By Billy counting end to Grant America, Lau Proud and Sassy back on the Big One and later of course read Spaceball continues tonight, we'll see what happens with Verlander. A curse Scherzer was scrapped last night. Reds win, Reds win seven to six. I guess the extra point was missed by the Metropolitans. But nonetheless, big things going on. And of course Rob Sanders has

been busy in the month of April and murder after murder after murder. I can recall Rob Sanders who's saying about eight months ago that Covington slash Kenton County won an entire year with no murders. What happened with that, Well, we made up for it. Willie went on a little bit of a hair during COVID and that people who I guess and getting bored with lockdowns and lock ins, and a few people didn't live to tell about it. And we've

been clearing out that COVID backlog. So I was in trial literally the entire month of April. We did a murder from the south end of Kenton County, we did a murder from Ludlow, we did a robbery from Ellesmere and all guilty verdicts. That's the good news. We've been getting our twelve dollars a day worth out of this current jury panel that we have. But they've been great jurors. Everybody's been guilty, and we've been moving on one trial

a time. Sooner or later we will dig out from under this COVID backlog. Have you ever had a not guilty and a murder case that you tried, because Joe Dieters told me as prosecutor he never lost a murder case. As Rob Sanders, I don't like to use the term loss because every case is different. Justice is not to get a guilty. Justice is to do justice. Have you ever had a murder case in Kenton County not guilty?

Willie? You just said that. You know, we were talking about not having a murder in Kenton County and then I had a flood of them. So I'm not sure that I want to talk about not having a not guilty verdict, But we have had. When I first took over the office, we had two murder cases that came back not guilty that we're holdovers from my predecessor. They were not investigations we conducted. They were not cases that I

process personally. Those are the only two. Since I have been coming with attorney, every murder case that has gone to trial has either been guilty of murder or guilty of manslaughter. We've never had a knock guilty verdict. Hold on knock on wood because certainly I don't want to jinx myself, but no, We've had great investigations. We have great teamwork with our law enforcement partners. Makes for better trials, better evidence, better trials, and better outcomes

for the citizens. Ken Kenny, you know, I tell the American people that when a murder takes place, you have the arriving officer who tends to believe the defendant did it. I'll use the name Tony Bender just for fun. That the arriving officer might say, you know what Tony Bender did it? And then you have a supervising homicide detective that says you know what Tony

Bender did it? And then you have an indictment in which the prosecutor presenting it to the Kent County Grand Jury will say you know what Tony Bender did it? And then you had the grand jury itself indicting saying you know what any vender did it. And then you have the trial counsel that you or one of your top assistants saying, looking at all the evidence, saying, you know what, Tony Bender did it. So by the and then you

had the trial judge in Ohio, it's it's a rule. It's a rule about making a motion Rule twenty nine motion at the end of the state's case, and the trial judge says there's probable cause to believe the defendant did it. So by the time you get to the verdicts, you have a strain of obstacles to jump over to make sure that Tony Vender did it. So by the time you get to the trial itself and the verdict, there's pretty clear evidence. So all the may I use the term bad cases are bumped

out before you get to that point. Correct, Well, if you're doing the job right, you're exactly correct, Willie that you know, we're here to work with the police to make sure that they build good, solid cases that can sustain an attack by defense attorneys and still maintain that guilty verdict. Anything that can't rise to that level, well it's our time to weed those out. And that might be that some buddy is charged with a lesser version

of homicide like manslaughter, reckless homicide. It might be that somebody has not charged at all. You know, some of the biggest decisions that we make as prosecutors or when we tell police know or when we tell police that was self defense, so that's not appropriate for homicide charge because somebody was justified in their use of deadly force. You know, that's ultimately a major part of being successful is being able to sift through all the different cases that we get.

