credit cards off. This was April of twenty twenty three. You started doing this, yes, And was this a payment plan ordered by the courts? No? I called them because I wanted to consolidate my credit cards and I did not want to file a bankruptcy, so I, you know, made the agreement with them that I would pay ten Now, why did you call them? Of all the people to call, you had a bunch of credit
cards and you wanted to consolidate them. Why did you call? Did you say Cordova Cordova with the B Cordova, Yeah, Cordova got it there. I don't know. I just looked. I mean, how'd you? Oh? So you did they advertise that they do consolidation. Yeah, okay, and tell me what happened. Okay. So I've been paying then and I received a thing from my one of my creditors. Uh, it's uh. I have to go to court on March first. I fear. I fear you fell for what could be a scam. Now the name of this place
is is it Cordoba Law? It's Cardova Legal. Okay, now listen, here's what I want to tell you. There are a few ways these places work. Okay, some of them are legit lenders, and they pay off your credit cards and you pay them. However, very few of them are legit lenders, and even the legit lenders charge you so much for these consolidation loans. They're often not worth it. That's one way they work. The
second way they work, and this is really insidious. They tell you they're going to settle your debt and you make payments to them under the promise that they will accumulate these payments and then they will make offers to credit cards to settle your debt. These almost never work, and what happens is people end up paying this company, and this company either goes broke and runs away with the money or they don't make the settlements quick enough and you get sued.
So, Geraldine, I need to know if you have any details of how they were going to work. How much were you paying them every month? And fifty two bonds? And what did that represent as far as your monthly payments for credit cards? What did that three fifty two represent? Was that more than your payments or less than your payments? Yes? Okay? Now how many credit cards did you have? I had two? And also they wait, that's all you had were two credit cards? You called them about
two credit cards? Yes, and a main one alone through main one. Okay, but what is that three credit cards or two? Well? There was actually three? Then? Okay? Now you had three credit cards credit card and you're paying this, you're paying Cordoba three hundred and fifty two. What did they say they were going to do with your money? They were going to pay, they were going to Why did they say they could do
this. Did they talk about how they did it? Well, they talk a lot, is crap I get Did they tell you to stop making payments? Yeah, they told me to not make any more payments to my creditors. Okay. Now which creditor is suing you right now? It's Capital One? Okay? And now it's even higher than it was originally, of course it is. They haven't been making payments, Yeah, they haven't been paid. How much do they want? How much does Capital one want? Capital

property stolen by freedom mortgage. Holy crap, let's talk about this now. How long have you had a mortgage with them. My original mortgage started in twenty twenty one. It was with round Point Mortgage, and I think I made two payments to round Point. Then I was notified that my mortgage had been sold to Freedom Mortgage. Okay, when was the same? I think it was October November of twenty one. And then right when the COVID started,
Freedom Mortgage put my home or my mortgage on for bearance. Who dan they Freedom did? Yeah? So Freedom took it over right and immediately put you on a forbearance. Yeah, because of the COVID. That's right when COVID was starting up and all of the version. And now how did that forbearans work? Oh? They told me I could make payments or not make payments. If I missed a payment, don't worry about it. So I
did. And what did they say? What did they say would happen if you missed a pay Well, they said, what would happen is the payments I missed would be rolled into the end of a loan, because got it. When the forebearans ended, they do a modification and they'd roll the payments I'd missed into the end of the loan and carry them as a lean, oh, I said, okay, So they came back and did you sign paperwork to that effect? Did you sign all the paperwork? No? I
didn't have any paperwork sent to me none. Okay. So on the surface, on the surface, it looks like you simply stopped paying. Well, I made a couple of payments, but there were payments that I did miss No, but I get it. Here's what I'm saying. Though you're saying it was the forbearance agreement. What if I'm not saying this will happen but Robert. What if we call them and say, hey, Robert had a for barons agreement and now you're foreclosing because he missed some payments. And what
if they say we never had a forbearance agreement? What would you have to prove it? Just their phone conversations are all recorded, But do you have the recorded one? Do you have them? No, I'm in the process of trying to get a VA attorney. Now what makes you see what makes you think they're going to be forthright? If they are trying to steal your home? What makes you think they're going to come forward with recorded phone conversations?
Why would they if they're subpoenaed by the court. Don't they have to unless they don't have them. I mean, they can simply Listen. What I'm saying is if they're crooked, and if they want to take your house and you say you had an agreement and they say you didn't, they don't have to do anything. So I don't know what you have. Robert, you say you had a Forbearents agreement. Hold on a second, important I want to take this break, man, But this is another important one.
