Now again, Uh, I've had a number of people who've called and I'm trying to give direction and we're trying to help. You may not agree with our directions, So here's what you do. You can do what we ask and recommend or not. Some people have gone against our recommendations and have come out ahead and said, you know, Tom, I did this anyway and it turned

out better. You know, I'm not pretending that we know everything now. Our percentages are pretty good. We usually solve more than we don't, and we do help people and give them the right direction. So let me get right to the phones. But as you see in our wide shot here I have Jaris with me from Jars Hansen is from our Peace Center, retirement planning Center of the Rockies. You know, every day we try to take a different topic. That doesn't mean we concentrate only on that, but he'll be

here to talk about that. And right now jaris that. You know, here's what I want to say, real quick. Everyone's optimistic because the market's going crazy. The market had two rallies last year which made up for all of its losses, so it finished really strong, really really strong. And now this year it's really really strong. They say the FED cuts rates. The Fed cuts rates, we could see a six thousand, a six thousand level which would be unheard of. But it can't. And again I'm not

pessimistic on purpose. I don't want to just make people upset. But it can't sustain. What do you think, you know, I wish I had a crystal ball tom No, no, no no. But I mean, in general, in general, the stock market over time, as Warren Buffett has proven over the long run, if you just don't go crazy, you can make a pretty good hedge against inflation. Yeah, and that's that's really

the point of what we do with our clients, Thomas. We help them figure out ways and not only take advantage of the market growth over time, but make sure that their money's in a place where short term they're not going to lose huge amounts where they're going to have to stop and like positive retirement for example, most people make them. Here's where most people make a mistake.

They try to day trade or short trade or play the market. Now some people could do that, some people can, but it is so so difficult. Well, and it's really easy to get whips when you do that kind of thing too. You know, they say, oh, I'm going to invest in this or in that or in this, They find one or two stock and then they go to something else. But Warren Buffett, over

the long run, it's probably the smartest investor that ever lived. Now I'm not talking about well I am. I'm talking about him as a person that's smartest investor. But he has done nothing flashy, nothing nothing flashy. I mean, it's weird. So is the stock market safer is it not? The bottom line is this, The stock market is as safe as you make it. Here's the problem with the stock market and people. And you hear Joe Kiana talk about this a lot. He says, get out of the

stock market. You know, I think what he means is this, And I want, I don't want to put words in his vote, but I think what people mean is this. If you have a retirement account and you have a certain window, if that retirement account suffers big losses during that window, you may not have enough time in that window to get him back right. And there's different phases of life when you should write that's right, different

that's right. And I think I think that's what really it means. If you're going to stand with some solid stocks for the long run, you're going to hedge against inflation and do pretty well. If you're going to try to play the market, don't do it with your retirement account. If I'm a twenty year old and I've got a bunch of money and a tech fund, I'm okay with that. Yeah. If I'm a seventy year old or a sixty five year old, now my money's in large cap tech, that's a

problem. I'm going to need to talk now. I'm going to go to the phones. But Mark loves playing with stocks and he does pretty good here and there, but he pays a lot of attention. A lot of people don't have the time or energy to do that. Let's go to Marguerite. She has an issue with movers and oh, I hope it's not the same issue we hear all the time, Marguerite. I'm going to let you start your story here. What's going on? Hi? Tom, Nice to meet

you. Nice Tom. What's going on? I've been in an earthing home for about three years now due to some physical issues, and I've got the opportunity to transition into the community, so I hired some move to move my storage into my apartment. The storage is five foot deep and ten foot wide. I met with one of the workers and he looked at it, and my transition coordinator asked, how long do you think it'll take? She said, oh, about two and a half hours. Okay. Then after that

they where'd you find the mover? That's what I want to know. And always listen to your gut. When I don't, I always regret it. It's a friend of a friend. Well that's better than just going on the internet. But I mean still okay, So but I want to ask something. Do they have a company or are they just people know they have a company. They have a website, they have a company. What's the name of the company, dear Carrying Transitions? Oh, did they specifically work with

older people? I think they do a lot of the state sale and transition. I don't think they specifically work with older people, but I think that kind of becomes there. But so you hired Caring Transitions to move you correct, And you told him you had a storage unit of ten five y ten and he came and looked at the storage unit with me and the core. He gave you a bid. He never gave me a bid. Well, hold on, he just he did. He kind of gave you a bid.

He said two hours. He said two two and a half hours, yes, And then after that he said, oh, by the way, it's one hundred and fifty an hour. I'm like, well, that's kind of a lot, but no, not really. How many men for that one He ended up using four? But it was it still one fifty or was it more like? In other words, the one fifty an hour represented what one worker, two workers, three workers, four workers one? You didn't really get details in writing, did you No, but the one fifty

per work her. Oh, so it was going to be three hundred an hour with two workers, Yeah, but it turned into four workers, so it was six hundred an hour. Correct. So what happened then? Well, you know that all kind of snuck up on me because I got it in increments. But did you sign something saying you were going to pay one fifteen hour per person? I did? Okay, keep going then what happened then? So the day finally comes and he's got four people, which I

was like four people. I thought it was going to be two. And he was supposed to go to the storage, thought that my daughter's house pipapa bed, then go to the apartment. Instead he went from the storage to the apartment, then backtrack to my daughter's and then back to the apartment. By then, the freight elevator was being used someplace house by someone else, and I guess he had to wait, did you have a freight booked? Did you have a freight elevator booked? I just I just reserved the freight

elevator. Well that's what I meant you. You had it reserved and he missed the winter? Correct? Okay, So what happened because he was backtracking. Let's get right to this. Well, let's get right to this, Marguerite. Is the problem you got builled way more than you expected? Is that the problem? Two thousand, three and seventy five dollars? Oh my god, I seat by ten feet from where to where? It was just about a thirty minute drive. It's from like Alameda. Did you how many

hours total did it take them? And was part of that time waiting for the freight elevator I'm imagining it it was. I'm assuming how many hours did they bill you for? Five hours? At five hours and four men? Correct? Okay, did you have anywhere on the paperwork you said you signed something one hundred and fifty dollars an hour per man or per person? Correct? Did you also sign something saying it was only going to be two hours? No, he never put that in writing. Then he then, okay,

