living interesting times. It's really unbelievable what is happening in this great country of ours with the Biden Department of Justice. And of course every time this has mentioned Jack Smith as some independent character that Mary Garland and of course Joe Biden is no control over. And if you believe that I'll have some swamp land to sell you in Florida, of course it's orchestrated. Of course they know

exactly what they're doing. Of course they could have brought this if these charges were able to be brought a year and a half ago, so all these matters would have been concluded well before the presidential campaign of twenty twenty four. What they want to do is make sure that Donald Trump's the nominee of the Republican Party. They've done a great job doing that, and then they believe

be careful for what you wish. They believe that he's unelectable, much like in twenty sixteen, unelectable, that somehow suburban voters are going to be really happy with Joe Biden's performance in office. How about this factoid, twenty percent of Democrats want Joe Biden to be their nominee. About this one, sixty seven percent of Americans believe America is on the wrong track. That is a

unbelievable set of a number. So the Democratic Party does not want Joe Biden to be their nominee, and the country in general wants to go a completely different direction. Country on the right track during most of the Trump years were

in the fifty sixty percent positive, not sixty seven percent negative. And so right now, the Democratic Party, working with their friends in the mainstream media, is orchestrating a political hit job on Donald John Trump because they want to make sure he's the nominee of the Republican Party, believing that he cannot be elected to the presidency in twenty twenty four. The four count indictment came out

August first, which was well on Tuesday. And if you noticed, there's a correlation between bombshell evidence coming out against Hunter Biden slash Joe Biden on one hand, and then quick action, very quick action by Biden's Department of Justice on indictment fronts. For example, I have no doubt the coordination is happening on For example, on June seventh, June seventh, documents indicated that the Ukrainian gas company Bisma paid Joe Biden and Hunter Biden five million dollars each.

June seventh, there was a little bit of reporting of that by the mainstream media, and of course that reporting would if skyrocketed and the days after June seventh, But then on June eighth, the DOJ indicted Trump in the Marlago secret document matter, blowing the Barisma facts off the front page of the papers. Of course there wasn't there. The media wasn't going to cover it anyway.

So imagine that we had a normal presidency and there was documents in FBI ten twenty three's to indicate after interviews that the six president received a five million dollars bribe while he was in the office of the Vice Presidency, much like spirot Agnew took a bribe when he was a governor of Maryland to do some highway project in Maryland that caused spirot Agnew to resign office. June seventh, documents show from the FBI files Joe Biden took a five million dollar bribe.

The next day, the DOJ and diets Trump of the Marlago secret documents matter that was pending for months that just happened to release it the day after the Breezema evidence came out. On July twenty sixth, Hunter's plea agreement unravels as the DOJ rolls over to play dead. A bright federal judge looks deep into the documents to find out that Hunter Biden was receiving childways, say at Texas al Paso, on all pending matters and future matters. She inquires to has

that ever been done before? The answer is no and unravels on July twenty sixth that the plea deal of two misdemeanors and then a gun charge kind of evaporates. On July twenty six big news, Well guess what happened on July twenty seventh. The next day, Smith unveils a superseding mar Lago charges against another person, the property manager so June seventh bribe reported given to Joe Biden.

June eighth, FBI indicts Trump on mar Lago later in the later in July July twenty sixth, Hunter's plea agreement unravels because of the improper behavior of the Department of Justice where justice goes to die. Then the next day, Jack Smith unveils a superseding mar Lago charge against the so called property manager. It continues on July thirty first, Devin Archer's testimony torches the bidens. He gives statements under oath in a deposition like environment to the House of Representatives.

Some of that information hit the newspapers about how many times I think it was more than twenty times. He's on the horn, He's on the phone with Joe Biden, sitting in the Office of Vice Presidency and talking about Hunters business deals to give Hunter credibility. That happened on July thirty first. Media started covering it well. The next day. On August the first, Jack Smith

slaps Trump with the January sixth related accusations. Each time negative stuff comes just coincidentally about the Bidens, the next day Biden's department adjust and blows it off the front page of the paper. And nonetheless, the Department of Obstruction of Justice has urged that federal judge his speed Archer's imprisonment on unrelated charges two days before his Capitol Hill testimony. So the timing of these three events is really

completely unbelievable. And so this morning and all the talk shows, by gosh, do we have serious problems? Jesus, Jesus, Mary and Joseph, do we have serious problems? And every time someone starts reporting on the on the sins and crimes of Hunter slash Joe Biden, the next day Jack Smith brings bombshell indictments against the President, and of course Pending I watched this morning.