I mean, are they foreclosing on you right now? Foreclosed and sold my poverty? They already did? Oh yeah, why did you let it go that far? I don't know myself. They offered me a loan modification. They told me that it would begin March first of twenty Oh wait, you already you already lost your home. You already lost it? Right when did you lose it? October eighteenth? So when did they start foreclosure back in
April? How many payments did you did you skip? It's probably about five or six, okay, But what happened is they offered me a loan modification. They told me not to make a payment the month before that my modification would start on March first, twenty twenty two. I said, Okay, I didn't make that payment the month before. I made March payment, April made June. What does this have to do with payment. I've tried to make the July payment and I was told, well, no, you can't
make this July payment because it's a foreclosure. Bro, it's a foreclosure. Robert new Robert, I got to tell you something, Okay, from everything you're telling me, I'm going to tell you the straight truth. Okay, We're going to try to help you, but I don't know if I can. Here's the straight truth. It looks like you stop making payments and they and they foreclosed on you. That's what it looks like. Now, did you go, I'm taking payments so they stop taking them from me. But
you stopped making them first? Well? No, after I made the modification payments. Yeah, well I made the March April May. They sent me three forms that needed to be signed. You said, listen, Robert. You said back, Robert, you said, back in twenty twenty one, when freedom took over, you went into a forbearance. Now you're telling me every one of those six payments, every one of them, including the first
one was withheld because Freedom would not take it. No. Once they started the modification on March first, they took March payment, April May, June. I tried to make my July payment, and as gallas as, we can't take a payment because your new modification is going to start. You know this has already been in front of a judge, right, I mean, this is done and over. I know it is. I mean, but did he go did you go, Robert to the Role one twenty hearing?
Did you go to a hearing to argue your side? I wasn't aware of any hearing. I'm seventy one years old, Robert. Hold on, just hold on, Okay, this is a very very serious and sad situation. Gap coverage was sold to people as a way to pay off your mortgage balance when you get in a wreck and your car is worth less than you owe. It's when your car is worth more than you owe. So what I'd like to know is, though GAP doesn't just cover people who've been stupid in the past and have a
lot of negative equity. So there are limits to GAP coverage. Is that correct? Yeah? Yeah, it specifically states on every loan gap can I can imagine at least that I've seen it always excludes carry over balances from previous loans. Okay, but what about that loan? What about what if you overpaid? What if you did not have negative equity rolled in? How does it deal with negative. How does it deal with simply a car that lost value or you paid too much for it? Well, it does it.
Here's I can tell you. I'm looking at one right now. The exclusions to it are overdue loaner lease payments. Financial penalty is imposed under a lease for excessive use or abnormal wear or thera. If this is a lease, obviously, security deposits not refunded by a lesser costs for extended warranties, credit life insurance, health accident or disability insurance purchased with the loaner release, or
carryover balances. That's what's excluded on this Now. I heard there was always there was an exclusion of percentage loan to value, like they won't go beyond one hundred and twenty five percent. I have absolutely seen that this particular carrier. I'm looking at two different ones just because I knew you were calling about
this. Neither of these two carriers that we write state the twenty five percent, but I have absolutely seen it. So, Brian, it is possible if you were stupid and paid too much for a car, and you owed ten thousand more than it's worth, that that gap cover. As you're looking at would pay for it as long as that ten thousand dollars wasn't in the form of you know, uh right, the extended warranty or the you know, credit life, the clear coach, you know what I mean, right
right. But the fact again, I want to make this clear, the fact that you were stupid and paid too much does not enter into it. They'll pay these two policies I'm talking, but I am with you. I have I've even helped people that have called your show that they sent me their form and it okay showed a twenty five percent. I had a caller yesterday one other quick question and then I go to gg Wink from Wink and Wink
one other quick question. I was told gap insurance is going away. No, I have not heard any of Okay still definitely available on is it a good coverage to have? You know, it is in the first couple of years that you own. If you buy a brand new call our loan, gap is is definitely something that would be worthwhile for people. But if the car is you know, two, three, four years old, at that point, it's already lost that value and hopefully your loan account has kind of
regulated, if that makes sense. So, okay, I understand how much is that coverage? About? How much does it cost? Oh, let's say sixty seventy bucks a year with the show, So it's not expensive. Okay, And she's been making payments since last year of three point fifty two a month, but the consolidation company has not been making payments to her creditors. Now she's being sued. Have you heard of this happening before
all the time, all the time. It's in the fine print, most likely, but they do not explain that to you when you sign up. Then why are you making payments to a consolidation company? Is it under the guys that they're going to get together a lump sum of money and negotiate exactly, and they pay themselves first, so you're first paying them usually then you're
building up a fund from which they can settle. And if your payments are three hundred and fifty dollars a month, you're not gonna get there in time. You know, getting sued takes about a year year and a half from default, So if you're not making pretty large lump sum payments, there's never going to be an opportunity for them to settle. Debt effects. I would
say, I have never seen a debt consolidation company work. I've seen them, do you know, maybe the one or two little debts, but we get We get the folks after they've been sued, and they're usually somewhat bewildered or frustrated or angry and Jardine you may not want to hear this, but the reason I have GGI wink on. She hired an attorney's firm. Though it has it's not where they pay a certain amount to this to all these credit card debts or whatever. She entered into an agreement for three or four
hundred bucks a month for an attorney's firm. A law firm to actually negotiate to debts down. That's what she entered in. Mark, That's exactly what she did. That's what we're talking about, and that's what fails. Ninety eight percent of the time. You hire this firm. This firm promises to negotiate your bills and they pay with the accumulated money that you've paid monthly.
