Three h three eight six two five five five four Brandy, What is on your mind? Brandy? And how can we help you? Hello? Brandy, Hi, my daughter's friends went to the bar on birthday night in Laramie, and she left with a young man and texted her friends Friday that she made it home. That was the last anybody heard from
her. She Oh my god, Wait a minute, Brandon, Wait a minute. So she was at a bar. Now, I want to ask a couple of things here. This is your daughter's friend. Yes, her name's Sabrina Geller. Okay, And it was in Laramie, you said, yes, my daughter and her friend. They went to the police and told him she was missing. After a couple of days, the police fold her she probably went into the woods to commit suic item to drop it. Wait a minute, now, I want to There's a whole bunch I need to
ask, Brandy. How long has your daughter known this friend? Since she grew up with her, since she was a child. She's now was the friends suffering? Was the friend's suffering from any depression or any anxiety or life problems? Sure not that she knows, right? Okay? Did the police really say she probably committed suicide? Leave it alone? Yes, sir? Did she really? I mean, does she have proof of that? Yes,
sir? They told her to. My daughter asked, wouldn't you at least like to go look for the body so that her mom can bury her. And they said, we can't right now. So my daughter ended up point and looking for and they went and searched. Heh, wait a minute, I need to know some stuff here. The bar that she went to. Did anyone go to the bar and say, does anyone know the young man? Did anyone? Don't to the bar? She knew the man to begin with. These are both National Guards or her young the young man?
We're both nash? Wait, wait, way, so you know for a fact the young man she left with was National Guard? Yes, how do you know that? How do you know that her friend? It's her friend. They went back to the bar. They looked at the videotape. They saw them leave together. They saw another videotape of them getting in her car together. Who did this? The police? No, police won't wait a minute. So this did this National guardsman she left with? Has he been
identified? I don't believe publicly? Know what I don't mean publicly? I can't, Brandy, this sounds where's your daughter right now? Can we talk to her? No? I'm in Nebraka. I actually just got to work. You guys called me on my way to work. Okay, good because you called us. We called you back. Now now, now, Brandy, I gotta ask a question. Your daughter is your order in the National Guard. No, my daughter was going to school in Laramie. And now, but was she at the bar? Was she at the bar with the
with the young lady or with the guardsman? Her and her friend were and went back to the bar afterwards and watched the video. Kid, Yes, they are the ones that are all but they were all together when she left with this young man. No, they left first and then went back afterwards to find out what they left her. They left their friend, the woman in the National Guard. They left her at the bar and was told friends from the National arm and her and they were told she left with a young
man from the National Guard. Correct. And when they looked at the video, did you did your daughter see the video? Yes? Did your daughter see her leaving with this young man? Yes? Did anyone attempt to see who this young man is? Yes? And okay, did they question this young man my daughter has yes? And his story has changed three times? Okay, Now, this woman, what's her first name? Sabrina? Geller Uh I said, first name, Sabrina. So, Sabrina. When was
this when did this happen? Thursday? And she Sabrina Geller, has not been seen from since her body was found last night. Oh my god, well you should I think you should have led with that one. Oh oh my god. Okay, hold on out. Her body was found and now does it look like suicide? I don't know it? No, Okay, So they found us. Why I was trying to tell you, you have
to stopping me. They found her car. Kep stopping you. You said your daughter went to a bar in Laramie found and left with a young man doing They found her car on Saturday, and the cops still told them that's when they said it's probably suicide. They went up and looked for her on Sunday, still couldn't find her. On Monday they took out the helicopters,
still couldn't find her. On Tuesday, they found her body a mile from where her car was and said she was just underdressed and died of overexposure to the weather. And her body was found last night a mile from her car, off of the trail with her backpack propped up and sewed away. Okay, are people now? Are the police or is the medical examiner looking into this. Did they determine a cause death over exposure to the weather. Over exposure to the weather, So she was out and froze to death. No,
no sign of homicide or foul play. That's not what they're saying. What do you think? And also, at like five thirty, her phone supposedly sent some random texts to some random people saying what sound like thanks for being such a great friend. YadA, YadA, YadA. It was the exact same word for word text to ten random people, not like ten of her best friends. Just can this has made the news up there? I
just looked up. It has, Yes, it has yepring to get On Sunday, twenty one year old Sabrina Gello was reported missing to all Benny County Sheriff's apartment. Her carvers found a band run. What's that? What news? It's it's all over. It's every news outlet in Wyoming. Okay, because I called yesterday and nothing, no newspaper had seen it, and they were like, you have the first Well this one was published a couple of days ago, so I'm sorry. We're using different googles maybe, but this
one is all over the news about her. This is terrible Is there a possibility we can talk to your daughter? Can you give us a number, We'll call her off. Let me give you her number. Off the air. Hold on, off the air. Okay, hang on, Kachina, get this. She's on her way to work. Let's get this information and try to call the daughter. Hey, I have a question. What are our parents doing? I don't know. That's what we have to find out, doc. But the woman was in the National Guard, so was the
guy. I'm sure they're questioning her. I'm sure they are. I mean, but maybe they did. Suspect suicide for something. But I'm finding this all over the news, all over the news. Let's see. So, Sabrina Galler was found dead February thirteenth in the morning, and it said that Sabrina Galler was a student and active in rot C, missing since the eleventh, which is Sunday. Her last known whereabouts were Ranger Bar and liquor store on the ninth and uh. Anyway, that's a sad, sad story.
We have more coming up. Go with a sure thing Denver's Best roofer Excel roofing dot com. You don't pay a cent until you're content. A young woman found dead. She was missing in Laramie, Wyoming. Her name is Sabrina Geller. She's all over the news if you want to google that. I'm not sure
why the mom is calling, or the mom of a friend. I imagine they suspect foul play and she left with a young man also in the guard Now I have to believe that they're going to investigate all angles of that, So please give us a call if you'd like to talk about that, or if you know anything about it as well. Now, today is Valentine's Day and romance scams are taking advantage. Do you know that at least forty percent of older women not got ripped off, but we're in touch, have been
in touch, or have been ripped off. Now not all forty, but they've either been in touch, are in touch, or been ripped off in a romance scan. Think about that. It starts out first of all, with phony maloney, photos and profiles. Now, Deputy Doc, he had a solution, but I don't know if it's a fail safe. He said, do a zoom call, Insist on a zoom call or some kind of video call. Now, in some of the cases we've investigated, when women insisted on a video call, or not insisted but asked for one, the
guy had all kinds of excuses. So Mark, are you doing it? Tom? Yeah, of course it's a red flag. But I think they could fake a zoom call, don't you no, Come on, what do you mean? No? No, you don't think they could fake a zoom call. Well, I'm not sure that they do that. I mean, I think one way to protect yourself, and you know, the other thing
is you have to have some sense of your identity. If you're a middle aged woman and you're fifty or sixty years old, a twenty three year old soldier or oil rig worker, well, then normally, normally, here's what it is. Here's what it is. Doc Normally, you have someone in their Women starting at fifty and up are the biggest target, and you have men who are in their fifties. And see, they don't normally pose as twenty or thirty year old guys. Interested they're trying to make it somewhat credible.
And the guy might be forty eight to fifty five. That's there, but there are a lot that are sixty. Let me take Charlie, Charlie, what's going on with you? Charlie? Hello, Oh Charlie, are you the friend? Are you the friend of this missing girl? I mean yes, I'm sorry and we went to preschool together and oh my god. Sorry. Now, now here's what I want to know. She's she's obviously dead. Are are you thinking she was depressed and wanted to off herself or
get lost or what do you think happened? Honestly? Knowing Sabrina, Sabrina was a very strong person and always encouraged others to get help if if they were even even remotely, you know, stressed or anything. Sabrina was a very bright person and a very light in the world, and she was constantly talking to people about how they shouldn't be ashamed to go to therapy or anything like that, and she constantly encouraged those of us who did have any kind
of struggles or issues to go and get help. So personally, I couldn't see Sabrina going and doing something like this. Now, is it true, Charlie that when you went when did you first go to the police? She was missing on Thursday night? She went to the bar? Is that right? So she was actually seen leaving the bar. We did see footage from the bar of her leaving and leaving like the parking lot. Yeah, so
this was this young was this other young guardsman with her? Yes, in the footage he did leave with her, but obviously they just left the parking lot together. We can't say anything else. Our main problem is that we want to push the police to go and they still haven't even gone and gotten the footage, even though we've told them about it, and granted I don't know about this. Now. This is yesterday morning, before you know she was even recovered and we even saw anything. So, Charlie, don't you
think change? Things will change now that there's a body. We're hoping that just the police are pushing an investigation, you know. We had to push them to even get a search party or anything together. We went up on Monday afternoon, me and a group of one of her other closest friends, and my younger sister and my stepsister who was also a very close friend with her, and just our small small group of four girls were up there with one of our moms and we were the only ones out there looking for her.