So one of the attorneys for the Donald Trump said that the Trump's is going to be indeed in Fulton County in Atlanta on charges about the telephone called Rafsenburger the Secretary of State, in which he said, all you have to do is find eleven thousand and seven and eighty votes, and that's gonna happen. Maybe she's gonna hold a hold that until something else negative comes up about Joe or Hunter Biden. And to think about it this way, she has

new pictures being taken of her. Fannie Willis Fulton County Prosecutor. They have the barricades up around the Fulton County Courthouse acting as EPs is going to be a riot, and downtown Atlanta by Trump supporters. That indicates to me indictment

is coming in that regard. Also, it's unbelievable what is happening. And to go back in time just a little bit, imagine the courage it took for Gary Shipley and Ziggler, who are the two shall we say courageous FBI agents, to have Shapeley and Ziggler come forward and under oath testify before a House committee about the sins and crimes of Hunter Biden and being barred from pursuing the matter against Joe Biden, which should have been felonies. That is,

again a matter of incredible courage. I can't imagine how much more difficult it's going to be for Shapely and Ziggler to do their job in the irs. And on top of all that, we have the circumstances we have a former FBI agent coming up to talk about how unusual it is to have these so called stars suspicious activity reports, something in the range of one hundred and sixty

five of them filed. But the US Department of the Treasury being pursued by the IRS, and that means money was flowing into the country through twenty shell companies put together by Hunter Biden, who by the way, still has his law license, showing how all the money flew into about ten or twelve different

members of the Biden family for the last ten years. And when those who care about the rule of law, Shapely and Ziggler and others said, you know what, we need to pursue this and find out where the money went, who got all the money. There's been some reporting on the grand kids getting tens of thousands of dollars put in their accounts, twenty some LLC shell companies, which which is washing the money. So that's hard to follow.

And when the I r S says this must be pursued and Department of Justice says no, because of who it's being pursued against. To me, it is absolutely unbelievable, So let's continue. According to James Comber, who's the Kentucky congressman. Six different banks have filed a staggering one hundred and seventy suspicious activity reports on Biden's transactions involving elements of the Biden family for the past twelve years against one family. At least one hundred and seventy stars have been filed

and nothing comes of it except maybe two misdemeanors. And now a federal judge said we can't. I can't go with this because you guys, this is unfair, this isn't right. Well, get ready for one hell of a ride. And secondly, if you were listening last Sunday night on an unrelated

matter, but demonstrates where we are as a nation. I had on Congressman brad Winstrip, a medical doctor, also a congressman for ten years, very close with a representative Jim Jordan, and Jim Jordan told Representative Winstrip that because you have a medical background, I want you to pursue the COVID matter where it came from, where lies told, Why wouldn't we told the truth?

Does masking work? Etc? Etc. Etc. After months and months and months, finally there was subpoena power at least over the past eight months that the Republicans have in the House of Representatives, and Representative brad winstrip knows where the bodies are buried, and he said last week, which is something he said two months ago, that it appears very likely that our top health officials, especially Fauci and doctor Collins, new early on due to the seaquesting the

of the DNA, that COVID nineteen did not come from a wet market somewhere around Wuhan, China, or some cave in southern China. That he came out of the Wuhan Laboratory for Virology in Wuhan, and it was created by

Chinese scientists, and that's what he said. And as proof of that, among other things, there was emails back and forth among the leadership of FAUCI and other leaders of the medical industry in and outside of government, including doctor Collins, that we, the American taxpayer, funded the creation of the COVID nineteen virus in the Wuhan lab that we spent millions and millions of dollars, and the emails in and around Fauci and Colins, et cetera indicated, according

to Representative brad Winstriped Congressman, that they could not let out the fact number one that the American taxpayer paid for the creation of COVID nineteen, and number two that they knew it wasn't the wet market, but that was a good

cover story. Can you imagine Trump was still in office, what the Trumpster would have done with information that the American taxpayer provided the funding for the Ruhan Lab to create COVID nineteen, and that when it was discovered and it got out and the first two or three who died were personnel who worked in the Wuhan lab. They did not work in the wet market with a rat or

a bird or a bat or a raccoon. They were medical personnel who died somehow there was improper handling and there was a leak, and those infected died were medical personnel. If we knew in twenty twenty that doctor Fauci and those of his ILK took American taxpayer money to pay for the creation of COVID nineteen, then covered up its origins for political purposes to make sure that Joe Biden would win the presidency, I wonder what Jack Smith would have done with that

information. And it's kind of like, well, that's true, that's well known, and I have on Congressman bred Weinstrip, who has the emails back and forth. Let's not talk about the Wuhan lab. Let's blame an infected bat. Let's blame a bat, because if the American people know what we've done, we're in serious trouble in this entire process. As Representative Jim Jordan has said, doctor Fauci has become even more of a multi multi millionaire.

And as Wine dined in pocket lined all over liberal America. Think of the wreckage caused by COVID nineteen. It elected Joe Biden to the presidency. He wasn't able to campaign then, He's even less able to campaign now. But the idea that the American taxpayer paid for the creation of COVID nineteen then covered up its origins for political purposes as one of the great stories of the twenty

first century. But the media refuses to cover it because it is so bad for the Democrats, and they don't cover the cash bags of cash picked up by Hunter Biden at all, and many others because it is so good for Donald Trump and so bad for the Democrat Party that the Democrats themselves don't want

to cover that either. Believable stuff is happening. Thank god you got Mark Levin and Sean Hannity and me The Great American and other outlets that'll tell you what's going on, because the mainstream media covers weather, but they will not cover the funding the creation of COVID nineteen by the Wuhan lab that we paid for. We have a similar lab, by the way, in North Carolina

and one in Texas. But the rules over there are lighter and not followed as closely, which means there that doctor Fauci and his ilk to that could have less rules and regulations to stop them. And the purpose may be worthwhile, which is when these viruses arise, we need a vaccine. But the protocols have got to be strictly followed. And when caught, how about blaming a wet market and a bat, A bat did it and not those that