I'm going to give you the bad news. First, you kind of obligated yourself. I mean they just snowballed you, man that they obligated you signed saying yeah, I'm going to pay one hundred and fifty an hour per person, and so they have five hours and four people. I mean that is never? What's that? That was never? In writing? You just told me that you Now, I'm not arguing, I'm asking did you sign any First of all, let's start here. Did you sign anything at all?

Yeah? Okay, what did you sign? Did you sign an estimate that said one hundred and fifty dollars an hour per person? Yes? Correct? Did it also say how many people they were going to use? No? Did it say how much time they were going to take? No? Okay, so you obligated yourself. It wasn't writing you say if they had ten people for ten hours, you would have theoretically had to pay that. Theoretically, I mean there's something called unconscionable, but you would have had to

pay it. Did you end up paying the two thousand, three hundred and seventy five dollars I have not paid it yet. No? Okay? Is your stuff delivered? Yes? Oh? Good, good, good good. Hold on a second, let's figure out what to do. Hold on three all three seven to one three talk seven one three eight two five five. What would you do in a case like this? I'd like to know. Do you think she was misled? I don't. I think both yes and no. We'll talk about that coming up. Three o three seven one three

Go ahead, Greg, tom so retirement investing in the

stock market. The thing that frustrates me is when people say, oh, you're fifty or fifty five or sixty, move all of your investments to something you know with less risk. The longest time between recordhis in the stock market is seven years approximately, So unless you're planning and using all that money in seven years, there's no reason to think you need to withdraw all of it into lower risk. But Greg, Greg, I kind of agree with you

and not. It depends and you're right, there's no one answer. But Greg, one thing I wanted to mention when you talk about record high peaks being about seven years apart or sooner, the problem is the record highs don't always make up for all of your losses of lows. They don't always. It doesn't balance necessarily that way that you have to make up more in the plus than you did in the negative. You know that, right, sure, But that's yeah. I mean, if you're maintaining a fund, that's

consistently following the averages. Though, then if you don't sell it when it's low, you'll be fine. And some people are more risk averse, some less verse. I'm not advocating to change your strategy, but the notion that you're approaching retirement agent you need to you need to move everything to secure you're just going if you if you're a person who is willing to take on risk, you're passing up earnings. Okay, But here's another thing I wanted to

mention Greg. There is a time, and I don't think all of your money, but there truly is a time, and I've I've done it. I really did it where you convert some of it to an annuity. And I don't mean a regular annuity of the high priced, crappy annuities, but I did a guaranteed annuity with a bonus and with income. I actually did it. I mean, but not all my money. But what you know, I don't know what you think about that, but I think that's a good idea. Jaris Yeah, Tom and Greg. It's never a good idea

to have all your money in one basket. Now, of course it's safe or in the market. And one thing that that's important is if you've got a bunch of money in the market and you're relying on it for income, that may not be the best place to keep all of it, not for

a long terms. So you know, if you are a retiree and you're getting ready to pull money out of an account, I wouldn't want to keep that all at risk because if I've got a thirty percent drop in the market all of a sudden, I'm gonna have to take a little bit less out as income from that account in the future. I want I want to I want you to later in the show. I want you to talk about the three buckets. I love that scenario. Hey, doctor Gary, I'm going

to go back to the mover thing. I just we're just noodling on it. Figure out what we can do. Doctor Gary. You you have a question, go ahead, Yeah, Tom, I'm really calling to see if you were pleased with your top surgery for your low back. I'm one thousand percent please yes, But but I have done You have to understand something. I got it for what it is right. It's not an end all be all. It is for what it is right now approved for is one level

and it's going to be multi level. I don't see why it won't be, but because but the one level, meaning instead of a fusion, you get this. And what it does is it stabilizes your back and allows for full movement. Gary. Have you seen his video he did on it. Well, I haven't seen the video. I actually spoke to Prima in Connecticut, a company that actually developed it. Yeah, now listen, here's the

deal that they're They're really wonderful people. And the top surgery for those listening is a titanium implant with a movable disk in between, and it literally takes the place a part of your spine. Do you understand that the bad level of my spine was removed? It wasn't fused, it was removed. There's nothing to grow arthritis, and there's nothing to ever pinch that nerve again. There's also no adjacent disk disease because I'm not putting extra pressure above or below

it like you would with a fusion. That's not to say I could not develop arthritis in in other facet joints. Of course you can. I mean, you know, you still have to whatever be healthy. But if you had multiple levels and of bad, bad, bad back facet joints and discs. If you don't want to wait for a TOPS to be approved for multi level, you may have to go ahead and get a fusion. Well, go ahead, Gary. In my office, I see all those fouled fusion.