There wasn't even a sheriff's car up there. And so we came down the mountain that night, or we came down from Bedewoo that night, and we made posts on Facebook and we begged to post them on one Wyoming Missings person and Missing Persons of America, and we begged and we posted, and
we begged people to share and get the word out there. And it wasn't until then, And it wasn't until we started pushing and we got the word out there that suddenly Albany County wanted to get involved, and suddenly the police office wanted to get involved. They didn't even post her as a most persons on her page until until like eight hours before they posted her sound. Now, now, Charlie uh it's been fair, Charlie, Charlie, to be fair, many times they wait twenty four hours. But I need to ask
a few important questions. When was when did you first suspect a problem? You went to the bar Thursday night? Were you expecting to meet her there? See? I hadn't gone to the bar personally. That was her other close friend that we weren't able to get a hold of this morning. And when did you, guys, or when did anyone first suspect anything? I mean, it's not unusual for a young woman to leave a bar with a
young man, So when did you suspect something might be wrong? We suspected something would have probably been wrong when she stopped answering her phone on Friday, around five point thirty, she sent a message to a couple close friends, and one of those being the close friend that was out there yesterday and the day before with me, And she responded instantly like I'm talking within minutes, and Sabrina didn't answer back, and that's pretty unlike her when she had just
messaged. Did Sabrina make any mention? Did Sabrina make any mention of going for a walk in the woods. No? And that was another thing that was really unusual for us is all of us girls who grew up together and were really close together. That was something that was a big thing for us because you hear it in the news all the time, but you never think it'll be you, but you always, you know, you always just hope
it's not, and so you always stay in touch. You always keep your location on and tell people where you're going and bring another person with you. It's not like her to just go out in the middle of February for a hike in the winter. Charlie, how old are you? Your friends? My birthday is actually tomorrow. I was supposed to celebrate my twenty first birthday with Sabrina. She turned twenty one about two weeks before me, and so
we're all about that age, twenty twenty one, Charlie. Does anyone and we're not accusing anyone or saying anything, but does anyone know the identity of the young man she left with? No, Sir, I don't know. Personally. We're trying to get more information. We know a couple of people who might know him, but you know, we only certainly maybe probably it probably wasn't his first time at Ranger Bar. No, I believe that it wasn't, but I wouldn't know for sure. Okay, I'm not twenty one,
so I haven't attended. No, I understand, you don't go to the bar. You're not twenty one yet. You're twenty one tomorrow. And what a mixed what a mixed birthday this is with joy and sadness and Charlie, this is a terrible, terrible situation on Valentine's Day to find out your friend has said, I, what do you think went on? What do you think? Do you think she was simply going for a walk and was exposed to the weather that sounds so unusual. Do you think she drank a
little too much? What do you think happened? I genuinely don't know. We we have so many unanswered questions and just so many things that you know, are still so fresh and we still just don't understand, and we're not getting questions too, and so we're just really pushing for resources and just for the police to have some kind of investigation and some kind of something and not just push it off as, oh, you know, she laid down.
Oh I can't imagine. I can't imagine they're not investigating you do know it's all over the news up there right. Yes, they told us they would be investigating, but we just oh they are. They're asking for all kinds of help. I guess it's the sheriff's department. All Benny County Sheriff's Department is investigating. Yes, we know that. We're in touch with them, and yeah, well you know, so at least you got their attention.
Unfortunately, you feel they weren't taking it seriously right away. Normally they do wait a while before they sound the alarm when they say someone is missing. When when someone says someone is missing. Now, what was the last text she sent that I don't personally have I was not one of the recipients.
Sorry, Okay, listen, Charlie, if you would do us a favor, my producer will get some information so we can stay in touch and you keep us informed, and then we're going to ask anyone who may know anything about it, or anyone to who you know who knows people there or are are following the case, to keep us informed as well. This is this is very sad, Charlie. And by the way, was it unlike her to leave with a young man or do we know if they got in the
same car or did they go on their separate cars? Do we know? No, she she was not parked in the parking lot. So the you know what we were able to see was just her leaving the parking lot. Were they leaving obviously together? Yes, they were. They were you know, walking together. They had walked through the bar together and left the parking lot together. Okay, Charlie, thank you so much. I know you're hurting. Happy birthday. I'm sorry to mix this up, but just I
don't know. I'm going to say a prayer for you. But this is a terrible time for you. I understand it. I lost a friend when I was younger. It's it's a terrible thing, especially when you're young. You just don't expect it more. Coming up, Go with a sure thing Denver's Best roofer Excel roofing dot com. You don't pay a cent until you're

Bie Tom Martino here three oh three seven one three talk three oh three seven one three eight two five five let me bring up my wishod here. We have Mark with us Mark Conkle from Probidenergy dot com in the solar business and they, of course do systems. One of their hall marks as a system starting at twenty one fully installed battery backup good for most houses, and that's after your tax credits. There's also financing available right in addition to that.
That's out of pocket twenty one, but you can finance that. I'll go ahead, sir. Colorado renew loan is a great loan right now. That's through the Clean Energy Fund that Colorado supplies, and that's available to all solar systems or any of the renewable energy or what solar solar batteries, yep, all those things. So you can finance that through Colorado Renew. Three credit unions participate in the program, and that's kind of where I've been directing
people. The traditional solar loans. The dealer fees are quite high right now. Okay, So, last time you were here, we had a question. I don't know if we adequately answered it, but it's a it was a text question on how much of that initial cost do you actually get a credit on if you add batteries, if you add a generator, or if you add different things insulation, does that all count as part of the system that gets the credits or do you have to parse out the solar part of
it. The solar and the batteries are both a thirty percent federal tax credit. Okay, But if you spend extra to upgrade insulation and that kind of stuff, there are some programs in Denver where they'll offset that, and believe it or not, Excel we'll actually offset some of that with rebates as well, and we do have partners in the industry that can do all of that. Okay. So but really the move now is to encourage people to do
renewable energy, I mean resolutely, big time air source heat pumps. So people just doing EV chargers, yes, quite often, Mark, have you ever thought of doing solar? For that? We do. I'm talking Mark you there. Oh he's not there right now, No, I'm here. Oh, I'm sorry. I didn't see you there. I'm sorry, go ahead. What did you think, Mark? Have you ever thought about doing just for the for the you know, like maybe even the motorhome or the
car? Now they can't. It just simply won't power my house? Man, I would never, I would. I think I'm the worst fit for solar ever, and I've had multiple companies look at it. Oh, I'm taking you don't think the payback would be there just for the the EV charger? Well, can't they do many systems? What am I going to spend seventy thousand dollars? I don't know. I'm talking about an EV charger. I'm not talking about a house. So for me, everything comes down to
this. In a lot of circumstances, people can spend X amount of money and get rid of their electric bill. It makes perfect sense. What am I supposed to drop? How much do you come out of pocket to charge your car? When the car costs maybe seventy bucks a month to charge? What am I going to come fifteen thousand out of pocket and make up for it in fifteen years? That's absurd. I don't know. I'm just asking
what about EV chargers? What are they running you? Know, it's just enough solar for an EV charger out out in your driveway or your garage or whatever. I'm just curious. Five thousand kilowatt hours, so probably two kilowatt system. How our solar two three found? Mark? How fast is let's get real though, how fast? Six or seven grand with a fifteen percent kicker? Yeah? The issue with that Mark is I hear where you're coming.
I'm not trying to sell those, I'm just wondering about it. Yeah, but Tom, what he's talking about would charge my car in six days? What are you talking about? Are you talking about a LoVa? You're not talking about us big charger then, are you? Mark? Yeah? You are. That's not how solar works really, it's an offset of what you are running. So we're going to offset your electricity pull from your utility. And could you make a standalone I'm just curious. Could you make a
standalone? You could? But you know, solar is built on an annualized basis because it doesn't produce as much in the January, February months, Okay, summer months, right, so you do have to have something to help augment it. Absolutely, that's why it's meant to be on a system. To me, solar is so great. And here's why. If I lived where I used to live in Castle Rock, I had sun hitting every part of my house, I could one percent offset my electricity bill and cash flow
immediately. That is where solar's great. Forget about the green I just don't care about that stuff. And people can send hate mail. That's just not my motivation to get. No. No, no, you wouldn't do it just for that. No, And I don't know of anyone who would do it just for that. My goodness, maybe there are PBEs. Ninety nine percent of the people are trying to save money. We have to take this break, but I want to tell you, what do you think. We've
talked about it before. The number one problem with married couples is not cheating with another person. It's cheating with money, sneaking money out of the marriage, sneak sneaking things that you buy, keeping debt from people, and hiding bad news about finances. All of that coming up. Three oh three seven one three talk three oh three seven one three eight two five five. This hour brought to you by eight eight eight Heating dot Com. And uh, you know they're doing high efficiency systems. They're also doing heat pumps by the way, for people that have solar and want to put the burden back on the solar.
And they have all kinds of options for replacements that save you going in with their great deals and also each end every month a company that you can trust. Three o three seven seven zerold two seven seven six eight eight eight Heating dot Com. So let's talk what's on your mind, Darlene, And you can call us of course all the time, anytime at three oh three Martino three oh three, six, two seven, eight, four sixty six.
