For Donald Trump, he must anticipate the question from CNN moderators about whether or not he now accepts the results of the 2020 election. For Joe Biden, it is likely he will be asked whether he acknowledges his son Hunter's laptop was, in fact, real after being used as state's evidence in a trial to convict the first son on gun charges. Will Jake Tapper and Dana Bash actually follow through and ask each of these questions on a level playing field?

Jack Phillips, owner of Masterpiece Cake Shop joins along with attorney Jake Warner from Alliance Defending Freedom with an update on their testimony before the Colorado Supreme Court in yet another chapter in Jack's seemingly neverending religious freedom case.

Donald Trump win this debate with Joe Biden a week from tonight? Is it the American way to be spending impossible amounts of money, impossible amounts of money putting the homeless in hotel rooms when you know you can't sustain it, and you have to cut lots of other things, including going to an automated nine to one one system eight five to five four zero five eight two five five

then number wow. Jump on any of those you'd like to. You know me right now, I'm totally obsessed with this debate a week from tonight, Ryan, I don't think we can even call it a debate. This is this is not a debate in the traditional sense, right, It's not a presidential debate like we've known ever in our lifetime, because only one of these guys is going to be their party's candidate for president. So what do you want to call it? Next Thursday. What is it really? I mean,

it's it's It's Biden's swan song for Trump. It may very well be the election because if we get the A Trump, it's going to be hard for Gavin Newsom or whoever they put up there to beat him. And I think so many voters right now who are truly undecided, So many of those voters right now are just waiting to see if Trump still got game. So they want to see him up there because I think everybody in America who's honest and knows what happened in New York and that that was a wrongful conviction,

politically motivated abuse of our judicial system. And so what they're looking for now is does he still have game? You know, has he lost a step? Or is he still real sharp? Is he is he stable? That kind of stuff, Because listen, as far as the public, not not

the Trump supporters like me, but as far as the public's concerned. Ryan, correct me if I'm wrong on this, But I think all the public has seen of Donald Trump since that wrongful conviction was his national comments the next morning when he went live at about nine o'clock mountain time the next morning. And I think that was very, very widely watched, and he did not

do well that next morning, and who could blame him? You know, the guys served the country great, he's just been put through this awful wrong floor deal, he's just been wrongly convicted of felonies and he's only human. But he wasn't sharp that next morning. So I think for an awful lot of Americans, they just want to know, you know, is he as sharp as he was during his first term. If so, then yeah, no brainer, they're going to vote for him. So I think, well,

you can't. It's a trial. What's happening next Thursday night is the trial of Donald Trump in the court of public opinion, and what's on trial is whether he's still got his game. Joe Biden is a side show. He's like, you know, you go to the circus, right and you got the bearded lady over here. Joe Biden's the bearded lady. This is all about Trump. You know, Trump's the elephant in the ring. What what did people when the circuses used to have animals, people were going to

see what were we going to see the elephant? We were going to see the elephant. We're going to see the tiger. Did you ever see that picture of me riding an elephant at the circus? No? Oh, okay, you got to show this. Yeah. Anyway, all I'm saying is that's what Next Thursday Night is, and we're making all this up on the fly. It's pretty good, right. Next Thursday Night is the trial of Donald Trump in the court of public opinion. The one and only issue for

the jury does he still got game? How much you want to bet? And if we replaced these odds in Vegas that the first question of Donald Trump is if he still questions the results of the twenty twenty election, right, And that's what the left push are Jake Tepper's first question should be who won in twenty twenty? Right? And you can be sure for those reasons, it will not be the first question, but it will be asked, right, Because if Tapper just makes it the first question, then I just no

obvious ringer for the left. But it will be asked, and it's fair to ask. I think it's I think it's important that Trump answers yes. Yes. That's why the tougher That's why when I try a case, Ryan, I want the toughest possible opposition in that court room, the toughest possible opposition, because then then you know, right, it is going to bring out your best. It is going to clear everything, clarify everything for the

jury. So that's what Donald Trump needs, he needs the toughest possible questions, because that's what the voters have in their mind. Here's the difference between us and them, though, Dan Jake Tapper, who I want to like and I want to respect him. I think he's got it in him. I do. Is he going to ask Joe Biden about Hunter's laptop? Then you asked, Joe, is it's again you think so dead? Nuts?