Sixty one percent of them fail within four to five years. And those exactly yeah, I see. Even when they don't fail, Gary, their lives are miserable because they can't move right. Right. So when I spoke to Prima, they said, and I told him my diagnosis, they said, you are the perfect candidate for this particular procedure. I went to a regular spinal surgeon yesterday and he basically said, oh, it hasn't been around, it's experimental, and he was just saying horrible things about it. Now,

doctor, I'm going to tell you why, okay. And you know this about the medical profession, just like the electrical profession, the investment community, the HVAC community, the automobile community. What is it If they don't bring it to you and they don't do it, then they diss it. That's what it is. Because this moron doctor has no idea what he's talking about. They went through extensive trials, extensively and hundreds and hundreds of these

were done in Europe. Here's the point. The point is is, of course you're going to still have doctors who say, oh, it's experimental, it's no good, it's that Well, we do know one thing for sure that the fusion is the worst thing you can do. Okay, we know that, So if you know, here's what I'm going to tell you. Look, I am living proof now I've had it a year. People to say, well, you don't know what's going to happen to him. It

might fail, who knows, of course it might anything could fail. But I'm telling you it's the same materials that a fusion is made from, right, but instead it moves. So why are people saying, why would that moron? Doctors say a fusion is fine with the same materials, but put in a different way, why would it not be fine? Why? Exactly?

You know? I mean, here's the deal. What you need to go is see a forward thinking neuro surgeon who actually does all kinds of surgery, so he's not held bent on selling you on one or the other. I already have appointment with both of them. The only two guys that do it in town, and one of them is my doc thought, right, one of them is your doc and the other one's over in a war on

see you, and they're both really they're both really good. Right. And my other question for you was how how long was it before you could resume your regular activities? I was walking around the next day. I was, excuse me, I was walking around that night all over the hospital ward they said, what are you doing? I said, I'm walking. I'm having a wonderful time, and I resumed. Now, listen, I'm not recommending this, but I was. I was doing regular walking. The next day.

I was going to the now I was. Let's put it this way. My people here will tell you that they couldn't believe I had surgery. Okay, I'm the only thing. The only thing you complained about that I remember was the incision itself. Yeah, yeah, the itchy and all that. Yeah yeah. And here's the thing I'll tell you. Okay, my doctor said, Tom, before you go to the Jim, wait at least six weeks. And then when you do go, don't put don't put weight

right on that. You know, let those screws really really adhere to your spine because it's holding it up in bottom. And but I'm going to tell you somebody, Okay, I was crazy and I had no I felt zero restriction. If you're wondering, are you going to be laid up like with a hip surgery, No, absolutely not. That doesn't mean you should do what I did, but but you will not feel laid up. You know what he told me yesterday was no lifting, bending, or twisting for three

months. Well, okay, that's true. I mean, I know, I know what. I know what they're saying. And when they say that, what they don't want you to do is like lift, they don't want you to do stupid lifting and stupid twisting and all of that. I understand that. Yeah, right, And but my recovery will probably be cut in half because I have a hyperbarret chamber in my office. So that really is

and you probably are. Are you fit anyway I used to be? But because of my disability, I'm not as good as I used to be. Yeah, and that's the same I was, although I still I still you know, was I think below twenty percent body fat. I think that I had to just I had to be held back. Let's put it that way. I had to forcibly be held back because I had zero pain and zero discomfort and zero impingement. So the best to you stay in touch with me

every step of the way. And either doctor you choose is going to be a good one. You're gonna love it because they both doctors who do it do a fine job. Three all three seven to one three talks seven one three eight two five five. You know, it's really funny though. I know you've all heard this, right. If they haven't done it, or if they don't tell you about it, it's bad. And that's not just

with the medical profession. That's with all professions. I mean, I have through my entire life have heard people tell me about how bad something is because they were not familiar with it. Now. At the same time, that doesn't mean you go to everything that's brand new either. There's a balance there now, Marguerite, here's what I'm Here's what I'm saying. You have movers that charge you way more than you thought they would. But they were right

up front with you with the written contract. But they told you it should only be a couple hours and a couple men. It turned out to be way more. Out you have one a witness to that this happened to us when we help Miles move. It just happens. I guess, like part of the industry. Here's what I'm going to get out. Okay, Margaret, it doesn't matter if you have a witness. You're not going to go to court over it because you're going to lose if you go to court.

So really all that matters is what's in the written contract. And movers are are are extremely good at cheating people. Okay, I'm just going to tell you, in my opinion, it's cheating because they they they bait and switch you. But here's the deal. What can they do to you if you don't pay? Let me ask you that. What can they do to you? I guess maybe take me to small claims. Course, yeah, they could and get a judgment. But bot I'm asking is what do they get

if they get a judgment against you? What do you have? Yes? I have nothing? Right And what is your income? What is your income? You know I'm in a wheelchair, Margaret, Marguerite, what is your What is your income? I get social Security every month. They can't garnish social Security. They have nothing. You're called judgment proof. There's nothing they can get from you. Do I suggest you not pay them. No, I suggest you pay them for two hours and two men, which would have

been six hundred dollars right, or may be a thousand or whatever. Now you do know you're gonna owe something. What were you expecting to pay? I was expecting to pay about seven hundred dollars. Okay, then I would put down I would I would pay them, saying, look, you know you estimated way less than this. It was I had an eight by or a five x ten storage occer. And I cannot pay you anymore. And this is what I was expecting to pay. And I've had witnesses. I'm

not This is not legal advice. This is if you were my mom. I tell you, this is my sister. But here's the deal. Once you do that, they can't. They can do something. They're gonna uff and puff, but they can't blow your house down. They have nothing. You have nothing. They can get nothing nothing. She wants to talk about a repair issue I believe with Hyundai. What's going on? Nina? Oh? All, good morning, Hime. So this is the this is the dilemma on facing Okay. On February fifteenth, I was driving to my sister's house for her