What's cappening, Darlene. I'm trying to get out of a contract that I signed unknowingly with a water heater plumbing company to replace my water heater. How'd that happen? How did it all start? It started with my water heater obviously going out, and it was kind of an emergency, so I just I didn't do my homework and so I just called the first one that popped up in Google. And they couldn't come out Saturday due to the weather,
so they came out Sunday. And when when you said you unknowingly signed, what does that mean? Well, on the contract, the PDF contract that he gave me, it is above the signature box that says subject to a twenty five cancelation fee. It was not mentioned, however, and the box that I signed that was on the gentleman's phone was blank. There was no disclosure or anything on the See this is changed nowadays. This is happening to a lot of people. They're signing on iPads or phones and they don't
see all the terms and conditions. Darlene, why do you want to cancel. Just he I did my research after the fact, which does not help the situation at all. But they have complaints on Better Business Bureau. And who is the company? What's the company? The company is anywhere Ruter? Uh huh? Any you know, by the way, I have found that any company with Ruter in the name other than one is uh. I found them all to be ripoffs. I don't know why, but I have so.
So here's the deal. I don't know of anywhere routers are ripoff, but man, when there's Ruter in the name, there's usually trouble. And what I want to know is why do you want to cancel because of the complaints or the price? What is the price they quoted for a water heater to replace the water heater was twenty two fifty And what size is it? Well, it's a forty gallon. It's a forty gallon. I'm not sure
exactly. Well, let me give you an exam. If you went to Europlumbing Colorado dot net, which is, by the way, one of our companies on referral lists dot com that I talk about all the time, for a forty gallon tank, it would be thirteen ninety nine one three hundred and ninety nine fully installed with the old one taken out in haul. However, I want to be fair here, I think, and I'm not. I don't know this company from anywhere anywhere, Brouter, I don't know them.
But that is not an unusual price in the industry right now. People are just charging out rages amounts and I don't even know if it's outrages. Mark, what would you think that price is? How much? Was it a forty twenty two point fifty for a foll? Bad at all? I mean, as we know, you're old, beat it, but there's a ton of companies that would commit it over three thousand without blinking. Yeah. Do you know what kind it's gonna be, Darlene, I know the brand name.
I just know it's made for propaine versus natural. Guess why is it made for propaine? Are you obviously you're on propane? Yes, the heaters are the same. Here's what changes, the orifice changes. It's not really a big deal. But did you so your water went out? They came out, gave you an estimate, and they didn't do the work yet. No, okay, and you decided you wanted to cancel. Did you find
another company. Not yet. I was on Angie's List. I don't know how reputable, but they said that they could help me find somebody for Angie. Of course, you just don't learn lessons, do you. Most of our problems come from Facebook, Marketplace, next Door, Angie's List, Home Advisor. This is where all our complaints come from. And where else Google? So so you know, that's why I have a referral list. It's called referral list dot com. And I would say, first and foremost,
I don't know if you should cancel. You may be liable for a penalty. But if you say you didn't know about it and didn't have a copy and they had you sign a phone, that suspect. But they're going to fight you for the money. How much do they want as cancelation? They want the twenty five percent that I put down, where I put a little bit more than twenty five, but they want the twenty five percent and how much? Okay? So then what what about? Uh? When did this
happen? Sunday? Sunday? Because if it was made a sale in your home, there's usually an automatic right to rescind that contract in seventy two hours. If the sale was made in your home. Was there a right to rescind on that contract? Probably not. I would have to read it over it well if not. If there wasn't, then they broke federal law. So I mean, here's what I'm thinking. We should have somebody call over there and tell them. I mean, if they they did not leave you
with a copy of that contract. I did, but it was a kind of paper copy, just a PDF. That's well on the PDF. On the PDF. If there is not a three day right to rescind, then I think they have to give you three days. I mean, I and they can't charge you. I can't can lession fee. I can't imagine that's not in the agreement though these guys, most of them all use the same software. Honestly, Darlene, can you send us a copy of that? Yeah, take us, send us the PDF. We'll look at it over
the break, Kelly'll give you the information. I do want to put this on you te It's actually in your inbox. Guys. Oh cool? Is if this they think if this was one of our referral list members. Now, granted, they'd most likely let him out of the contract. But let's say these guys are up and up, and we know nothing about them. But there's not a lot of bad reviews. They don't rip people off. They go out to the house, they look at it, they give her
an estimate. She agrees twenty five percent down. They order the water heater, they do whatever. I don't know. If they haven't order it, it's in stock. I don't know how that part works. But is it even fair of us to say or call over that these guys did something wrong? No, not at all. No. But that's not why I would be calling. Why I would be calling is if they did not follow federal law and give a three day right to rescind. And I think it's going
to read through this agreement during the break. I don't see it here at all. It's a very simple agreement. I hereby authorize blah blah blah. If payment is not made as a great anywhere, router can remove in set equipment blah blah blah, ten percent fee, blah blah blah, alteration, derivage a new very prayer. I don't see anything here that says you have three days to change your mind or to rescind this contract. All cancelations are
subject to twenty five percent cancelation fee. I can't see how you couldn't have seen that. But do you think this is the entire Do you think this is the entire agreement? Is there anything on the reverse side? I don't see anything referring to a reverse side. Here's the deal. I want to make this clear. Contracts do not have to have a three day right to rescind, but contracts at home do require a right to rescind. So I
don't understand why they would not put that on there. And if this is the contract, I would have one of our deputies call and say, are you aware that if there's not a three day right to recind, you have to include that. I mean, I unless I'm missing something, was that law changed? I don't think it was, so, So Mark, look it over a little closer. All Right, I want to talk about this three day right to resin because I don't want people going nuts. Now I looked it up. It looks like and again, I am doing this quickly. We're live on the air. Blah blah blah blah blah. Okay, So it looks like only when you're solicited at your home that you have a three day right to rescind. And it's not just that your home, it's or if you meet someone
in a place other than the normal place of doing business. For example, if you meet a car dealer at a restaurant, or you meet someone at a restaurant, you could have again, I say you could have. It's very fact dependent a three day right to rescind. Now at your home, if they solicit you, you have a three day right to rescind. Except
for roofing, you always have a right to rescind. And also with some other ones here mortgages, health clubs, well, any time mark not just more anytime you're putting your home up as collateral, and timeshare agreements and health clubs, whether they're no matter where you sign those. So it's very fact specific to what the contract is. But I think if you call someone out there for an emergency repair and sign something, there is absolutely no recension.
I don't think they had to put a three day right to rescind in here. I think she's stuck. That's what I think. But I'm not going to give her legal advice. But I have a feeling they can probably press this, Darlene and get a cancelation fee. And as Mark pointed out before, if they came to your house when you called them and they gave you an estimate and they took a deposit and they're ready to install it. The mere fact that you did research afterwards should not be against them. I mean,
in other words, that's your problem, not theirs. And I look at I'm not sticking up for these guys. You have to understand this. I am not telling you these are good guys or you should go with them. What I'm saying is it's kind of not fair. Did I change the rule after you signed it? And you're gonna say you didn't know about the cancelation fee. We'd have to see that signature box and how it was presented.