And this arises every few weeks, how inconsiderate and entitled they feel that they have two pet dogs that are German shepherds. One is named Commander, the other one is named Major. And for the last two years they have bitten Secret Service agents and so White House personnel, who by the way, tend to be African Americans that have been there living in Washington, d C. In some cases for twenty thirty forty years. To have two German shepherds regularly

biting the staff is corrupt. According in one website, the dogs regularly bite the staff and Secret Service agents who a have to walk around with umbrellas to fend off the two German shepherds. Normally, if you had dogs biting individuals, the dogs would be put down. But you can't put down, shall we say, the president's two German shepherds. You can imagine if Nancy Reagan or if Missus Donald Trump would have dogs that were biting black staff members.

What do you think the media would do with that? It's unbelievable. Having refused and to acknowledge their seventh grandchild, now they have two dogs. This is a small matter, but small matters often reveal character, how inconsiderate is it. They have the President's German shepherds biding individuals, putting their injuries in life at risk by two large German shepherds, and the media won't cover it

because it's Joe Biden. Are you kidding me? Arriving, they found new victim. Lieutenant Jonathan Cummingham says the woman had been driven to UC Medical Center, where she later died. And the Reds losing six three to Washington, giving the Nationals a

I want to set up tonight's big show about an hour and a half or so. We have on a guest from thirty three years and the FBI, Thomas J. Baker. It's written a book, The Fall of the FBI. Spent thirty three years. FBI stands for fidelity,

bravery, and integrity. And he has shocked and dismayed about what's happening to the FBI the past ten years, especially under Komey and Christopher Ray. I'll call him j Edgar Ray. What's happened to his FBI? And the book indicates that when the FBI agents get together, he was out of the Washington DC office, they snicker, what's happened to their agency? It's become entirely too political. It did not make any difference abscam whatever it was.

The shooting of Ronald Reagan in nineteen eighty one. There was so many circumstances when there was Congressman with their hands out, they never checked at someone's political affiliation before they launched an investigation. That's not the case anymore. The DOJ has been so politicized that Thomas J. Baker and others cannot recognize as a legitimate agency. The majority of US do not accept now the FBI is being legitimate organization. In fact, some of the Republicans have said that if elected,

they will disband the FBI start all over again. The field offices are great, they're fine, but once you get to Washington, you get infected, and once infected there's no way out. You're done. So Thomas J. Baker is about the best. There is a thirty three years an agent the fall of the FBI. Then, also later on, I read this column written by Craig Rucker of CFaCT dot org about what Greta Thunberg and others are doing to the environment, and even I couldn't believe what I was watching.

About a week ago, CBS News did a story of the destruction of the mammal life off the coast of Massachusetts because of the damn windmills. Some of which are six hundred feet tall, killing millions of birds and also destroying sonar that many of the whales and the mammals and the dolphins have. It's killing literally millions of birds, thousands and thousands of fish. It's going to destroy jobs and produce little electricity. But because of the Green New Deal,

funded by the Inflation Act, there's lots of money to go around. And I live in Cincinnati. When I go through Indiana, there's thousands of windmills and in Indiana and Kansas in Missouri, all of which destroy the environment. And so Craig Rucker has made a living out of detailing how the environmentalists are

killing the environment. About the worst is Greta Thunberg. And I also about passed out about three nights ago when NBC News ran a story how evs have been oversold and under delivered, that it's much more expensive to own an EV than a unletic aslene powered vehicle, and that Farley, I think the guy's name is Farley, the CEO of Ford Motor Company, says they're losing billions of dollars every year on evs and they can't afford it. It's going to

cost them money the Stokers way down. So I find that story extremely interesting. So and then later on we have on James Bogan, criminal defense attorney, about some of the possible theoretical defenses for Donald Trump, one of which is the First Amendment, which is even a president has First Amendment abilities. He can say what he wants to say and do what he wants to do. And the record of Jack Smith is not very good when it comes to

convicting politicians who speak. What Donald Trump did with a telephone call to Georgia Raffenberger was simply speak, and he said. He didn't say to illegally find eleven thousand, seven eighty votes. He said find them because they're out there and I believe I won the state. We can say that he can even be wrong when he says that, and many defend that as a good use of the First Amendment. The presidents have that power also. And by the

way, what came of the telephone call? Nothing? They called to Governor Doocey in Arizona, nothing, nothing came of it. Pence did not take on some role to which he was not entitled. And to bothering Mike Pence has about as much chance of being the next president as I do. So that's what we have coming up later. But please, Thomas J. Baker goes after with great sorrow the FBI that he worked in for thirty three years

as a top agent, because they've lost their way completely. It began with Muller but tast his eyes under Komy and is now completely out of control or Christopher Ray and the top staff has has no control whatsoever, unequal protection of the laws. Wouldn't take a rocket scientist to figure out that a crack cocaine head named Hunter Biden was probably connected to the bag of cocaine found in the