And as Gigi explained, they first pay themselves. So if you accumulate in ten months thirty five dollars, that pays the law firm, and then they hope that no one will sue by the time they get another lump sum. The problem is it doesn't work. So so anyway, paying them, you know, two thousand dollars a month, right marketing Mark, Mark, What was the point though, What was the point of what you were saying. I didn't get. They're not collecting money from her to pay the credit card.
They're just taking three hundred a month for legal advice. Mark. That is not true. If it's a debt cansis way to their website and looked at how they operate. It's a law firm, okay. But if it's a debt consolidation company, the agreement usually says, they will accumulate lum sums of money and attempt to negotiate down your balances. Now, I don't know about this one, but that's how they all work, so maybe this one works differently. No matter what, if they told her to stop making payments,
what why would they do that? I mean, are what are they because a credit card debt? It's non secure debt. I'm sure they were trying to negotiate it down to a lump payment. I know, whatever it is. What I'm trying to tell Geraldine right now is stop making those payments, Cheraldine, and name them as name them as one of the creditors in your bankruptcy, because you're going to need a bankruptcy. You're never going to
get out of this debt. Okay, that's the hard fact. But wait a minute, but there's good news because you can get out of that debt. And you know what, a bankruptcy isn't the end of the world. If there's no other way. It certainly is better than having a life of
debtedness, I mean, I indebtedness. I would definitely contact Wink and Wing have them start a bankruptcy for you and get these people off your back, and you better do it quickly and you make and whether and whether or not they're a law firm promising to negotiate or they're a consolidation company promising to do both, it doesn't matter. They do not work. They do not work, Gigi, Why would any why would a credit card company settle for anything?
I mean, I mean, have you heard of that happening? I guess now? And then if they know somebody's going bankrupt, I don't know. What do you say? We do debt settlement and it works, but you gotta be realistic. It's not going to be better than fifty percent. Fifty percent is a good deal for settling debts, and they want it right
away, yeah, and they want it in one or two Okay. So if she's been three hundred and fifty a months just for the legal fees, as Mark said, and they come back to her with fifty percent settlements, she can't do that right, which should have been part of the plan from day one. If they're a legitimate law firm, this person should know exactly what kind of funds she's going to need to tap into to settle this debt

message clear. Debt consolidation companies, whether they're a law firm promising to negotiate your debt or people accumulating money to make lump sum offers, they don't work. They don't work. Most of them take your money and run. In this particular case, they take that it's a year for their fee, and then in addition to that they come up with a settlement. You have to come up with a lump sum. It's not going to work. So just remember that if you get that far behind, you shouldn't. But if you
do, bankruptcy is sometimes your best option. Unfortunately, Robert, you have an issue, and we talk to you, and I want to I want to continue here quickly. You had a mortgage. I want to make this clear. With Round Point mortgage in twenty twenty one, you freedom took it over and put you on a forbearance agreement. Even after this is what you told me. I want to make sure I'm absolutely clear. After you were put on the forbearance, you continued to make payments. I missed about five
payments my hold on. But you said you continued to make payments until they refused to take them. That's why you missed five payments. They started once they started a loan, modification offered me to modification. That's when I were doing making payments. It was March of twenty twenty two. Okay, I sell make payments in March, April, May, June, and when I tried to miss it before that, Robert, Really this is so this doesn't have to be confusing. I'm really trying to make it simple. What I
really need to know? Okay, what really is premier here? You stopped making payments at one point you said it was because they refused to take them. Is that true? I didn't know anything. And he's using the excuse that he's seventy one years old. Robert, here's
the sad fact. You lost your home. You lost it because of not making pays. You did not have the forbearance wallpapered. It sucks, but it went before a judge and there's nothing we can do about it now. If you'd like to give Kelly a case number, we'll look up the case.

