All you have to do is give me a call at three all three seven one three talk three all three seven one three eight two, five to five.
What's going on in your life? How can we help you? I just have one thing to say, really, and I'd like you to just pay attention because this is, uh, it's kind of serious. Okay, so hang on a second, just be patient because I think you'll like what I have to say. You're ready, You got the whole My memory is fine. No, when the fall, No, I guess I just forgot when the report made several claims over mister Biden's mental Competcency. You said at
the table, there'll be time enough. A well meaning elderly man with a poor memory. My memory is fine. There you go, there you go. Now. The best we have to offer this country is him and a malignant narcissist. I can't believe you. What nothing? Do you think we have good choices? I'm not here, I'm not going down. Do you think we have good choices? Mark? Or are you just picking the lesser of me? I love when Biden screws up you and every other pun din
out there. I'm not a hash to throw Trump involved in it too. He can't sit back and just take his own crap. I'm not, I'm not. I'm not exactly what you can. You say that we have two great choices for president. You can do you can do better on American Idol. We would do better. We would do better choosing a president on American Idol. Just ask people to come and and and and audition walk that line.
Hey, Tom, I have a question for you. Would you rather have a donnering old man for the next year or a giggly idiot if the vice president takes over? I didn't look at first of all, I said we have no good choice. That's what I said, didn't I I wasn't saying we have one choice that did a lot of great for this country,
whether you recognize it or not. No good choices. Look, if you want to Look, I'm not saying that the politics were not better, or the or the Congress didn't do I'm not I'm not saying it when I don't even they didn't Actually the economy wasn't really that was The economy wasn't really that much better. Yet, listen, I'm not for Biden. I'm not for Trump. You don't like it? Do you? You hate when people actually speak truth, don't you? You actually hate it. We're talking about Biden,
but you have to bring up Trump. It's absolutely what I said was we'll be on MSNBC. What I said was there's no good choice. You don't hear that on MSNBC. They love Biden. Everyone loves Biden. I am saying we have no good choice. If you tell me that you believe that Trump is a great man, you're full of trap. Okay, and he wasn't a great president. And you want to know the truth. If you really look at facts and not your political leanings, you will see that
we don't have a good choice. That's all I'm saying. We don't have a good choice. I think we should be ashamed of herself. This is either are the two best people we can set up and anybody, anybody truly examining themselves, would say that. Am I saying that one wouldn't be better than the other. Of course I'm not saying that. Of course there's always going to be one better than the other, depending on your leanings. Of course there is. But if you look at the fundamentals, tell me,
tell me what Tell me what was so much better? You know? I mean, come on, when you really, Mark, do you really look at him and say he's a great man, either one of them. I'm not going down your rabbit hole. Man. They told the guy that he was what. He had hookers pissing on him in Russia, and that was his first year of his presidency. They tried to set the guy up in every possible way that if anybody could imagine. Of course, of course he's
the bad guy. Mark. I didn't say he's a bad guy. I said there, but we have a poor choice, That's all I said. We have a poor choice. No matter who you pick, we have a poor choice. Is better. I remember the name, by the way, but I don't deny. Today is kid die And I listen, see Mark is making He's making his pontifications. What I'm saying is this. We don't have a good choice. I am saying is one better than the other?
Probably, I'm not saying another thing. Did they do we have a country that is out of their minds when it comes to derangement Trump Derangement Centem. We absolutely do. There are people out of their minds. I I'm the one who brought it up the day after our couple of week or two after when when Trump was elected, they had a million women in March talking about how they lost their rights and not one right was sacrifice, not one.
Nothing had changed. People are deranged, But that still doesn't take away from the fact that the man is a scumbag, just like Biden is. They're both scumbags and we're putting them up as president. And if you don't like hearing that, I'm sorry. They're both scum three all three seven one three talking. But Mark, I know you disagree. I know you love Trump, you think he's a great man, but I don't. By the way, I don't think Biden's better. Okay, I don't think he's better at
all. I think Biden is a sorry excuse for a president, along with his crooked, corrupt son and family. I really do I believe that man is so corrupt. So you know what, four time, you know that's going to be a hard choice. Maybe I'll just write in Mickey Mouse or maybe no, no, I don't like Disney either, So who the hell do I write in? Let's let's all write in Mark. Yeah, god forbid? John? What's going on with you? Man? What's happening? John? Let's talk, bro? What's going on with your flooded? With
your house? I hope you didn't get flooded. Yeah, well, you know, uh, right before Thanksgiving, our upstairs toilet valve ruptured while we weren't home, and so well that's good because a flood wouldn't be covered, but a broken pipe would. Yeah. Well yeah, every day everything's going good. But you know, my question for you is, like, like service Master came out, they did a good job, and you know,
they found some asbestos. Of Meridian Company came out and they did an awesome job too, And then I got a they had to come in and do a the rebuild and the guy that they kind of recommended, uh who record? Wait, who's they recommended? Oh? I just service Master? All right, how did you why did you call? I'm just curious why did you have service Master come out? Well, because, I mean it was
it was kind of weird. We got American Family, you know, it's it's linked into our mortgage and okay, no, no, it's not linked in to your mortgage. You have American Family. An American Family is a company you chose. An American Family is one of the worst companies you can
have, and they recommended Service Master. Is that right correct? Do you think that American Family, the suckiest, one of the suckiest insurance companies alive would recommend the greatest restoration company to spend the money they needed to spend to make you one hold? Do you think they would Who do you think an insurance company will recommend I would hope they would. Yeah, but they won't. Okay they won't. They're gonna find the quickest, fastest, and cheapest.
Here's the deal. Service Master wouldn't have been my first choice. Am I saying they're lying sheets and crooked? No I'm not. I'm just saying they wouldn't have been my first choice. American Restoration twenty four to seven would have been, or or any number of companies. But here's the bottom line. Service Master has no business recommending a restaurant, somebody to build the come to rebuild. So you had American Family recommend service Master. Now you have
service Master recommend a contractor. So who did service Master recommend for the for the contracting, Well, they recommended like Ati and a bunch of other ones. But I went ahead and got my own. Oh good, So you didn't take service Master's recommendation. No, no, no, But my question for you is, good, who did you end up with for rebuilding? Aga? Construct? But the estimate, the rebuilt estimates like sixty thousand,
and he's he's asking thirty thousand dollars upfront from the insurance. Goodbye, goodbye, goodbye. That's what I say. Goodbye, Now that's what I say. Yeah, not to you. But why would they want that? How would you justify that or anybody justify that in your own mind? John? You know? I you know, hey, John, how did you? I got another question? Service Master did not recommend Ata. How did you find him? You mean? Ati? Ati? I'm sorry? Ati? Yeah, yeah, Well you know what it was was the Uh, I'm
just asking how you found out? I just called I just started looking at like in Google and really so there was no recommendation, no references, no nothing. You just started looking at Google. Yeah, well be because had never been through this before with our house. Hey Tom, I buy the hold on. I'm a little confused. I look up ATI. They do do reconstruction and demolition. But they're they're basically the same thing as service Master.
I don't right, they're a restoration company. Well, see what it was was they when the service Master came in and then they after they got everything dried out, and that was kind of a mess too, because they you know, kind of melted a wire from from my two twenty from the house to the roof, or from the pole to the roof, and they fixed that, but they found asbestos. So Meridian came in and they did this asbestos mitigation. And who called Meridian? Who called Meridian? I did?
I did? And how did you find Meridian? Well we do that. We do their autoblasts. Okay, good, okay, you know them. So did they do a good job? Yeah, they did an awesome job. And then they did a bunch of flood cuts and you know, they did this I'm calling I started I started in the of uh the phone, you know, the Google whatever for rebuild and this guy Kyle from uh kg A. You know yeah he se he seems pretty good. Hey, John, what's the problem. Well, they want half. You didn't hire
them. Did you sign a contract with ad I A T I. No no, no, no you mean kg A No no kg What the hell you just said? You just said A T I you hired to rebuild? No? No, no, no you missed them. No, it was the kg B A T I see I had I had to get I got like three or four different estimates. Okay, hold on, before you go on, John, before John, before you go on. I'm just a kind elderly man with poor memory. So let me go over this. And
on Thanksgiving or right before Thanksgiving, you had a flood. Service Master cleaned it up and discovered asbestos. Then you called Meridian to mitigate the asbestos. After you did that, who did you hire to rebuild? I haven't hired anybody at we're doing the estimate. Thank god you did. Thank God, because I'm going to help you do the right thing. Thank you God that he did not hire someone. Now, what are your questions? Go ahead,
sir, I'm sorry, keep going. Okay, the questions I have are I mean, because are some of these companies that are asking for like half down, but nope, I don't. I don't like doing any money down there. Well, you can do some when they start work, do not put half down. I don't care who they are. Yeah, but they're doing it like they they they're sending the bill, they're sending the estate mens to the American Family adjuster. Man, it's just everything's just taken.
Okay, Here's what I want you to do, John, Here's what I want you to do so you don't get ripped royally. I want you to call Matt. Listen, just listen, bro. Call Paragon Services, Matt Stanford, a public adjuster. Let him review your claim. You would be better to get him on your side because you will never, and I am saying, never be treated fairly by American Family. That's number one. Number two. Only hire good contractors that you can check out that do not want
fifty percent down, and preferably someone on my referral list. If not, just don't pay fifty percent down. Period we have. If you call mad Up, he can probably connect with Genesis. Genesis can come out and actually do all the estimates, and then Matt knows every nickel he can get It's gonna be your best deal, and Genesis will do a great job on your house, and Matt will get you every penny. It's the best way to deal with this. Please do what we said. If not, good luck
on losing your money. Three oh three seven to one three talk seven one three eight two five five. Give him the number for Genesis. Please, we got more coming up. You know I like to think of myself as impartial. I get a text here saying Marcus right, the Trump economy was way better by saying that the economy isn't better, or excuse me that Biden's economy isn't wasn't it, or Trump's economy wasn't any better. You're showing that you're economically ignorant. Well, thank you. If you want to text me, you can go five seven seven three nine. I absolutely, honest to God, have no dog in this fight. I want what wants. I want what's best for everyone.