White House. Wouldn't take Sherlock Holmes to figure that out. And when you have one hundred and seventy suspicious activity reports, which are very unusual to be filed collectively against one person, but in this case, over a ten year period, it routinely happened of millions of dollars flowing in in this country from Romania, from Barisma, from Ukraine, from China, from Russia, three million dollars from the wife of the Mayor of Moscow, Russia flowing into the

accounts of the Bidens, and no one is suspicious at all because of who he is, and then Shapely and Ziggler stepped forward and say something's wrong here and that this isn't right. And the next day more indictments coming against Donald Trump and the media quits covering it. I would imagine right now the Biden administration is causing ir this agent, Shapely and Ziggler to go through a living

hell. And especially Ziggler, I've watched him do some other interviews, but he said he was a Democrat. He's a gay man who married to a course another gay man. He votes Democratic and this hurt him a lot to watch Democrats gained the system for personal benefit. And also how many times have you seen Hillary Clinton and Chuck Schumer and Jimmy Carter and Bill Clinton say First

Amendments? Is their right to say it that Donald Trump is not the legitimate president, that what he does is completely illegitimate, And they engaged in the same First Amendment protective speech as the president did. Donald Trump the same stuff each All of us have that right to speak freely. And Brandenburg versus Ohio is the decision that I think Attorney James Bogan's going to talk about that says you have the freedom of speech to say what you want to say, as

long as you don't incite violence. And whatever. The mainstream media talks about the speech given by Donald Trump on January the sixth, they always clip off the part that says peacefully and patriotically marched down to the Capitol that they cut it off when if you don't protest, then you don't have a government anymore. They cut off the parts that defend Donald Trump, and they include only the ones that hurt him. That's what the media's in the business of doing.

And the media has become nothing about a weather service. So start every broadcast, and one of my guests tonight, Craig Rucker, is going to reference that fact. Especially he has the reasons why the environmental environmental lobby is destroying the environment and more so, I guess we're blessed to live in interesting times. But the Democrats are doing everything in their power to make sure that

Donald Trump is the nominee of the Republican Party. As Trump said, I think yesterday or today this morning, he said, look, if I get one more indictment, I'll be elected president for sure. I sense average Americans are saying enough is enough, and we can't take it. Anymore. Thirdly, do you think as an American that Donald Trump, who now wants to change of venue, can get a fair trial before a jury in Washington, DC, or in the city of Atlanta, or in the city of New

York. Absolutely not. And to make this prediction, I hope to be with you in three to four years when this thing finally metastasize it. He will be convicted at trial, and then on appeal it'll all be reversed and it'll be found not guilty, which will play into another Democratic theme, which is the Supreme Court is corrupt. But they did the same thing with Democrats

and Republicans. The First Amendment is very broad, and presidents who are under the duty to faithfully execute the laws can say and do almost anything under the First Amendment as long as you're on insight violence of one type or another. And I listened to some of the other discussions, I love what Dershowitz is saying. Alan Dershowitz been on my show several times about the First Amendment and

the way to confront bad speech is better speech. And the Secretary of State of Georgia did not respond at all to what the President requested to find eleven thousand, seven hundred and eighty votes. He did not say corruptly find them, he illegally find them. He said they're out there. Find them. And when he said bags of ballots showed up from underneath tables, that did occur. But had they been counted yet? I don't know. And according

to Raffensburger, the Secretary of State, that they were counted. So the remedy for bad speech is better speech, not no speech. Democrats have the right to speak, but guess what, so do Republicans. I call it d ie that young men and women don't want to join an organization that's racist, that you have to stop what you're doing and worry about diversity, equity and inclusion. When the role ought to be to kill the nation's enemies. That should be the role. But no, we have military leaders who give testimony under wrote to the Congress it says the number one problem in the military is

white supremacy and number two is climate change and climate mitigation. That's what we have to do is not kill the nation's enemies. Is not declare war on the Mexican war lords that are killing one hundred and fifty thousand Americans every year. No, no, not that. It's all about diversity, equity and inclusion. But there's a split in the environmental movement today. You have those who are the mainstream, the big boys, the environmental defense funds, the

green pieces, Sierra Clubs, those organizations. When it comes to some of the environmental impacts of this, particularly renewable energy, they're all crickets, you can hear nothing. And that's probably because a lot of these groups receive big dollars from those who are putting in solar and wind farms. On the other hand, those on the grass roots level actually are concerned about these things and are in dismay over the direction that some of these big groups are doing.

Because as evidence is coming out that wind farms are chopping up birds and bats and endangered eagles and the like, and you know, the offshore wind is possibly harming whales and dolphins and other marine mammals. You know, this is actually making this split in the environmental movement more apparent, and I think for moving board, it's gonna be very interesting to see what actually happens there.

Well, what's going to happen is we're going to continue I'm kind of waiting for the Sierra Club to go after Greta Thunberg and others to eat their own, because one cannot imagine talk about the commercial fishermen off the east coast of this great country of ours that are being chased out of business with these with these windmills in the middle of the ocean. It hurts the views, which

those a Matha's vineyard don't like. But nonetheless, what is the damage to the marine life, which you would think the environmentalists would be all pissed off about. The whales are washing up on shore, there's sonar abilities are being disrupted. I can't imagine how many millions of fish are being being killed and how many billions of birds are being filled killed. But why do you think

that the environmental movement ignores the damage done by the environmental movement. Well, there's actually an article written by this and Los Angeles newspaper recently that they say maybe some species may have to be eliminated for the greater cause of climate.