If anyone right now is considering a forbearance agreement, or if you're in what you believe to be a forebearance agreement, or you entered some kind of an agreement during COVID and now you're being bugged, please call us before the foreclosure at the first sign of trouble. non refundable deposit to put me on their wait list. And this was how much did you pay them five how much? A five hundred dollars? Shot it? And you did that last year? Correct? In January twenty twenty three? Yeah, got it. They told me the estimate appointment date was going to be June of twenty twenty three. Once that appointment date came and a month after, I would call them back and say, Hey, what's going on? Where am I at in the line? Right? They would
say they still finishing a couple of cars. They had an issue with the lift issue finding help to work in the shop. So have you ever gotten into that body shop? No, sir? Why Every time that I've tried to call them to see where I'm at in scheduling to bring my car in, they always tell me that there's some cars ahead of mine. We'll call you back in another month or so. Let you know, crapp setback. How did you find this body shop? Daniel? I was looking high and
low online between Google and recommendations on Facebook. They were one of the last body shops in Plablo that explicitly works on older cars, classic cars. Yeah, and I just found them online. They had some good reviews and a good website. I just gave it a shot, Okay, where does it stand today? When was the last time you talked to them? I talked to them a couple hours ago this morning. What did they say? I asked them where they're at, and they said they still had a couple of
vehicles ahead of mine that they were still finishing. And at that point I asked them if I could have my deposit back. Of course, they said because it was non refundable. Oh but I've been so patient and kind with them. They would give me half of that back. But my argument is, we're eight months past my own No. No, listen, listen, listen. First of all, it's unconscionable that they would take a deposit more than a year ago and now say that, uh, they're going to give
you half of it back. It sounds like a bunch of other scammers we know in the car business. We need someone to get on the phone and to talk to these people for you and to tell I mean, they're full of crap. I think you could go to small claims court and get a judgment immediately. But let's try to reason with them. Why in God's name do they feel they're entitled to even half of it? That's what I don't understand they're not entitled to any of it. Why they say it's non refundable?

What is so sad and hearing some of these callers come in where they have just gotten in such a bad place with companies, right, and it could have been prevented, right, that's right. What this is about scheduling calls to come out four times a year for every part of your home. And there's no extra for those calls, there's no part of them. See. So when you do the math, if you can do the math for membership and it works out, then it works
out. It absolutely works out. Just one of our calls. So this is for the plumbing they'll do a water heater flush. Yeah, that costs you four hundred dollars, right if you wann't a member. If you're a member, it is free. So normally this is twenty nine and even on

car is registered. Okay, I'm trying to just call Denver County and talk to a person but Denver County, Okay, Denver County can issue a title with a lost title if it was doubt and never received did Ford Motor Credit. They should be able to tell you if they ever mailed it out. Did they tell you that? Yeah, they said they did mail it out, Okay, then I would believe them. Ford Motor Credit. It's pretty cool. So if they said they mailed it out and you never got it,
it's a lost title. It's that simple. Yeah. And when they mailed it out, she lived in Arapaho County, so it would have went there. Now she's moved in. Sure, I took my car over to a new Big O Tires for the first time in six years, and I thought I could striving that it's closer and a We went there for an oil change and they told me, hey, you know, pull synthetic, but you also need to take care of the check engine light, which is we need to remove and replace your thermostat housing and that'll take care of the light. Wait a minute, how did they know what the engine light was? Did they pull
a code? Yes, sir, and they so they pulled the code said it they needed to removing replace a thermostat housing, okay, well as well doing alignment, which I didn't notice any alignment issues. Well these listen, these are up sales. I mean sometimes they recommend things you need. Sometimes they don't. But you know that's not I mean almost every car could use
an alignment if you don't remember the last time you had it done. So you had an oil change, an alignment, and you had the housing done on your what on the fifteenth on the two and fifteen g wranglers, sir, got it all right? So what's going on? It's been just under two months, less than six hundred miles around town, and I noticed all my oil is ending up on my driveway and I'm like, that's weird.
Something's going on there. And then my check engine light came back on, and my alignment's so off that my steering wheel got to hang to the less to go straight. And then now the tracks control lights on as well. So I call them. They tell me to bring it back in and I say, hey, guys, look, every three things that you guys did is now having an issue again. Can you take a look and see what's going on now? They're telling me, oh, yeah, so it looks
like we got it. We Basically the reason why I check engine lights back on is now you have an issue with your sway bar links, your alignments off? You need new How many miles on this? How many miles on this total? Seventy nine thousand. I just did four thousand dollars worth of work about a year and a half ago. Over well, hold on either either what they say is right or not. I mean, why don't you take it somewhere else to get another opinion? Like if you're down in the
springs, go to Honest Accurate Auto. You talk to Jesse and you say, listen, I was sold the oil change. You got the oil change, you got the alignment probably and the oil filter housing. So now ask him do you need these other things or did they cause problems? He'll tell you yes, sir, and to cut to the chase. I don't waste your time. But the main reason why I'm calling is because the bearings, all that stuff I had, all that replaces a year and a half ago,
like four grand were of work and it was all brand new. But that's not my main issue. The main issue is that with the oil being all over the ground, right, they said that, oh, well, what we noticed when you brought it back in just now is actually your entire oil filter housing is cracked. And I said, well, you guys just change the filter. So wait a minute, didn't you say they did that? Didn't you say they did that housing too? That was the thermos that
housing, Oh never mind, got it, got it? And now they're saying now they're saying that the oil filter housing has to be completely replaced, and so does the engine oil. Okay, but Alex, is your message to us that big O' broke these things or that they're trying to create work? What is your message? The message, to be clear, sir, is that the oil filter housing when they replace the filter. From calling around other shops, they're saying, more than likely they overtort the oil filter down
