literally save the country. And Dan, if you get a chance sometime to actually read the Supreme Court opinion in the Trump immunity case, it is a work of art. You know, I've been practicing law forty years. I read a lot of Supreme Court opinions. It's probably going to take me two
or three days to fully digest it. But the gist of it is so correct legally and so critical for our survival as a nation, especially now that the Left has opened this horrific, this horrific Pandora's box of criminally prosecuting political opponents for political reasons, because at that point, at that point, the country falls apart. How does somebody function and as president when they're thinking, Okay, this action's best for the country, but I know that the other
side will then prosecute me, and I may die in jail. So is the president really going to do what's best for the country there? You would hope so, but don't bet on it. And so yeah, they save the country once again, and we can get into the nuances, and you know, it's a very thoughtful opinion. There are different levels of immunity here,
but the bottom line is it's for official stuff. If the president's screwing around and he commits some horrible assault of somebody's having an affair with the rate, he's not getting any protection for that or she, But official acts yes, And again we'll get back into the mechanics, and then talking about the really fun stuff, right because the left deserves this, and it's as long as Biden is removed as president quickly, which is not likely to happen that
then the rest of it is good for America because America gets to see the truth about the Left just liars to their core, lying about Biden this whole time, their media arm covering up for Biden the whole time, the lefty politicians covering up for Biden the whole time, liars about big important stuff, and now they're fully exposed as liars, who have endangered this nation because no thinking person can look at Joe Biden and think that he doesn't endanger this nation.
My lord, can you imagine what the enemies are thinking? Yeah, this man could not be a wartime leader right now. Enemies know they can have their way until January twentieth at noon because could Biden rally this nation? Would Biden even fight back? Nah? And so Americans get it. And that's why, as we go to our phone lines, we are in a moment right now unlike any we've seen in our lifetime, because every single thinking person knows that no elected Democrat can back Biden, can go out there and
say, oh, yeah, he's capable. He's capable running this country without losing their own credibility. Right, So where have all the Colorado Democrats gone? Where's Jared Polis? Where's Bennett? Now? Hickenlooper wouldn't go on camera, but he mumbled something to Channel nine about all behind Biden all the way.
But Hickenlooper doesn't have to run for a little while. You know, these Democrats who have to run in this cycle or anytime soon, they know they are exposed as liars, as jocksniffers, as unbelievable the second they say, oh no, that guy Biden, he can run the country eight five to five for zero five eight two five five the number. So how do they get out of this? Well, I've got some ideas as to how
they're going to try. And it starts, and this will be a funny, feeble part of it, but it starts at five point forty five Mountain tonight, when they're gonna wheel Joe Biden out and they're going to put him in front of a teleprompter and he's going to give you three to five minutes off a script condemning the US Supreme Court decision today and using it as an excuse to try to wash the taste out of america mouth of that ugliness last
Thursday night, and and spew some more venom at Trump in the meantime. So five forty five tonight, we're going to take it here on the show. Let's go back to the phone lines. Welcome hello over Dan, and you nailed it and bottom line is everybody who's a voter that has any common sense, no matter what party you belong to, you have to vote for President Trump because otherwise, who the hell wants to have an Alzheimer's dementia person with the nuclear codes? He can sure sure, he can't handle it. He can't do it. No, Obviously, if Biden's their candidate, they're going to lose. And the Left knows that now that the thing is, we all know he's not going to
be their candidate come election day. So who is it going to be? And how do they get there without completely imploding the party at least in the eyes of the rest of the country. And we can't have Kamala Harris because everybody who's ever listened to her knows that she is totally incapable of leading the country. So they have what they need to force Biden out? Do they have what they need to force Kamala out? I think her own speech and
actions betray her. I think how she's acted so far, how she's spoken so far, shows that she's not much more. Oh I'm I'm I'm with you. Kamala Harris will lose unless and thank you did for your call. Thank you very much for that. Kamala Harris will lose unless she becomes president sometime soon. If she becomes president, let's say it has at least two or three months in the presidency before election day, then public perceptions of her