Certain? You really think so? Yes? Yeah, see, I guarantee you, Oh, you can wipe clean the slate of all the Tomahawks. You owe me and Kelly Tomahawks. Kelly owes me Tomahawks. You will get that question from one of the CNNs. You will get that question, which is, hey, you stood on the debate stage right and you said that laptop was Russian disinformation? Why did you say that or something along those lines. Will you admit now? Yep, So they're gonna say Trump, will

you admit that Joe Biden won that election? Biden? Will you admit now that laptop was Hunter Biden's and the evidence on that laptop is real. Yeah, you're going to get those two questions, and you should. I'm just hoping we do get both of them because I will guarantee that. Yeah, Trump's gonna get asked about twenty twenty the outcome. Does he accept the results? You lot? Do you think he's gonna say? I don't know, Well, I want to open it up. What do people think you should

say to that? Eight five five for zero five eight two five five text d A N five seven seven three nine. What's he going to say? We know what he's going to say, but it's how he says it. He still believes he won that election. I think he believes that. Listen, if there's one thing you can be certain of other than the Good Lord himself, you can be certain that Donald Trump is going to say he won in twenty and there are a number of reasons he's going to say it.

Because understand these the Biden Whitehouse prosecution of Trump and federal court. We've been so focused on this wrongful prosecution in state court. The federal court prosecution that won't get to trial before election day. The whole premise of that case is that Donald Trump allegedly knew that he had lost and argued to overturn the election anyway. So there is zero zer chance that Donald Trump's going to get up on that debate stage and say, yeah, you're right, I lost.

I believe, if I truly believe that Donald Trump believes to his core and has always believed to his core that he's won, that he won that race, I've never seen any proof to the contrary. My position has always been I've seen evidence of fraud. I haven't seen evidence of enough fraud to change the outcome. Could he say something as simple Dan as well, I believe I won the election, but we weren't able to win it in the courts. Something like that. Sure, I mean, but this will be such

a barometer of how well he has prepared. And because back to how I opened the show, you've got the discipline Donald Trump, the guy who built that tremendous real estate empire, got himself elected president in sixteen, etc. You've got the disciplined and did some great things as president. You got the discipline Donald Trump, and you got the wing at Donald Trump. Yeah, and if we're going to get the discipline Donald Trump. It isn't going to

be because he decides next Wednesday night. Hey, I'm going to be disciplined. It's because he's already decided and he's doing the pre right now to be his best in a week. So if we get the discipline Donald Trump, you'll get an answer like that, right, If you get the wing at Donald Trump, it's part of the part of the amazing entertainment of Donald Trump. But the wing at Donald Trump, who knows. Yeah, we'll see. And I'm still I am not as certain Dan that Joe Biden gets asked

about the laptop. He absolutely should. And if they're doing their jobs, they're gonna even look like they're hamodicum of fairness in it, then they're gonna have to ask him about it. Right. The reason I'm laughing is I'm looking at this headline and CNN a couple of minutes ago, aides colon Joe Biden pouring over briefing books and questions for debate. Now I picture Biden sleeping on the briefing books, and you know that isn't true, because they've got

to know. The more of that kind of prep they do with them, the worse it's going to be for them. That's why they agreed no notes. Yeah, because if he had more than one little note card up there on stage, it would short circuit. I can't overload him with data in facts and numbers and information. They can't do that. No, this is just going to be angry old man spewing venom at Trump. And it's really it isn't even about Biden next Thursday. He's almost irrelevant. He's not their

nominee. This is the trial of Donald Trump in the court of public opinion. The only issue for the jury does he still got game? debate. We're not going to refer to it that way. It's not a presidential debate because only one of the people on stage is going to be their party's nominee. It's I'm calling it the trial of Donald Trump in the court of public opinion, and the only issue for the jury is whether he's still got game and how he wins. Boiled down to two words. I mean, we'll talk about lots of other stuff because we enjoy that, but it's simple, be presidential. If he's presidential, he wins. It's that simple.

Undecided majority just want to see if he's still got game or if he's this divisive, chaotic, unstable wacko the left paints him to be. And while you and I have been watching him in action, right, if you're like me and if you want him to win and you're paying attention all this stuff, most of the people who are going to decide this race have not been watching him in action. You know that they're not dialed into this stuff the way you and I are. So yeah, they'll dial in next Thursday,

or they'll see clips whatever. And that's the one big question, you know, does he still got game? And so his path to victory is very easy, very easy, and very obvious in that debate, and it's just going to take a lot of discipline and prep. now to have the ten command. It's in classrooms, along with the quote context statement that hey, these are going up here not to try to convert you to a religion, but as part of the state's history, et cetera. Chris, what do you think of my friend? Hey, good to talk to you again, Dan, oh and quickly, Ryan, congratulations on hosting your own show. You deserve it. Thank you, Chris appreciate it. Well, he hosts this show too, right, I mean, so

he's got a two shows. Yeah, and that's hosting. But no, that's really Kelly going to get a show. Kelly, You're the only person around here without at least one show. And so I wanted to weigh in on how Donald Trump should talk about January or the twenty twenty election and what he should say. I mean, I think he needs I think it would be good if he did it a little bit like put context to it.