and they cracked the housing. But they're trying to tell me that they're not going to stand by that and that I need to come out of pockets to replace the whole oil filter housing now, even though they just change the oil filter, they're claiming it's a coincidence that within six hundred miles my filter housing cracked and it has nothing to do with them. Crankd Maart, What do you think? What do I just don't know. I checked out by somebody
else. I mean, he's saying it wasn't leak and before if that housing was cracked before, well it would have been leaking right, And it started leaking very shortly after I left, and it was just as small. But whold on the other thing is, I don't know just by tightening an oil filter, I don't know how that thing cracks. Maybe Kevin caukn over a share it and can shed some light on it. But by hand tightening or even ratcheting down an oil filter, I have no idea how that housing would
crack exactly. That's what I was thinking. Marked those are way softer or I mean they're just aluminum tin can or something. I don't see how it would crack your housing, he told me. When I just went picked it up just now because I asked for the print out so I can get a second opinion. He told me that he kind of spilled the beans on accidents, claiming originally that they had nothing to do with it, but then he decided to omit or say that, well, yeah, you know, these
housings that come stock on these cars are generally plastic. And he's like, so sometimes, you know, with these older ones, when we're going and tightening down these filters, it can just crack the whole housing all the way down. So you know, it just happens. We just did three last weekend. And by the way, Alex, if that's the case and they didn't do anything wrong, it could be brittle or old. I don't know that particular car. I mean, we could ask one of our experts.
But what do you hope to accomplish? I mean, I would take it and ask if Jesse tells us Tom this thing was brutalized and he doesn't need bearings and all this, then we go to war with Big O. But we need to have some intelligence first. Yes, sir, I'm actually I just pulled up to the old shrap by used to us. They've always done great, honest work for me. Who's the old shop you used to use? right because they're concurrent warranties and they don't add any protection whatsoever. Go ahead. So anyways, I just so I have thirty two thousand miles on the truck right now. I went to Discount Tire to get tires. I want snow tires. My current tires are still good because they have the real deep tread, but I never rotated them, but they still have They're still in good condition. However, Discount Tire could not get my right rear wheel off
because the lug nuts would not come off. So I took it to Castle Rock Chevrolet. Of course, they're all upset that I have not been going to them for the oil changes and tire rotations. I do my own oil changes myself, gotcha. So because I did not use use them and I've never rotated my tires, they're saying, well, that's neglect and Chevrolet is not going to warranty your vehicle. So I went to wait a minute, wait a minute, Chevrolet is not going to warranty any part of the vehicle.
Or they're not going to warranty that one wheel thing. That one wheel Okay, okay, that's a toss up. That's not totally unreasonable. What they're saying is had you rotated them as you were supposed to, that stud would not be stuck. So anyways, I took the vehicle too, because discount tell your partners with breaks plus. I took it to breaks plus. They were able to get it off within forty five minutes. The lug was bad. They said it looked like it was bad right from the manufacturer.
So I have everything taken care of, but I just wanted to let hold on. So wait a minute. So they say the reason it wouldn't come off had nothing to do with the neglect. It had to do with a bad MANU. How do you manufacture a bad stud? I mean, did they have to take the stud out and put a new stud in the wheel? You cross thread when you put it on? You mean at the factory mark? Is that what you're saying? Yeah, I mean according to whomever his expert was. Big. Oh, Now, where did they say it
was cross threaded? Where the nut went on or inside the wheel? I think it was inside the wheel because they had to snap the old lug off, and then they drilled out the old lug and then put a heating coil in or tapped it or what now, they just pushed through generally. Yeah, they didn't have to redrill it. They said that if they had to redrill it could have taken leaving it there. But we get it done.
So they basically got it out. But they said it was cross threaded, but I don't understand if it was cross threaded, how did they get it out without ruining the threads that I don't know. I don't know if was cross threaded or they had to snap the old Do you have the old parts? I did not keep it? No, Well, how are we going to prove this? Well? Like I, like I said in an email, I'm not I didn't have to pay for it. It's under discount tires
warranty. I'll wait a minute, So you mean to tell me that dis way? Wait? Wait? How can this be under discount tire's warranty? How did that happen? That's just what they offered because they came in and took but they never got it off to be let me get this straight. When you went to get your tires rotated. They never got that off to begin with, Is that right? Correct? They just they just said they'll take care of it because I bought the tires from them. Well that's really
really nice. Holy crap. They didn't even touch that rear stud and they're taking responsibility for it. Yes, they tried getting it off. They couldn't, so they send me to I get it lost because they partner with breat. But what I don't understand is why they warranted something they couldn't get off. They never even I mean they obviously didn't cross threaded. Correct, that's niceough. Okay, how much would this repair have cost you had they not
taken care of it? I don't know, because I would have probably thought with Castle Rock Chevrolet over it, because I'm still under warranty with them. Okay, whether Castle Rock should cover this or not, I mean, what do you want right now? Since it didn't cost you anything? What do you want right now? Okay, Mike, that's a good point. What you're saying is there would be no skin off their back do this repair and gets because they make somebody happy. But there you're thinking they weren't going to get reimbursed for this. Correctly. So I think, however, another way, and that is from all my ears dealing. Let's stay with Purefoy Chevrolet over the years and Roally sold and he's not there anymore. But Perfoy Chevrolet, they would actually
go to the manufacturer for the customer and plead their case. They wouldn't just turn them away. If it autos something the manufacturer should cover or there were times they simply covered it themselves just to keep people happy. What would it really have cost, you know, Castle Rock Chevrolet to replace that stud for goodness sakes? Correct, But think of it from a business perspective. Just dollars and said, try to take a modi and completely out of it.