birthday dinner. And I was five miles away from more house and my two thousand and four King Hyundai Tuson, which has eighty two thousand miles on it. The check engine light came on and started flashing. So I made it to my sister's house and I just left it there for the evening and I called the Foundation Hundai. On Friday, February sixteenth, and I told them I was going to have my car toad there. Well, the female that works in the service department said, well, you don't have an appointment,

we're not taking the car. And I said, well, you have to take it because it's being told. She goes, no, we're not taking it. Well, wait a minute. Why did you think they had to take it though? Well, because it was a because in my mind, I thought, well, it's a Hundai. The check engine light's coming on, so you know, and that's that's the place I usually take it to. No, I understand that, But you had it taken. You instructed

them to take it there before you at eb and called them. No, No, I called them before I had a toad from my sister's house. I called Hyundai and female who as the female who answered the phone said, because I did not have an appointment. No, I get that, but I know I understand that. So when they told you not to toe it there, what did you do? Well? Then I towed it to another garage accurate auto okay, which is not too far from me. And where

is it? Where is that located? What part of the town are you calling from? Denver or Springs or where I'm calling from. I'm calling from Erie, Colorado, Eerie, Okay, got it? Okay, so you took it to another place and what happened? Right? So then that morning around ten thirty, the mechanic from Accurate Auto called me and he said, well, Nina, I've got some good news and I got some bad news. And I said, okay, so yeah, what is it? Good?

He said, The good news is your vehicle is The bad news is you're going to have to tow it from us to Hyundai because the diagnostic testing came out that it is a bad cart in your engine. Now, how many miles on this car? Eighty two thousand? And is it still under warranty? Mark this two thousand? What was the in service date? Like it's a twenty fourteen hundred, I'm all going to come down to the in service date because it's roughly ten years. When was the in service date?

I mean when when did you actually did you buy this new? Yes? I did. I bought I bought a July fourteenth in twenty fourteen. Okay, so it's under the ten years. I would assume that it's under warranty. seven one three A two five five. Well, Nina, it looks like your YNDAI will probably be in that tenure warranty. So where does this stand right now? What is the problem? Why are you complaining? Well? So then when when the when the accurate I'll cally, I had it toad from accurate auto because they had told me they had called the court. I don't care about that. Where did it go from accurate to where? I don't need to know the reason. Where did it go too to Foundation?

Hunts? Okay, good, now is it now? What did Foundation do? Did they fix it under warranty? No, they're they're fixing it under warranty. Why they're they're telling me that they're diagnostic testing because their diagnostics machines cost anywhere from ten thousand. Okay, all that is that. I want to know what do they say? Foundation says they will not fix it because their diagnostics says what that it's uh, it's my it's spark pluge, it's not what it's not this TSB that came up. Okay, so get the

spark plugs replaced. Who cares? Well? I yes, I told them that. Okay, I told I told the manager of the service department, okay, let's get it fixed. And so then he said okay. He said, well, because you didn't have an appointment, is here, but we can see your car till March fourth. I said, okay, I understand that I can wait. So March fourth came along, I didn't hear from them. I called Foundation Hundai on March fifth and he's and Eric told me, oh, you know what, two of my mechanics were injured.

One is back Okay, now, Nina, without all, I don't need to know the entire history of their workstaff. Here's what I need to know. Where does it stand today? Did they ever get to it? They got to it, but now they're saying that they're waiting for a part to come at. What are they doing to it? What are they doing to

it? He said that they're replacing the spark plugs and that there was a slight leak in my oil pan, which I said, I've never had in any oil leaks and he said it's so slight that it would evacerate before it hit the ground. Well that's not true. But Nina, Nina, I don't know what the hell they're saying. But I know Foundation went to hell in a handbasket. They used to be a good organization. They suck. I don't know how that happens. They go from hero to zero in such

a short time. It just absolutely amazed me. So here's all I need to know. When do they say your car will be done? I received an email from the corporate office. When do they say it's going to be done? When do they say it's going to be done? They said in the email it might be done this weekend. Okay. Now, are they fixing it under warranty? No, because it's not a warranty issue, because

it's normal warrant here. Well, that's what they're saying. Okay. So if you get your car back and it runs fine, everything's going to be good. But what you're upset about is it's taking a long time. Is that what the essence of the call is? Yes, Okay, I can't. They told her they told you not to tow it in the very first place. Yeah, I know, and then they thought you no, but then the wrong diagnosis by the other company got it there. I don't know

what they did wrong. To be quick, they didn't do anything wrong. Okay. I was about to tell her that, Nina, They're not doing anything wrong. Everyone is faced with these delays, and it's a terrible situation. I think. The only here's what I'm more concerned about. Here's what I'm more concerned about. But I don't think this is happening. But I'm concerned about it, and that is that your car does have a deeper problem. But the good news is you have a record of this, and you

have a record of the previous diagnostic from the other place. Accurate. Therefore, if you do have a problem that surfaces right after the warranty expires, you can make the argument that this problem reared its ugly head while it was under warranty and foundation sluffed you off. Although I don't think that's what they're doing. My gut is telling me I understand why you're upset, but they're not doing anything wrong. They truly aren't. If you analyze the situation.