You know how close it was, I mean something like forty thousand votes in three states, you know, and where those votes made the difference were in Milwaukee and Atlanta, cities that are Democrats, bistoms that haven't had Republican mayor in decades that are known to be corrupt and talk about the funky things that

happened. And so Chris, give us the verbat of my friend, because obviously you're in this format where if you are not right to the point, if you don't have something real, concise and punchy, even if you've made a great point, it's going to get missed. Yeah, yeah, I don't think I could do that. Actually, that's okay. No, no, I appreciate that. I'll read for you, and thank you Chris for your call. I'll read for you one of the greatest texts we've had in

a long time. And this question because we know that Trump's going to be asked and he should be right. It's only fair that he'd be asked, hey, do you still believe you one in twenty, just like only fair Biden will be asked, Hey, you said on the debate stage the laptop was Russian disinformation, and do you admit now the laptop is your son's and the evidence on it is real. So how about this one from a Texter. If the first question to Trump is about the twenty twenty election, his

response should be, do you still question the twenty sixteen election? Right. What a great point. I love that. What a great point because when you stop and look at this, this wrongful trial and conviction of Donald Trump in New York, that is an election denial case. The whole theory of the prosecution was that Trump stole the sixteen election. So that that is a brilliant point from the texter. How do you think Trump should answer that question?

Eight five five four zero five eight two five five, Well, we're doing Texters, Dan. Trump should say, of course I won in twenty twenty because there's no way Cricket Sleepy Joe got eighty one million legitimate votes. When you can only fill up six circles with fake news reporters, and I fill stadiums, you don't need any more proof. What do you think of that answer? Ryan? Okay, we'll wait, grind up back there and what are you smoking? Question Mark? If you think that the question of

Hunter's laptop will be given to Biden, you probably think unicorns exist. See that's so interesting in me that text, because it's obvious the question will be asked. The question has to be asked. You've got to look at the self interest, right, you always look at people. Self interest doesn't mean they're bad people, They're just people. And what is the self interest of these moderators. The self interest of these moderators is a defeat Trump. Well,

no, let's make it a tie. They have a dual self interest between defeating Trump and elevating themselves within the profession. And so to have professional credibility, they have to ask Biden some of the obvious tough questions. And they're not doing it at that point to hurt Biden. They're doing it to help themselves within the p fashion. But clearly they want Trump to Trump to lose, and they'll find other ways to try to accomplish that. And of

course, come on, I've said this for thirty years on air. However, long stop counting. It's about the follow up questions, right. You can ask whatever question you want to ask and think, oh, that's a tough question, but it's meaningless if you let the person answering get away with gobbledegook. So Biden's going to be asked that question, He's going to completely avoid it. And the real test of Jake Tapper whomever from CNN is going

to be do they follow up with him and Amram? Now, what's more likely to happen is they ask both Trump and Biden the tough questions, but then they follow up with Trump and they don't follow up very much with Biden. We'll find out together, Ryan, I wish there was time for us to pull an event together for next Thursday where we could watch it with people, watch it with listeners. Why now we've got time of week. It's a week. Yeah, what about it at your house? Go to your

house? Yeah, now we should have an event. Here's the challenge with the events, because I've been to some of these different radio station events and debate night. You can't hear the darn debate. Yeah, you would want a venue where you could absolutely hear. Why I don't go to super Bowl parties? Yeah's inviting, but I don't go to Super Bowl parties because I want to I want to watch the game. I agree. I want to hear what the commentators are saying. I want to hear the commercials, right,

yeah too. Yeah. By the way, what am I smoking? Nothing? I have never smoked marijuana. I've never eaten marijuana. I just you know, I've got all my own stuff, but yeah, I've never done that, your own stuff. But you know, we're all human. Right, we've all got our flaws. No, I'm glad you Clark. You're right, somebody would have. I don't do bod I got. I got much stronger stuff than that good one. Thanks for catching down that would