You have a customer who already has proven that he's not going to service with you. He's probably of previous behavior, going to service somewhere else. Yeah, he wants you to do some goodwill, reach into your own pocket and pay for It's not your fault, right. I can't. I can't argue. I can't argue with that logic. They were thinking, Wait a minute, this guy didn't even bother coming here once. He'll probably not come back
again. Okay, maybe maybe, Mike. You know what, Like I said, it used to be we do anything we could make someone happy. You're saying dollars and cents take over to some extent, take emotion out of it. But I do agree. I do agree with what that guy said. My guess is he works for a dealership. But I one hundred percent agree. I'll give an analogy in my own life, back in my goodyear days, if I had a customer that would come in and purely just want a free flat repair all the time. You know, eventually they're at the bottom of
the barrel. Man, They're the ones that are going to be waiting in line the longest because they don't even buy an oil change, or the ones that just come in with the nine to ninety five oil change coupon and never buy anything else. Usually at the end of the shit, I get a company credit card, They total everything up and I'm paid. So end of the night comes,
I handed my ticket and that was it. They said we'll send you a check and I thought, well, okay, it's not usually how I do this, miss But hey, Rachel, may I ask you something. As a food truck owner here doing gigs like this, do you usually get the Do you usually get the contracts in writing or is it a handshake? Or how do you do it? It is usually through an email or this time it was through a third party service called Truckster. So I was hired
through they called contacted Truster. I was hired through Truster and I was just told that I would cater their company party, that there would be tickets, that I would be paid for the tickets. Okay. Now, now, after about a week or so, I received an email saying that they were going to pay me ten dollars per ticket and that is and I kind of lost it. No, wait a minute, how much did you think you would be paid per ticket? The ticket price, which is the item that
the customer purchased. This is how I've done business and this is how food Oh wait a minute, hold on, so yet it specify in the email price per person that was capped. No, they just said said the gusts would have a ticket. And this is how it always works the host anytime it's a host paid event. So so you mean there was no limit on that ticket, like what if I bought what is the most expensive thing? I mean there was no limit on a ticket. So it was one ticket
per one item. I think the highest price I had on there was actually on that night was fourteen dollars. You know, I do have some menu items that are up to fifteen, but on that particular night. So when you say per item, if I go get a meal and a drink, are they is that two items? So we were not to provide coverage services since they had a bar inside. So it was okay played just for an entree or an app. I get it. So one ticket per food item? Got it exactly. So, and give you an idea what kind of
truck is it? Is it American food? What is it? So we have a plant based street stood truck. So I do things like soafas and Asian tacos and curries things like that. I get it. So what ended up happening? Did they send you the ten dollars per ticket? So in an email, they stated that they would be pain me ten dollars per ticket after the event. I said, absolutely not. There is no verbal or written contract that these tickets were supposed to be ten dollars or else I would
have completely redone my menu. I would have cut the portions in half. I would have worked out something so that it would have been a fair ten dollars ticket price for me. And sort of, well, no, I get it, that makes sense to me, but right, hold on, what do they say that was never the deal? I mean what, I can't see the Crawford Hotel wanting to beat up on a on a on a female owned business. What is there? What is their take on this? What if I called them, what are they going to say that you got
it wrong or what? Well, So, what it happened is after I had called them out that there was no agreement, no verbal contract that right tickets for worth ten dollars, they handed it off to another member at the marketing that's apartment at the hotel, and they finally decided that they were going to pay me the ticket price because I had written on the back of each ticket what the item was and how much it costs I did also mention that
it was very very rude for them not to cont me a twenty percent gratuity, which is customary, since I now had to cover the cost of the permit. Well, though, wouldn't that be up to the guests to tip well because the guests were getting screen tickets. Okay, tell me how that works, as the host who's paying for the event would do gratuity. I didn't expect it after. I wanted to just let them know that it was very rude and very uncustomary to tip a service industry or to not. But
you did finally get them to bend to the ticket price. Correct. But may I ask what the difference would have been? Can you give me, Rachel, give me an idea of the numbers? What would the numbers have been? Like? Give me an idea of how many tickets you sold that night? I sold about seven hundred. I think it was around seven hundred and fifty dollars on my price of the food, so that was a large portion a good meal about fourteen dollars a ticket, about seven hundred and fifty
dollars just to their GasPort. So they wanted to comp me only around five hundred dollars for Okay, I now would have washed money because I also gave them full portions. Got it? So I also have not and paid. Wait a minute, so they agreed to pay but never did pay. You never paid, so to this day, hold on to this day, you've not been paid? Correct? Are you kidding me? There? Wait a minute? Is it? Are you crazy that you have not been paid a dime? I have not? And this is this was when? When was
the event? This was on New Year's Eve? This is crappy. This is crappy. I mean, come on back to them, and who have you been? Who are wait? Who are you dealing with at the Crawford? You'll see this happen. You'll
see this with celebrities. What would the intent, though, be for a private individual? Why would anyone want to worry? Well, if you're mad at them? Okay, okay, if you're mad at the president of the dollar store, or of a car dealership, or a salesman who works at such and such. I mean, it's really just to harass people, But man, does it get scary. And doxing is not illegal, they're trying to make it illegal. But Mark, you're right, there were a lot