And what you're seeing right now as a bide administration has this program to put thirty thousand megawatts of offshore energy in place by twenty thirty, and no doubt they're listening to the likes of AOC who said, we have only until twenty thirty until the end happens, but they're going to be putting in one thousand, five hundred gigantic wind turbines about fifteen to thirty miles off of our coast.

Well, these are right in the lanes of a number of migrating whales up and down the east coast, and the noise and vibrations many are starting the wink to why we're having an unprecedented number of whales beaching themselves, some say upwards of four hundred percent since twenty sixteen really when they started the sonar blasting and mapping of the ocean floor to put them in, and today they're doing a pile driving where they use these allow hydraulic hammers to put them in.

But even once they're up, the size of these structures and the turbulence that they can create when there's windy conditions can literally put an impenetrable wall, hurting the sonar activity. Because of course these are marine mammals that get their direction from sonar, and this could be three hundred and sixty five days a year, you know, twenty four to seven where they're actually having their direction

messed up with and they really aren't doing any studies to do this. If this was an oil platform, you better believe they would be out there. So as far as the wind turbines, when I think of a wind turbine, I don't see a huge structure. Can you describe the size one thousand five additional wind turbines killing millions of mammals and also billions of birds? What are the size of each one of these things? How big are they?

They're varying inside. I've generally range from about six hundred feet in the air to about seven hundred and fifty or eight hundred feet in the air to their motor. When you include their blade, which is quite huge, you're looking

at over a thousand feet. Now, to put that in perspective, the Washington Monument is only about five hundred and fifty feet tall, so these are about, you know, just about double the size when you include the turbine and the spinning portion together, they're massive, and in fact, the biggest ones in the world are supposed to be put in off of Virginia, and that's why we and some of our allies are going to try and sue to

stop that. So they at least to a proper environmental impact statement before they PLoP these things down right in the middle of where you have. You know, some of these marine mammals are very threatened. You have the right whale. It's not called right because of its political affiliation. I guess whale hunters thought it was right for blubber and oil back at the eighteen hundreds. But the right whale, there's only three hundred and fifty of them left. They're

critically endangered species, and nobody seems to care. On the environmental movement, Why can you give me the reason? Because I would think Greta Thunberg would attach herself to one of these wind turbines, maybe throw tomato soup at it. Well, why does the environmental movement New York Times, Washington Post ignore the damage caused by environmentalists to the environment. Why does the media ignore it?

I would say twofold reason for that. I would say number one is a lot of them are on the take to get money from the renewable energy industry. It's big business. There's a lot of money to be had in

this thing. The second reason is because they are bought and sold on the idea that the world's gonna explode and come to an end, despite the mounting evidence that climate hype is closely exaggerated, if not completely fabricated in a lot of cases, with some of the claims they make, and they feel that the ends justify the means, you know, I mean, Greta Thunberg actually made a prediction back in twenty eighteen the world would end in five years on

Twitter. She just took that down because the five years has come and went, and actually there's you know, light goes on. It's not a whole lot different. And of course others have made such claims as well, and the dates have coming gone, they just move the dates up, and it's almost like people forget that. They keep car crying apocalypse and it has yet to emerge. And what is the value of wind turbines when it comes to

the production of clean electricity? By the way, nuclear power plants are much more efficient, put many more people to work and has no environmental damage. You take natural gas and fracking puts to work hundreds of thousands of middle class Americans. It's the cleanest source of energy this side of nuclear power. Natural gas has been a revolution as far as cleaning up the environment, Well, how much electricity are we talking about? Of course, the cost of that

is the natural world as being destroyed by the environmentalist. But any idea how much electricity is actually produced by these wind turbines. It depends where you are in the country. Some states that can be as high as anywhere from ten to twenty five percent. In those are places that are aggressive, other places much lower, but they do pay an enormous cost for that, as do

nations that go heavily into wind power. You take like Denmark, for example, the citizens there paying about thirty five cents a kill a one hour. It's approaching forty cents to kill a watt hour. By contrast, Americans pay about ten to twelve cents a killer one hour. So the more you have renewable energy, the more it jacks up the cost, plus it to stabilizes

the grid because it's intermittent power. It does produce energy. Wind is blowing, but you need backup, and so what winds up happening is you have these natural gas plants that have to be ready at at any moment to crank it up and cover for wind. Wind energy isn't producing anything, and that

cranking up of natural gas actually admits a lot of CO two. So even though they're putting this into allegedly try and lower CO two emissions, in truth, it's hardly limiting them at all because they actually wind up, yeah, you know, having the backup power, and that backup power winds up having

to spew more CO two out there in order to cover wins. But and before we talk about evs and solar panels, is there an idea among the so called the smart ones, you know, the educated ones, the ones who use the proper prefectus and pronouns, those who run our society, any apprehension at this point in August of twenty twenty three, relative to these wind turbines that were on the wrong track, we got to stop doing this because it is being funded by the federal government. The Green New Deal is being

funded through the Inflation Protection Act, both of which are misnombers. Is there any apprehension that this has got to change, That we're the wrong course, That we're killing mammals, we're killing birds, where changing the environment, that our movement is causing damage to the environment, we're hurting what we're seeking to help. Is there any idea that the gretted Thunbergs and the Sierra Clubs and the al Gore types. Do they now know they're on the wrong track.