They're simply delaying it after you get it fixed. My recommendation is that we have one of our people check it out to make sure it's in good shape. I'm Tom Martine Moore coming up. I understand that its power in this cargo ship couldn't stop. In the video of that bridge coming down, and they're finding cars. They found a car about an hour ago, or a truck and the people that died. Now, I hate to say this, but what it reminded me of is a video I saw of you way back in the day. You look like you're twenty something. On early nineteen nineteen eighty, I covered the Sunshine Skyway bridge

collapse. I was the first one on the scene, bar None and I got there and I picked up my photographer on the way because we were eighteen minutes away. I pulled up on the bridge before they had even cordined it off. And I drove up there and saw that one car up there looked over the edge and mark that is indelibly. It's in my mind. I can never erase it. I looked down and horizontally under the water. In other words, just under the water. I could see Bobby up a bus.

Oh my god, an entire bus. Yeah, and inside the bus were people bobbing. Oh my god. It is so similar. It's crazy. It looked like the bridge you were at. I was watching the video and for folks out there, a couple things. You got to see how similar this is to this recent one. Plus you're gonna see Tom way back in the day. To me, he looks completely different. And if you go to our YouTube channel and just type in Troubleshooter Network on the next break,

I'm gonna actually play that video so you can see it. But you got to go to YouTube, type in Troubleshooter network and hit the live button. But Tom, I mean, it's crazy. I think way more people died on that one. You covered. If I recall this, like thirty or forty thirty two people, I believe it was mark. It was hard, crazy, it was horror hing. Did they pull anybody out? Did you see anybody literally get rescued and live? Oh? Yeah? I interviewed, Well, the one guy that car. You see, that guy ran

back, you know, he got out of his car. I tell the story a lot. He ran back towards safety, you know, down the bridge, and as he got halfway to safety, he realized he did not lock his car, and he ran back to lock his car. That's how much shock he was in. I interviewed him. Then I interviewed a guy who had a pickup truck that went off the end and bounced onto the tanker and he fell out of his truck before it hit the tanker. No, he was, It hit the tanker and he fell out, was ejected from

the truck and lived and in fact was not seriously injured. I interviewed him. I'm razy, yep. And that guy, what was that one caused by this one? They're saying the ship lost power? What? What what caused that? I actually, let's see, I'm not sure, I remember all of the years. I remember there's the tanker ran into it or the Yeah, I think it was a tanker and it ran into it, and of course it came tumbling down. But I'm not sure what I think the

guy may have been even prosecuted. It was so long ago, and I did not bone up on the details I should have because of this incident. But it's so similar. It's scary, man, it's crazy. Yeah, I know it. And and it's it's scary. That's right, that's a good word for it. And it is the thing that it is so similar. Now that bridge did not as I remember, you know, I don't.

I think there were alternate alternative ways over that alternate ways highways in the in the video, it looks like there's two bridges that are independent of each other, side by side, and the first one from the direction the ship was coming is the one that collapsed you're talking about on the Sunshine Skyway. On the Sunshine Skyway. So I think what maybe one direction was one bridge and then the other the other way, or one was old one was new.

I don't know. Yeah, but here's the thing on the Baltimore one, here's what I want to know are they are they saying there's no other way back and forth? What are they saying? I mean, do people have to drive miles and miles and miles and miles or what. It's really bad. I think they're going to just have of course, they got to start rebuilding this thing. But I think they said something like thirty five thousand people a day. It's really nuts. I don't know what they're going to

do. And it's one of the largest shipping areas in the country for containers. I mean, this is going to affect all kinds of businesses, all kinds of jobs. This thing is gonna it's just not good. I mean the death, of course is the worst part, but going going down the road. This is really a bad deal man. Yeah. I mean it's unbelievable. It's going to mess up commerce. Yeah, it's going to have a lot of effects. So in any case, let's talk to Robert.

What shop is it? But the shop is the body shop is my car has been done for a week in a day. Now, Oh, oh, I know what it is? The claim they're not paying it. You said, yes, and my car is ready and I need to get rid of this rental car. Can't afford it three hundred dollars a week. I'm over. I'm over three

thousand dollars plus. Well, you can always pay the body. You could always adopt and go after the insurance company to stop the rental car billing. Oh, I mean my car. I can't afford that. I don't have that kind of money. Did you hear what Mark just said? How much? Hold on? How much is the bill four with my deductibles? No, the entire bill with my deductible thirty four hundred. Okay, and you don't have it to pay one thousand dollars deductible. That's all. What I'm

supposed to pay is five to five hundred dollar deductibles. Well, I get it, so my car because insurance hasn't paid the supplement payment. Okay, So I get the entire claim. If you were to go in and you didn't have insurance right now, the whole claim to get your car would be thirty four hundred. Is that right? Yeah? That maybe taxes. So pus storage day Storage days now stays for storage because it's been over a week and nobody's taking it up. Nobody's calling them back. Did we have Chopper

call Temper insurance? Did anyone call Temper Insurance for you? What are they telling you? Why are they saying they're not paying it? No? No? Yeah, have you been able to talk to Temper Insurance and it's under review for payment. But after they and told the body shoff to do the work, now it's going to review. Huh, what are you talking about? What am I? I couldn't believe it. Do you have an agent? A local agent? We went through this before. Do you have a

local agent's he's what's called. But he has nothing to do with it, you don't. He says he can't do anything. Okay, Robert, respectfully, he's full of crap. Your agent is full of crap. Oh, this is not medical advice. Okay, let me let me ask you some Charles. You have a cardiologist that you want to change. Yeah. His opinion is, uh, he's just looking at my class stall and

my blood pressure and what is he saying? That's all He's checking out the biggest thing he says, okay, But what I'm asking you is this, do you have high cholesterol? I have it own new control with a statins okay, And so are you saying you're wondering about the controversy having to do with cholesterol. Why these old timeline doctors that they said they had it wrong, that clestol is nothing. Okay. Here's what I want to tell you,