But let's just take some things in job gains, job gains. Now, this is coming out of co That's exactly right. Mark. I know that I'm not trying to make a case. God damn it, I'm not trying to make a case for either one. They watched the Come on, man, I'm just saying. I'm not trying to make a case. What I'm saying is there was more job growth under Biden than when Trump. When Trump took over and Biden took over. Obviously Biden was taken over after COVID
there had to be one. The unemployment rate the same lower under Biden. Economic growth, the gross domestic product grew more under the under Biden in his first couple of years than than than Trump. But Trump then afterwards was hampered again by the pandemic. Gas prices were better under Trump, way better, and doubled under Biden. If you look at home prices and accessibility, you have more people buying homes under Trump. More people could own home homes and
afford that. Mortgage rates swored under Biden. How about just basic stuff like bacon, bread, eggs. I was just gonna say inflation. Inflation was a persistent challenge for Biden. Trump kept it under If you want to give them credit for every the reason it's a challenge to him, though, is because he's the one that created it. He was giving money out like candy.
Disposable income, Okay, disposable income. People had more to spend under Trump with disposable income than Biden. The stock market has continued its steady ascent from Trump through Biden, and any ups and downs were about the same. So there's no real change in the stock market. I mean, Trump said the stock market would tank forever and it didn't. Student loan debt, well, guess why student loan debt is down. Guess why? Because Biden wrote
it off with my tax dollars. Exactly, consumer sentiment. I just paid for someone's degree in bs. Now listen to this consumer sentiment. This is amazing. What do you think the attitude is of Americans right now? On the despite the economy's strength, Americans appear despondent when it comes to the feeling for America. However they hate America. Well, no, they're despondent about the future of America. The sentiment under Trump, now, this is one
thing, truly, I must admit. Under Trump there were very high consumer sentiment feelings about the economy and about the country. And even though hold On, even though he had low ratings, with Biden, who has even lower ratings, the sentiment is at an all time low for this country. And again, I can't say one way or the other. The federal deficit peaked under Trump. Both he and Biden have added trillions to the debt. It peaked under Trump. So I'm looking at all these factors. I'm not saying
one was better than the other. It's definitely a mixed that is a muppet at best. One has no brain. Who do you want on the code? Now? The only good news about Joe People are going, oh my god, we want this guy in charge of the nuclear weapons. He's got the football. Well, I want to put everybody at ease. There the guy already forgot the code, so that part doesn't matter. Pressure. Hey, Dennis, you know I hope, honest to god, I really hope.
When people hear me asking questions and bringing up things on both sides, here's what people do. They immediately think I'm sneaking in an agenda, and it's it's just not the way it is. You See, Mark can't have a thought without having true good and a bad. Can't Mark. You cannot biden without a winner? Mark, Why good and bad? Loser? Winner? He does not have a thought that actually considers all elements. He has to go one side or the other. You're either good or bad. You're
either up or down. Yeah, that's the way it is. Mark. With you, you you just don't look at everything. Yeah, win or lose. Maybe he's a better way. What's going on with you, Dennis? What's happening? I got my father in law was about to die in Arizona, and he has a lot of property and vehicles and stuff like that, and he's had his girlfriend for two years. So my wife just went out there yesterday and she called and she called his girlfriend about the cars.
He has like seven or eight cars, and ATVs and boats and stuff like that. And she said, well, you don't have to worry about any of that. It's all mine. Okay, Now I'm gonna tell you a few Hold on, Dennis, just hold on one thing at a time. Did he hold this woman out or ever talk as if she is his spouse just a girlfriend? As far as we know, she's getting the house.
We already said she could have the one of the house. I'm not saying listen, Dennis, I'm not asking anything about what you guys have agreed to. I'm asking some straight questions. First, did she ever consider herself married to him? Probably? I'm going to tell you that if they claim, if she claims she was a spouse, you have one set of problems. If she was not a spouse, you have another set of problems. She could be just an air Now. Is there a will? Yes? And
in the will? When was it? When was it the latest amendment or change to the will? That thing's probably six or seven years old. I'm not sure she does the will name her in anything? No, okay, only just three kids. Then let me ask you something. Why did you say we agreed to let her have the house. Why would you do that if this woman knew him for two years? By the way, how old is your grandfather? Is your father in law eighty four? How old?
How old is the woman? Seventy seven or seventy eight? I think okay, I mean it's okay. I just want to make sure it wasn't some kind of hustle. I don't think it is at this point. But in any case, what do you think. Why are you saying you're going to give her the house? Why? I'm just curious. Well, because he's been sick, he has cancer, So why are you giving the house to the girlfriend of two years? Well, he said he wanted to give it
to her. Okay, you're a good man, because you know what, without that in writing, that would be very difficult for anyone to know. So that's you're a good man. So you're going to honor your father in law's wishes and sign the house over to her. Right, Well, if he already signed it over to her at the courthouse. We went to the courthouse in Arizona and they did the paperwork on it. I guess when did they do the paperwork when he was dying? Yes? Yeah, well he
screwed her. Boy, he screwed her when it came to taxes. But you don't care. He totally screwed her. Let's talk about another thing. All of the other vehicles and stuff, she says, our mind. And how does she stake that claim? Well, he pays cash for everything. How does she stake the claim that they are all hers? That's just what she told my wife when she called and said, well, we need to because they have he has cars in a storage place, he has cars at
somebody else's house. He had and who are they titled to? Who are they titled to to? My father in law? But she, okay, then there's no way she can get them. Okay, but you have to go there and open a probate. And I'd put the house in it. Man, I don't even care. I mean, that's crazy. She's telling you she's going to keep everything, But you guys are so nice, you're going to give her the house. I think you're creating your own issue.
I think that's a point mark of negotiation. I think you're right. But she already had the house. He signed it over to her. Oh that's right, that's right, he already signed it over. I forgot about that. She swooped in in two years and it is going to get everything. Oh, I know, I know, But listen. If they're titled in your dad's name, she can't retitle them without probate. You have to open the probate and the will, will, and the and the law of If
they're not mentioned, then the ordinary laws of inheritance will take over. She will not. And even if she says I was a spouse, she's only entitled to five percent a year. Okay, now the house has already been turned over. You need to get someone who knows about law in Arizona and go and open probate. Have you done that yet? Oh she's my wife's only been out there since two o'clock last night. Okay, good, Have her find a good attorney out there and open probate. Why do I say
she needs to open probate because if you don't, the woman can. Well, she's already moved all the vehicles, she's hit them. Well, that's okay, but the courts can order her to make them available for transfer. She cannot take titled vehicles. What about bank accounts? Were there any bank accounts? Yeah's we went to the bank and where most of his money is and at first bank, and they said they didn't like the way the thing was signed, so she couldn't say anything until we get a death certificate.
No, here's what I'm asking. Whose name are the bank accounts in well? Obviously my father in laws on both bank accounts, but I think she's on one as well. Okay, if she's on it and it's titled as either or it's her money, you're not going to change anything he did when he was alive, You're not gonna do it. But anything that's titled to him, including bank accounts, goes to the estate. Now, if you have any other questions, give us a call. But that's how it is.
If she hit anything, the state can hold her in contempt for not revealing it, but you must open probate. Anything titled to him belongs to the estate, no matter what she says. Hi Tom Martino. Here, by the way, jobs grew way higher than expected. The US economy added like three hundred and fifty three thousand jobs in January. Pundits for saying it wasn't going to be that much, but anyway, the stock market's way up too. We were going and if you're just tuning in, no, I'm not
blowing a horn for Biden. I was going over both accomplishments when it comes to Biden versus Trump, and we were talking about the economy in general. There does seem to be more economic indicators in Trump's favor. When you went over all of them. We went over them, and these are from like the New York Times, Washington Post and both kinds of both rags, by the way, not just or on both sides. And I'm trying to put
together information. But jobs are doing very well as far as number. I don't know about the quality of jobs, but a lot of people say that the jobs now are a lot of them are remote and offer people maybe a little less paid, but more flexibility. And of course all of that was spawned by COVID. COVID changed a lot of things. But I would love for you to text me or to call because this is the ultimate consumer issue. What's going on with the economy. One guy says, Tom, thanks
for exposing the terrible economy under Biden. I don't know if I did. I just went over economic indicators on both sides. And then another one says, you admitted that you're old and forgetful. Just add grumpy and you have a perfect description. Damn, thank you very much. The other one says, of course, you know, Tom, You're going to be half wrong no matter what you do, because the country split. And that is absolutely true. In fact, I think that more people hate it when I don't
take a side than when I try to bring out both. I said, we had a very poor choice for president. We do, and I think we could have done better on American Idol. What we do is we have people come and we have a committee and maybe they they interview these people. Do you think Russia? Do you think Russia would have went into Ukraine under Trump? Or do you think any of you know what a lot of people, you know a lot of people ask that, I don't know. I
mean the world that's another thing. The world stage did seem more stable? Do you think it made cause? Do you think it was because of Trump or just coincidental? Of course it was because of whatever president. When it's stable, it's not just him. The problem is it's unstable right now. You realize Biden just came out and said that Israel's going over the top. Now, I mean, all he's doing is pandering. We know he doesn't actually well I was going to say he doesn't actually think that, but that's
not true because apparently the guy can't think. Now. Steve has is a business owner and he has an issue with a customer. High Steve, what's going on with you? What's going on? Steve Hi? Hi? Tom. Hey, I'm a long long time listener back from the eighties and first time caller. What kind of business do you have? Man? Thank you for listening to. What kind of business? It's called my private Patio. We sell privacy fences and oh like bamboo planner, anything that's privacy for the
patio. Okay. So yeah, So anyway, back in December, a customer ordered a one of our composite fences, quite a large order, like eighty nine hundred dollars, and you know the anyway he paid for it. I shipped it out and it was eighty nine hundred. Yes, I mean, where's that person from Chicago? Okay, so you're online? Yeah, online? So he got it online. We exchanged emails back and forth.
I shipped them out the product, and just recently last month, he's my Square payment processor said that they took the eighty nine hundred dollars back, said the cardholder doesn't remember making the charge, unaware of this charge. So I had to dispute that with Square or Square disputed it on my behalf to the cardholder's credit card company, and they came. You know, I sent all this information back. I had ups pictures h Steve I have to ask something.
