I was calling the school and driving over there. They did not answer the phone, and when they did answer the phone, they hung up on me because she said she didn't like my tone and she didn't have to talk to me

and the school. I asked the school to call the police, and because at this point this is serious, you're holding her captive in the bathroom, like, oh, it's no big deal, they refused to call the police. Captive Sherry. You know, there's six of them and there's one of her. So the threat were they physically keeping the door closed telling her not to come out, Not that I wasn't there. She says. They weren't necessarily saying not to come out, but the implication was or they were telling

her if you do come out, we're going to kick your ass. Period. Well, let me ask you something. What and you're saying the school is doing nothing about it. So their solution is it's like, well, we'll walk your granddaughter to school. Well, why are we walking the victor art to class? Why are we walking the victim to class? Why don't we walk the bullies to class? Why? You know, they're supposed to pursue this, they're supposed to make harsher consequences, Like what are the there's

no consequence of the school. What is the name of the school? She's not performing arts, But it's the entire district that I'm having that I can see if the bullying is out of control. Today I got a phone call from my grandson's school and he's only nine, saying that during assembly, a little boy walked across the you know the gym, blapped in the class the face so hard that his classic's flying off, and I'm like, when is the school? I understand you can't stop bullying entirely, but when are we

going to put some programs into place to slow down the bullying. I didn't realize it was such a big I know there's bullying, but I thought schools were doing you know, this is my perception was that schools were doing a lot to stop it. You're saying they're not. No, I actually moved through schools, and we actually even moved her. They call it ensembles instead of classrooms like they called it. It's like instead of homeroom, it's called

ensemble. And she actually moved ensembles to get away from this little girl because the pointing, the laughing, the having her brothers or her sisters. She doesn't have brothers. Her sister's pointing out her has gotten to the point she's like, I just wanted to stop. She's like, and here's the kicker of it. My Gander's like, yeah, but twelve year old listen, I'm not saying this is not happening. But twelve year old girls can exaggerate a bit. Yes, absolutely, they could, Yes they could. Does

she have any friends that witness this that will attest to it. Yes, I mean we've done all of that kind of investigating. What do you think should be done? Let me ask you that straight up, what do you think should be done? I think she should go to in state. She put these girls and in school suspension for a few weeks. I think the problem when you get this kind of amount of and it's not just it's cyberbullying, it's walking by her house like it's more than just you know, it

keeps escalating. Well, my granddaughter's like, I just want to we were friends. She's like, I don't want to get her in trouble. I don't want to fight. I just They even actually went through my granddaughter's phone,

so you asked me that, and they actually have the messages. They actually took the messages when they investigated and said that she actually handled it appropriately, and the other little girl was still threatening her where she was like, I just want to be friends, you know, or just not be friends. I just I don't understand what the problem is, but I don't want to fight with you. And the other little girl's like, well that's too

bad, because me and my friends are going to beat you up. So yes, it has been es you know, investigated, and she has tried to be escalated. So they are doing something. They are doing, so something about it. Not necessarily. They're just saying, well, we'll move her from a class. You know, the fine, we move ensembles. But that's it. That's all that happens. The pointing, the laughing, you know, the guinea trapped in the boundary. I don't know that can

be stopped. Pointing and laughing. I don't know if that's considered bullying, see Sherry. I mean, I had kids in school not too long ago, but I don't. I have another kid in high school still, but I don't. What I don't understand is what's considered bullying. I mean, if if they're jerks and laughing and pointing, is that bullying. I don't know the answer to that. And I don't know what schools can do about

it. I mean, I truly don't. I don't, Sherry. And there might not be an answer except moving schools there, And you're gonna say, why should she have to move schools because of other people? I don't. We are having a plethora of calls on HOA fees. I don't know what we can say about it, because what can you really do about it? People say, if our HOA wants to raise fees, can they do it? I mean, what do you tell people when they call? Have you ever had anyone maybe bring in bylaws? I don't think anyone reads bylaws. What do you think? Yes, generally HA boards do have the discretion to

raise dues regulator and to even change their rules. Yeah, there's a heightened voting requirement, like a bigger percentage of the vote to actually change the governing documents. But yeah, they do have the discretion to if they get the right enough votes to pass budgets and increase the dues if necessary. So if hoas say, you know, we promise not to raise your dues by so much like this one woman called, you know, if they can't pay their

bills. It would be unconsciable. They have to raise dues. I mean, you can't possibly have a document like that that can be enforced, because what if they can only raise by a certain percentage of years, Like she said, well, that's stupid. Okay, So now let's say they can only raise rates by thirty dollars and it leaves them fifty grand in the hole. They can't do that. I've reviewed a lot of HA documents. I've

never seen an annual cap like that in never have eye either. Never not to say that it couldn't be done, but maybe in the old days they did. It is setting up a problem to if if there's a cap and that's just not enough. And and what people don't realize when they say my HOA dos went up, I don't want to pay them, you know, or that the HOA, even though there might be a board and all that, the HOA is them. have to pay the bills. The only thing I think they have the power to do is to make sure the money's not being wasted. They can look at the budget. How many people go to budget meetings?