of I don't know if they're Democrats or what. They were liberals for sure that did that after the Roe versus Wade decision and they went out highly doubt they were liberal Republicans. I wanted to tell people. I don't know if you heard our off air discussions on the stream I was talking about after I got this VPN, which I don't use all the time, but I use it sometimes. It's to cloak your identity. So I do that when I'm probing companies or I'm looking on the dark web and I'm trying to find you know, doing my what I call my intelligence work, where I don't want to be tracked or found, and so I use a VPN, and I thought the VPN was slowing
me down. It turned out it wasn't. But I don't connect all the time to the VPN. But this VPN mark is amazing when you're on it. Do you know that it told me places where my information was being compromised. It told me, I mean, it said go here and go here, And I went to those places and sure enough they had stuff and I was able to delete it from old accounts. And I didn't know VPNs even
did that. But they do a deep search of you and find where your username and passwords are being not necessarily used, but where they can be known where data breaches have taken place. So that to me is an incredible reason just you know, for having one and every now and then signing on to it. That is really smart for individuals. You see this a lot corporations, corporate culture. They do this to protect their data because they're trying to
be hacked every which way right right right, and with remote work. I think private individuals are realizing the importance of this, so anyway, it's so important. Doxing has become the big deal, and I'm telling you that it it's scary. There have been like dates of birth, social Security numbers, addresses where people have had identities established for them and loans taken out because of

I remember your words marked during COVID, and you said, do you remember this? These four barons agreements are going to cause
people as much trouble as if they missed their payments regularly. Without one, it's going to be a hell on them. It's going to cause a lot of foreclosures. That's exactly what they did because they expected, in some cases for you to refi at much higher interest rates with payments added to the back, which is me with the balance added to the back. Or they expected you to do a second to pay off the ferance amount you didn't pay, or they expected you to make it up in a lump sum. There were
so many conditions that were almost impossible for people to bear. But yes, forgive me. Can you explain what the forbearance system is? Well, normally a forbearance is we're not going to foreclose on you. We will make some kind of an arrangement to allow you not to make a payment. Okay. During COVID they did it where a lot of them put it on the end of the loan. Okay, but you ended up owing a lot more because you got interest put on the back of the loan along with unpaid principle.
Now, most forbearance agreements did not do that. The payments you missed you had to make up. That's what people did not realize, you had to make them up. They presented some people with lump sums that were ridiculous. Others had to make payments on that lumpsu or not a lump sum, but had to make payments on the forbearance. And then what this guy said was and this happened to a lot of people. So I believe Robert, but there's nothing on his side. He never got a forbearans agreement in writing,
He never got anything in writing. He just stopped making payments so they foreclosed period. And he's a wait a minute, I had a forbearance in agreement. But he can't prove it. You can't prove it. Yeah, you know, So you just stopped making payments and you claim that your company gave you a forbearance. Well, guess what. That doesn't always work. So I'm anyway an attorney. You also know there are a lot of people who think, wait a minute, they're coming in and taking housing and hotels and food and
what. You know, we can't afford it. And I just need to know about the right now. And I really mean this sincerely. I'm not trying to trick you or anything. You stand for immigrant rights, and you'd say that the new immigration law being proposed is there's some bad parts to it. So could you ask I want to ask some basic questions because I don't think anyone in radio i've heard or on TV has interviewed anyone talking about immigrants'
rights. We've heard people bitching and moaning about immigrants, complaining about immigrants. We've heard about US running out of money trying to take care of immigrants. We've heard all of that negative stuff. So there is a humane topic here. Let's face it, there are people. They don't want to just toss people away. But what is your feeling, first of all about coverage? Do you feel the coverage is unbalanced in any way? Yeah, I definitely
think that there's a negative in the coverage. One of the things that's been really frustrating for me is some reporters have been getting the framing wrong. Right is, I've seen some coverage reporting people who are here right now write new arrivals as illegal immigrants, which is actually incorrect. They're actually as silence seekers and the only way to seek asylum is to present yourself out a port of entry, which is what people think they still get for Mark, Mark letter

It seems to be the time when people want to talk about immigration,

But I think by and large, like people who are getting assistance from the cities and therefore are new arrival. The majority of new arrivals have a numbers, which is an alien number. It is a number that you get when you pass through a port and
you create an appointment with ICE. Okay, so your appointment might not be for like a year or two from when you got it, but that would be somebody who is presented themselves there in the process. And I think that's the vast majority because the city is that not necessarily supporting people who don't have a numbers. They are you know, we're kind of requesting that people have a numbers in order to guess it's okay, so a books, But here's
the thing. What if cities can afford and states can't afford to help, what are what is? What is your position on that? And again, I truly, honest to God wanted discussion Colorado Immigrants, writes coalition. What are cities and states supposed to do they can't afford it, shouldn't they at least limit the border right now until they can work it out. Yeah. I do think it's a federal government responsibility that is being neglected at this moment.