Really, I just don't know what to say, but I do know that these electronics signature of boxes, like even at a doctor's office or a hospital, they have you sign a blank pad. I mean it's literally a mousepad, right, or not a mousepad, but like a track pad that you sign and they let you look on the monitor and that's what they tell you you're signing. There is no guarantee that that signature is being attached to
that document. I mean it's to me that's one day is going to be challenged when it comes to responsibilities, rights risks all of that, but right now people are skating when it comes to these electronic contracts. However, in your case, I think you're going to have a tough time. Is there no way you would even consider letting them do it, Darlene? I would? Is I just want, like sensitive a water heater and having to do deal with gas. I'm just not sure how professional or if they're like I
don't even know if they're licensed or anything. Well, Darlene, I don't think they're not licensed. I mean, you can ask for licensing information and all of that. There's nothing wrong with asking for that. If you simply think you're paying too much and you changed your mind, that's not gonna work. So you're gonna have to deal with this because I think that everything looks
plain and clear to me on this. They've disclosed everything. I mean, I don't see that you're automatically assuming now, well, maybe they're not licensed or they don't know what they're doing. Well, for goodness sakes, you should have thought about that, or you called hey, can I make a suggestion? Tom? Yeah, it's gonna cost if she cancels, it's gonna cost a five hundred bucks, right, Yeah, So why don't you let them put the put the water heater in, and then for a hundred bucks,
have one of our people go in and just check it. That way, she saves four hundred dollars and she gets on. First of all, they need to pull a permit so the city will check it. If they don't pull a permit, I mean that I don't know if you have to pull a permit on a swap do you not on a water heater? I don't think so. I don't know, but I have one of our guys take a look at it, and then she'll be satisfied. You know, let's find out. You know, what is it? Permit? I don't
think you'll have to pull a permit? You don't think so. Well. I'm not saying on some cases you might have to, but I'm saying generally, I don't think. But I guarantee we have a ton of plumbers listening that know the answer. Three ozho three martino, let us know or three

I'd like to know if in fact it is applicable for a swapout like for like and Darlene, what are you doing for hot water in the meantime, I'm just taking showers outside of the house and heating up water on the stove to wash dishes. And you've been without water since one day. Okay, Okay, I, like I said, I would be very cautious about not going through with this. So far, I don't see what they have done wrong, and
you know, I just don't think that they've done anything wrong. So on, Thank you very much for calling. Let us know how it goes, though. You notice new stuff around the house, or your spouse or loved on wearing new stuff okay, jewelry, watches, clothing, or when you bring up the subject of money, your partner gets defensive. Hey, I'm gonna share it. Let me share a story about exactly what you're talking about. Suzanne's got a very good friend, and I will not mention names her sister, her best friend's sister. Listen to how crazy this
is. She had so many credit cards, she had a po box and most of the credit cards were actually in first or second hubby's name, and she would get all the bills to a po box. This person, for years and years, built up credit card dead of well over fifty one hundred thousand dollars in her own God never knew a thing until it came unraveled. And by the way, that's number three in danger signs the mail is secretive
or off limits. Number four. You suddenly get at gifts and he or she says, Oh, I just wanted to do something special for you, Yet you can't figure out how it's being paid for. What about this? You notice large cash withdrawals that are unaccounted for. Many people assume it's for a mistress or for a mister or whatever you call a man you're cheating with, But in any case, no, it's not. Sometimes it's just because someone needs to make payments. What Mark, you know one of the saddest

Hello Tom Martino, your troubleshooter three oh three seven one three talk three oh three seven one three eight two five five. So Ray wants to talk about Fred Lawyer insurance. By the way, God almighty, you just don't get worse than
Fred Lawyer, do you? You just don't get worse? Ray? What's going on? When you have read Fred Layer, you have a problem. What's going on? No? I don't have friend lawyer. The person that rear into me has friend lawyer. That's worse. Yeah. Wait wait are you are you not getting paid? I'm like, well, that's just it.
I took my card to the body shop for the estimate and it comes out to twenty three hundred dollars I received out of the blue a check for Fred Lawyer for two hundred and eighty semi dollars, which is far less it's going to cost me to get my vehicle red here. Wait wait, wait, did they say it was full and final settlement. No, they didn't
say full and final settlement. What they said was when I called him about the two hundred dollars two hundred dollar tech, they're telling me that take it to the body shop, have them do a what is it a supplemental claim or whatever they call it? Yeah, yeah, right, So they're saying, are they actually saying by their estimate is two hundred and thirty dollars correct? And that's too coincidental that it looks a lot like ten percent of the
estimate? Are you sure? Are you sure they say we believe it can be fixed for two thirty or are they saying we traditionally give ten percent first and then they have to submit a claim. What does it even matter because they told you that they'll they'll pay whatever supplemental But every body shop that I go to, reputable body shop, says that they will not deal with for a lawyer. Well, I don't blame them. I don't blame them,
they'll do. They'll do the work and they'll take it'll take they'll approve the supplemental dam. But then it would take eight nine months for them to get paid. You know they're not lying, they're true, that's true. Well, you know what I would do. You know what I would do. I would sue the other driver in small claims court for the money. They would have another problem. The individual that hit me did not have a driver's license, but they sold him insurance and he has a he's a residential car
art or conflict card from the country of Columbia. So he guy doesn't even have he doesn't even have a valid US. Yeah, but who cares. He's got insurance. You're going who cares if he's valid or not, long as he's got insurance and they're willing to pay. Did you tell him your neck hurt? Yeah? I tell them all that to you. Yeah, and that what they say. Well, I have an attorney who's going after him for the I'm just wor about the property right now. Well, here's
what kills me. If he called I don't know who your attorney is, but let's look at it this way. If he called up John Fuller, he wouldn't have this issue because John would help him with this. But good news for you, caller. John wrote a book, and it's a very quick ebook on exactly how to deal with this circumstance, and he'll give it to you for free. But here's the deal man you need. I think you can probably find a body shop that might deal with them. Or did
they on the check? Is it made out to you? This made out to be. You may have to go to a body shop and sign for the work and then have them pay the bill. You may have to do that. You may have to guarantee it. Ray you always do that anyway. I have never once gone to shop without guaranteeing the work. Okay, even if you have insurance, they want you to guarante you sign for it. They don't. They don't have the other party signed for it. They
have you signed for it. Right, But I would make damn sure you never signed a thing that said that was full and final settlement. Do you have anything in writing that says they will pay the claim? No, I just have their confirmation that they accept live ability for the accident. Okay, that's what I would do. I would go to a reputable, reputable body shop sign for the work, and then I would have if it's a reputable shop and you sign for the work, when they get paid, they'll give
it back to you. Okay, they will, but make sure it's a good body shop and they're not going to keep the money. Yeah, but that's my issue here. I don't have any body shop to say it. What you're telling me to do is go aheadside for the work and pay for it out my old pocket. No, I didn't say to paid for it. I said, see if they'll bill lawyer and if loyal will pay them, and then you tell the body shop if they don't get paid, you'll
make good as long as they reimburse you. There's nothing wrong with that, Okay already. I simply have to find a good body shop, and we know of several. I mean, really, they will do it. So go to Mark. Who do we have just right off hand referral list? Well, Michael sold I still think you're a good organization. I don't know about the new ownership, but I'll tell you this, it looks like the same people are there that actually work on the cars. So I'm pretty comfortable
saying Michael's in Castle Rock is a good one. Michaels and Castle Rock. Okay, they are a good organization, although I couldn't do a call back the area. Yeah, body Works, Murray body Works, they're excellent. Okay, Well, thank you so much for you body Works by Murray Motor Imports. What kind of car do you have that's a Chevy Tahoe. Yeah, they can still work on that. You can also try a good Chevy dealer that has a body shop. Don't go to one that doesn't have one.
They're just going to sub it out. But yeah, try body works. Although I'll tell you where'd you get the estimate duel collision? And why don't you want to go there? I do want to go there, but they refuse to work with for a lawyer because of problems they've had in the past with them. But would they do it if you guarantee it? Oh, they'll do it if I guarantee you yes, and then you might if
you know these guys, you might want to do it. Listen, Mark, we have to shore up our We have to shore up our body shops. Man, we don't have any we got I'll tell you what happened to them during COVID. I think they're recouping now, But I mean they'd have cars three four five months. There's another one that I've always heard was good, and that's caliber. They're a big outfit over on East Evans, I've heard. I mean, they're a big outfit. They did some good work
for me, Tom. Yeah, I heard some good things about him. All right, uh Ray, let us know how it goes, though, and that's what we that's what I think we would do. three or three seven one three eight two five five. AJ, what's going on with you? Man? Hey, thanks so much for taking my call. I've got two issues. The first one I had a contractor walk off the job. I mean could go yesterday, and this person already did a project for us. And you know they have a deposit no money, of about oh fourteen thousand dollars. WHOA so wait a minute, can I assume AJ? He walked off the job after taking a deposit of fourteen grand and
you did not get any value. So a portion of the materials were delivered, and when I looked him up online, the value of that about five thousand dollars. And they weren't the entire material list, but they walked off the job because I got frustrated because they weren't putting the preventative measures down as far as the plastic and heartwore and all that stuff down on the carpet and everything. So I kind of called the contractor out there. They have the
initial demo, and we just hold on, hold on, AJ. Some materials were delivered and they did do some initial demo or not no demo, just a portion of the materials were delivered, and it was the first day of the demo to began. They had already completed a project's basement and they put all the preventive measures down around the doorway and all the Look, okay, AJ, what I need to know is this on the basement. I don't want to mix these up on the basement. Right, it was completely
done paid for. There's no issue, is that right. They're still an outstanding credit that they owe us, so approximately let's say fifteen hundred dollars. But that's the point of matter, is that job was done to a certain standard. No, I get it. I get why you're upset. What's the name of the contractor. I'd rather do that off line or not on the air, just because okay, and and let me ask another question. If this guy walked off the job, does he expect to keep the money
or is he going to settle up? Uh? The reason they love they walked off the job is they claimed it was a hostile work environment because I I lost my cool getting the fact that our family just withdraw this health issues. No, I get it, I get it. But it doesn't matter what reason he gave. Is he saying because it was hostile, it was a breach and he gets to keep the money. I didn't say it was a breach, He just said it was unsafer? Is for Okay, I'm
going to ask this again, AJ. Does he claim he has a right to keep your money? They want to. They send an email to basically say, we want to give you credit for the material delivered. The reality is the material delivered he wasn't complete and be and it was marked out for I'm sure pretty What does that mean? What does that mean he wants to give you credit for materials delivered? You mean he wants to get credit for that? Correct? Well, Sin, what does he think he owes you?