I have to ask something. He says he doesn't recall making the charge. Does he deny getting product? Yes? He well he that's I don't even know. I can't call him. I can't. Why can't you call it? Oh? His phone numbers being off? You know where his house is? Wait a minute, you got a phony phone number in the beginning, probably, I mean, you call it and it just says it doesn't accept calls, probably from you anyway, So what's going on now? Well,
so I sent all this information. I have email strings of us talking back and forth. You know, he has a billing address and a ship to address in Chicago. So I had sent to all this dispute information with ups tracking numbers, pictures, blah blah blah blah. Yeah, you know, there's there's a good possibility, guys, that it wasn't this guy. His credit card got stolen and he's a victim. Yeah, especially if if the ship to address is way different than the billing or if he's not around

as can show Shooter's gonna help come Man six is the Troubleshooter Show. No Tom Martinez, Hi Tom Martino, your troubleshooter, Welcome to the show. Three oh three seven month three talks seven one three eight two five five fighting for you and also trying to help you through rough times. We have a business owner who sent eighty nine dollars and stuff and the charge was contested. He doesn't know where his stuff is. He can't get a hold of the
person that made the charge. By the way, this happens all the time. However, many credit card companies will at least look into it. But I need to say something. The credit card company itself is not the arbiter of who owes what. They are simply deciding if they feel comfortable billing the
customer and collecting the money. There have been many cases where a credit card company lets a customer contest a charge and the charge goes away, but the business owner can go directly after the consumer and sue them for the money. The debt does not go away when the credit card company makes the decision. You've got to understand that that is not the final decision. We've had cases where with utilities and cables and phone and sells and other things, the credit
card company simply contested the charge and let the consumer have the credit. The consumer thought they were off the hook, but the creditor went after the consumer and won. So that first and foremost, that arbitration between the credit card and the merchant and the consumer is not the end all be all. It's not a court of law. So the question is you're out eighty nine hundred dollars for merchandise you sent out. So Steve, where did the merchandise.
Go was it signed for? Did you do any investigation? No, it was not signed for. And from now on, I'm gonna make sure when I have large orders that they're going to be someone's going to sign it. But yeah, I mean it was delivered. I don't know if I should if police could get involved at all, well, sure they can if in fact, do you think something's going on? Did you look on Google or anywhere to see where it was delivered? Is it a warehouse? It is
address. I have the cardholder's address and the delivery address, and they're both in Chicago. They're you know, they're, oh, I don't know, thirty miles away from each other, but I have the delivery address, and man, I don't know. It would be cool. Now, let me let me ask you them the person who bought this, Are they a business or an individual individual? And did you look into that individual? Yeah? I don't know how to contact him. I googled his name. You know,
I just don't know how to contact this guy. You did you? Did you get number for him? Yeah? I've got a number when he made the order online. But the number is bogus, right, Yes, you know it sounds to me like it's you were a victim of fraud. Oh, absolutely, but you your loss is the cost of that furniture and shipping. I don't understand how you take eighty nine hundred retail and call it a loss of seventeen thousand? Can you you were right about that? Yeah?
Okay, so your loss is the cost of furniture seventy eight plus you're shipping, right, Yeah, how much is that total loss? It's it's like seventy nine hundred, you know. Frankly, I don't know how businesses don't this doesn't happen more. I've heard of many many businesses being stung with you're going to see it. You're going to see it happen a lot more. Yeah, you got to take the physical card, man. You basically you just don't take mark if you take the physical card. Since we're in
the processing business, tell me how that changes things. Well, they know the card's present, so therefore you're going to get paid when you take it over the phone. You have no idea who you're talking to and whose credit card it is. You simply don't know. Or an online company though, or an e commerce company, and you know we we've done well, then what you would have to do is what a lot of e commerce do.
The only place they ship to is the address on the credit card. Okay, and you do get a signature, you ship it to the address the billing address on the credit card, and you make sure you have a signature. All right, that's good advice. It just sucks, man. I mean I feel for you. Man. I almost got stung like that years ago, same exact thing. I got lucky and didn't the stuff out at the last minute. But it happens all the time. And here's the bottom
line. Someone paying with the credit card, even if it is their credit card. A lot of gambling sites, and I don't mean FanDuel, I mean the offshore ones, they get stung all the time. Someone that actually has the credit card will deposit money in it, they take the credit card. Remember we're dealing with someone overseas. Then they say the credit card was stolen after they lose their money on the gambling site, and it gets reversed because there's no way to prove if it was stolen or not. Yeah,
it is terrible. And this is the same reason I give advice out all the time. Tom Where if you legitimately got screwed by a company and you did not give them the physical card. And I understand people are going to say, well, that's not fair. You're lying. I don't care if a company screws you, regardless of what it is, and they took your credit card over the phone. You don't call up your bank and say, oh, well they didn't build the fence high enough or they didn't do the
flooring properly. You don't say that at all. You say this, I have no idea what the hell the charge is. And guess what you're going to get it back? Yeah, I know, I'm telling you. It's it's really a gamble, Steve. I'm sorry this happened. I don't I can't think of anything that could get that money back, or that that stuff back, that merchandise. I mean, unless you had someone in that city
investigate the delivery place and go after him. Somebody got that stuff. Yeah, and you're chasing you're chasing a ghost and you're not chasing it on your own in your own neighborhood. Man, You've got to fly out there. You got to do the leg work. It's crazy, it is crazy, and you just got to chalk that up. Again. I'm just shocked that more and more people are not burned by this. Three oh three seven one
three talk Thelma, what's your issue with taxes? Okay, last year I was working at this company and when I got my deputy form, I didn't pay much attention to it. I turned it over to my CPA and then he called me and he said, you have two social security numbers, and I said what, And then he gave me the number, one of them with my telephone number or the other onom with myself security number. So hold on a second, Thelma, Telma, was this your tax preparer? Yes,
he said you had two social security numbers? Yes, the one that I worked for had given me a deputy form with my telephone number on it by mistake, obviously a moron. So so what did you do about it? Well, I would working at that company, so I got ahold of my boss and he said, you take care of it. So now I get my W two form phone. So I only woked about eight a month last year. And then I went to another job talk at my W two for them and I look and oh, my SOD security number my telephone number.
So I mailed it back to them and I wrote on them that they had made a mistake. Then I get the the other W two for them, and it's still got my telephone number. Now do I keep pounding this guy head into the numb You know what, I'll call over to this jump get get me the number. I'll call over and get you a W two. This is crazy, Let's see. I don't hold on a second. I want to ask you a couple of questions. Thelma, okay on your ten ninety nine's okay? Yeah? If you simply reported the income and did
not correct it, what's the consequence, Because here's the only consequence. They're never going to come after you for reporting more income than you have. They'll only come after you if you don't report the income you do have. It might be messing with her return though, oh it could be messing with her
credits towards Social Security too. I guess what could it be possible that I could get omit the W two form and have my SPA through all my other tacts and leave it and then well, no, you have to claim that income, dear, Well, what is it possible I could just make one mark through my telephone number and mark out in the low bark my social security number. I guess you could, but on the irs level, they have already received the one with your phone number on it. You'd have to collect
it at that level. I'll listen, let's go to a break and let Mark, well, all this time I'm reading about this. The really all you have to do. You mentioned that you have a CPA, so since you have a CPA, he should know this. He's just got a file of form W DASH three C that gives the correct information if some of the information on the W two is wrong. So I'm not sure why you're your accountant's not doing it. That's a great nugget. So felma tell your accountant
about this. Okay, what what would the Conde number for my accountant to do? Tell her what form it is? A W DASH three C, and then I still don't mind calling this company. I mean, I can't imagine while they're screwing this up. Unless when you filled out it's not the W two, what is it a W nine when you filled out the inn information. If you accidentally gave them the wrong information, I don't know if
that happened or not. I would think not, and I would think that if I told them last you that they had made a mistake, they would have corrected it. I understand, but just have your accountant to have your accountant fill out that form and then send that form also back to that employer. So if your husband is getting more than you and he passes, you no longer get yours, right, and he gets and you get his. Yeah, you'll only But to your exact question, Yes, your husband, when he passes away, you'll no longer get that money because he's no longer there. Well, you'll
no longer get her money. What I'm saying is you'll no longer get his portion of his money. That's right, you get the whole check. Let's just put it in real numbers. Let's say you're getting fourteen a month and he's getting twenty four hundred a month. When he dies, you no longer get your fourteen hundred, but you now get his twenty four hundred. Okay, that's what I thought. That's what a survivor benefit is, unless if something has changed this year, which I don't know. I don't think it
did. We just did the seminar last night and went over this with an expert there. I don't think it did. Okay, so that's a survivor benefit. And are you both getting social Security right now? Right where people run into trouble is they think they're going to get both theirs plus their husbands. No, I knew that wouldn't happen. So I just didn't understand where
he said that I would only get half of his social Security. Maybe he's thinking you're going to knock him off and he wants to discourage you, and sometimes you probably feel like it. I don't know anyway, Oh, yes they do. Yeah, you know. Mostly I hear this, Cynthia. When guys retire, they say, holy crap. I never knew what a pain in the ass he was until he started hanging out at home, Thelma, what's going on? Thelma? Oh, I'm sorry. We had Thelma
and Mark was going to call over there. But Thelma, I think you can take care of this relatively simply by having your accountant make that, you know, change with the form. talk guys. Hey, one complaint we've had a lot of lately, okay, and that is people having their cars in the shops for excessive amounts of time, and especially body shops. Do you have any thoughts on why that's happening. I mean, when we say excessive, we're talking ninety days people. Ninety days. Yeah, ninety days is a long time body shops.