And that's a great thing about my job as we never had the same case twice. You know, this job changes on a daily basis, and I really never know what fate will throw at us on any given morning when I wake up. But that's part of what we do is help the police sift through these pick the good cases out from the mix, and you know,

make the bad cases go away one way or the other. Whether it's ruling that something is not a crime, whether it's ruling that there is not probable cause even if it is a crime, ruling something that's self defense, that's all part of the job. Before we talk about Shane Walters, who have scound that but then was caught. Stand your ground is gonna come under

more controversies. It used to be if someone was in their home, stay upstairs in the bedroom, and somebody kind of walked in the front door of your home at night, and they never presented a risk of harm to you or your family and simply started hauling out your stuff and never threaten you. At least in the state of Ohio, you didn't have the right to shoot them. And the back is they're taking out your TV because let's face it,

you weren't defending a person, you were defending property. Then the law changed in Ohio where you had the right, and now it's stand your ground, which means in Ohio, if you're in your own car, or if you're on the sidewalk much less than your home at two o'clock in the morning and someone presents a risk of physical harm to yourself or others, you have the duty the right to stand your ground. Can you explain to the American

people to stand your ground law when it's outside your home. In the state of Kentucky, well, you have the right to meet force with force. It's when someone is outside of their home, outside of their car. In Kentucky, it is a much more traditional common law definition of self defense and what you're allowed to do. However, Kentucky law gives people special protections, as you mentioned, when they're in their home or in their vehicle. Because

Kentucky law treats the vehicle as the home. When they're outside the home, they're allowed to use the amount of force a reasonable person would deem appropriate in order to repel whatever force is being used against them. Frankly, Willie, I think things were a little cleaner before Stand your Ground, because stand your Ground, while well intended, oftentimes expands the ability to defend one's self so broadly that it ends up covering situations that stand your ground laws I don't think

we're ever intended to cover. You have to be really careful if you're going over to the house or to a car of someone that you have a problem with that could be a threat to you, because if you set foot in their house and that person happens to deadly physical force against you, police and

prosecutors are gonna have a real tough time doing anything about that. If they're in their home, that person basically has to just articulate why they thought you were a threat, and that you were there unlawfully and the next thing you know, it's to stand your ground. Situation outside the home, though,

it is a much more of a reasonable person standard. So if a jury of twelve people here's a case and thinks that, now, that's ridiculous what Tony Bender did in that situation to draw his gun or pull his knife and use deadly force against someone who did not threaten his life, then he could still be convicted of a crime. In a home. In a vehicle, it's a much more difficult thing to prove. It's a much higher bar to

overcome. So if some eighty four year old woman walks up to Tony Bender and slaps him in the face, Tony doesn't have the right to pull out a six shooter like Matt Dylan and a load on that woman. No, not if it's none. If it's some outside of a home or outside of his vehicle, No, And again everything turns on the details of every individual case. But he gets a lot more leadway if he's in his homer in

his vehicle. All right, now, let's go on. As Shane Walter's about a week ago, this was a terrible story, and what's this. This criminal killed Megan McCree. I guess his wife or a slash girlfriend's significant other. First of all, tell us the fact. So how Shane Walters was ultimately played guilty or convicted a manslaugh or what did he do to Megan

McCrae. Well, he was intoxicated and had been drinking alcohol all day long and thought that that would be the appropriate time to show Megan McCrae how to use a handgun. He was very wrong, managed to discharge a handgun while he was attempting to disassemble it and shot Megan one time in the chest. That bullet entered her chest and on forting right through her harden, killed her. He was indicted for manslaughter, played guilty to manslaughter. However, this

case is unusual Willy, because he was out on bond. It's very uncommon that anybody in Kenton County facing a homicide charge is able to post a bond. However he did. He had a pretty significant bond. I believe he was twenty five thousand dollars cash that he had put up to get out of jail pending the outcome of his case. He played guilty, continued his sentencing a couple of times but finally was out of continuances. On May first,

the judge told him, no more continuances. You're coming in here. We're getting this thing over with. Of course, we had been objecting to the continuances for a while. Now become May first. Shane Walters was no place to be found. Didn't show up the court. His attorney was there, his family members were there to see him get sentenced. The victims family members were there, but no Shane Walters. So there was a warrant issued for

his arrest. The US Marshall's Fugitive Task Force in the Kenton County Sheriff's Department jumped into action. They started looking for only took him a couple of days and they found him at the Lookout Motel and right on the Fort Right Park Hills border on Dixie Highway in Kenton County, which is pretty much the heart of Kenton County. He obviously didn't run very far. In fact, his house that he had shot Megan McCray in was in Taylor Mill, which is