We sent the response email on Saturday. What does he think he hasn't told you? Yet what he is willing to refund correct. That's where it's all going to lie. Three O three seven one three talk three all three seven one three eight two five five Here to help you solve problems, answer questions, and take complaints. Waterpros dot net now has financing available for all their water systems, and you can get a whole house system the full Monty for just ninety bucks a month for a limited time. Also, I want to tell you you can
get drinking water reverse osmosis at the kitchen sink now more than ever. Did you see those stupid little filters Denver sends out to clean up your water? Are you kidding me? They're admitting they can't keep your water safe. They're admitting it. Denver has gone in the toilet. By the way, a waterpros dot net three O three eight six two five five five four. You remember what a great city we moved to, or maybe you were born here.
I mean, can you believe? Can really can you believe what's happening to this city in general? In general? God, I mean, what a mess? What a mess? You know? I don't even go downtown. Do you go downtown anymore? You think people are gonna go downtown ever only to the theater and then go back home. But even there, you're right, you can part it and get out. It sucks. Now. This issue with a contractor, AJ said he put down some money and the
guy walked away. There was a disagreement. No matter what the reason, if there's a breakdown in communication, I don't think any contractor should keep money that has not been spent on the project. In fact, the Contractor's Trust Act is very clear on that money put down for a project has to be used for the project, can't be cross collateralized or cross mingled with anything else.
Now, if AJ put for fourteen grand down and they had a falling out, unless the contractor lost money as a result of that and can prove it. Let's say AJ breached the contract and this contractor had ordered stuff and paid for it, well, then AJ should pay for it. But then AJ should get the stuff that was ordered for him. If there were designs done, he should be paid for the designs. The contractor he had mentioned that about five thousand dollars in materials were delivered. I think that's what he
said. AJ. Is that what you said, were about five thousand dollars in materials delivered? Yeah? When I looked at all the goods that were delivered, you know, the value what I could look online was about five thousand dollars. Now did the contract or pay Did the contractor order those or did you pay for them? Yes? The contract Yes, I said, did the contractor pay for those or did you pay for those? I paid the contractor who delivered those goods, and then okay, value that I determined.
Okay, So what I am saying is if you paid him a fourteen thousand dollars deposit and he gave you five thousand in goods, he would owe you nine grand. Yes, But what if I choose to go in a different direction with the materials and just say you breached it, you walked off the job, take it all back, give me one hundred percent refund other than the plans you drew up. I don't think you could do that.
Well, I think you could under this, says Okay. If you could prove that he was one hundred percent at fault for breaching the contract, then I would do Then. I believe you could unwind everything and say I don't want those materials. But here's what I think would happen. I think it would cost you more than that to prove that, and it would be a mess. I think that you have the value of the goods, and in most court cases they would probably rule I'm not giving you legal advice, but
just what has happened in the past, they would probably say. It's something called quantum Marriott Marriwitt, which means you got the you got the value, pay pay for what you got and any design work. If this contractor could put together a reasonable amount that he he he gave you in goods and in services such as design work, then he could probably walk away and refund the balance. So I don't think it's I'm just saying my my impression. I
don't think it's reasonable to want one percent of your money back. In fact, I don't think you'll get it, So I don't think I think it'll be more of a fight than it's worth. Well, unfortunately, when my wife signed this deal, the legal ramifications there's nothing other than a better Business Bureau mediator, which I'm not a real fan of, but that's our really only option. Wait a minute, we're going to agreed to a better Business Bureau arbitration? Yeah, our family did, Yes, so you agreed not
to sue. Yeah, well that's good because a lawsuit in this case would be useless. But I don't think I think the better business brewer. There are a bunch of morons. So I mean, if they're a dinosaur that you know, they don't they have no function at this point in life. I mean, it's it's a relic of the past. But if they have, did they say who they provide as an arbitrator and how you do arbitration? I haven't even gotten that other than that's the course of action on a
disagreement. Has the guy offered anything or is he expecting to keep the whole thing? What does he want to do? I haven't heard anything since our response on Saturday last week. They walked off Tuesday a week ago. In your response, your response was what what? A response to what? Basically said, listen, you broke the contract. You walked off the job. Yes, a husband got upset because you didn't follow a protocol, was laying
you know, things down the carpet and protective measures. But that doesn't just fly you to break a contract. And secondly, we've asked for our full deposit of materials given back and you can come pick the stuff up. That's where we left it. And we said we've taken an inventory of goods. What is your inventory? Show and spend crickets? Okay, But before you said that, did he send you anything? Yeah? Basically said unsafe, hostile work conditions. I don't want to put my staff at that risk.
And we were relieving and we can give you credit for whatever materials. You know, Okay, he can pay for whatever those materials, but I don't want to have to pay more. Hold on, hold on, So did he say though? Did he say I would refund the balance? It was a very loose language, well determined adult, and that's kind of what we've corresponded as what that is. Well, I think you're unreasonable. He's unreasonable, So you're both unreasonable. So it's probably going to end up in court
unfortunate or at arbitration. But I believe that if you are willing to walk away, I don't what what design did you get? Did you get a plan? We did, and that's part of the fee, and that's fine. We accept that fee. But well, hold on, how much? How much is the how much is the plan? A couple of thous of books? Well, who says, well, that's what that's what they determined for sure? Who determined, aja, I'm sorry, who determined this?
Designer and contractor they established? Did the designer say they wanted two thousand dollars for design? I had a certain fee that was agreed upon before the project? How much was the fee that was agreed upon? Two thousand Okay, So the way I look at it, there's two thousand in a fee, five thousand in materials for a total of seven thousand. So I think you should ask them or or we can for you if you want to settle for seven thousand, get a seven thousand dollars refund and move on. If you
want us to do that, we will. If you don't want us to do that, good luck and go to the Better Business Bureau. But I think both of you have to give a little. Zach's got a comment on this. Go ahead, Kachina, just find out what AJ wants to do, and we'll let Deputy Doc call over to the contractor and say, look, you know two thousand for design, five thousand for materials, will you give the other seven thousand back? That's what they should do. Zach,
what do you have to say? Go ahead, Zach Hei Tom. I think what this guy is trying to say is the contractor went through his buddy to buy the materials and he got a markup on it, and he doesn't think the guy should pay for that guy's kickback on the markup. That's why you say I didn't hear it, Well, I didn't hear him say that at all. But if that's the case, that's not for him to determine. If he if I mean, it would be whatever the value of that
material is, that value has to be discussed. Whatever the value of the material is. He doesn't just get to arbitrarily say here's the way it's going to be. I want all my money back. He's just not going to get to say that. And it's too bad. But it doesn't work that way. You don't get to dictate your terms and conditions. Thank you, Zach, I do appreciate you calling though. We need to out way is there's no charge to come out and look and do design. No, not at all. We'll do that. We can even do it virtually. I just have to provide us with
one of their electric bills and we can build something off of that. Do most people have the exposure for sun that they need to get a system. Yeah, around here they really do. I mean there's a lot of great sun exposure in Colorado and we're we rank high for solar power and there's a lot I don't have to do. You have to have southern exposure. Southern's the best. But with time of use. Now east and west also works
very well. Now what do you mean by time of use? So Excel charges you more in the afternoon for your electricity, So if you're on a west facing roof, you're producing more in that afternoon. So there's a lot of tricks to the trade and that's why we're an experienced solar company. And now batteries help with demand too, right, Yeah, charge the batteries with your solar and discharge during the highest price, which is hey, mark you
and the charge. When Excel charges more money because of these smart meters, by the way, people are insane, I would go with direct billing those smart meters that they're just garbage, and they're thinking of changing that. I don't know if you guys saw that. They're thinking of instead of whatever it is now three to seven or whatever the peak time is, they're thinking of
moving that. They were talking about it in front of the PUC. But where I'm going is when you pay more money for solar, are you selling it to them for more money or for the same amount or for less money. How does Excel screw you there? Well, it's it's a per kill a wat one killowat to one killowat trade, you know, So it's an even trade with the production. So it doesn't matter when you're producing it. You're getting an exact trade on it. Yes, that's my way. When
you produce excess and sell it to the grid. So if you don't they buy it at wholesale, they don't buy it. They store it as a grid credit. If you do buy it, they pay it back at like four cents of killo watt three cents ago. But the wait marky that was my whole question. So it doesn't matter what the pricing is. So if all you do is use peak time and you're paying whatever that is, as long as it's a credit per credit, it doesn't matter the cost. You're
offsetting it with a credit. Correct. Now, there are some examples that Time had earlier with commercial where they'll overproduce and have a partnership with Excel, But very few times will you see that in residential sitting. No, No, you won't see that in residential by the way. By the way, Mike wants to talk about breaking a lease, so let's get him in here.