I'm not necessarily saying that that's terribly long. Right now. I mean, right now, I'm driving around at a black ping pong ball because they're a golf ball rather because I got hail damage earlier this summer and they can't even get me in until July third of this year in order at least your vehicle

We can't keep blaming COVID for God's sakes, When is this going to go back to normal? No, I think it's an accepted norm. They don't have to inventory the parts as they did. They're just major warehouses. They are regional as opposed to
local. Quite frankly, quality control's gone everything, but insurance companies aren't helping. We have cars in there for three or four weeks to do a curb hit, you know, a raq a control arm, things like that. It's just the email thing. Now, will you email an estimate and a question You got to wait three days for a yes or no answer. It's it's really challenging. And when people come in and say, don't worry, I have an extended warranty or I have one of these service plans, makes
you cringe. Oh you don't say good, you think, oh, some of them are good, but some of them want to send adjusters and the same thing. Now you push the car on for four days, wait for the adjuster, and no matter what, it's going to take you longer. Okay, fine, yes, Jeff said you needed this out of the other thing you've already got to fix. Well, Jeff a professional. Here's I guess what I'm
asking is this? Okay? Sometimes at a doctor's office, people get pissed at doctors because they didn't submit the insurance and do and get paid and then the consumers on the hook. Do you ever have people who say hey, you say, hey, your your warranty company won't pay and they say, well, that's not my problem. They didn't do the work yet though time they're going to wait till the organization prior to No. No, okay, but are there times you get a pre off and they and they won't pay

Hey Tom Martino here three oh three seven one three talks seven one three A two five five. Today is Friday Car Day. You can call about anything you want, including cars, of course. And I also wanted to talk about the elephant in the room. I call it. I'm sorry it needs to talk about it. You
know. I'm wondering what the reason the Special Counsel mentioned Biden's physical condition, mental capacity. I'm wondering. And here's what I'm wondering too. What they're basically saying is we're not going to prosecute. He didn't say because he didn't commit a crime. We're not prosecuting because there's not a likelihood of conviction. Now, I want you to read between the lines. There's not a likelihood of conviction, not that there wasn't wrongdoing. In fact, they absolutely found
wrongdoing. So this is what you call prosecutorial discretion. And I really would love to talk to an expert about it, but we don't know any prosecutors. Do we know people that used to be prosecutors or do we know people that know enough about prosecutors? Maybe, don't you Yeah, you know, that would be a great one because you know, he's a lawyer and I'm you know he does personal injury. But yeah, capitalists would be good because
he has a good legal mind. Another one would be Joe Lazara because he's criminal defense. Maybe. But anyway, with prosecutorial discretion, what that means is they can decide whether to move forward. But what I find odd is that what they're really saying is Trump is likely to be convicted. In other words, they feel like he's more of an unsympathetic with defendant. Think about that. I mean, they're saying a sympathetic old man with a poor memory.
So they're saying that people would feel sorry for him. So on the converse to that, think about that, they're really saying they don't think people would feel sorry for Trump. It truly is a different level of justice. They're going after Trump for everything because I think they feel that they can get convictions easier because people don't like them. I mean, we're talking everything from sexual harassment to secret or classified documents to inciting an insurrection to what are the
other things, you know, tampering with elections? I mean really, and then the New York people for committing fraud. It really does no, seriously, it does look like an absolute intentional way to get him off the ballot. I mean, and everyone who's prosecuted him, they're all Democrats, they all have promised to prosecute him. Some have it run on it, and it is clearly a way to try to keep him from running in the presidential
race. It's crazy. And again, if you tuned in earlier, you know I'm not I'm not trying to tout anyone as a candidate or for a reason. I mean, I have my personal preferences, by the way, I don't think I don't, but I don't think I need to get on here to convince you one way or the other what to do. And I'm not going to change your mind anyway. But what I find odd is that they are really saying, did that occur to any of you? That what they're saying is we can't convict Biden. He's too nice. No, it
wasn't too nice. It was too dumb. Yeah, that's right, that's exactly right. If they're saying that it would be too hard and the juries would take sympathy on him. So what theyre's But but aren't they saying in the opposite or in the reverse, that Trump is not sympathetic. Well, they're also saying that Trump hasn't. Whatever you think of Trump, whether you hate him, love him, or in between, he doesn't have any dementia the way Biden does. Of course they of course, but they're saying he's
not sympathetic. Right. What I don't get over the presser last night. I assume a lot of people watched it. When Biden came out, I didn't know what he was going to do. I swear there was a part of me that I thought he was going to say he's not running again. I mean, I didn't know what was going on. But why not one person, including Peter Douschey? Is that right, Douchey dooceci Why they didn't ask him this? Hey, by the way, when did your son die?
Or hey, by the way, where were those are the last country you were in besides the US? Or hey, what's your birthday? Not one of them had the balls to actually put him on the spot. I don't think he could answer the questions. See, he just denies everything anyway. He would go, oh, well, I just don't think that's even a fair question. Because the ghostwriter had access to the secret information to write the book. It's amazing. To your point, Tom, it's absolutely unbelievable
how corrupt the United States of America is under this regime. Well, let's put it this way. You cannot deny. You cannot deny that the justice system has been weaponized. You cannot, Oh, my god, beyond belief that. I want to ask a question, and I don't mean to piss everyone off, but I'm asking a question. I swear to God, I've wondered this, Okay, I really have. I'm not placing blame. I'm
asking why or when? And here's the question. We have to admit that this country is more divided, vehemently and violently and hatefully than it's ever has been. Okay, I mean, I personally feel that that hate is on both sides. But I have never seen more hateful and uninclusive people than people who preach not to hate and to be inclusive. That's my own feeling. However, we have to admit there's a lot of hate and a lot of division. It's different than it used to be. You used to be able
to have a discussion with someone and there wasn't this hostility. When did that begin? I don't know. Vietnam War, no mark that. I mean, we had violent protests about the war. But I'm talking about liberals versus conservatives and how I mean where they're you know, I mean you know where look at you had? Didn't Shumer a call for the call out the dogs on the justices? Didn't a lot of liberals give out justice ards the whirlwind? Now here's what I want to know, though, When did this start?
I personally feel it started right after Trump won against Hillary. That's when I thought, That's when I noticed it. We had some of it during Obama, but not like this. I think the Trump derangement syndrome. And also Trump himself is responsible. I think that with his name calling and his style after they said he was in a Russian hotel, Gillan, he thought about his style from the very beginning. His style. I think his style might have sparked people to do that or not. I'm just wondering, and
I'm seriously wondering, when did it really get this bad? Because it is bad, Mark. I mean, there are families, for God's sakes, that break up because of discussions. I don't just say with Trump, Tom, what's that? It thought it was Trump? That's what I think. I think it's just because we're living that moment now. I think if you went back in time, I think I would disagree with you. I really do think when family Reagan versus Bush, do you think it was this vehemently
but Reagan versus Bush that never happened. I'm sorry, not Reagan versus I'm sorry, I'm not talking in the Reagan No, I'm talking about the Reagan Bush erar. I mean, I mean, do you think that it was that way a senior Bush. I don't think it was during that period of time. But I would say during Gore versus Bush, that was massive. Yeah, that was pretty bad. But Mark, that was short lived once once Bush became president. I think that kind of, like most things,
drifted away a little bit. Yeah, but people except to him as a president and they that's right. I agree with you. We didn't have the twenty four hour news cycle, and on top of that, even if we did have CNN and Fox and stuff like that, it still wasn't like it is now, and we sure as hell didn't have social media where everybody is glued to it like robots in doing whatever TikTok says to do. Here Terry's got a comment on politics. But I was wondering when it went so south. Somebody suggested on YouTube one of our morons that it was maybe social media. Did it go ahead? What do you think?
What's going on? Terry? O? Hey Tom, it's Jarrek calling him from Alaska. Just hear me out on this. I agree with both of you, Tom and Mark Aleen Moore with Mark on you know my politics and that, but I do believe it started with Trump. But the other thing you got to keep in mind is, you know we're talking. I can tell your passionate about he's just so mean with name calling. But think about this, if you're him, you're not in politics. People like what
he stands up for, be like a safe country. You know, they're calling him the Orange Man. They're doing Saturday and Night live skits. So he's taking a lot of pressure from the media and he's got all of Hollywood coming against him. This guy has sticks again. But what is he doing for us? He's lowering taxes, he's protecting our country or we're not in
a war. Our economy was booming. If he would have had another four years after the first floor and had all this stuff with coronavirus didn't start up, this would be a completely different narrative. I think he's the only guy that can turn around. I think the reason why there's trump Ism as not just Trump. I'm an independent, and it's not just conservatives or Republicans. It's because he's saying what a lot of us are saying he's just saying it
with a lot more color. But he gets the job done. He does what we want. And I think that people are just fed up because most of the time Conservatives are Christians, we just don't say anything because we get oh, you're so judgmental if we say anything. And I think people are getting ticked off and are starting to stand up and have a voice, and we want our country back. I don't care what you do in your personal life, but then at the same time, don't tell me what to do.