may change dramatically. I still think she loses even if she becomes president. But if she becomes president is cloaked in all of that, huh, then you know, all bets are off and maybe she does win. So if you're a Democrat right now, what you're thinking is you have got to invoke the twenty fifth Amendment or have Biden voluntarily step aside, have Kamala become cloaked
in the presidency so she at least has some chance to win. Or if you're one of these lefty powerbrokers, you're thinking, do we have what we need to force Kamala out of the race. I have no idea if they have it or not. I don't know anything about her personal history. I don't know what kind of skeletons, if any, are out there. But you can bet the left does so do they have what they need to force her or induce her to step out of the race. Let's go to how
about Dennis Denver, you're on the Dankaplas Show, Welcome again. You were giving letter grades Friday on the debate, and I think one that was missed was President Trump's restraint. When he walked out on stage. I noticed the scowl on his face, and I wasn't so sure that he wasn't going to physically attack Joe Biden. He didn't shake his hand. What do you think he would have done? If Biden had walked over to him and stuck out his hand to shake his hand, to shake his hand, he would have
absolutely ignored him. And how would that have played? Oh, you know the left would have played it up. I haven't, But how about normal people? The normis out there. How would that have played with the normies? I'm just not sure because it would have killed him. You know, as I see it, I can help out there, Dennis, I can help out there. It would have killed him. It would have killed Trump.
And I believe if Biden had walked over and stuck out his hand, Trump would have shaked his hand, because yeah, Americans across party lines, you know, just basic decency. Somebody walks over, sticks out their hand to shake your hand, you don't leave them hanging unless it's literally Charlie Manson. But Dennis, no, my friend, if I remember, I think I started on Friday by giving Trump an eight plus for self control and listen, it wasn't perfect, He's only human, but it was pretty darn good.
Jennis, we have a problem in the line here. Yeah, go ahead. Well, another thing that I don't here mentioned about that debate is something President Trump said in that he wasn't going to run again until Joe Biden started his BS. Do you believe that? And I think I'm not sure. I don't sure he was going to run, and he had every right to run. He had a great first term. But oh absolutely he did.
Yeah, no, I think he was running. The more you got to ask yourself, after everything he's been through, is it worth it? Well, you can only play so much golf, you can only eat one breakfast, you can only lay on so many beaches. And after the great first term he had and the way COVID cost him a close election, I don't think there's anything on the face of the earth that would have kept him from running for a second term. But Dennis, appreciate your callers, so

We're talking about this monumentally great and important Supreme Court ruling and talking about how do they get rid of Biden? When do they get rid of Biden? Who is he replaced with? There are some developments in that
front. And then Biden's speaking live at four five point forty five about and off a prompter. I'm sure the community decision today. You're on the Dan Capla Show and now back to the Dan Kaplas Show podcast, and I will say, if you wait for definitive polling, we do have one pole that is now asked the horse race question after the debate, asking Biden versus Trump after the debate, who are you for? It's just from one state,
It's from New Hampshire. But in that New Hampshire poll, this is out just a couple of minutes ago, Trump leads by two points in the New
New Hampshire poll. If you can read my writing, Trump plus two and the critical thing there is in twenty twenty, Biden carried New Hampshire by seven point five points, So we don't have Oh you gotta love that, right, and love even more at the enthusiasm of MSNBC for this bad news for Biden, right, because it's so nice they have to desperately run them out of the race now after lying for him and covering for him all this time, because hey, they couldn't call Thursday Night a deep fake, right,
So this is just one of the most beautiful things I've ever seen, So I hope you're enjoying it too. The obvious downside, right is every day Biden remains president, America is in much more danger because our enemies see this as well, and they know that Biden couldn't lead this nation right now in any kind of serious matter, including any wartime matter. Eight five or zero
five eight two five five. Before we get back to the phone CBS poll, the percentage, what would you think the percentage of people are who say that Biden does not have the mental and cognitive health to serve as president? That number is now seventy two percent. Guess what you cannot win with that?