Charles. For the most part, okay, for the most part, it's not going to be settled with one doctor or another because there are differing opinions. But here's one thing that I believe, Okay. I don't believe that controlling the cholesterol with a stat and is going to be the end of the world. It's not gonna I don't think it'll kill you. Well, that's sorry. Muscle aches, pain, stuff like that. Yeah, it

can now listen. But let me explain something else. It's there's a lot more to cholesterol than cholesterol, okay, and I don't want to get into it right now, but it has to do with particle size and with certain things. But what cholesterol really is is a healing agent. Cholesterol is a building block of life. Cholesterol is not in and of itself, bad. The reason it became a bad actor in many of the doctor's opinions is because

when it rushes to your veins and arteries to heal them from inflammation. Okay, when it does that, it coagulates there to save yours. It's what it's doing. It's trying to heal your veins. Okay, it's trying to heal them. As a result, you have cholesterol and high cholesterol. But the real villain, truly, and everyone will agree with it, is inflammation, not cholesterol. Cholesterol are the firemen going to put out the fire.

So if you had a barn that was burning and you saw a bunch of firemen coming and you said, oh my god, firemen mean there's a fire, So I'm going to kill the fireman. When you kill the fireman, it doesn't stop the burning. So what I'm getting at is controlling cholesterol alone, if you had an unnecessary build up or an unusual build up, is not going to help the underlying problem. So where the problem is is where people treat the cholesterol and not the inflammation. The number one problem with us

today is inflammation for all disease. Inflammation. What does that mean? It means that our veins and arteries are inflamed, our circulatory system have inflammatory mons why, there's a whole bunch of reasons. The number one reason, yeah, but the number one reason for inflammation, well, there's two big reasons. One is improper dental care. Okay, gums, So I don't have any what's that? I have implants? I don't have anything. You could

have terrible inflammation in your mouth. You could have terrible gums. I don't know what your mouth is. But that's okay. Tent says, I'm all right on that. Well, okay, okay, but most people aren't. Okay, most people aren't, but you're fine. The number two problem I'm going to tell you with inflammation, if you'd like to hear, is glycation. I'm not going to get into a whole medical thing. Look it up. Glycation. It's basically too much sugar. Okay, that's really basically what

it is. Okay, So I don't like I said. So that's the controversy. If you're looking for another cardiologist, I wouldn't because you're never going to get them to agree anyway. I'm a landlord and I've been a landlord for like twenty some years, and I have a question about all of these new laws that are coming up and what all I can put in my lease. So one of my main questions is some of the fees that are allowed. Now we should get Brad O'Brien on for this. Yeah, he's not available today. I already texted him. He's available tomorrow. So a lot of these are not laws yet. The House has the Colorado House has

introduced a bunch of bills. Are you speaking of anything specifically that has been passed. Yes, So one of my questions is is out of the last set of rules that was passed, it was saying that you couldn't put any more fees in there, like lift out any sort of fees. And part of that is so they can get rid of all the junkies, which I

understand. But in my particular lease, I had to fee in there for like a lease break fee, you know, that they would lose their deposit and maybe two month's rent, you know, or I had to come Well way which law But which law are you specifically referring to? Well, maybe I'm just confused. I thought there was a law that was passed that said that you can no longer have fees listed in there that you can't have. That's going back. What that's going back to like twenty twenty, though I

know that's what I'm trying to figure out. What says the landlord shall not require a tenant or mobile homeowner to pay any fee or other charge other than the rent, except that a landlord may require a tenant of a mobile homeowner to pay a U space fee that is described in the rental agreement. See here's the deal. Okay, So I take that that statement, and then does that say that I can not have a lease break fee or that I cannot say, you know, I'm going to charge you three hundred dollars for

cleaning if you don't clean the place before you leave. No. I think if it's spelled out in Tom by the way, it's HB twenty dash one one four one HB twenty Okay, yeah, dash one one four one. But no, my understanding. And now we're going, I mean, really, you're this is like COVID times. You can put like a late fee in there, but the late fee can only be a certain amount. I

think it's like, you know, eighty bucks or three yea. I'm looking at it right here, and I think, Mark, the main deal of this is that they have to be spelled out you can't just if you more of a clarification what I was gonna say, If it's not in the lease and it's not already laid out, you can't all of a sudden come up with a new fee. No, no, mine, We're spelled out in the lease. Mine said. You know it's always best. Did you when was the last time who made up that least for you? By the way,

did you have an attorney make it up? No? I made it up. Well, that's a bad thing to do because you could lose all of your rights when you have to evict people. You need to really get an attorney like Brad O'Brien O'Brien Legal Services to go over It won't cost you a lot to go over a lease and make it legal according to today's laws. You know what's coming up, Laura. Have you heard about the one

that says basically, you cannot evict or terminate a lease. It has to go on and on and on unless you have a specific cause and they outline what the causes are. You can't. Even if you just don't want a lease anymore, you can't do that. Our governor's not going to sign that. As much as I can stand the guy. There's no way. I read about that too, and I have a question about that too, And then what if they're just are that's not a law yet? What is your

question about it? Well, the question would be if they do pass that, and I have people that are on months to month, which I do that on purpose. Once their one year lease expires, I just keep them on months months, because then no, month to month is no longer. Month to month, month to month is forever unless you want to move back into your property. Under certain circumstances, you can't just say, hey,

my son wants to move there. You have to have a good I don't want to go through the law, but you have to have a good reason to get rid of them. So you can't just even if you just want to get rid of them, if you don't want to rent anymore. I have to correct you there time. It's not a law, No, that's what I meant an act. Yeah, it's a bill, right, So it's not a law yet, Laura, Yeah, but when it, I guess when it becomes a lot, then you're saying there's no more months to

months. So then if so, then I would have to well, no, there is a month to month. There is a month to month you can terminate at the end. See let me explain this. If you had a one year lease under the new if it became a new law and you had a one year you would have to deal with this at the end of the lease. If you wanted to just trade tenants for a better tenant or a friend or a neighbor, you can't do it. If you want to just take your property back, you have to have a good reason. Okay,