I want to work hard, I want to take care of my family, and I want to live in freedoms. We have rules, we have laws. We got to stop off the nonsense. I think that's why people are very passionate about Trump, because he has a void. He's speaking for us. Look, Terry, where in Alaska are you? I moved from Colorado. I was there for fourteen years. I live in Wascilla. I just got back from Washington, d C. But I live in Withasilla, Alaska, about fifty miles away from a bridge. Look, hey man,
that's cool. So Terry, listen you you did make one comment that's really weird. You said you align more with Mark than I than me in politics. Here's what's really weird. Okay, if you really want to know the truth, Mark and I do not differ at all. I mean, you know we differ on the radio when I'm talking because he picks out part what I say when I try to bring up both sides. But what do you mean by that? I'm just curious what you mean by that. Well,
when I listened, I listen to you every day. I love you, I love your joy. It seems like you're afraid to almost speak like how Mark speaks is terry, terry. It's not fear. What I feel is there are people listening, probably from both sides, and what I try to do, honest to God, is just try to bring up the other side. That's what I try to do. No, And I see that,
Tom. But what I'm saying is when you're specifically asked marvels specifically, say Tom, how you feeling, sometimes I feel don't get a little don't get upset at me. But sometimes I feel like you get a little offend when Mark is just brain it wrong. It's like, yeah, Tom, what I like to hear is when you bee Tom and you just say, you know what, I'm an American. I stand up for this and this is how I feel instead of kind of well, and I do I do often
do that. But what I try to do is simply is simply say why though, Oh, here's why Mark, because here's why. I socialize, and I read and I look and listen to so many different viewpoints that I think, you know, some of them should come to light because it's it's they're interesting. Shooter's Gonna help come dix Is the Troubleshooter Show, No Tom Martino. Hey, I'm Tom Martino, and I welcome you to the show. Three oh three seven to one three talk seven one three eight two five five. We're going to go right to the phones at his car day, but we'll take any and all calls. We have a couple of car calls as well. Let's go to Michael. He has a heater issue in a Nissan Rogue. Anything you people want to talk about, give us a call. We're
always willing to take your call. And I have a story to tell you about a guy met last night who did an insurance check up with Compass. And you're not going to believe this story. Mark. He said, Compass proposed to him insurance that was three times as much then he was getting with American Family. And I said, how is that? And wait till you see and hear what I found out and the reasoning behind it. But first
I want to go to Michael. What's going on? Michael? Yes, Tom, I got a twenty thirteen Tom, and U I mean from at a month there. Time I turned on my heater, it will make all kinds of rattling noise and ugly noise. But the air still come out and it would be hot. So this happened for like a whole month, and probably one day I just went off. It won't go back on. No heat, no air. When you said it went off, the heat went off, or the blower motor or what everything turned on? It was the
flower motor went out. No heat, No does the air conditioning work? Nothing works? What do you guys think is going on here? He probably the blower motor was acting up and it finally just quit. Okay, Tom, I took the blower motor out. Sure enough, the fami was all wobbling and everything that was making noise. I replaced it. I replaced it, put it all back together, but turned on and I still don't got nothing. Well, that's probably because you didn't put it together. Well,
you also have a resistor in there. You might have blown when the motor went so you got to look for the resistor or even if fuse at that point. Right, Well, the inside the box, there's a resistor. You get just a new blower. Is that all you got? I checked the fuses, the ant new blower in okay. So, but Kevin is saying there's a resistor too, And if it's shot or overheating or whatever.
It's dead because that's what changes speeds in the fan is a resistor. So the resistor is what So when it was going out, it blew that because of the resistance exactly connected. I mean in the same piece with the ban. No, it's in the box, but it's it's a separate piece, and it's not like a fuse. It's like a big square thing. Yeah, it actually bolts into the box. It's probably two three bolts. You pull it out, it sticks into the air chamber itself. Oh oh,
it's not in the fuse panels. Oh no, no, it's in the heater box. I got you. Okay, my heater, my my blower, everything's under my dash. Oh yeah, that's fun. And I bet it'll never sound the same driving down the road. Right, those clips break. I mean, it's really crazy, it is. Could it be a simple thing like a fuse? Probably not, he said, he checked him, but saying it's the resistor, I mean it's very common, extremely common. Okay, good check it, Michael. Let us know three oh three
seven to one three talk seven one three eight two five five. Now, who's been waiting the longest hair? We have John, John, what's going on with you? John? Welcome? Hi Tom, hey man, what's going on? Being false? We perched. I'm a daycare owner up in Firestone, Frederick, Colorado, have been for ten years. I'm the only male probably in the northern Colorado who operates and runs daycare data. What are you being accused of? John? A child molestation from chick Oh my god?
And the tickle is a kid that I've had for four years. It's on video in the school I've own the school resource officer for seven years on the family and to that school parents were brought in to see the video. They said there's nothing there. They actually told the CPS in the school that literally, if they died today that me and my wife have been more for them and their family, that I would get their kid. They have willed their kids to meet. Look, I got to ask them serious questions here,
John, that is some serious stuff. So here's what I need to know. How did the charges come about? Did anyone complain? No? So I actually haven't been charged yet. There I'm in the middle of investigation. But why did they even start? Where did it all begin? Apparently in the office because I pick him up at one o'clock every day because they can't control him for a full day, so we sent him there for kindergarten.
I have to go pick him up every day at one o'clock, which is inconvenient, but we did it because we love that family and I love that kid. I don't think you're understanding that, John, John, you really have to listen to us, okay, because because I'm asking, you picked the kid up every day, you take them to daycare. The parents pick them up when they're that when they're done with work. What I need to know is why did an investigation even begin. They don't just start investigations
for nothing. Why did it begin? There's a Firestone resource officer who's inside the school called GPS and said that I got it kid, that's all wet. What did the resource officer say that made him suspicious of molestation? It's her. She said I was tickling his butt and and and did she say you were tickling hold on? He said you were tickling his butt in school when you picked him up or at your center. Yes, in school, as I picked up and supposedly all on film. Okay, so did you
see the tape? Nope? I said they haven't charged this yet. I did retain a lawyer just because I don't trust cps. And that's twenty years I've been doing well. You have to retain a lawyer. You have to retain a lawyer. But right now they're investigating. You understand, John, this is devastating. They have to investigate obviously, this school resource officer.
I want to ask you, do you think the school resource officer she is truly she is truly concerned or do you think she's just some wacko making trouble. I'm not going to make in trouble. Why, that's what I need to know. I don't know. I've always felt like she's given me a dirty look. I've never thought she was the best resource officer. Anyways, she's been really nice this year to my kids. So just kind of looked
past it and then like everybody, But I don't understand. She said she went hold on, John, she said she witnessed you tickling this kid's button. Correct, Okay, now, uh no, I get it. Now. Was there something she did she confront you when she saw it? Or did she just make a complaint? She just made a complaint. Okay, Hey, John, I want to say one thing, John, you really should talk to your an attorney before you call a radio station. I think
you're doing the dumbest possible thing anybody who's ever done well. This is some serious stuff for sure, Yes, sir, But John, I understand you're frustrated and you're but I find it difficult personally to believe someone someone wants to drag a kid and a person through these accusations. I'm not saying that it happened. I'm saying that maybe she believes something is happening. But here's the
thing. If they're how old's the boy five, They're gonna probably talk to the parents and the boy, maybe have the boy talk to a psychologist or or someone. And then did they talk to you yet? No, they have talked to the boy, interviewed him privately that dad hasked to go in. They said no. And they've come to my two daycare centers. They've interviewed just kids so far, three and five year olds with super leading questions and then no talking to any of the parents. Most of the parents have
reached out to him. They haven't interviewed a staff member yet. Okay, John, five year old little kid, John, They're going through the motions they have to go through. Are you assuming they're looking for trouble too?
Or tell me why you're calling. I'm calling because I was I'm really good friends with your buddy Carlow, So I was chatting with Carlow and I was just I've had a lot of parents reaching out to me telling me that they should make we should make this a story because if out of the female, right well, well you should. If you're accused and you're falsely accused right now, you're not being accused by by anyone except this school resource officer.
I just here's what I'm thinking. If there is a well, if there is a video, huh, this video is going to tell all. Did your attorney ask for the video? He apparently hasn't asked yet because I haven't been physically charged. Okay, I get what you're saying. How did you find I don't want any names of school Listen, I don't want any names of schools or people or kids or attorneys, but I need to know.
How did you find the attorney through another friend who is a criminal attorney that I would normally use, but since I thought it was criminal civil, he had made some referrals, and I called a few different lawyers, which all were depressed because they said this is the worst agency to work with. But then I found him through two referrals. He's been up in that area for forty two years, in that Weell County lay in my area. So if he supposedly knows the right people, well, first of all, it is
unfortunate Weld County is corrupt. But that doesn't mean I can't see them falsely accusing someone just to make their lives miserable. Here's the problem with child molestation, the real big problem. I'm talking about accusations. If it did not happen, and you're truly falsely accused, your life is still ruined. Yeah, that's what I'm trying to say. Right now, Now have you here's the Here's the most important thing. Is your record one clean of all problems
other than a couple I think college twenty five seven years ago. Of what of They're all misdemeanors. There was like assault, drop to harassment. I was a free sport athlete, Okay, in a couple of Okay, I get it, that's okay. I'm not talking about that. That's good. I mean, that's not good, but that's okay. You're troubleshooter three oh three seven one three talks. So we don't have an attorney available right now to talk about this, and it really is terrible, John, But all I can say is this, at this point, we will get an attorney and get you on again. At this point, cooperate, but do what your attorney says. If you have a criminal defense attorney, do what he says. What does he say to do right now? He just says the way to see if it gets dropped or if it's
if they decide to charge you with anything. That's what you really need to do. Do you realize what Mark said previously about calling us. What he meant was this, let's say they find no reason to charge you. But before that happened, you went on radio and TV bitching about the fact that they're investigating you. You're always going to be looked at as a suspect in child molestation, even if even if you were never charged. So what I
would do if I were you right now is weight to fir see. But we can talk to a defense attorney and get you back on if you want, just just to make sure you're doing everything correctly. Three zero three seven to one to three talks seven one three eight two five five Trace has an engine issue with a ninety six dodge Ram. Well that's the issue right there. It's a ninety six dodge Ram. How many miles on a Trace? Actually it's only two hundred and forty three thousand, but this wa wait on
that engine? Yeah, yeah, but it's the old twelve valves. They're million mile engines. Well is that true? Guys? Is that ninety six dodge Ram a million mile engine? Is it diesel? Oh? Okay, So what's going on? Man? Well? I blee the turbo. It went out because of age, as something do, and so it wasn't a big deal. I just replaced it with the outer store one and and basically
got it in. Everything's working fine for a couple of minutes, and then I start having really bad oil bowl by and I'm trying to figure out really what's going on with it. I'm doing troubleshooting, oil going to it, the oil return tubes completely clear, everything's spinning fine. Nothing's going on that I could tell from troubleshooting. So I'm like, okay, you know what, I'm going to go ahead and get it to a local shop and have
them trouble shoot it to see what I'm missing. So take a local shop, have it towed in, and they proceed to call me and tell me that they tried to tell troubleshoot it. They started it. It basically had like a runaway engine, and they set my engines right now. We had one of these, tom not I mean it was in Colorado Springs. I remember it on the Mercedes and it was pretty new. It was a sprinter
vey it was, and it ran away at the shop. I don't remember how it got into gear, but it got into gear it hit something. But more importantly, the engine revved up so much it blew. Now trace, what do you think is going to get into gear? But they're saying it went over like eight thousand rpm. Yeah, what do you think? Are you blaming anyone for this? I really have no idea what to really
think on this. So I got me right away. Why why replace the runaway if you replaced the turbo for you, I'm sorry say that again? Who replaced the turbo? I did it? Okay, there is very clear literature. Plus I did my research, make sure that I prelived it, made sure there was oil getting to it, made sure the return tub was clear. Basically, I double checked everything. Okay, when did it run
away when you started it up? No? At the shop? So okay, when you were getting you were getting let me get this strengthen trace. After you installed it and was getting blow by, you took it to a shop to check it. Yeah, and when you took it to the shop, that's where the overrevving happened. That's what they're telling me. It was just supposed to be a simple diagnostics. And are they saying they did not? What are they saying? Are they not taking responsibility? Guys, chime
in on this. Is it their fault that had over revveed? Well, it can if there's an excess oil and fuel that gets in there, they got to be careful with that because there's no spark. You can't just could the excess fuel and oil get in there due to his installation or was it something they did wrong. That's the you're gonna have to determine that. That's the hard part. Now. Yeah, a diesel engine will run on oil, it'll fire it off and once it gets going, the only thing you
can do is try to choke out the air. Yep. But why does it over rev Why doesn't it just idle? It just keeps feeding itself. Yeah, the oil is not being monitored or meter, it's just there's no throttle body. No, well it's all bypassed. Then there's no sparks. You can't just turn the key off. I get it. Does that ever happen when someone's in gear, like going down the highway and all of a
sudden they're doing one hundred? You can get kind happen over the road truck if you can actually pull up YouTube videos see these guys pull over the side of the road. You'll sometimes have fire coming out the stacks. But where, oh my god, where where is the oil being fed from? It could be coming past the old control rings. You've cracked the oil control ring. It'll sit there feet itself, right out of the crank case. Yep.