By the way, though, will Biden out tonight at about five point forty five Mountain is the schedule to give a few scripted remarks about the Supreme Court immunity decision today, take some shots at Trump and then wheel them back out, so we won't see the wheeling part of it, but we will see him speak for a few minutes, and we'll carry it live here on the Dan Kaplis Show. Let me get to some of these other great texts,
Dan, I do not agree with your statement about Joe Biden. She's part of the Biden crime family, and you know that she has dirt on a lot of people in power, and she's willing to use it. That from Sarah. Sarah, thank you for taking the time. Listen. I think we have to keep in perspective right now what's referred to by some as the Biden crime family, and that is they are small, small timers.
Now, I think they've engaged in very dangerous corruption, maybe not computable, maybe prosecutable, but morally, you know, selling access to the office of the vice president and access to the office of the president. You're the vice president. And so with that said, these are small timers. I don't think there's anybody on the left who fears the quote Biden crime family. Nothing like that. These are small timers who've been barely tolerated by the people in
power. Biden knows and his family knows. They've never been respected by the powers on the left. They've never been loved, They probably haven't even been liked. They've been used. When he became convenient because Obama needed a vice president so weak, nobody would ever call for the backup quarterback. They went to Joe, and they humiliated Joe on a regular basis during and after his
presidency. And we've talked about those examples on air. So no, they Biden's always been viewed quite properly as a small timer, and so there is no fear of Biden or the Biden crime family. And again I don't know whether Biden ever influenced Obama directly on behalf of any of the people who were pouring all this money in through his son, But to me, just selling that kind of access is despicable. But nobody, nobody on the left fears
the Biden family. Dan money talks for Libs and lefties. I say, the mega donors offer Biden and Harris an amount of money they can't refuse. It's going to be interesting to see if that happens. You know, with Harris, they've got to get her out of the way. I don't know whether there's major dirt on her or not. If there is, they would use that, or it may be an inducement, Yeah, an amount of money, some big you know, business opportunity or this or that she could
not refuse. But in order to win, they have to get Harris out of the way, right unless, unless she becomes president and gets cloaked in the presidency, becomes president before election day, gets cloaked in all of that and can change public perception of her as she assumes that office as the first female president. Obviously, for that to happen, Biden would have to leave voluntarily. They're not going to invoke the twenty fifth on him, even though
they should. Let's see so many texts to day Dan. Getting back to the immunity ruling. Does that mean that you can not criminally charge a president or any other elected officer when they violate the constitution. Where's the accountability besides
not being re elected? That from Kimberly, great question, Kimberly. First, this ruling today only applies to the office of presidency, and the Court does a fantastic job of going through the history, the American history, the importance of the office, the breadth of responsibilities, the need of the founder's and vision for the president to act boldly in the nation's best interest, not be sitting there wondering, OMG, if I do what's right for the nation,
am I going to end up dying in jail because my political opponents will jail me after I leave office. So only applies to the president. And I'd love to get maybe a more specific example of what you're concerned about in terms of violating the constitution, Kimberly, what kind of constitutional violation because it would have to be a criminal act, right, So what kind of criminal act are you envisioning that would also constitute to violation of the constitution. I'd
love to have that conversation. But bottom line is the court saying no, if it's a core function, like you know, talking to Trump talking to his attorney general about election fraud, total immunity, no criminal charges whatsoever. If it's a perimeter official function, you know, say, talking to election officials in Georgia, then the trial court has to go through a certain analysis to see if it's entitled to immunity and then private stuff unofficial stuff. No,
there's no immunity. What'ssoever eight five or zero five two five to five? The number text d A N five seven seven three nine. Again, Biden's scheduled to speak to the nation at five point forty five about the immunity decision today. The real reason he's coming out, obviously right, is to just try to get the taste of Thursday night out of America's mouth. Ryan, let's go to that. Oh, there are so many good cuts here on so many polling results. We don't have time to play him before the
break. What's your favorite polling result of the day. I have mine. There are so many good polls. There's not necessarily audio of it, but yeah, every poll has reflected a turn for President Trump plus two in New Hampshire really jumps off the page at me that he even has a lead there. This one though, from Harvard Harris, this has been a consistently reliable poll, head to head Trump plus four third party candidates included. This is
the national popular vote Dan Trump plus eight forty six thirty eight Wow. And Ras Musselm had him up nine last week. I think that may be an outlier. But you know what's so striking to me, right when you come back to even some of the more conservative polls in Trump's favor it back in twenty twenty, this same time, So Trump in the most conservative polls now is up one or two and then more in other polls. Twenty twenty, this same point in time, Biden was up nine and a half, nine