have been played back and you're not tune time. Yeah, peanut Butter, isn't it true that you admitted on air to using hard drugs? No, I've never done any drugs, but you told Ryan Shuling. Yeah, No, I don't smoke marijuana. I got my own stuff, that's the way you said it. Yeah, that's great, that's great. Let's see what else do we have. I have that in common with you. By the way, I have never smoked Marina. Yes, do you miss it. I've never tried it. Right, But I mean, do you sit there

and think, Man, I wish I could smoke marijuana. I've done no desire, zero desire, Right, I've never had any desire to be a stary. You got this far without it. Jack Phillips has risen to the status of kind of a biblical type figure who were just blessed to have here in Colorado, as he's constantly persecuted by the Left that controls Colorado, persecuted for his Christian beliefs. They insist that he bend the knee, that he take the knee, and that he expressed things he doesn't believe in. And if he doesn't, then the Left's going

to keep using the law against him. And Jack's going to keep fighting and he's going to keep winning all the way up as he did before, to the US Supreme Court, and we benefit from it. It'd be so much easier, imagine Jack, welcome back to the Dan Kapla Show along with your

It would have to be a lot easier for you to just sort of roll over on all this years ago, just go about your life, you know, you know, give them, you know, whatever bending of the knee they want, But you've fought the good fight, and we're the ones who are going to benefit from it. Boy, that is so true, because I think most of us going about normal daily life have no idea what's involved in mounting appellate court challenges at this high level, all the way through the process, including winning in the US Supreme Court.

It's a monumental undertaking. But obviously they couldn't accomplish this without you, without somebody willing to fight this fight. So before we get into the legal issues of the last US Supreme Court pardon me, Colorado Supreme Court appearance a couple of days ago, what is at this point the personal toll on you? Are you glad that you have fought this battle? How are you doing with

all of this? You know, I am glad that this battle came to us and that we were able to pursue it again with the help of Alliance Spinning Freedom, because honestly, Dan, I could not take a lawyer out to lunch, let alone afford this fantastic team of lawyers and everybody else involved in Alliance Spinning Freedom helping to preserve the right of every American to live and

work according to the beliefs without fear of punishment from the government. And so it's been a battle that I didn't look for, but I'm glad that ADF was there to stand with us. Poor Jack and Jack Phillips are special guests.

That's such a great point because not only the cost, I mean, if let's say it was a corporation paying for this level, this high level of Appellet's support through this many cases, you're talking probably fifteen to twenty million dollars in attorney's fees, But not only the cost, but the quality of the representation. Because when you know Jack and most of us don't in daily

life, is that the quality of lawyers at Alliance Defending Freedom. These are top people who could be earning top corporate salaries in big law, but they decide they're going to stand up and fight for what's right, and so we're lucky to have them but Jak and Jack, obviously it's your case. Just bring people up to speed on what was going on in the Colorado Supreme Court. To me, it seems like a very clear, simple issue. This

is obviously expression under these circumstances, this cake. But please just educate all of us on it. Sure, Well, it's a pleasure to be back on the show. Let me give a brief update about where we are now. Your listeners might remember back in twenty seventeen, when the Supreme Court took Jack's first case, a Denver lawyer called and requested Jack to create a custom cake blue on the outside and peak on the inside that would celebrate a gender

transition. Of course, Jack serves all people, but he can't express every message, and that's a message he can't express for anyone. Well, this attorney sued Jack, and here we are at the Colorado Supreme Court after lower

court said that Jack could be punished for declining to express this message. So earlier this week we were at the Colorado Supreme Court arguing that free speech is for everyone and the government shouldn't force anyone to express messages they don't believe, and that principle protects people like Jack and his views on a marriage and gender and some of life's biggest issues, but also protects people on the other side

of these issues, so the government can't force them to express rights they don't believe. Hey, and I think that goes to the point Jack opened with is that he is helping the people who are oppressing him. He's protecting their right to free speech. These rights got away for me, they go away for everybody. Free speech is for everybody. If they go away from me,

they go away for everybody. And so align spending freedom is helping protect artists like myself, like Baronel Stutsman or Lourie Smith, the owner of three to Zho three Creative, whose case also went to the US Supreme Court, to stand and have the government protect our right to express what we want to

and not compel us to express things. So we don't. Well, and Jack, I'm glad you mentioned three Zho three Creative And Jake, maybe I'm missing something, But isn't it at this point given the Supreme Court body of law so far, isn't this kind of open and shot that this is clearly expression in this context? And so what's the issue. Well, we argued in court earlier this week that three or three creative directly controls this case.