So with two hundred, here's the problem trace you know. I know everyone says they got a million mile engine, but it's two hundred and forty thousand. This blowby and stuff could be happening and have nothing to do with the shop. I think you would have a hell of a time trying to prove the shop did it what you just did your own turbo. What do you guys think it'd be a real uphill climb. Yes, how much?
Let me rebuild that engine? I honestly don't fifteen all right, they told me sixteen thousand, but you could use ones for anywhere from three to six thousand. Ye are you let me ask you something, Trace, I'm just gonna ask you straight up, what do you think the shop did wrong? Really? At this point, I'm kind of looking for suggestions on a reputable place to take it to to actually give me real answers on even what the heck happened? Okay, where Wait a second, So let's say they brought
it over to you, Kevin or Jeff or a diesel shop. What would they do to actually figure out, now that the engines toast, why it revved up like that? How would you even go afterward? Try to determine where the oil or where the fuel came from, if it was caused by something. Well, let's say be able to prove anything. Let's say it came from the turbo. What does that mean they may not be able to
prove anything. Yeah, well, but then at this point they weren't even able to tell me anything of what was wrong with the engine or anything like that. So I don't even know sure at this point. So Trace, here's a I don't think you're ever going to be able to pin it on them period. If you want a reputal spot, where are you located in the Littleton area? Guys, Mark, do we have some really good diesel people? No, we don't, But I still want to go back to
this. I mean, I don't know what he expects to get out of it. I just don't know you fixed. Yeah, Okay, well let's say. Well, no, I'm saying if you brought it over to someone, at minimum, they're going to have to tear it down to do some kind of I don't know, some diagnostics to figure out what happened. I mean, you could be thousands and thousands deep into figuring out what happened.
And once you do figure out what happens, that sure is hell. Doesn't mean the shop's going to give you anything, but it's most likely from the turbo installation. It's awful coincidence if that's not the problem. Yes, So Trace, I'm so Mark, who do we have as a good diesel shop? These guys would know better than the one that I use. And you know Mark cast Iron, Oh yeah, cast Iron they have the tow truck company too, but yeah they are good Diesel mechanics. Okay, I mean,
listen, man, this is a terrible situation. But I wouldn't get my home getting any reimbursement. What did the shop say to you, like so sad, too bad? Or what? Pretty much? That was it? And it's really I didn't know. I took it in to get a diagnostic for a reason. I wanted to find out what the heck was going on. And instead of finding out what was going on, look, man, I don't think it matters. So listen, I want to re emphasize
this point. You bring it there, you drop it off, go out to bring it into the shop, they turn it on and for whatever reason, and who cares the engine over revs and destroys itself. How in any how, in any circumstances, is their problem? Hasn't It isn't It isn't And why would you drave on thousands of dollars to figure out you're getting crap? And next would be Sonny, Sonny, what's going on with your twenty eighteen Mazda? Three? Sonny, My son bought a car at
the Ralph Schamp Mazda dealership and he took it in. He bought it maybe like a month ago new and that then no, the twenty eighteen right, yes, it's used. And then he took it in because he purchased them to get his windows to it. So he took it to the dealership. They asked him to leave it overnight, becau they weren't able to work on it on the weekend, so he had to work the next day, so he dropped it off after work at night, dropped it off the next day.
They said they were going to have it ready, but the next day when they called him, they said that their car garage where they put all the cars to get serviced, got broken into, and they left his keys in the car and they stole it. You know, Tom, we get this call. The circumstances might be different, but this call on liability we get so often with shops. It's crazy. Now. I want to explain a couple of things to you, Sonny, because people don't like when this
happens. They don't like my answer. In most cases case, Sonny, the garage is not liable for crime. Okay. I know you added the little part about them leaving the keys in it. It doesn't really matter because they locked it inside a garage. Okay. Had they left the keys in it outside, that would have been stupid and they would have been liable. That the fact that is the car was locked up and it was a theft. Now, did they steal more than that car? No, that was
the only car they stole. Okay, Now how many cars were inside? Do you know? Just his? Well then that's the reason, right, there was only one car. Now, the argument could be made it wouldn't have been stolen had the keys been locked up. That could be made. Okay, that could be one area. Well wait a second, let's just ask our guys here. Hey, when you have a car overnight or even during the day, and it's in the shop, where are the keys to the car in the car? In the car? Where else would they be?
Okay? Good, Well, I don't know. I thought maybe they have a lock box where they hang it. I don't know. I don't know. But here's the thing. They just said. The standard of the industry is to put the key in the car. So I'm going to ask them another question, both of them. If your shop was broken into and they took the car, would your insurance cover it? No? Nope, okay, because it's a theft. Right if you left your door wide open and it stole, what would happen? Yeah, we'd be on the hook
for it. Okay, now here's what I here, Sonny. I'm assuming the car was insured. It was, but they're not claiming liability either. What do you mean who's not claiming liability? It was insured by your who? Did you have it insured by Gary LYMB? What do you mean they're not taking responsibility? Maybe she's saying they don't have that coverage. Well, of course, do you have comprehensive coverage? Yes, he had to get full coverage to get the car. Well then, how okay? For what
reason are they turning down the claim? They said they can only hold the person who stole it liable until they find that person. Then they can't do anything. No, wait, wait, wait, wait, Sonny, if you have theft insurance, they said, until they find the person who did it, they can't cover the claim. Yes, well they're wrong. Okay, we need someone to help this woman out. I want to hear someone from dairy Land Insurance. I want to hear someone some moron at Dairyland actually
say we can't cover this until we find the person who did it. Wait, what do you mean did he put in a claim for a stolen car? He did? Who did he put the claim in with? With his I guess. The insurance adjester called my son back and told him they will not claim to cover up. Let's was on, what's that, Mark, Let's get someone from Compass on. Yeah, okay, let's do that. That's a good idea. Hold on, this is I mean, I've just never heard something more absurd in my entire life ever, ever, ever,
ever, ever. I mean it's it's a crime, it's a stolen car. If he has coverage, they better come through. There could be a bad faith claim here, for God's sakes, Oh my god. I mean, it's it's just it just befuddles me. How many morons we have in insurance? Tom, shouldn't we first find out to be sure he has comprehensive I'm assuming you have the right coverage. Otherwise why would they say, Han, they have to have full coverage to leave with the car with the loan
on it. But yeah, they do, Yes, they do. But did he get full coverage? I mean his dairy land the name of the it is. Did you talk to dairy Land? I did not, because I've never heard of such thing. It's so ridiculous. There's no way it's happening. That's where I keep coming back to. I mean, can you imagine if your car is stolen and you have comprehensive coverage until you have your car back, there's no coverage it. It makes no sense, Sonny.
They said, until we find the person liable, we can't cover you. M m. They actually found the car, okay, what did they say? So the insurance suggester went and then he released it to Ralph Schant Mazda. What did the insurance adjuster go for? Wait a minute, wait wait, sonny, wait a minute. Why did the insurance adjuster even look at
the car but they're not going to cover it. I don't know. They went and looked at it at the where they got it, towed the Denver policef and and then I guess he I don't know what it was the car damage, Sonny, Sonny? Was the car damage? All the tires, all the tires were flat, and then they ripped the interior and they're saying that they're not going to cover any of that. Uh huh. And then the dealership hold on, I got to take a break. We need to
call Compass insurance. This is getting even weirder. You weren't completely straight with us. We didn't know they recovered the car, but still they should fix the damage. Hold on, I'm Tom Martino. friend of mine? Uh lost her job and then got her car repossessed? Yeah? Did she miss pen? It's Ken? Yes, okay, And what's going on with that problem? Right now? Well? I was the co signer on the loan. Oh my god, you're going to be responsible in fact, it could be. It could be way worse than you think. She probably overpaid. And what they're going to do after the repossession is
eventually sell it, and they're not going to sell it for much. Then they're going to apply that to the loan and whatever's left over, Ken is holding the bag. It's called the deficiency, and they can go after either of you. Right, So let me ask you a few things. First of all, did you know she was in trouble at all with the payments?