and a half and barely one one, barely one. Hey, when we come back again, Biden's going to speak. But also Gabe Evans up in cdaight will do a quick drop here on the Dan Capliss Show. You're listening to the Dan Kapliss Show podcast, and you had to sort of wonder how the context affected the justices. I mean, if they want to look at the implications of leaving presidents without protection, they just need to look around the
country. Even though Manhattan was not a federal case, it was a political prosecution in the view of many of us that was rather raw and open. And so this is a context that must have concentrated the minds of these justices as they did what Justice course had said and tried to write for the ages to have something not for this case, but for future cases and future presidents. Yeah, beautifully said one of the most important decisions today in US Supreme
Court history. I think very much saving the nation today with this decision, and will continue to examine that. President Biden, do you think this is a mistake. He's they're wheeling them out to speak to the nation at five point forty five about the immunity ruling today. The real reason, obviously, is to try to get the taste of Thursday night out of America's mouth. Spoiler alert, not going to work, right, not going to work.
Americans have seen too much of the truth. And I promised you like months ago, months ago, that these were going to be the best of times in many ways for conservatives and therefore for America. We're entering into that phase now. Part of that is the good things we see happening in the Colorado
GOP and you see so many impressive, talented young candidates stepping up. And one of those joints is now Gave Evans, who won big the primary up in CD eight, and it's attracting a lot of national money, a lot of Republican money because it's Caraveo on the other side, and a real chance to beat her their impressive cat. can you fill folks in? Yeah? So. Gabe Evans born and raised here in Colorado. Twelve years US Army and Colorado Army National Guard. One deployment overseas and then fires, search and rescues everything that you do with helicopters here in Colorado. Didn't have enough fun doing that. Another ten years in
law enforcement with the city of Arvada, married with two boys. Got absolutely frustrated watching twenty two years of my service and the military and law enforcement going down the drains with the way the left is running the country and the state.
So two years ago I stepped away from my law enforcement career. I've been a state representative down at the state Capitol in Denver for the last two years, and I just had a really big primary win last Tuesday for Congress in the eighth congressional district, which, as you said, is it's a national battleground race at this point. Electgabevans dot com because I hope a lot of folks not in your district to think about contributing to you, whether it's boots on the ground, money if they have it, etc. Because obviously this could be a big, big win for the GOP and control of Congress. But also you know, to put a really talented guy who's lived a great life in place, and the more of that we can get, the better, because I think the day will come when Republicans start
to win state wide here again. So, Gabe, what's the plan to win the race? Well, I mean, unfortunately that plan is around us every single day, and I wish that wasn't the case. But under the left, under the Democrats, Colorado has become the third worst state in the nation for crime. I think most folks know we were the worst state in the nation two years running for auto theft. Colorado is the second worst in
the nation for teenagers overdosing and dying on fentanyl. Somewhere around three hundred million dollars of taxpayer money just here in Colorado is going to illegal immigrants because of our massive crisis on the southern border, and the fact that Democrats here in Colorado are doubling down on their sanctuary city and state policies, set and all the number one killer of Americans ages eighteen to forty five. Colorado is one
of the most expensive states in the nation. In fact, my Democrat opponent, a piece of legislation that she sponsored has cost about seven billion dollars with a bee in economic loss to the eighth Congressional district. So everywhere we look, we see high crime, high cost of living, and just a numerous
other disasters caused by the ruling left. And so with my background, you know, I bring two decades plus of experience working on American safety, working on public safety, working to try to make Colorado and the United States a safe, affordable place to families again by cutting red tape and empowering our economy. And it's just carrying that message to voters who I think are ready for a change. Cape Evans, our guest gave it seems to me, you
know, politics aside. Obviously I disagree with her on every big issue except one, which is and then she went soft on the harms of illegal marijuana. But it seems like Representative Caravo has not really made much of an impact at all. Hey, you're on the ground in the districts. Is she registered with people either through personality policy in any way. I don't think so. I mean, I'm endorsed by two thirds of the sitting mayors in this
district. Two thirds of the mayors in the eighth congressional district have said, we do not feel like we're getting adequate representation from our current congresswoman, and it's time for a change. And so they've thrown their support behind me. And really everywhere we go in the district, we're getting the same message of she hasn't really done anything. Tap it is. And then you go look at her actual votes and you see all the negative things that she did.