further out than the Lookout Motel was. In fact, if you're ever going to run from the police to Lookout Motel's probably the last place you want to go. I'm going to the hotel as the name implies. Really it is the kind of place you would expect to find someone running from the law. In fact, Marshall's probably the save time in the future and just stop there first and check the register before they even do any investigation. But nevertheless,

they made quick work at the situation. Found Shane Walters in a room with a new girlfriend whose name I don't have unfortunately, but she and Walters are both facing charges for his bail jumping as well as Walters was found to have a handgun, a new handgun, not the one he shot Megan with, but a new handgun in his possession, which he's not allowed to do since he had already played guilty to manslaughter. So he's facing a new handgun by

felon charge. He's facing a new bail jumping charge. He's already played guilty to the manslaughter charge. The bottom line for mister Walters is he probably doubled, if not tripled, the amount of time and he will actually spend in prison. If he had just shown up for sentencing and taken his medicine owned up to what he had done, I guess he'd already owned up to it, but he hadn't accepted his punishment yet, and he had just come and

face the music. He'd done his five years in prison for the manslaughter and he would have been parole eligible after a year. He already had a significant amount of jail credit in because he was in jail for some time before he posted bond. But now he's looking at five to ten for the handgun charge, one to five for the bail jumping charge, so upwards of another fifteen

years in prison rather than this show up and face the music. Well, Shane Waters is not a mensa candidate, but any rason why show up? I mean, we had this woman in the hotel room. Is at it? No? I don't know, Willie. I think it's That's one of the things. You know. This is very small part of a much bigger conversation on bond and the appropriate use of bond in our court system and what

defendants are appropriate to let out on bond. But nevertheless, when some defendants are out on bond and they are looking at a sentence that is prison time, a lot of them want it comes down to it, don't want to show up to court because they know they have to go to prison that day, and even though it makes no logical sense, they will run from the law and end up spending much more time in prison, just so long as they don't go to prison that day. Makes no logical sense whatsoever. You'd

have to ask Shane Walters himself what he was thinking. But whatever his explanation is, it can't be good. Lastly, how about a minute remaining the primaries coming up. I know you've been a great supporter of the Attorney General of the great State of Kentucky. What is your LUIGI board tell you about what's going to happen in the primary? Well, Willie, election day is one week from yesterday, so one by probably one week from today you and

I will be talking about who won the Republican nomination for governor. But voting day is May sixteenth. There's already early voting. Kentucky's getting so confusing with

this early voting stuff. There's early voting with an excuse if you're going to be out of town on election day, or if you're in the military, or one of these other excuses that you can sign an aff to David saying that you're not going to be around on the sixteenth you can already vote early, but then they have no excuse early voting on I believe it's this Friday

and Saturday. They have to check your local county clerk's websites. But then one week from yesterday Tuesday, next week we will have the regular election as scheduled. I think Daniel Cameron's gonna hang on. He's been the front runner for quite some time. Kelly Craft has been about ten million dollars of our own money attacking Daniel Cameron and tv ADS, but I don't think it's gonna

be enough to overcome it. I think too many people like Daniel. I think he's done a great job his attorney general, and I think he's the most cohesive candidate to take on Andy Bisher. And if there's one thing we need to do, it's pete Andy Bisher. Everybody needs to remember the lockdowns and all of the tyrannical governing we were subjected to under this governor back during COVID. Since then, he's not done anything except hand out federal checks to

victims of tragedies like bloods and tornadoes. So he's had a very lucky kubernatorial run since then to try and make people forget about his COVID shutdowns. You know, it's nice when Joe Biden just sends him millions and millions of about billions of dollars to ride around the state and hand out big checks. It's easy on your campaign. Nevertheless, it's time that we get a governor that

can work with our Republican legislature and keep Kentucky on the right track. Oh, once again, thank you very much, Rob Sanders, and we'll see what happens on Tuesday. at three o'clock today. Three o'clock today, the Ohio lawmakers are going to vote whether or not to raise the limit on constitutional amendments from fifty percent to sixty percent. And I would point out that from all of our history the United States Constitution to amend it requires two thirds of the House, two thirds of the Senate, and three fourths of the states. And the reason that is in there it must be a principle widely observed as necessary and needed.