I'm just telling you the law gets into your rights. Now. If it's month to month, the same thing, you you get to address it every month. So it is there's still a benefit to having a month to month Okay. So for then when you say that, so the new proposal would be that you have to give so many ninety days notice. So my question on that would be no, that is not no. No, it has nothing to do. There are some notice requirements, but that is not

the real That is not a big deal. You still have to give notice requirements. Now you know this. Guy Dave hold on Guys Dave on a YouTube says that the Republicans have inserted an amendment that permits in a eleven month quote trial period for new tenants. They can be evicted without cause before twelve months. So once again, this thing is just negotiations at this point.

Yeah, I wouldn't even worry about it now, Laura. So going back to the question that I have from the from the last thing that passed during COVID, is there anything that, like, is it legal for me to have in my lease that says, you know, if you break your lease, I'm gonna charge you. We can't. We can't tell you that, Laura. We can't tell you that. Specifically, you have to Everything in there about fees is highly regulated. You have to do it according to the

law. You can't you can't even evict someone for fees. Let's say they have a late fee every month and they never pay their late fee. You can't add interest to them. They can only be a certain amount, and as long as they've actually paid the rent, not the fees, you can't even evict them for nonpayment. My suggestion, what we're trying to get We're not trying to be koy here. What we're saying is this, in general, you can charge many, many fees, but specifically they have to be

worded and you have certain limitations of rights. When it comes to enforcing them, it's best to get an attorney to go through your lease and make it legal. So in general, yes, you can charge fees, but you have to do it in a very specific way. Three oh three seven one three talk three oh three seven one three A two five five. One of the big deals, whether it be an annuity, or whether it be savings, or whether it be an investment account, one of the big deals people want is to have money can draw out. If you simply exhaust an account, you will run out of money. Most of the time. You won't have enough money for retirement unless you're just ultra wealthy. Or here's the deal, if you have certain ways to preserve that money,

it could last you. Our PCE center does what they call the three bucket solution. That's one of their strategies. Explain it in a really stupid way for me, and you know what I mean, very simple and briefly, what is the three bucket solution? Definitely, so everybody's got money in multiple places, but there's really only three main areas that are that are there.

You've got safety, which are things like money in the bank, CDs, money market accounts, things that are liquid and accessible and ready to go. Could an annuity be considered safety or not? We don't put it in the safety okay, okay. So the second bucket is income, which is where an annuity would fit. Other income producing assets fit there. This is where we will put your social Security, if you've got a pension, or maybe some dividends yep, things that generate income. And then the third bucket is

growth. The growth bucket is where we put money that we're going to need but we don't need right now. For income, what I prefer to do and what we do at Retirement Planning Center is we'll get income set up. So you've got Social Security and if you've got any pensions, whatever, and whatever the case, you got income. But we want to make sure that you've got as much of your income guaranteed as possible and as much as you're comfortable with, so that if the market does crash, we're not relying on

money out of the market to cover the income that we need. What that allows us to do is have time in the market with the money that's in the market and not have to worry about relying on that for income during retirement. It makes a big difference as far as how people can sleep at night, and it helps people make that money less than in three different buckets, correct ye anyway? Did the irs basically say you could not file your tax return because it has uh a social Security number that has been used. My tax lady just took Blake off of my taxes and then it went through.

So it went through, but it only went through with Oh, but it only went you through with you in other words, in other words, you had to do it, did you, Well, did you list Blake as income or did you do it totally without him? Uh? Well, she just took him off of it, then off of my taxes, and then I went ahead and she went ahead and filed them for me and it went through. But well, I understand that, but did you do it asn't? Did you do it with only your income or did you do it for

the household? Yeah, we did it for the household. We did it okay, so you did accomplish its disability. I might so have a disability. So this is what my tax lady said. She said, just so you know, the difference in your federal return was about twelve hundred dollars after removing your husband. I would try to find out who is claiming him. Oh, in other words, you would have gotten twelve hundred dollars more.

But most of the time, unless you can show and prove your case to the manufacturer, King Supers has no liability at all. It would be the manufacturer. What King Supers is doing is a good will gesture. If you want to take the three hundred, go ahead. If you don't, you would have to go and sue the manufacturer. The manufacturer, but you don't have any information

anymore. You don't have the proof, you don't have the evidence, You have nothing, and it's too hard to reconstruct it, and it would be too expensive because no attorney will take it unless and even if they did take it, there's not enough money there to justify a personal injury claim. So this is one of those weird cities situations where it's probably not worth it to pursue it. And I know that you don't want to hear that, but I have to tell you the truth, all right, Okay, I was

just kind of bouncing it off. Yet That's why my mother once broke her tooth eating Swanson's frozen chicken years and years and years ago, and my mother thought they should pay her the world, and I said, Mom, it's only worth what it's worth. It's it's you're not going to get anything. And it was a bone, which is a normal it was supposed to be boneless. I think it's something. to do. First, they're trying to save money, but they're also doing what's called comparative negligence. Do you know what that means? No? Well, what does this sound like comparative negligence? What they're saying is they're saying you were responsible for about seventy five percent of that, and the other guy was responsible for twenty five percent of it. Now, that's totally arbitrary that

they just make that up. And the reason they do that is to save money, or they do it because they don't think the other person will fight them on it. So what I want to know is how is this affecting you? Well, if they only pay seventy five percent, I'm concerned that the other party will come after me for the other twenty five And you're absolutely right, they can. But most of the time they won't pay out that seventy five percent to the other person. In fact, they have to protect

you, so they would get a release from that other part. So the other party would not receive the seventy five unless they said, okay, we'll settle for that. That's that's my understanding. I have never seen that happen before where they leave you exposed. Okay, but I want to make sure hold on, hold on, Billy. It's really easy to make sure. You ask them what insurance carrier do you have? Unfortunately it's all stake. Okay, Okay, ask them if they're going to get a release from the

