Bouarfa v. Mayorkas

In this case, the court considered whether federal courts have jurisdiction to review the Secretary of Homeland Security's discretionary decision to revoke an approved visa petition under 8 U-S-C §1155, based on a determination that a prior marriage was a sham.

The case was decided on December 10, 2024.

The Supreme Court held that Revocation of an approved visa petition based on a sham-marriage determination is the kind of discretionary decision that federal courts do not have jurisdiction to review. Justice Jackson delivered the opinion for a unanimous Court.
