Episode description

In the first of our podcast series, Fieldfisher Director and IP expert Sheena Sheikh Brown summarises the decision of the Louboutin v Amazon joined cases (C-148/20 and C-184/21).

This decision saw the CJEU rule that Amazon and other online marketplaces can be held directly liable for counterfeit goods sold by a third party on its platform, if a user is confused by the origin of the goods advertised.

The overall view was that this result was seen as a win for IP owners in the fight against counterfeit goods, and Sheena dives into more detail about this on this episode.