Yes, you know, after a after she missed a couple of payments, I got to notice and I knew, you know, that's when I found out, you know, I asked her about it and she said she lost her job, and you know that's when I knew, uh that she was in trouble. But so, what what stage is it in right now? Ken? What stage? I just found out yesterday that they sold the car for one thousand dollars and what would do? How much did she owe on it? You need advice so you don't have come. Run in just as fast as we can. Shooter's gonna help coming, man. This is the Troubleshooter Show Now, Tom Martine. Hey, I'm Tom Martino. Welcome to Car Day today. That's what we call it on Friday when we have discussions about cars, but we can discuss anything. One
of the things we discuss all the time is insurance. Compass Insurance Group is with us right now. I have a funny story about them too. They said the insurance check up, this one guy had showed triple the amount as State as I believe, he said, State Farm. But anyway, no, yeah, one of those coming anyway. Jeremy your turn. Jeremy's with Compass Insurance Group. We're gonna tell that story later, but right now I
have a question for you on insurance. So this woman calls and says, her son's twenty eighteen maz To three he purchased at shomp was in there for window tinting, and someone broke into the shop and stole the car and the keys were in the car. But that's how most shops do it, when they locked the shop, so they took the car. The car was recovered.
The car is heavily damaged. Now according to the mom Sonny, she's not here right now, but she said the claim was rejected by dairy Land Insurance, and the reason they gave is they did not yet find the thief, so there's no one to go after. Oh wow, yeah, I mean I'd be interested to see how accurate that is. But no, I mean it's I don't think that Dairyland as bad as Dairyland is. I cannot see Dairyland doing that. I would agree with that correct. Now, what
is Dairyland? They're an insurance company. How good are they? I don't know a lot about them. I mean, it's not a company we represent, but I mean that's as clitter cut as a get. So, I you know, the only thing I think there's got to be something missing. I mean, really, that's what you're saying, right, Yeah, exactly. It just doesn't sound like it adds up. Okay, but what you're saying is you've never heard of a perpetrator having to be caught before insurance is
processed. No. That brings up a curious question though, how long do you most insurance, Let's take Progressive or somebody you represent, when your car or vehicle gets stolen, how long do they wait before they actually cut you a check for the entire amount? I mean, is it a week,
is it a month? What is it? A lot of times they'll go to the police report, they'll get a police report, and they'll kind of, you know, it's case by case, and a lot of times it's the police are, you know, saying hey, hold off, you know, we might be able to find it. So it really is case by case in that I had one the other day where the guy got paid out. They did end up finding it. It was an rv A trailer, but then they ended up having a total le anyway, because of all the
drug use in the RV. But let's say that didn't happen, and you know, the guy gets paid out and then they do find it. Typically at that point, you know, I'll either pick a back out of it, get the RV back, get it fixed or vehicle or it's total they paid out, and then the insurance company would take the vehicle at that point. So I mean, basically, if it gets stolen in Denver, they might even write you a check that day because they don't try to find it.
Or if it got stolen Douglas County, they might make you wait a few weeks. It depends on where it is, and certainly different counties obviously could be different with that. But there's there's no good solution, right because, yeah, you don't want to hold off on a payout, but if the car's found a day or two later and it's not damaged, that obviously paying it too soon can cause a problem too. So it is tricky right now with that. You know, you mentioned last thing you mentioned the drugs
in that AREV case. I'm curious if someone does steal your car and they're you know, I don't think anybody's going to make meth in a car, you know, a little car or an suv. But if they're smoking myth in the car, is it always total? These days? That's what we're seeing. I mean, I don't know if every company's policy is that, but all the ones that I'm running into there was a mess, smoke in the car. They're totaling it because the liability and there's just no way to
really clean that and make it safe. And isn't that crazy? Tompsons? Unbelievable? Hey, Jeremy, listen to this. One last night, retirement Planning Center of the Rockies had a bunch of people were taking selfies with people, and a guy says to me, you know, I went and did the insurance check up and Compass came back triple the amount of my state farm for my home in auto. And I said, there's no way, there's
no way, and they said yump. He said yump. So I start probing and he said Compass tried to get me to insure my house for one point three And I said why. He says, because that's what the value is now. And I said, but my old company kept it at three hundred and I said, sir, you're not insured. So he's paying two grand for no insurance, and I said, you're not insured, you may
as well just draw. He said, well, my house is paid for, and I doubt I'll ever have a claim that equals three hundred thousand. And I said, no, no, no, no, no, that's not how it works. You are literally ensured for one third of your value, actually less than one less than one third. Therefore, when you get actually it's probably a quarter of the value. So when you have a claim, it doesn't work that way. You don't get to have a claim up
to three hundred thousand. They're going to take off seventy five percent of every claim you have, every claim, correct, I said, So you have no insurance, and here's what But I have an umbrella, he said. I said, an umbrella will not cover you until you exhaust your minimum insurance. And the minimum insurance must be adequate or the umbrella doesn't even kick in.
So you don't have umbrella coverage either. Because he was talking about liability too, and he said, so, I said, the reason you saved half going with State Farm or wherever the hell you have is because they're not being honest with you. Eddie has no insurance. I say, you are not insured. I mean in a lot of that these days, and a lot too, specifically with what you said about the umbrella, where I will bring up something and they say, well, no, I'm not worried about
it. My umbrella, And people just to understand, an umbrella is simply extra liability coverage. It has nothing to do with your you know, and and the liability coverage is only after you exhaust the underlying coverage. When the underlying coverage must be a certain threshold. Yeah, like five hundred thousand. Right, Well, I don't know, Mark, I don't know what that threshold is. What is it, Jeremy? Usually for most companies it's two fifty five hundreds, so two fishes. Okay, So think about this.
This guy literally was walking around with no insurance. So here's another thing. He said, Well, if that's the case, it doesn't really matter if the house is destroyed, because he thought he would walk with his three hundred. Would he walk with three hundred? Potentially he could, I mean in a total situation where it burned to the ground, he potentially could if he is that far under insured. And depending on the company, it certainly could
be something where they invoke some co insurance or he'd have some issue. And I said, even if you did, I said, what are house is worth in your neighborhood? He said about one point five? And I said, do you understand? And then he said, well, they're simply raising the houses anyway. They're they're they're and and putting new ones up. They're just doing away with houses. They're they're scrapes. And I said, even with a scrape, Okay, you lose your equity, because I mean,
that's what I believe. But if your if your lot, here's what I told them, if your lot is truly truly worth one point five or one point three, then you shouldn't have insurance. If your house is If your house is paid for and it's a scraper and your lot is worth a million dollars, why would you have insurance the liability you would have right, of course, you need the liability. Now, that's Jerry. That is a great question. It is a great question. Should I buy Is there a
such thing as just liability? Let's say I have a scraper and it really is a piece of crap house and no one would ever buy it except they want to be in the neighborhood and they want that lot. What and Let's say my lot and this can happen in Cherry Hills. Let's say my lot is at is worth a million? Can I get just liability so I'm not sued? You can not with like the standard companies we typically talk about. But yeah, there is a product out there that you can do that and
then add an umbrella on top of it. It's not a traditional standard market type thing, but yes, you could do that if that's the round, if I got just liability on it, I mean basically I'm covered for that. I don't care about the house at all. I mean, would I save any money you could? I mean I did one the other day that was similar to this, and it ended up being cheaper for him to just
do a fifty thousand dollars deductible. It was actually going to be cheaper than any kind of just liability only type thing because you're basically ensuring, you know, so he'd still get some coverage because even if you are going to scrape it, it's still better to have them pay for it if something actually happened actually having to pay for it. But you can get you know, if you did like a fifty thousand dollars deductible or something crazy where you're clearly only
using it for that worst of the liability. Those are pretty cheap. And so because liability doesn't have a deductible, it would not have a deductible, but you'd have no property coverage. So if you think at what but Mark, this is the very first time on this show in forty five years that we have ever discussed this. I have never discussed I love it a house
that's a scraper on a lot worth a million bucks. But but so this guy, so I told him, I said, if truly your lot is worth that, then don't have don't I said, you don't have insurance anyway, so why pay Tom? Would you explain something to me and the other idiots? So if he has a house that's insured for three hundred thousand and his roof burns down and it costs fifteen thousand, you're saying that his insurance won't cover it. Yeah, we're gonna go. I'll go over that coming
up. This is a very important question and if you don't understand it, doc, as a doctor, I should explain it. We got more after this. By the way, they arrested that moron from Texas driving from Colorado Springs to Denver in twenty minutes? Did you know they arrested him?
I don't even know what you're talking about, yells guy. Okay, there's a YouTube video of a man driving his motorcycle and he made it from Denver to or from Colorado Springs to Denver in twenty minutes. The entire twenty minutes was put on YouTube. Can you believe it? How fast was he going? Oh my god, I don't know when you figured out. I don't know twenty minutes? Mark you ride? Can you imagine doing that twenty minutes? No? I mean that's anyway. Do you know what his name is?
Moron? Rended, No, I don't want to insult my YouTube guys. He never got he he got arrested after the fact when people saw the YouTube. Yeah, because he posted that, but no one knew who he was. I don't even know how they identified him, but they did and they went after him. So his name is Rendon dits Ditsman of Texas. D E t z M A N N Ditsman. Anyway, he was charged
with menacing, engaged in speed contest, reckless engagement. By the way, that's called racing engages because so menacing, racing, reckless endangerment, reckless driving, speeding forty miles an hour over the limit. He was probably more than that too, engage for plus fact I thought he was engaged. Listen to this charge exhibition of speed, Wow, and then the other one no license
plates. Listen to this man. So back in the early two thousands, I had a good year in Castle Rock, and every night on the news for about two or three weeks, say, show this motorcycle guy being a complete idiot on the highway. He would go right up next to a cop and either pull a wheelie or do that opposite where the backwheel comes up and just make fun of the cop flip them off and take off. It was happening every night in Castle Rock for a few weeks. So I'm at that
store one morning and a cop shows up. Douglas County shows up, and then right behind him patrol. So I got two of them coming in asking for grant my service manager. It was my service manager doing that for two or three weeks, and I literally had no idea Tom. Wow, Hey, Jacob, what is your comment on that motorcycle moron? I just wanted to say, isn't it kind of crazy that there wasn't one single state patrol or a cop on the highway that whole route unless they just saw him.
And what would they have done if they saw him? Would it be a chase? God? But if you couldn't even come close to chasing, here's what's funny. This guy's right. He did that whole thing. Not one cop does anything. But if you accidentally cross that double line, you'll get a seventy five dollars ticket like you did. Tom exactly. Yeah, Jacob, thank you for calling. Now let's go back to co insurance penalties.
