再審は有罪が確定した人が、有罪判決を出した裁判所に請求をします。通常の審理は非公開で、裁判官は「無罪を言い渡すべき明らかな新証拠」があると考えれば再審開始を決めます。決定が確定すると、公開法廷の再審に移ります。