Go ahead, Mike, and anyone can call. We have some lines open at three oh three seven one three talk seven one three eight, two five five, or of course three oh three Martino, and you can always leave a message and we will call you back three oh three six two seven
eight four sixty six. Go ahead, Mike, Yeah, Tom, this started the first to last month right about and then uh, my water in my bathtub was not going town down when I was taking the shower was growth slow, so I'd ended up setting it in dirty water where I took a shower. Yeah, first or last month, I told the landler about this, plus a couple of other small things in the apartment. As she said, you get a fix all month long. I stood in dirty water first
of this month. I told her again. I said, I got actless slit my skin on my on my bottom of my feet, killing off because I stand in dirty water every time I take a shower. TM I, we get it. Yeah, we get we believe you. This is almost a month and a half too much, Okay, Now, Mike, that would not be a habitability issue most of the time. It depends on the
municipality. But what they consider a habitability issue. Of prime importance is safety and security, and they consider for example, heating not air necessarily, but heating utilities like running water, hot water. There's certain things that are considered habitability issues. Okay, now I'm seventy years I'm seventy years old. That's week so sopium. Other than that shower, I slipped the fount and almost broke my back. Mike, Mike, that's not considered a standard of habitability.
Okay, I know you're trying to make it so, but it's not. I'm not telling you they shouldn't fix it. I'm not telling you that. But I don't think it would be strong enough to break your lease and say you had a right to do it because the landlord breached the lease. Now, what you could do is go through this. You could go through
the steps of that constructive eviction. You could say to her or him, you need or the management company you need to fix this for this reason, and if you don't fix it within a certain amount of time, you are going to withhold the rent to pay for it. You can't withhold all of the rent, but you could call a plumber to fix that to you and
pay the plumber for that issue. However, you're going to risk an eviction, and what you would have to do is prove with receipts that you had to do that repair for health reasons and that you paid directly the plumber the money you did not pay in rent. Or you could ask the landlord. Just ask the landlord if they will let you out of the lease. Do you think they would let you out of the lease? I don't know, I asked, I don't know. Now you're telling me you've complained about this
and they've not so much as called anyone. Did you know a lot of times you could buy something called liquid plumber. All I'm saying is I tried that and it did not work at all. Uh I would well, well, like one day it went down a little bit, a little bit quicker, but the next day would back to stop again. I mean sometimes it takes reteat repeated treatments. But you know, we don't mind, Mike. We wouldn't mind calling your landlord for you and just saying, look, you
know, you really have an obligation to fix things like this. We could exaggerate a little, but I don't. If you think do you want to move, let me ask you that, Mike, do you want to move? Yes, I'm I can't live there no more, Tom, I'm in my apartment fund apartment. They okay, okay, do you have any serious problems that would be habitability issues? Do you have any heat problems or security problems or anything like that. No, okay, what's the most serious problem
you have? Are you want any subsidies? The other day, well today, and I complained about it, and she took pictures of it. I walked out of my apartment and still to this date, it's quote ice. When I walk to my car, it's like ten inches of ice, nothing but ice. And the other jack Now, I'm stout, almost broke my neck. So I complained them to her. She went and took pictures of it, and up to today, the eye is still there. The suddenly hit it. I don't think you almost broke your neck or you would have
been in the hospital, But well I did. I did, scratched my arm up pretty quick, and I showed him the cuts I got out my arm, and uh, she just looked up because, wow, do you want us to call? Do you want us to call the landlady? And kind of scare her A little into getting a plumber out there. I was gonna I'll go out ask you to now the viction, Now, why don't why don't you do it in a nice way? First, here's what you
do. I got an idea, Mike. Why don't you tell her that you've talked to us, and we talked to you about constructive eviction where you can get out of a lease if it's intolerable or unsafe or unhealthy, and you don't want to have to go through all of that. If she will simply let you leave sounds, call me back and let us know what she
says one way or the other. Okay, I'd like to know. Three oh three seven to one three talk seven one three eight two five five Mike, real quick here, let me start you, Michael on this insurance claim. Maybe we have to get an expert on what's what's the issue with your insurance claim? Michael? So it's basically on my credit report. It's a negative account because the insurance company took more than six months to pay it off.
Oh, hold on, hold on, So they're the ones that made you late and it's showing up on your credit report, right, Yes, all right, hang on, we'll come back on that go with a sure thing Denver's best roofer Excel Roofing dot com. You'll think you're his only customer when you choose Frank durand the real estate Man dot com to list your home with Remax Alliance three oh three nine two zero sixteen twenty two. Hi, tell Martino, you're troubleshooter three oh three seven one three talk. Oh so Michael, you're what insurance claim? Was this a health insurance claim? Or property or casualty? What? Was it? Auto?
Auto accident? So what happened? Okay, so full coverage on the vehicle. Yes, it was my fault. I rere in it somebody, but they, of course agreed to pay the claims as it was full coverage. I owed a balance on the Wait wait, wait your car? Was your car totaled? Yes? So you were ended another car and your car was totaled? Yes? Okay, go ahead, keep going so I had still a balance on my loan. So the insurance company agreed to pay me
the portion on top of what was owed. So I got a check for like a few thousand, but then there were still like six or seven or so thousand on the loan. They said they would have to send directly to the credit union and not to me because it was owed to them. They had a lean on it. So, Michael, I need to know something. Did you have gap insurance or did it just so happen that the value of your car exceeded the loan both. I did pay down the loan quite
a bit. I also have GAFF insurance, so I'm not sure. Okay, you benefited, Okay, gotcha. So, by all rights, your car should have been paid for. Yes, the issue is it was paid for eventually, but it took so long the credit union wrote it off. So now it's like, I don't know what they call it. I forget on my credit report. Yeah, it's a rite off. It's a bad debt, they said. You know, okay, they took just you know, the credit union did the right thing. They had a right to do
that, and they had a right to hold you responsible. You know that right, So it's not the credit union. Your beef is with the insurance company. How long did it take? How long did it take your insurance company to pay off this balance. It's been a while, so I know it was like somewhere around six orine months. That's that's unreasonable. I received my check within a few weeks. But so here's the thing, it took
longer. So I started calling my insurance. I was going back and forth between the insurance and the bank, be like, why what's taking so long? What's the problem? You know? And I did this multiple times, right, and they first they sent it to the wrong place for some reason. The bank said they never got to check. Then I you know, it's just over and over again. I was trying to make sure you know, I agree it sucks, but I don't think it really matters to you.
Well, hold on, Mark, technically, he was responsible to keep making his payments. I find the bandlord and something happens and someone owes me money, and you know, there's all kinds of reasons they don't have it. At the end of the day, it doesn't bother me. I just want my money. Mark. We're not saying that. I just say that I just said that his credit union did the right thing, and they don't owe him anything, and they should have reported him late, and all of
that's proper. What's not proper is that his insurance company took nine months to get it done, and that's what caused the damage. However, the argument may be made that during that nine months he should have continued to make his payments. Would this is what I need to know. Did you ever consider, because you would have gotten some of that money back, did you stop making car payments? Yeah? I did so. On paper, it looks like you defaulted on the loan. I can't argue with that. So,
but your insurance company should have been quicker at doing this. This is weird, man. This is weird because it's possible that even if they took a month or so, you could have been late on a payment or two. See, this is what this is where people get into trouble. I don't know, man, I think I'd be very upset if your insurance company took that long. What does the credit union say about it? They they're really
not taking any blame for it. They're not going to change anything. Well, they're not going to change anything, but at what point did they say they wrote it off after how many months they didn't? I found out just because I did one of those annual credit checks looking over my credit, you know, and how bad did it? How badly did it affect your credit? Well, it's hard to tell you. Well, I mean, what
was your credit before and what is it now? I couldn't answer that I didn't follow it the month before and the month after, you know you did it was now? Well, let me ask you if do you normally Michael, what do you normally have as a FICO score? It's around six fifty normal? In other words, the year before you say, you do your annual report, the year before, what was your credit score? I did an annual report at that time. I wasn't really concerned of what my credit
score was. Okay, but I don't think your credit. Hold on, I'm I'm reading between the lines here. I don't think your credit was affected that much. If it was six fifty at its best, what is it now? Take fifty at right now? What was it at its best? Oh, it's been up to six nineties maybe, Okay, So what you have to establish is that it substantially affected you and caused you damage or will cause you damage. I think, so that's not coming off of there.
So you have an active default on your record? Is that right? Yeah? Which is bringing my score down regardless of what it was prior. Well, no, it's not regardless, because if it's bringing your score down, your score would have had to have been higher. They see that burden is on you. Okay, you have to show that this is going to negatively affect you and for how long? And I would seek damages from my insurance company, but you're going to have to hire an attorney for it. It's
called slander of credit. It's a difficult case and it's going to be expensive. But do I think they did you wrong? I think they did you wrong. Do I think you could have avoided it? Possibly? But hell, who would make payments for nine months on a car that was total? I can see where this happened to you, man, I can see where this is dangerous, and it could happen to anyone. Who's your insurance company? It was Bristol West. That's a high risk company? Is it that
a question? Yeah? Well okay, I've never heard of the company. It sounds like a high risk company. I want to call our insurance experts. But I have another question for a miracle. I think it was Farmers that I was my agent, but then they pawned off the big policy the Bristol West. Yeah. When you say pawned it off, that means that you didn't fall within the normal risk tolerance of Farmers. And I believe Farmers owns this crystal company. But I want to check with our insurance experts to
find out a few things I need to know this. How is this affecting your life? Well? I just had to recite I'm not refinanced, but finance the new vehicle, which gave me twenty percent interest rate, and I feel like that has something to do with my previous credit history. It could even what was your interest rate before this? I got to take a break, come back and we'll talk. Here's what I'm trying to get at. Six is the Troubleshooter Show. No Tom Martine, Hi Tom Martine. Here, This is the Troubleshooter Show. Forty five years going strong, the longest running radio show with
the same hostill on the air doing the same thing. That's right. Well, here's one other show that actually was on longer, but it's not technically well, it was part music, part talk at one time part music, then talked then. So I mean, but he's actually the king of being on the radio the longest he's been on even though the show changed, So that's a little technicality. Never talked about that before. But he can't take it away from that guy. No highest paid radio celebrity of all time ever.