Well, there have been some, and I point out people like Michael Shellenberger, who was once charge of the Obama putting in the Green New Deal. He's now come out and done in about phase. Meredith Anguin, she's written

a book now and she is understanding renewables aren't doing that. You have Steve Coonan and others who have written bestsellers it used to be on the left and now on the right saying that you know, much of the climate hype is overblown, but this push for renewables is actually bad news for the environment. But by and large, most of the utilities, and you know, the

public utilities commissions and the industry is seeing dollar signs. They don't nobody's really managing the grid in a strategic fashion because federal dollars are out there and you get certain perks. But putting this in and if people have to in their covered because the ratepayers pick up the tab. So as long as the businesses

are profiting, it's not really a market situation. You have no choice but to get the energy from where you're getting it in most cases, and they're making money at it, so no, they aren't really taking charge of the grid. And many experts feel our grid is poised to collapse unless somebody starts taking charge. You should be the job of Pirk or Nurk some of these federal agencies. But they know they just seem to be blinded to the Everything

is looked through with climate change lenses nowadays. Greig Rucker. It's an old principle of government that when you fund something, you get more of it. When you tax something, you get less of it. And because of what Joe Biden has done with giving out money to wind turbines and cellar panels, you get more of it irrespect of the value it brings to the environment. Now lastly, on electric vehicles, a guy named Farley runs a Ford motor

company. He had missed. They lose every year billions and billions of dollars in creating these electric vehicles without the power stations, without their power grid to support it. And we have no way of getting rid of literally billions of individual solar panels once their use has been completed. Tell the American people about solar panels and how much electricity they produce, and what happens when the sun doesn't shine in the wind done blow, So solar energy one to three percent

of our electricity production. They're very non efficient, they have not shown themselves ready for prime time. Very disturbing about them is well, first, they can only be used in limited places where it is a lot of sunshine generally speaking, but they actually are composed of minerals that are rare minerals that have to be mined in other countries that don't have the pollution standards nor the human

rights standards. We get a lot of the materials from the Congo for example, where they use child labor, or from China, which seems to have a corner on the market for the rare earths that we use for solar panels, and they use weaker labor, slave labor in order to get it.

And of course there are a strategic enemy, so by going solar, we actually have serious national security interests you that are at stake here, and really from our perspective, it's a you know, it has not shown itself ready for prime time and is just an energy source that I think, again absent the federal dollars nobody would be pursuing. When you fund bad policy, you

get more of it. I had a guest on two months ago that talked about what happens to Congolese boys and girls who go into the mines in order to with their bare hands, often use use their fingertips to pick up rare earth minerals, putting on their their backpacks, and then marching out of the

mines twelve hours a day, six days a week. And the communist Red Chinese have bought off the leadership of the Congo with millions of dollars, taking billions, and those rare earth minerals make their way to the coast, make their way then to China, then they come into the solar panels we now use. I could not imagine if America had elementary aged children five six and seven years old reporting to mines every day in West Virginia, digging with their

fingers for rare earth minerals. How long that would last? But as long as as long as it is a black kid in the Congo. The liberals don't care, do they No. In fact, they get excellent ESG scores, that's Environmental social governance scores. The companies that are involved in renewable energy are looked at as you know, captains of industry and you know, the ones that we ought to be following. It's it's actually kind of infuriating.

We've actually confronted Black Rock and Vanguard at some of their shareholder meetings about this, trying to put in a resolution to say, hey, we won't do business with companies that are involved themselves and these sorts of things, and they basically shot it down every time. So, you know, they're very far left, and they don't seem to really care about human rights or the environment when it really comes down to it. They care about pursuing big government policies,

policies that empower China at our expense and pollute the environment. It'd be interesting if Michelle Obama and Oprah Winfrey would leave their Martha Vineyards mansions and take up the calls of black kids in Congo being killed to mind these rare earth minerals to benefit the communist red Chinese. Wouldn't that be interesting if Oprah Winfrey and Michelle cared about the black kids being killed in the Congo. Wouldn't that

be good? Well said, yeah, And of course they're very involved in trying to shut down wood fired pizza ovens and telling us we have to get rid of gas stoves and barbecue grills. And several days ago, of course, the President was indicted by Joe Biden's Department of Justice indirectly, indirectly through the Special Prosecutor on four counts, which