We went all the way up to the corporate level and they have denied it, and they said unless he can come up with some different or some new evidence that wasn't presented, they are not going to Now what evidence did he have, if anything, I don't remember what evidence is specifically, Tom, but I remember I was sort of in the middleman I was connecting him with Yeah, I get it. Yeah. So we sent emails to uh Cluppard and they he sent his claim in and they denied

Well, I sid my turns mention went out on my truck. I thought I had done my research. I found Cotman

Transmissions. I took it to them. He called me the next day, calling me my vehicle was retired? Which Cotman did you? Wait? Wait, wait, which Cottman did you take it to? I started on the one on Broadway. They're both affiliated. Okay, so I took it there. He called me the next dage only it was six. I picked it up within a day. Now, how can it be fixed? The next day? What did they say was wrong with me? He told me that he had repaired the whole transit. They had replaced the transmission. Wait a

minute, wait a minute. Overnight I took it. I had it, towed it there and overnight. Yeah, and he said they rebuilt it or did what to it? He said that they had rebuilt it. You mean, not rebuilt the one in there, but exchanged it for a rebuilt Huh. I believe he told me they had built it, it was fixed. I don't know a whole lot about cars, but he told me he was

fixed. I take three dollars three thousand, okay, okay. So the next day I had another transmission figure light come on, so I took it back there and they told me they had fixed it again, and the same thing happened two days later. Well this went on about five times that I had to keep taking it back and all within you know, it would run a day or two and that was it when the light came on. Did you have a failure? Yeah, it was always a failure. So eventually

how many times did they attempt to fix it? Totally? Like five? This is crazy? Then what happened? It is so I actually got a hold of the Better Business Bureau and that's that's like call okay, that means nothing. So let's get to the real part. Apply to me. They replied that to me. THEYD reply to me, and Topman said that we would take care of it. He told me to bring it down to the shop over in wheat Ridge. Oh I thought, okay, I'll give him

a shot. I took it down to the wheat Ridge office or the wheat Ridge shop. So now this will be the sixth time at least, and I took it there three or four times still, so basically they've tried to fix it a total of how many times I would have to say nine? Okay, So where does this stand right now? Well, it stands right now that the second to the last time, the owner of the manager of the shop told me that I had a misfire, so he told me he

would not repair it again until I took care of the misfire. Well, what did do fire have to do with their transmission? Don't know? He told me that's what was causing my transmission to go out, but it would only run two or three days before the transition would go out. So the last time I had a toade over there, it cost me over a hundred

dollars. Can you get Jeff Kimer on? It cost me over one hundred dollars I had a toade over there, And he tells that's when he told me he would not do We could not move forward with any repairs until I had the missfire taking care of. Got it. So I finally got all that done, and not all well done? Got all what done? The engineery chair, the pits fired by who a friend of mine, because I couldn't take it anywhere it wasn't running. It was here my parking lot like

all that time, so my case. So was there truly a misfire? There was a mess fire. One of the it needed spark plugs, is what it. But you know what, the first time I took it around to Cottman's I paid him one hundred dollars to do as park puck change here. Okay, I get it. It's getting complicated. So right now, though, after the misfire was corrected, what did Copman do? He told me that my warranty was expired and he would no longer take care of it.

How long was it from the time they attempted to fix it the ninth time to the time you took it back after the misfire? Probably about three months? How long was the total How long was the total warranty? The total warranty was for a year. But we're talking to I. No, wait a minute, so hold on, if the Darryl, when was this? Let me get back to the important thing. I should have asked this in the beginning. When did they fix it overnight? What year was the

date was that it was two years ago. It was a December. Well, bro, Bro, you didn't tell me that in the beginning. That was two much Really, that really shouldn't matter because I got well, I got a letter from the manager of the shop stating that as soon as I got my answers taken care of, he would do the repair. Yeah, but here's what I need to know, No, Darryl, Darryl, listen, one step at a time. Okay, you got your transmission done two

years ago, then it started failing nine times. How much time did the nine times take? Oh was over? It was over like a year and a half. Okay, And that fixed it nine times for a year and a half. Okay, okay, So that okay? And so really, then the transmission didn't fail every time you got it back immediately you did get used. No, no, no, it did fail. It did fail, but every time, but then it did it fail as soon as you picked it up? As soon as you picked it up, Well, then

the box rounds maybe a week. But how did that if nine times lasted a year and a half, okay, what was the total miles you put on that transmission after they fixed it the first time? What's you know what probably I probably didn't put on more than maybe a thousand miles, if even that. Okay, So after a year and hold on, after a year and a half, you then had the misfire fixed. Tell me what the minimum and maximum would be on repairing something that was damaged from a misfire. Give me a range, well on the unit. I'm just assuming that I'm talking about the correct unit.