By that, I mean it isn't one party getting fifty one percent of the vote and impose a constitutional requirement on everyone. So Ohioans for a long time have had a requirement of just fifty percent of the vote. Fifty one percent of the vote, and we amend the constitution. That is Bass ackwards. And at three o'clock today there's going to be hopefully a change in that. Joining you and on now a is Mike Gonadocus and he's with Ohio Right to

Life. I think he's the president executive director. And Mike, can you tell the American people as we sit there what's going to happen after three o'clock? A man thank you so much for having me on your show. I'm at ground FEEDO. I am at the Ohio State House as we speak right

now. So I apologized for background place, but I can tell you at three o'clock today, ninety nine men and women are going to walk into the floor at the Ohio House of Representative and they're going to push a greenbroton to try us the voters and to allow us to decide what our constitutional stands to be. Or they're going to press a red button and say the political class knows what they're doing and we shouldn't be able to practice democracy. This is

you what this is the United States. This is our constitution. It's not the politicians constitution. It's not Michael Bloomberg's or George Sources constitution. It is ours. And what we're asking for is a right to protect our constitution from out of state interests coming in and prostituting it and put whatever they want in it. So to talk to me, because this abortion law has been drafted by Planned Parenthood and by the ACLU. Normally, legislatively, it may take

months to pass the law. Each side has their say, and there's all kinds of ifans and butts what they do with the fetal tissue of the remains of the unborn baby. Who can conduct it? Is there an agreement with the hospital and all that has ferreted out? Shall we say, at the legislative level, if the way the Constitution is written right now today as we speak, what happens if planned parenthood proposed as a law? How do you

get it passed? Well? And you're exactly right, And this is why we're fighting so hard because of the ACLU, A plan parented and everyone else is trying to go around the legislature, go around you and I elect our state reps, our state senators, our governor, and the ACLU wants to go around them, spend one hundred a million dollars from Bloomberg and Soros and others and come in and jam abortion up to and through ninth month of pregnancy

into our constitution. It's not a state law, it's our constitution. Therefore, parental consent wiped out, Any bands on late term abortion wiped out. That's what's happening in Ohio. Almost every year now we're seeing another valive initiative because people are going around, are elected officials and just buying their way in our state constitution. We have to stop this. But listen, Bill, We're not doing this just for abortion. We're doing this for our Second Amendment

rights. We're seeing states across the country do the same thing in their constitution eliminating our rights to own a gun. We're seeing our family farmers get get wiped out by radical activists at PETA and these animal rights activists in our small businesses. Right now, the SEIU, the one of the are just labor unions in Ohio. Its circulating petitions to do a mandatory minimum wage in Ohio.

Think how many small businesses in the greater Cincinnati area are going to be decimated and closed if they have to do a mandatory minimum wage in our constitution. We have to stop this now. So well, when the ACLU and Planned Parenthood they're targeting Ohio because Ohio is like a red Republican state in which we elect senators, governors and lawmakers to pass laws. They know they can't win at the ballad box. They know they can't get these liberal policies through

Columbus because we the people have spoken. But if you ever proposed one law that you propose directly into the constitution that means in the future, none of the lawmakers in Columbus can change anything about the Constitution because it's in the constitution. Therefore, they circumvent the people of Ohio by saying, you know what, fifty percent gets it done, and we're going to draft the laws and

pass them that way. And as far as these commercials I see being run constantly, this time against Cindy Abrams and against h and against Genie Schmidt, it makes it makes it looks look as if they're the ones opposing the people when just the opposite is true. And I don't know who's who's paying for those for those commercials saying that Cyndey Abrams does not want the people to be heard. Who's paying for all that? Yeah, we don't know. It's

an odd dark money out of state special interests. We don't know. We love Cyndey Abrams, we love Genie schid stay of both devoutly pro life, super conservative, and they both support and they're going to hit the green button today to support and save our constitution. And if that passes, assuming the lawmakers say okay, it takes sixty percent to amend the Constitution, not fifty percent, the Senate still has to pass it. Is that correct? And

then the governor still asked to sign him A good question. I just making some sausage here. Just let our listeners know that the governor had plays no role on this whatsoever because it's just a resolution, so all that we need to send it already. Path that we just need the House vote today to concur with what the Senate did, and we're off to the races. We're going to have an election in August and we the people will get to decide.