I mean, we talked about that seven billion dollar economic hit to the district, but there's a lot more just bad votes, bad policies that she's pushed. Yeah, you know, you get some other Dems that they don't do anything but power of their personality. They may be on TV a bunch of spouting lefty points and all this, and that she just seems to be a non factor. So hopefully that helps you win. Appreciate the time I hope you come back off. Hey, you think this is a good idea or a bad idea for Biden to do what he's going to do in
a couple of minutes, and that is address the nation. And he's going to address the nation ostensibly on the Trump immunity ruling today, this great ruling from the Supreme Court. My guess is he won't like it as much as I do. But we all know the real reason they're rolling them out there with half the bronzer in America port on his face is again to try to change the channel from last Thursday Night. I think we all know that isn't
going to work. Right. Americans have seen too much and Thursday night, if it was a one off, it would still be enough to end the race for him, But it's not a one off. America's Americans know this has been going on for a while now, So hey, we'll find out together. We're going to bring you the sound and if you're driving, we'll
describe the images as well as we can. But you can picture it right now, right, I mean, he's going to be out there in front of the prompter and whatever shade of and they make fun of Trump for orange Ryan, what would you guess the color is tonight? Oh, they're going to try to, like you said, kind of bronze them up. I think that's going to be a play. They had him, they had him.
What would you compare that color to when they rolled him out in North Carolina the morning after the disaster and disaster for them is to find as America seeing the truth, right, that's a disaster for the left. But that was a pretty attractive shade of browns. So I would guess we're going to see a similar thing tonight. But it's not going to matter. You know the old saying about it doesn't matter how much perfume you put on a pig,
or lipstick on a pig. Whatever, doesn't matter how much bronzer you put on Biden. How short it is, you know how much teleprompter screen you have there. Americans are not going to forget what they just saw. And that's why you have polls. What was it up to CBS poll It is seventy two Americans saying he does not have the cognitive ability to continue. So let's pop this break now so we can come back if he starts during the break, which is unlikely because he's usually late. You know, we'll
just bring it to you from the beginning. You're on the Dan Kapla Show. And now back to the Dan Kaplas Show podcast. As expected and predicted. Not a tough prediction, right, They wheeled out Joe Biden, and they brought him out pretty close down time five p forty five. Well play a little bit. You can get the feel, but you can already guess what he said. But hey, they had him looking good, right, the same three or four gallons of bronzer and the same I think suit I'd
have to double check that he had in North Carolina. So he looked better than he did on Thursday night, sounded better than he did on Thursday night. Thought it'd be hard for any living creature to sound worse, and they kept him out there, I don't know, maybe four minutes, maybe three minutes, and they actually think that's going to change the minds of Americans about his mental fitness to hold the office. The content was just what you'd expect,
ripping the Supreme Court decision. Now, every president's a king. Trump's awful, all that garbage. So Ryan, why don't you give folks a taste. Let's play. I'd say a minute or two of it, but I think it only went like four. The presidency is the most powerful officer
in the world. So an officer not only tests your judgment, perhaps even more importantly, it's an officer that can test your character because you're not only face moments when you need to courage exercise the full power of the presidency. You also face moments where you need the wisdom to respect the limits of the power of the office of the presidency. This nation was founded on the principle that there are no kings in America. Each each of us is equal before
the law. No one, no one is above the law, not even the President of the United States. But today's Supreme Court decision on presidential immunity that fundamentally changed for all, for all practical purposes. Today's decision almost certainly means that there are virtually no limits what a president can do. Give us the fundamentally principle. I'm sorry this and folks got an idea of how he
sounded. It is such a blatant lie. And the reason I have to jump on it is he talks about the morality, the importance of morality in office. Have you seen got to ask this, have we seen a less moral president in modern American history? Now? Nixon engaged in raw criminal acts, But I leave the question on the table. Have we seen a less
moral president in modern American history than Joe Biden? And he proves it by then immediately telling another whopper of a lie that this US support or whoever wrote that right. This US Supreme Court decision absolutely preserves the ability to criminally charge presidents outside of their core functions. So a core function in this example is, hey, he's talking to his ag about election fraud. Trump saying, Hey, I think there was election fraud. I want you to go out
there and investigate it. Court says that's a core function. President can't be faced with criminal liability there and goes into the separation powers reasons for that, But there's a whole another world of official acts that are not core functioned that the Court describes as outer perimeter that a president can be criminally charged for a whole world of that, and then of course anything unofficial. So Biden just flat outline. But again, listen, they think the American people are stupid.
