And we recently started going through a list of realator terms and things that maybe you'll hear a realtor talk to you about.

And you're going, what in the world do these things mean? And what is the next term on our list? Here, Brent deed our first letter D. So this is what is like a title on a car in South Dakota. We are a titled state. It's called a deed. And so that is what's transferring. And that's that's basically a piece of paper explaining this is what you own. All of the information, the legal information of what you actually own with this property correct, it's recorded at the courthouse.

This is what John and Heidi have purchased. Here's their so called license. Nice to live there. Default an unpleasant word, a whole different D. It's a whole opposite D. It is when as the title people, I'll say, if you pay, you stay. Yeah. If you don't pay, you don't stay, you default. You have defaulted on your mortgage and

at some point you will be moving. Depreciation depreciation we typically associate with commercial properties or commercial equipment, but a home can depreciate if you don't maintain it. It depreciates in its value because you didn't keep the sighting painted you didn't replace the shingles as needed, the gutters are falling off, the property is

depreciating, it's just not being taken care of. Yeah. Disclosures, So when you're buying an occupied home or a home that has been previously occupied, there are disclosure statements and it is just simply what has happened during the tenure of the current owner, and you, as a buyer, want to read those disclosure statements to see if they've had insurance claims, insurance fail, have they had problems with the septic It's a long In South Dakota, it's essentially

five pages. But then you might have for a rural property, you might have a well disclosure. And so where I work in Minnesota, Minnesota requires a well disclosure and a septic disclosure, a meth disclosure. They have disclosures to see if you change your underwear on the right day. But you do want to read those because sometimes there's little tidbits in there that are interesting. Dome payment, so this is not between you and the realtor. This is

between you and the lender. If you're going to get a mortgage, the lender needs to know what you're going to put down and there are no down payment mortgages available, but it is that percentage of the total purchase price that you're putting down. Nice. I think most people are familiar with that one. I would hope so. And the more you put down, the lower your payment will be. Nice. Earnest money deposit sometimes referred to as skin

in the game. So earnest money is what you are putting down at the time of your agreement. When you reach an agreement. It is not a part of it's not your down payment. How earnest money came about, and this is a little bit of a long story, but years ago, people would write multiple offers on properties, all at the same time, and then whichever one accepted their offer, or several people accepted their offer, they go,

I want that one, not that one. And the problem was everybody thought they were under contract, but the reality is the buyer picked a different house, and so to eliminate that, they created earnest money. And because that money will get deposited within one or two business days of reaching an agreement, and so that put a stop to the multiple offers and just leaving people

hang. Yeah, yeah, that's not very fair to do it the other way so no, and these poor sellers were thinking they were moving forward with something and maybe went out and bought another house only to find out or turned turned away another offer. Correct, So this keeps everybody honest ish hopefully so. Encroachment and encroachment is typically something we see in older parts of towns.

But occasionally somebody puts up a fence and they didn't put it up on their side of the property line, so now it's encroaching on the neighbor's property. Older parts of town we see fences, garages, sometimes driveways. In other areas you might see landscaping where they just went too far. They didn't know

where the property line was and they didn't stay within their boundary. It is also a very vertical line, not purely hard, so if the eve of an adjoining property owner's building or house hangs over that line, that is also an encroachment. Very nice, and again I think this would be a very good place to take a break, and we'll come back next week and we'll work our way through the list. Brent.