And I am confident vast majority of all Highlands agree with me and you on this issue. We need to protect our constitution. Oh. Right, at this point we have a minute romany. I know you're busy. We're gonna have Melissa Powers on and talk about that and more so, this can be somewhat confusing. Let's talk about let's you and I discuss first of all,

the status quo. Status quo is that if about five hundred thousand citizens get together and say we want to propose a brand new law in the Constitution, not a statute that can be quickly amended, but in the Constitution, and get it on the ballot, that we will run tens of millions of dollars of ads in favor of what we're proposing, too, I think trick the American people into believing it's a good it's a good law. That's the current

status. If what's going to happen at three o'clock today transpires in Columbus, it changes the rules just a little bit. And it says, among other things, that in order to pass a constitutional amendment, sixty percent of us would have to vote yes, not fifty percent plus one plus. I got a note from Denny, from Denny from Dayton is always knowledgeable about these things.

Just you have to presently get signatures out of ten counties of the eighty eight, which contained, by the way, fifty percent of the population. The other seventy eight counties in a matter don't count, including Warren County. So you have to get signatures about a half million valid signatures from ten at least ten counties. And if you get that and it's on the ballot, and if it's on the ballot, it means you vote to change the constitution

with fifty percent of the vote plus one. So they're seeking to make that sixty percent. So it's a principle, and that one particular issue cannot be adjustice to such an extent that many Ohioans have no idea what you're voting for it all. So let's continue with more. We've scheduled next a representative, Sydney Abrahams to come on. Then after that we're gonna have after two o'clock today, Melissa Powers, the county prosecutor. Let's continue with more. We

never stop, We simply continue. And I tell you what it's going to be. It's gonna be interesting because the issue is one that could be easily twisted in your mind. We just went through with Mike Gnadakis of the right to life, and I don't think the average he's kind of inside baseball. He's up there walking the hallways. And as an American, I think constitutionally, as I've said many times, it's the states issue, not a federal issue. But some in Ohio want to put it in the constitution with a

fifty percent vote, which cannot be changed by the legislature. If it's not changed by the legislature, it is what it is. So if you're planned parenthood, or if you're believing that Bernie Sanders crowd that everyone should make at least fifteen dollars an hour and put that on, put that on the ballot to vote on. There should be wide acceptance of constitutional principles not legislatively taken

the place. And the reason this is happening in Ohio is because we're such a red Republican state that often the liberal progressive viewpoints are not passed through the legislature, and if they are, then Mike Dwine will probably not sign sign

it into law. So, knowing they can't get the acceptance of abortion in Ohio through the lawmakers in Columbus, they want it in a sense, put it in the constitution by fifty percent vote, and by the time the issue rolls around to vote on the great majority of Ohio wins who have no idea what they're voting for. It is difficult to go in and out of these issues. Now other words, does it approve partial birth abortion? The answer would be yes, wore to provide for abortion up through the ninth month of

pregnancy. Yes, it would wore to take away the ability of a mom and a dad to know if their child is taking transgender hormones or a schedule for surgery altering care, The answer would be yes. And so having not gotten the ability at the ballot box to control important issues in the state of Ohio. The Planned Parenthood and the ACLU want to propose their own statute spend literally unlimited amounts of money, which in the advertising business, in a sense,

we should be happy about. But I'm talking principles with the elie and not a l at the end that it ought to be to change our constitution, there ought to be overwhelming support for a principle, not simply bypassing the legislature that we put there to look out for our and Ohio is targeted because we are Ohio, a very very red state. Abortion on demand is now

permitted almost all the blue states, in the Blue cities. In fact, there's abortion van set up in the state of Illinois against the border of Indiana and against the border of Missouri, so that those mothers and those states can kill their unborn babies in a mobile van. That's all ugly. It is. We have fought as Americans against right on favor of right against wrong for a long time. You and I know as adults there's good things in life

and there's evil things in life. And this is evil, and what it seeks to do is take away the ability of the people, through our elected representatives, to pass laws that provide the nuances of abortion, or the minimum

wage, or a climate change or fracking, whatever it might be. And the special interest when it comes to abortion are going to be very strong, and they're going to spend tens of millions of dollars, maybe up to one hundred million dollars to pass abortion on demand in the state of Ohio, which I think citizens in this state want a limit abortion completely to maybe until there's