You think the American people are going to forget Thursday night because the guy spent what was it three to five minutes out there, didn't take any questions,
not a chance. Here's the thing, Ryan, And do you think we'll see it if and nothing's going to change what America saw Thursday night, But if they're serious about trying to do that to change American impression and all, it was really just one bad night, right and ignore the many many many months and years before that, they would have to put him out there for a no holds barred at least our long press conference. Do you think
that? And I don't think that's going to change anything significantly for him. That guy is cast and quite appropriately, But do you think they'll do that? Do you think he'll go out there for a full, real press conference? Well to quote Elie Honig, there is zero chance of that happening.
And again, I don't get the myopic nature of not only Biden but the administration condemning this ruling when long term, Dan, this will benefit Joe Biden because he won't be prosecuted for all the shenanigans he's pulled by colluding with these local prosecutors to persecute and prosecute his political opponent, Donald Trump, or for the southern border, et cetera. But Ay, they know conservatives wouldn't do that, because conservatives respect the rule of law. But b Ryan, they
don't give a darn about Biden. They never have. They've never even liked him. He was a useful idiot when they were down to their last hope of beating Trump, right remember during the primaries. So they've never liked him and they don't care about him. But here's the thing, my friend, and that is the reason I think this devastates the left is this was their new nuclear weapon because they've always done the politics of personal destruction right the left.
They can't win the argument on the facts, the logic, the merit, the morality, so it's politics of personal destruction. Now they've got the nuke. They can keep most good conservative candidates out of even running for office, because now the left has proven they've crossed that rubicon, and they will put you in jail. They'll get a friendly prosecutor to charge you criminally,
and even if you somehow avoid conviction, it'll ruin you. So they keep a lot of great conservatives from even running, and then the ones in office at that point, hey, they don't feel like they can do anything that would upset the left for fear of going to jail if they happen to be where a lefty prosecutor can reach them. So at least for presidents, now
this doesn't affect anything except the presidency. For presidents, at least the left has law stet Ryan, I think that's a devastating loss to the left that goes way beyond Trump. It does, And for Joe Biden, this is a guy that only respects the rule of law as long as it goes his way. For instance, the Supreme Court ruling against his student loan ballout program, he went end around them anyway to enact at defying a directly by them.
Well, and we could sit here literally for days and talk about my question of is Biden the least moral or the most immoral president of our lifetime? And you just cited one of thousands of examples, right, and the immorality falling into lots of different buckets. And so yeah, now he's done. The only question now is how does the left run him out? Because the day is going to come when he stands up there and says I'm not going to be your nominee. But how does the left get him to that
point? I think they have a lot of different ways to get him to that point. For the texture, right, Stan, why are you an apologist for how hungry doctor Jill? She's cold, ruthus, evil, elder abuser. How am I in any way an apologist for her? And no wayte shape or form am I that? So welcome back tomorrow and this is an amazing thing to behold. How do they get rid of them because you know they are going to How do they shed themselves of Kamala Harris because she