There, the US Supreme Court said that the government could not use this very same law to force artists to express messages they don't believe. So we're hoping to colorade a Supreme court. This is the first chance of a Colorado court has to apply that decision. So we're hoping the Colorado Supreme Court will apply that decision faithfully to protect Jack in this case because as a draw court below found, this cake expresses a message, It cribilizes a transition from male to

female. And when the government's trying to compel a message to compel speech, three or three says it can't do that. Yeah, it just seems so straightforward, and I have to believe that. First of all, I'm hopeful obviously you'll win at this level. But if you don't, I have to believe the US Supreme Court is going to take this case up and say, hey, this is straightforward. I would certainly hope so, because you remember, back in twenty eighteen, the US Supreme Court did rule in favor of

Jack, but on the free exercise issue. I didn't reach the free speech issue that we raised there because the other violation was so clear. Of course, in the sixty years since, Jack has continued to be harassed, and he's been in litigation now over twelve years, as government officials and activists have been misusing the wall to try to force them the say things he doesn't believe.

You know, certainly we hope to Colorado's Supreme Court reaches the right decisions here, but if it doesn't, we certainly stand ready to appeal to the US Supreme Court, and we hope that they would end this harassment once and for all. Yeah, like some smart person said referring to Jack, the process is the punishment. You know. It's almost as if, in my view that this secular, far left government in Colorado, I just know they're going to lose in the end, but they just want to punish you for

standing up for what you believe and standing up for religious freedom. So I think they've got to know they're going to lose eventually at one of these appellate levels, but they want to punish you with this process. sports themselves. So yeah, the state is conceivably just like you said, hoping to wear me out and that I'll i'll just get tired of it or whatever, can't afford to go further. Right man, I'm telling you that is we are talking the other day about the ten greatest Coloradens in Colorado history, and Jack Phillips has to be way up there on that list, way up there. We are just so lucky to have them and I'm serious about this alliance defending freedom thing. I mean they are the highest highest level that the guys. Now back to the dan Kaplis show, Alliance

I mean they are cream of the crop who could be at big law earning these ginormous salaries, but they've decided, Hey, they're going to devote their god given skills to doing things that matter. More So, it doesn't get any better than that you're on the dan Kaplas Show. I don't know, I mean maybe not. I mean that's for

courts to decide. I don't have a particular problem with this. If somebody wants to hang up a piece of paper in a schoolroom that says, you know, hey, kids don't murder, don't steal, don't lie, and respect your parents. You know that doesn't bother me. I'm not out here crusading for it, and I certainly don't think public school teachers should be preachers. But you know, these are the fundamental tenets of Western Sibylis. They

kind of underpin, you know, our entire criminal justices. I mean, look, if they're part of a historical display, if they're hanging up there next to the Constitution, the Mayflower Compact, the Declaration of Independence. I don't have a problem with that. I do see that is key because you're probably hurt, I'm sure. But now it's the Louisiana law signed yesterday that

makes it mandatory to put the Ten Commandments up in classrooms. But what's left out of a lot of stories is it has to be up with a context statement, a statement that essentially says, and I'm paraphrasing, hey, this is part of our state's history. These are foundational documents of our state and our nation. This is the moral tradition of our state. You know, it's not a statement that says, hey, you've got to pray to my

God. And the US Supreme Court has been real clear, Hey, you can put Ten Commandments up in all sorts of public government places as long as the motivation isn't primarily religious, because you can have these other motivations. It is true, as a matter of fact, the Ten Commandments are, for many states and the nation foundational documents. They're part of the moral tradition of the nation and most states there's this secular moral message as well. And you

know, constitutionally, the state can't be hostile to religion either. I can't just say, oh, something could be read as religious, so you can't have it there. So No, I think there's a real good chance depending upon what the evidence shows. When they're looking at what's the primary motivation and they start doing depositions and using subpoenas to get electronic evidence, etc. What

was the primary motivation? So I think the way Louisiana's approached this, there is a I think there's a real good chance the Supreme Court upholds it ultimately. But could you just say, hey, we're putting the Ten Commandments up in every classroom because we want all these kids to be Christian. No, you couldn't say that the US Supreme Court would strike that down under their current doctrine. But yeah, don't be surprised if this one's upheld. Hey,

we've also been talking about debate prep. Dan Kelly does need a show, says a Texter. I would listen. I guarantee you that I would listen, Dan, Why wait for Jake? Teppard asked the question of Biden.