I don't think our federal government is doing enough to help coordinate. Part of the reason that it's been more stressful for people arriving and also for the cities is because there's no coordination, there's incentive to make this more political than it is, you know, instead of treating it like a humanitarian moment right
where we can choose to welcome people. I do think their cities are right to be calling on the Biden administration to actually step up and the coordinate and to provide reasonable funding, right because it's not reasonable to expect to these cities and states. When they had one thousand a day, that was pretty good. But now we're talking about what twenty and thirty thousand? I mean, is there a limit? I mean I guess as an organization, what are you trying to accomplish? Do you think there should see be some
sensible process or limits or and when you say, the federal government. I agree, the federal government isn't doing much at all. So what do you see as a solution. Yeah, we also want to see an orderly process. We want to see people have reasonable time, you know, like amount of time before they're going to see a judge, and also have access to council so that when they do see an immigration official, they're able to really make the case. Because the thing about asylum is is a life or death
situation. You never want to be in a situation where you are fleeing your home because it is unsafe, you know, for you and your family, and so the stakes are really high. We want to see it be an orderly process. We don't want to see people put in situations where they're in additional danger. Right when Title forty two is in effect at its height, people were being exploited and put in extremely dangerous situations when they were forced to
wait on the Mexico side of the border. And so we also want to see a coordinated, efficient border process. I don't think that means turning people away. People have a the United States has a legal right or a legal obligation, sorry internationally, to have an asylum process. I think people deserve the right to make their claim right, and if they don't, and if they have the resources to make a strong claim and they don't pass, and I think, you know, it makes sense to have processes for who gets
in and who doesn't based on their claim. But right now what we're seeing is just a big effort to undermine and to remove the United States legal responsibility to provide asylum. Well, sure, there are those who think hell, I mean, you know, why should we take care of the world. There are others who say this how the country was founded. You have that die cotomy no matter what. And I don't want to make a political foo pit here, but I'm going to ask you straight up. Do you think
both parties have some right and some wrong? Do you think one is mostly right one is mostly wrong? How do you feel about the political process? I mean, right now with this White House supplemental that is being pushed, which for folks that don't know the White House Supplemental, it's a budget bill, but it includes funding for weapons for Israel and Ukraine. And the negotiation that's being made is to essentially eliminate the United States responsibility to asylum, to
have asylum and increase mandatory detention, it increases funding for immigration reform. So it's that trade off that's being made right now, and that is being led with bipartisan efforts. So we have Republicans and Democrats who have decided to you know, turn their back on immigrants and to make that choice in this historical moment. So do you feel that's being done. Do you feel that's being done because it's the popular thing to do and they're trying to get votes.
I mean, do you think that that basically people have a sentiment against immigration
in general? I actually don't. I think what I've seen in terms of actual people, right outside of politicians and outside of the media, I think people have really been wanting a solution, whether that's you know, like MARKT sorry I have I have the hop in two minutes, but whether that's more importantation or yeah, people want to see, you know, a passing citizenship, like how our pools show that people support creating meaningful paths for people to
be here. Okay, So I think I do feel like the sentiment and the ground shifting is happening more and in the media, and it's also happening within the political spaces. What matters is not who owned the vehicle, but if the vehicle is registered with the apartment complex. So did your grandson when he got the vehicle, no matter what it was, a year earlier, a week earlier, a day earlier, did your grandson go to management and register that vehicle with them? Well, this is the clarity on that they got it on the night of the twenty seventh, So management company wasn't available at that time, and they towed it that night. Oh, the very first night they got

So so the night true that Connie hold on, the night that they got Connie, you're saying that the very first evening that they had the vehicle, the very first time in their life that they had it, or they I say, they it's your grandson, right, is your grandson?