I think brings the number to about seventy five or so. And then sometime this week or next we're going to hear from a Fannie Willis, who's the county prosecutor and Atlanta, Fulton County. She wants to have her fifteen minutes of fame. She's getting new pictures taken, she has the barriers up. We know what's coming. She's not getting new pictures taken of her in the

office and the barriers up when there's nothing to occur. And so the Trumpster is about to be indicted in Fulton County slash Atlanta for activities and telephone calls he made there to try to make the vote appear to be legitimate in the state of Georgia. Should he have made the call? Should he not have

made the call. Some lawyers said there is something to look into. Other lawyers said, don't do it. But whatever it is, it was a office holder and a politician faithfully executing the laws and United States of America got to make sure that all the ballots had been counted. He didn't say corruptly find eleven thousand, seven eighty votes to the Secretary State. He said, fine, I Love, All you need to do is find him. He didn't say corruptly or make him up. He assumed in his own mind they

were legitimate votes that have not been counted. So Joanan, you and I now is attorney James Bogan, who's many cases in federal cord constitutional scholar and James Bogan welcome again into Bill Cunningham Show. So can you break down to the American people in a rough sense the foremost recent charges filed by the Department of Justice underneath underneath Joe Biden, Trump pursued unlawful means of discounting legitimate votes

and subverting election results, and in doing so perpetrated three criminal conspiracies. And these are the three conspiracies. The first one is a conspira to defraud the United States by using dishonesty, fraud, and deceit to impair, obstruct, and defeat the lawful federal government function by with the results of the presidential election are collected, counted, and certified by the federal government. Right there. Number one. Now, tell me what is evidence that Donald Trump did that?

What he had to have known in his own mind that he didn't win the election for that fraud to occur. Yeah, it all the all three of these counts, Bill, are based on the assumption that Trump knew that his claims of election fraud were false, and they ignore key records that were turned over to prosecutors by Bernard Carrot's lawyer shortly before the indictment, about a

week before the indictment that called this into question. I mean, I think there's a proof issue here, Bill, because it all revolves around owned They're saying that lawyers from the Justice Department told him, Hey, these claims have no water to them. Like Trump's going to trust the Justice Department that investigated him for the Russian collusion scandal. It's basically, hey, don't question us. These election results are right, don't protest them, don't question them.

They're right. Trust us. We're the government so James Bogan. If the President believed, and I think he honestly still believes, that the result of the outcome of the election was fraudulent. There was a lot of fraud. Whether it was sufficient to overturn the election, we don't know. But it doesn't make a difference in his own mind, which who knows what's inside his mind. There doesn't make a difference that he knows it was a fraud to

maintain that the election wasn't it wasn't on the up and up. Does it make a really difference in his own mind if he thought it was a fraudulent election or could it? Politicians lie cheat all the time. And so, assuming Donald Trump honestly believed that all the votes in Georgia were not counted legally, isn't he almost under a duty to have a recount, to have a

redone? He is, And this in case entirely hinges on the presumption the accusation that he knew his claims held no water whatsoever, and he believes them well, whether he's factually correct or not is irrelevant. He factually believes this. He's not trying to say, hey, I know this was a legitimate election. I'm trying to overturn this. He genuinely believes he was robbed,

and that's the key. So in his own mind, when he made a telephone call that could put him in prison for the rest of his life if he believed in his own mind that all the votes legal votes in Georgia were not counted in the urge of the Secretary of State to do so. How's that different than other comments a present or any politician makes that turns out later not to be true. Does that mean we're going to start locking up politicians

for making false statements? That goes to what I told you a while back about selective prosecution. Here you have a Republican who's running for office. He's the leading Republican and he's a political outsider to both parties, and so well, we could line up from here through the end of the year all the lies and misconceptions, misrepresentations told by Joe Biden. He was elected under fraudulent circumstances. If you use that theory, what about two, three and four

one offenses against the United States? What are the other ones? Well, the other one, Bill is that I lost my place. For a second is that it was a conspiracy to corruptly obstruct and impede the January or sixth Congressional proceeding at which the collective results of the presidential election are counted and certified.

And then the third a conspiracy against the right to vote and have one's vote counted, and the most serious charge of obstruction and conspiracy to obstruct an official proceeding, each carry of potential penalty of up to twenty years in prison. Of course that's not factoring the federal sensing guidelines. Yeah. Well, you know, he demands almost eighty years old, and if he's convicted of anything, of course he's going to go to prison, largely for the rest

of his life, which I'll never believe it's going to happen. Well, what are the odds. You don't do a lot of practice in Washington, d C. But the record of Republicans being tried in Washington, d C in front of that jury those child juries not very good. The record of Democrats are darned good. Do you think there was a forum shopping by Jack Smith to make sure that the jury would be picked from the voters of Washington, d C. I have no doubt in my mind, Jack Smith,

he tries to present himself as this impartial guy. He's neutral. He has a history of being a political hit man for the Democrats, and he abuses his power regularly. As you recall when he was working for the Justice Department under Eric Holder when the Lowis Learner Irs scandal was going on, and he

tried to interject the Justice Department into that. The same conservative nonprofits that Lois Learner was trying to single out the eye tax exempt status, he was trying to investigate and prosecute them, and he was pushing really freaking hard for that. In fact, with the governor of Virginia, a guy named McDonald. He received convictions for that, and that that matter was shall we say,

overturned and a nine to vote by the US Supreme Yeah. And him going after John Edwards, that's meaningless to me because it was in twenty eleven, long after John Edwards was on the outs with the Democratic Party. He wasn't one of their darlings like he was in two thousand and four. Now, if he would have gone after him in two thousand and four, sure,

maybe I'd consider thinking otherwise. And then he had another instance where he was part of a Justice Department team that relentlessly went after this journalist who wrote a less than flattering piece about the CIA. He was pounding this guy to try to get him to give up his confidential source. We know how it is with trying to get reporters to give up their confidential sources. What would happen? His team would issue a subpoena, it would get quashed, They'd issue