You know what I'm talking about, King of media, baby, Yeah, I know, yep, he is, there's no doubt, and even more than Rush Limbaugh. In fact, his income dwarfs some Hollywood stars when it comes to what I'd say, almost all, Well, I don't know about that. Who knows anyway? You know what you know what I say. There's one thing that I'm constant in awe of and that is people who produce the highest I don't mean money even necessary, but for their performance.
Like when I saw the super Bowl. You know what, you can say all you want about how much they make and all that, but these people are at such a high level of performance. When I think about Mahomes a twenty eight year old punk that man is so awesome, and then Purty, I mean when you think and Kelsey and all these, when you think of the the what do you call it? The performance? I mean such a high level at not only at their well yeah, at their age, especially
at their age. But you have to admire it. I mean, you know what, it's easy to hate people like that, I mean, but you got to admire performance where people are just excellent at what they do. God, I love it when it comes to music, when it comes to athleticism, when it comes to you name it, you have to you have to just say, you know what, those people are awesome and they're inspiring
as well. I think it shows that anyone can do anything. But then sometimes you have a tendency to look at your own stuff, your own kids, your own relatives your own life and think, God, how did they do that in such a short amount of time, because they had to have been geared toward that their entire life. If you look at the McCaffrey family,
it blows your mind. They got three sons that are high performers in football, and then you have you know, and Christian of course, then Eddie, and even as Eddie's wife, Lisa McCaffrey was a world class of what she was doing, I was track and I mean, man, I mean, there are just people that just they you know, you wind them up, they wake up in the morning and they blow everybody away. You could say that for any any occupation. I mean, there are people who
are incredible artists, singers, people. I just said that. I just said, high performers. It doesn't matter what field is. And you're absolutely right, but they just I wasn't talking about just I happen to pick a few athletes as as examples, but you're right, I mean it have I mean, look at these research scientists, look at these people who do a high level of anything. I mean, astronauts, for God's sakes. I mean, we have people that just excel. But you but think about at
what age do they start getting serious about whatever they're getting serious with. I mean, you know, did de Bakey start thinking about surgeries when he was in his teens? Or or are they just gifted? You know, I do believe a lot in gifted. I don't mean necessarily what do I mean by gift meaning that they have aptitudes? They just don't you think doc people have certain aptitudes, absolutely, And I think what's interesting is that you have
to find what it is like you take. Let's say, you know Roger Federer, who's a great tennis player, right, yeah, I'll bet you that if he had started on any other sport when he was nine years old, he would have excelled in that sport. So you think some more attitude. No, I think it's just people are athletically gifted. They have great Oh I say, yeah, no, I see what you mean. Yeah,
or aiding attitude has a lot to do with it too. There are some people that just can't take the challenge and they you know, but here's the worst part. Here's the worst part about human nature. When people can't do things or no, no, no, erase that not that they can't do it, but when people don't do things, or don't excel, or don't push themselves, or are a little lazy or some for some reason, maybe they weren't nurtured, whatever it was, and they start disliking those who
do because they're just downright jealous. You know what I'm saying. Yeah, that's crazy. Well, no, there are tons of people in the world that they'll hate this, they'll hate that, they'll do this. They're grumps, and it's because they don't. They just rather than appreciate what humans can do. If they can't do it, they poohoo it and they just don't give credit where credit is due. Now, as far as leaders, I've often okay, let's talk about leaders. You know, to be a politician
and to aspire to an office is a lofty thing. Now, you can be a crooked son of a bitch and be in the office, yes, but I'm talking about in general, to propel yourself to a public office, put up with all the scrutiny and get elected. That is one hell of an accomplishment. I mean, think about that. It is an accomplishment. I mean, you know when you have especially when you do a great job at it, you know, I mean, if you do a poor job
at it. It's still an accomplishment that you got there. But I often wonder sometimes what makes someone what they are? You know, is it true, like Doc said, would they be whatever they wanted to be? If John Elway put his mind to something else? And I'm not talking just athletes, like I'm talking about like if Mahomes instead of wanting to be a quarterback, if he put his mind to something else, would he have excelled in? Yeah, his dad was a major league baseball player. I'm sure Mahomes
but would have been a great baseball player. I'm not talking about athletics. I'm talking about what if he wanted to be a research scientist or something. You know what I'm saying, I don't think. I think. I think there's a weaning process where people have certain attributes and they get funneled into those professions. And don't you think parents have a hell of a lot to do with bringing it out? I mean, I mean, if you saw the story about Michael Jordan, how his mom what his mom did? Oh my
god? You know. And and by the way, Taylor Swift was playing a guitar at eight or nine, I mean, her dad apparently helped her, and then you had you have all kinds of parents behind these people too. But yet those parents themselves, well a lot of them have been like Archie Manning, of course, you know he has two quarterback sons. But but not all parents were great. They just made they made great kids somehow. But anyway, so so it's kind of fun to look for the positive
and and and all of the attributes that people have. Uh. It's also uh, it's also of course on the inverse, look at the Oh my god, look at the monsters, the human the humans have created. I mean, look at the I mean Hitler of course, the mind first, right, it's it's amazing. Anyway, Diane, excuse me, Diane, welcome to the show. What's going on? This is a follow up from yesterday? Yeah, what was this about, Diane? Was this wasn't about your retirement, wasn't? Yeah? Or the red Oh my god, I'm
so sorry for you. This real estate investment thing. She has sixteen or fifteen grand tied up there and can't get it out because she has to sell shares. There's no market for the shares. Did we send you to someone to look at that? Joe? Joe helped me Joe Cano, Joe Canno, certified planner. What did he do for you? Well, he helped me. We called the broker and we just he just educated me on the whole thing. And okay, what did you find out? Tell me what
Joe did and what you found out? Pretty much it's a jump junk. I ra and uh oh really so you can't get any money out of it. The only thing I can do is, uh, I guess it's required by the I R S too that they have to take out a certain amount each year. Yeah, it's it's called a minimum required distribution. Yeah, that's it. That's it. Now are they going to take Are they going to disperse some of that money to you? Well, you have first have to apply for it. Yes, they have to. Now here's what I
want to ask you. Did this guy try double talking Joe? You'd have to he You'd have to talk to Joe. I think I want to talk to Jock. In fact, let's get Joe on. I want to find out what happens. Okay, Joe Piano, what did you do for her? You called up the broker to find out what this was? This? Let me ask you your your candid opinion Joe, was this a flim flam getting her into this? Yeah? You know, I believe that one hundred percent. You know, you know why Joe, because you know as well
as I do. As far as requirements of an invest of an investment advisor, you have things called fiduciary responsibilities. You also have to be knowledgeable of risk tolerances. You have to be knowledgeable of the products you're putting people into. And there's something else show that can get an investment advisor in big trouble, and that is called suitability. Right, that is right? How would
you explain suitability to our listeners? Well, you know, we take that very seriously, Tom, because you know, we match the product to the consumer. You know, we we talked to the consumer and that when are they going to need the money? Are they going to need the money immediately? Then we know that a long term annuity or an IRA long term may
not be suitable for them. If they can say, well, you know what, I have enough money to survive for maybe ten or fifteen years, then and IRA with the potential for growth that will give them an income for life, it would be a very suitable product. And also the risk tolerance, you know, this poor lady, Diana. I mean, it just breaks my heart because he went to a broker and then the broker left, I guess he left the company and another worker took the place he ques.
So Joe, Joe, for just having this little amount of money, he had no business putting her into a red No, absolutely not, because see that read is frozen. Like I mentioned to you through my emails to you yesterday. You know, when the red it's a public offering. The company's going to redeem the shares at a discount rate, So the consumer will take a loss anyway if they do that. But when we can she get any money out of this at all? Nothing? Nothing, nothing, nothing.