Deputy Doc says, wait a minute, if you have a guy with a million dollar or a million dollar house, and he's he's or one point three or whatever, and he's insured for three hundred thousand and his roof is damaged for twenty you're telling me he won't get twenty grand if he has three hundred thousand in coverage. No, he won't. And here's I'm gonna use some easy numbers. Well, let's use those numbers. So let's say he's insured
for only twenty five percent of value. So in some cases, by the way, there are clauses that say they can cancel your coverage for extreme under insurance. However, let's say they apply the normal what's called co insurance penalty. What that means is you're ensuring part of it yourself. So here's what they would do. If he's insured for twenty five percent of value and the roof is twenty grand. Do the math would they pay on that roof?
Would they pay twenty grand? No, they would pay twenty five percent of twenty grand because he is only twenty five percent insured. So on a twenty thousand dollars claim, he'd get five grand. On liability, it's worse. On liability, he'd get nothing. So jeremy am I lying? Or dying. Tell me how that how that works, that that is true. Just to make sure to clarify it, it's you got to be insured for the
value of the reconstruction of the home. So like in this example, if his home's not worth that much and all the value real estate value is in the land, he doesn't need to have insurance for the real estate value. He would need to have the insurance up to the construction value of what it would cost to rebuild the home. So oh okay, okay, so that it might fare a little better for him, it would be in that case. Yeah, I just because there's a lot of times like if you have
a you know, small house and wash park or something. You know, that house could be two million dollars. It's not going to come close. So okay, So the value is not based on a praised value, but it's based on reconstruction of what you're ensuring. That's correct. Okay, that's good to know. We see we see so many people under insured on the just the reconstruction cost. Yeah, because that three hundred thousand really is a million. I mean, it wouldn't be that crazy to see. I don't
know about that. So in general, Doc do you see why even though you're insured for three hundred, you could be cutting your insurance claims by seventy five percent. And because that makes sense, I just didn't think there would be no coverage, was what I thought. You said. Well, although that explains it very well. Yeah, it's minute skill coverage. And in some cases, some of the newer policies are saying you've rendered it null and vo if. I don't know what the extreme is, but they have some
extreme clauses, like because they don't want to see it. And here's why they don't want to see it. They don't want people coming back suing them for partial payments for bad faith. So they're saying, well, the hell with you. Then if you breach your contract by miss by miscalculating your reconstruction, or by I forget what the term is, by you're misrepresenting it,
then you know. But a lot of times you're really not. What happens is they bought a policy fifteen years ago and they've stayed with the same company forever, and the company doesn't do anything, and they now Jeremy in that case. In that case, is the ownus on the owner or on the agent or the company from a co insurance standpoint. It's on the company,
not from a coverage standpoint. But yeah, Mark, you're right. If we wrote a policy and you're one hundred percent of value when it's arts and you end up not at one hundred percent to the construction value, they're not going to put a co insurance clause on that. It would be if you came in and we needed six hundred thousand and you only wanted three hundred, and we started it that way, that's where the co insurance. Hey,
Jeremy, let's just I want to ask you something. Man. Let's say my insurance is twelve thousand a year and I've got a high five thousand dollars deductible on you know, hail and win perils. If if I said to you guys Accompass, you know what, I want to go up to a twenty five thousand dollars deductible on those perils and maybe even on fire or let's say on everything, I want to go up to a twenty five thousand dollars deductible. With that twelve thousand a year on my insurance I'm paying for the
premiums. Would it drop in half? Would it drop by ninety percent. Is there even a product out there? What are your thoughts? There are products out there, so like for your company, they only go up to seventy five hundred, and that's pretty typical to see either a seventy five hundred or a ten thousand MACS for deductible. We're probably going to see that change here in a bit and more companies will probably offer more extreme high deductibles.
But we have travelers, like I mentioned before, fifty thousand deductible and yeah, I mean it dropped it well over half. I mean you're really at that point. So obviously the higher you go, but you get to fifty thousand, there's not a lot of scenarios where you're going to exceed fifty thousand. No, but it's crazy. I have the feeling after this year, I'm going to be looking at a renewal of fifteen to twenty thousand for insurance.
I'm almost sure of it. Yeah, it's it's going to be higher for sure, And yeah, I mean how much can people sustain that? And that's where looking at a higher deductible, which we've naturally done, you know, I mean it used to be one thousand dollars everyone's deductibles one thousand dollars. Some people even had a five hundred. But you know, at
some point it does make sense. It does make sense to take the gamble on a very high deductible if you're gonna pay that anyway in premium, for God's sakes, I mean, yeah, in three years you could literally make up for it. Yeah, So we got more coming up. I gotta take a break, and Bob, if you're on with the car insurance question, we'll hold Jeremy over. Let's do whatever we can to help you, and we will continue to help you. So this is a really uh busy day today. Let me get to the phones here and we're going to continue with let me just jesus, I can't just see
this a damn thing. Hold on, there we go. I'm trying to find Okay, Uh, Bob, you have a question on car insurance. Go ahead, Bob. Welcome, Yeah, good afternoon time. It's been a couple sir, talk. I'm trying. I'll try to be pretty concise here. I'm calling for my son because he's working. Uh. He was in up in Summit County a couple of weeks ago. He got a stop light and got hit by a rented vehicle. It was driven by a Florida operator. Florida driver. What's a Florida Okay, So what happened then?
Okay, So Progressive wrote up the repairshment and we're good with that. A question, is he entitled to have his truck repaired to pre pre collision condition? Well, of course he is. What that was that a trick question? Of course? He is tell me what they're not doing. Well, they don't want to repair, you know, a dented door, so it
will replace the dented door. They just want to repair it and that you know that could I don't want it to be well hold on, hold on, I think he can hold on. I don't think he can insist excuse me. I think he can insist on new parts and if not body putty, I think he can. I mean, it depends on how they're going to fix it. If you know, how are they going to fix it? Yeah? Yeah, I think we've got a good body shop that thinks that is kind of similar opinion. What year is this car? What year
is it? It's a twenty seventeen cook Coma. Okay, we're getting we're getting on the on the outskirts here, Jeremy, what about that? What do you think Jeremy is with Compass Insurance Group? Is Jeremy there's his line's up? I don't know what happened. Yeah, I think I was saying, is this the callers company or is this the other party's company? The
other party the other parties liable for damage? Right, yeah? And I mean with the other party, I mean you're going to fight with them on something like this, and it might be worth looking at your own insurance and let them suburgate because they're they're you know, there's nothing contractual. They're going to try and do it as cheap as they can. I'm not saying that's right, that's just what they're going to try and do, and you're going
to be fighting with them on that. Using your own company and letting them subrogate might be an alternative to you know, fighting with them. If they're not going to give in to replace it, what they should do that. But you know, with the other party's insurance, you just don't have the leverage like you do with your own. And by the way, it goes
more by value than it does psychology. Here's what I mean. You may not like the idea of putty or pulled pulling the dent and smoothing it out, and by the way, they use hardly any putty when they do it the right way. But here's what I mean. Psychologically, you might think it's not in pre accident condition, but let's say it was a twenty twelve. The it goes by value is the value that is putting. Is repairing that door any different really than replacing the door. They don't. It gets
it gets to a point of reasonableness. Okay, and that's why I said on twenty seventeen, you're on the brink. Yeah. I've talked with the body shop and they're they're willing to work with us on that. So second question, okay, I would I would go ahead. Do you have another question? You said? Yeah? Who is responsible for substitute transportation during the repair? Okay? Ultimately the company also have to provide that. Ultimately it's
the other driver. Okay, he's responsible for everything. Then it goes to his insurance. But if his insurance refuses to pay, or if he refuses to pay, you either use your own insurance or you sue them. Small Queen Sport, Yeah you could. Yeah, yeah, but here's the deal. You have to make sure that if you accept any kind of money from them for anything that it's not full and final settlement, then you can't go
back for another bite at the apple. I miss something. Why would you care if they fixed the door perfectly compared to replace it with some aftermarket thing. It's not replacing Mark he was more concerned about. I think he's Bondo or something. Well, then that wouldn't be back to original I mean that's a whole different story. That means it wouldn't be back to the original position.
And it's not so much original as it is pre accident. And so, Bob, it's all what the court's called reasonable, and I think it's reasonable to expect on a seventeen that you get at least and by the way, they can go to a junk yard for a door too. You know, it doesn't have to be new. You understand that, right, Damn well, if you had listen, if your vehicle was a twenty twenty four, I mean, it would have to be what it is, they'd have
to find a door for a twenty twenty four. But if that's exacty years old, they got to they can find a thirty year old door. That's what we're saying, pre accident condition. That's exactly what we just said. So Bob, uh, just you know that's really where you stand. Three O three seven to one three talks seven one three eight two five five. And I notice people have been waiting a long time. I know, but but I want to uh go back to Vicky, right, Okay, Ken

Go to Ken Ken listen man. On that reb possession that you had, you said the car was repossessed. They sold it for a thousand bucks. I want to go back to that. You had a twenty fourteen Hundai Tucson, right, Well, yeah, it was my friend's car. And well it doesn't matter. I mean, you're on the
loan. It's yours too. So here's what I'm telling you. I think what they did was the illegal personally, and if you want to fight it, because they're going to come after you for the difference, which is like fifteen or sixteen thousand dollars. They could have gotten at least ten grand for that, which would have really reduced your deficiency. However, that's a complicated lawsuit. You're going to have to sue them and defend yourself against them by
saying they did not sell that for fair market value. Okay, sue the credit union. You mean, yeah, you're going to have to sue them for not following, you know, the proper procedure supposed to sell it at auction at fair market value. I have a feeling. I have a feeling they sold it for Do we even know if it ran? Yeah? The car itself could have been a piece of crack. Yeah, I mean, do we know if it actually ran at the time. Oh no, I don't. Okay, I mean, I'm just saying it could have had a
seized engine. Anything could be going on. Well, I know it wasn't running. It didn't have a seized engine. Oh, you're right, you're right. If it was there for a problem, it could be that it was only worth a thousand. I you know, I didn't. I'm not actually actually you know that's actually true. That could be.