another one, and it's kept repeating over and over. Court kept saying no, they kept refiling subpoenas. So the essence of what Jack Smith under Joe Biden said a few days ago in Washington, d C. On the indictment say is that we have a president who has made a misstatement of fact, who probably believes something in what he is saying, and he therefore should be how to acountable for not speaking the truth when he, in his own mind

believed that he was speaking and perpetrating a fraud. How is that an offense against the United States? For God's sakes, he's saying, don't question the government or you'll be prosecuted. I've read this stuff for Jonathan Turley, etc. Do you think you know one of the things I said early on James Bogan is that he will be convicted in New York City, then it will

be overturned on appeal. In this particular case, he will be convicted in Washington, D C. And through the appellate process, he'll be found not guilty probably nine oh in the US Supreme Court. And that will assist another political goal of the Democrats, which is to make the Supreme Court even more illegitimate. So can you conceive of twelve Democratic voters in Washington, D C. Finding Donald Trump not guilty. I've a hard time seeing that, because

that's not their nature. Now, lastly, from thirty thousand feet, looking down legally on this situation, in the mar Lago situation, which is about a thirty six count indictment, it appears that Donald Trump's own attorneys were required to testify against him and the grand jury. It appears that they had Secret Service agents who testified in the grand jury. Now that's a far different matter. I've said, that's the most difficult case for Donald Trump when you have

your own attorneys testifying against you telling you to ignore a subpoena. Am I right or wrong in that regard? Yeah, that's a regular And in this case here we discussed this a while back. When a lawyer isn't representing a client, they cannot aid them in committing a crime. And all that standard was met for that veiled to be able to be pierced so that the lawyers

could be brought in to testify. And well, like I discussed last time too, I think that case is largely going to come down to did Trump actually take steps to declassify those documents? Well, and then the selective prosecution arguments too, but that's a whole different discussion. And at least there he's got a shot. In Fort Pierce, which is on the east coast of

Florida. The jury there is going to largely not be a ninety nine percent area that voted against the Trumpster. And in that case, it is quite

unusual, in fact rare. Have you ever in your career? I know it's never happened in mind, Well, you get a subpoena to appear before a grand jury to testify against your own client, and then there's a showing by the prosecutor's office that James Bogan or Bill Cunningham were participating with the defendant and the perpetration of a crime, in which case the lawyers between a rock and a hard place. Either you testify as to what your client told you

or you might be in die at yourself as a co conspirator. How unusual is it to have the lawyers testify against the client, and then the testimony given by those lawyers would be extremely painful. I thank for Donald Trump and the Marlago case. It's very rare. I actually have the distinction of being subpoened along with my co counsel when about ten years ago I was special counsel for Hamilton County and in relation to that, my co counsel and I were

subpoenaed by special prosecutors to the grand jury. I ended up not testifying, and my co counsel he testified, and actually he didn't really testify, He just invoked turn client privilege. And so in that case, it's very difficult. And Jack Smith, when you deal with selective prosecution, it appears that Joe Biden, for years or decades, had classified top secret documents in at least four different locations, including a garage where his corvette was located the hunter

Biden drove on a regular basis. Can you maintain that the FBI and DOJ did not prosecute Joe Biden for years and years of keeping top secret documents he could not have kept. And the fact that Hillary Clinton also was not charged criminally with obstruction of justice or then mishandling and classified documents because she was given in Texas al Paso by James come when he said no reasonable prosecutor would bring the case when he's not a prosecutor, he's like a police officer in a

sense. How viable is the claim of selective prosecution when you compare what happened to mar Lago to the to the other people who did the same thing. I think it has some teeth, Bill, How would you present it? How would you present that? Would you have a hearing on it? Or that presented a trial? Yeah, you want to fight, You file a detailed motion. You do it as a pre trial motion at first, make your you know, bring out the case law, lay out the factual scenarios.

And yes, you present that as a pre trial motion, and then that would be up to the judge in Florida to say that's excluded. And then you have all the motions to suppressed, including you sent me a note about blanket about the previous Supreme Court cases that may come to come to play on this thing. Explain that to the American people. Oh yeah, I think Jack Smith needs to review the US Supreme Court case Brandenburg versus Ohio.

It's from nineteen sixty nine. Just about every first year law student reads it and simply says, the government cannot punish inflammatory speech unless it is directed to inciting or producing imminent lawless action, and is likely to incite or produce such action. Now what we had Trump? I read the transcript of his January sixth speech. It doesn't even come close to meeting this brandonburse standard. About the worst thing. He says, we fight like hell, and if you

don't fight like hell, you're not going to have a country anymore. And but he also said in the same speech, I know that everyone here will soon be marching over to the Capitol Building to peacefully and patriotically make your voices heard. Now Trump had got out there and said, good cause as much damage as you can, then sure that'd be chargeable speech. But if you just review Brandenburg versus Ohio, which by the way, was argued by the

late Leonard Kirshner for the prosecution from the Hamilton County prosecutor's office. It's very clear that this standard is not even close to me. And maybe Jack Smith might like to review some of the stuff he learned in first year of law school. So Brandenburg was say that they first Amendment. It is as wide

as the Pacific Ocean. There's very few exceptions.