The only way that she can get the money out would be if the company goes out of business and they have to sell out the property that they invested on, then they'll get whatever they get. It's a bad, bad situation for Diane, I mean really totally bad. And the broker that sold it to her was not be enough fiduciary. I can't tell you that right now. She didn't care about what her needs were. Tom and Joe. There's no way to get any money at all out of it. No, not
at all. The only way would be, like I said, I mean, if they sell out the company and the red dissolves, then they have to you know, pay out whatever they have available to each of the investors on the rate. So they're not going to take the fall amount. They're going to lose money. And you know, I should mention something since you're already there. What when you teach other advisors? What courses do you teach? We teach. We teach about one hundred and ten courses a year,
and they deal. What kind do you do you teach? Like, okay, Joe, do you teach for the different series of licenses or just one or how many? Now? We teach actually for the life, accident and health and also annuities, long term care. We teach ethics, which is really important, and we teach suitability to the people holding licenses to sell those products. Okay, Okay, that's what we teach. So we're pretty well right Well, Diane, I'm I'm really sorry that this happened to you.
This this is like it's down the drain. Do you recall what your original investment was, Diane, you're the actual money out of pocket? Think? Yeah, I really can. Yeah, I guess. I mean, like I said, the original broker, he quit on me in them. Yeah, but what I mean is I don't think it's as bad. Well, here's what I mean. If we have to pick a bright spot. You have what they say is a sixteen thousand dollars value. But I don't think
that's what you invested. I think they're giving it a fake number. But Joe, do you think she invested that much to begin with? Yeah, I don't think she's made that much money. Tom, No, she didn't make anything. But what do you could you? Could you figure out what she invested originally? I think it. I don't think she invested near that
much. Uh, but no, I think she did. You know that that has not grown, It hasn't been dispersed, nothing has been dispersed basically, So that means I don't think she has made any money at all. There's not a car in a world where at that. So anyway, it's for sale in Vegas right now if you want it. So that's my Valentine's gift.
So let's talk about your problems, questions and complaints. I said, I was going to tell you about a farmer's wife, And here it is. On a weekend, the farmer's wife discovered a gambling site, a real gambling site. She went on and started playing blackjack and then poker, and she started making some ACH's from her account to a gambling site, offshore gambling site. Now he had to make some payments come Monday and get ready to bring his crop to market. And I guess you have to make a lot of
payments upfront on stuff and whatever. He didn't have any money. He says, honey, there's something wrong. There's no money in the account. She thought she was going to make enough money. She didn't. In fact, they lost so much money they lost the farm in one weekend gambling one weekend. His wife did it online, gambling online, couldn't go bankrupt. The money's already gone, so you can't stop it, and you can't claim fraud because they have her online. And guess what else, they actually have your
camera activated with you gambling, so you can't say it wasn't you. God. Now this is a few years ago, by the way. Well, they since made some changes on gambling sites. But this woman lost everything they've ever had and their entire farm and home. Think you about that? Yep, Jeremy, that that's what I'm telling you. You can gambling sites are very dangerous, Jeremy. What's going on? All right? Tom? All right, so let me try to make this easy. So I have a
roommate that I've had there for about two years. He lost his job, went to jail. I already knew that he was not going to be able to pay. I've confronted him and asked him if he's going to tell me YadA yah. Long story short, he's not going to be able to pay. He's well, what is he? Oh, you didn't tell me what he owes? So he owes about five hundred and sixty dollars. It's nine
hundred dollars a month that includes internet, water, trash play. The paper, food, all sorts of Wait, wait, but he only owes you five hundred. Yeah, correct, because he's only been there for sixteen days, he'll so he's he's moving out supposedly this Friday, so that'll be sixteen days that he will have been there without paying rent. Okay, that makes sense, yep, okay, all right. So my question to you is is it worthwhile to go after him to small claims court to get that if
there's no contract? It was all when you said he went to jail. Is he out of jail now? Yes, he's out of jail now? Is he out on bail? Is? Tell me what his situation is? So he so he got a DUI and he was driving on revacation and he got a he got a speeding ticket and they took his license again and he had the deal was that he had to go to jail because he was already
on probation for a prior to UI. So he had to do like I don't know, I call it jail, but it really was just some place in Wells County up in Greeley. And so for a d for a dui, right, for a dui? So he's out now, and is he working now. No, he's been in my he's been in my basement for the last sixteen days doing nothing. Well, how are you going to get him out? How are you going to get him out? Well, that's that's the deal. And I'm and my problem is is that I'm believing him.
I'm having faith in him, which I shouldn't. That he's going to leave on Friday. That's the supposed story, is that a friend of his is coming for you. Well, you better hope he does. You better hope he does. And here's what I would he look at. If you get a judgment against him, it's probably worth nothing, right, Okay, I mean I don't know. I mean you know, it's probably worth nothing
for the eviction process. Now, I would be more concerned, see he leaves voluntarily, because if you start the eviction process, here's the problem. If he's gonna think, oh, I got more time. If he doesn't leave Friday, do you have anything in writing with him? Nothing? Okay, there's a certain process you have to follow when you don't have a written lease. How long has he been there? He's been there, he's been there two years. You're gonna have a little problem. It's not gonna be
as easy as you think to get rid of him. But yes, what you should do is start the eviction process. But you should not serve him or not do anything or post anything unless he's still there after Friday. Okay, but you got to do it the right way. If he's been there two years on a month to month, he has certain there are certain rights that he has right. Are you friendly with him? I was up until
this more I mean he was. He was stealing food out of the kitchen and my wife caught him, and it was all kind of a big debat for this party. We've been We've been friendly for the most part. And listen, if you feel if your wife feels threatened at all or unsafe, you can try to get a restraining order, which would get him out immediately. Then you could do the eviction again. Hi Tom Martine here three all three seven to one three talk seven one three eight two five five pro bit energies with us, Marcus with us. Let me switch over to my wide cam here. And so you've dropped prices recently, so why the tariffs have been pulled off the solar panels? So it's amazing. So what does that mean? There were tariffs on shipments of solar panels for quite a while and those have been where are they made? All over? I mean China, Taiwan, here, Canada, Texas, pretty
much everyone. So there were tariffs and for overseas shipmentship so they were removed, YEP. Is that to encourage more people to get systems or what I think? So? I think it all probably ties into the Inflation Cares Act to you know, sentivize people to go solar with that thirty percent federal tax credit. That helps a ton. Now I want to mention something else.
Nonprofits that don't pay tax. Tax credits did them no good. But they've owned big buildings, churches, things like that, And now is this new, this direct payment. Now it's a great opportunity for nonprofits. So what they're saying is this, even though you can't get a tax credit because you have no taxes that you pay, we're still going to help you thirty percent of the total cost of the solar pad. There's still they're going to get
an actual refund of money they haven't even paid. In correct, it's it's a great opportunity for them to go solar right now. Well, it's free money, free money, I mean it really. I mean, well, it's not free to us, but it's free to nonprofit. So if you're a nonprofit, to encourage nonprofits to do sustainable and renewable energy, they're telling them, if you do a solar system, even though you don't pay federal tax, you will get thirty percent of the system costs back in a rebate.
Correct, it's a great opportunity for him to do this. So up till now that they've been doing have they been selling their tax credits? A lot of them had, Yes, they do pay purchase agreements or release and somebody buys that tax credit, so it's tax credits. That's another thing. People who can't use tax credits, even people in lower income or middle income, you can sell that tax credit. You don't get one hundred percent for
it, but you can sell it. Correct. In fact, we are a sun power dealer, so we can do some lease systems and PPAs for people that can't utilize that tax credit. They have lower incomes but still high energy bills, but then they can still get some of the benefit of a credit. Yes, through that RWER. So it does right, but it doesn't turn out to be thirty percent. It might be a little less.
It could be, but it's pretty attractive. We can usually do a PPA for less than what they're And when you say PPA, what does that mean? Paid purchase agreement? It's a lease. So they lease it and then someone else takes the credit, but then they get the reduced costs correct. Yeah, And so how does the lease work? A monthly payment? Monthly payment You factor that out with based off of what their production needs are annually and build a system and that payment stays fixed. It can grow one to
two percent a year. Or be fixed. You pain on how the deal is structured. And then at the end of a least how long are leases twenty five year lease? Nice thing about those PPAs is you have no maintenance. You're paying for the energy you produce. Really so so they have to keep track of it and fix it. Yeah. Yeah, So you're covered for twenty five years on a system that will be operational and working, and they send people out to make sure it is. Absolutely That's that's how they
make money. Who is the biggest one that finances these Well, I think the one we're with right now is sun Power. That's probably one of the largest ones in the nation. That's not Musk. Isn't Elon, No, no, Musk is. He used to have what was Solar City and that's gone and that went into bankruptcy. Musk bought them out and really just through the label of Tesla on it. So does Tesla Selar still exist? Yes? Do they do least purchase agreement? That's a great question. I don't
think they do them anymore. But are they still selling systems? They're selling systems, yeah, okay, So are the components for let's say a Tesla the same as most components in most systems, are they all basically this? They're pretty much the same. Tesla has their own battery, branded battery, They have their own solar panels, but they're all made at the same places, so it's just a branding thing. Okay. And when it comes to
the solar system in general, is there a lot of maintenance need? I've never asked this before, but no, what kind of maintenance would be needed? Something? Really? Just track your system. You might have an inverter go out, you might have a bad panel, but that's about it, all right. We don't want you up to washing them off either. All Right, we got more coming up. I'm Tom Martino.