a heartbeat, but certainly after that. The forces of planned parent that would like her to continue up through birth, maybe pass birth, and this law would allow that to transpire and take away the ability of mothers and fathers to give counsel to their a teenage children. When a teenage girl is pregnant and she's fifteen, sixteen, seventeen years old, that is the time, more than any other time maybe in her life, that she needs her mom and

a dad together to give her counsel and advice. So let's see what happens at the end. I all, the great American always says we get the government we deserve, and at times that concerns me greatly. Newest government numbers show consumer prices rising a half point from March to last month, but overall inflation is down year over year, thanks in part to lower gas prices. At this moment, we have at two o'clock a Republican Caucus meeting, and then we have three o'clock floor sessions scheduled at three and we are going to vote on the resolution to raise the threshold, basically to change our constitution. And I don't want people to be confused here. You know, changing our constitution should be a big deal, okay, And we have to protect that constitution from things like

again legalizing all drugs. Google Portland's see what they're doing over there. It's totally crazy, you know, getting rid of our qualified immunity for our first responders, of course abortion, protecting our set an amendment fifteen dollar minimum wage, which will devastate our small businesses. I have a lot of friends that own small businesses, and that's what they've reported to me. There's also something

that people can't be confused about. If we the General Assembly pass a law that the voters don't agree with, they can absolutely take that to referendum with fifty percent plus one and guess what they can overturn that law. So you know that that's the story. And Cindy, it's basically legislating by smear ads. I see the one about you in Cincinnati and also, Jeanie Schmidt,

you're from the west side of town. For those listening outside the region, and these ads make it look as if Cindy Abrahams, who's a lifelong politician, is now acting to take away the right of the people to vote. Can you address yourself to those two issues that's being run against you? Yes, thanks for that question. I am a conservative republic end of story period. My constituents, my voters sent me to Columbus to cast conservative votes and

I have I have a voting record to back that up. Again. Last General Assembly, in the budget I serve on the Finance Committee, we passed historic tax cuts. We're continuing that this year. The House passed a very conservative budget that included obviously tax cuts, you know, things like education, our priorities, public safety, and you know, in Ohio we have to have a balance and balanced and on time budget, which we're doing again.

To talk to me about a career politician, most of my voters, the ones that have my cell phone, have called and they're laughing like what is this, Well, guess what. My career was a Cincinnati police officer. I moved to Cincinnati years ago to serve with the Cincinnati police department proudly. And you know, politics found me, Bill. I certainly didn't go out and search it. They found me. I was a police officer, former police officer, and a small business owner. And let's not forget I'm a

wife and a mother. Okay, well before my title as quote politician. And I'll be damned if I'm a career politician because I've been involved since twenty nineteen. So your career as a career politician, you've been out at about three years. Correct in this role as state representative for the twenty nine district, Giesser. Okay, Now, I think the average citizen living in Mason, living in Ashtabula, living in Cayoga County may not understand how does law

exist? Number one? Generally speaking, the General Assembly is voted into office, the House and the Senate, and the five constitutional officers are voted in at the ballot box. When parties lose, such as on the abortion issue planned parenthood, and they sell you put together literally hundreds of millions of dollars to propose their own statutes and to get them passed. Generally in red states. In blue states, it's abortion on demand from the moment of conception.

A way through birth and partial birth abortion as a sacrament. And so in Ohio and many others so called red states, there's a view that abortion is the killing of the unborn. So explain to the American people. If Planned Paradote has its way and gets enough signatures, which is almost a half a million, and put it on the ballot, they will then not coin that new law as supporting abortion on demand. They're going to call it women's health.

Explain how something as we sit here at one twelve pm, how does somebody get on the ballot now and then we'll talk about changing it. But every now and then we vote a constitutional amendment, how does that happen as the law is written as of now. Yeah, so as of now, all you need for a constitutional amendment is, of course the signatures. There's

a process, okay, And I'm not saying the process. You know, you've got to go get signatures, you've got to have the wording correct, it's got to be approved, and you know it goes to the people. And look, you have to educate the people on what's going on. So seeing I again like these attack ads. You know there's things that are put out that aren't true and sadly, as you just talked about, Ohio is a red state. Okay, people can argue left and right, they can

say things are jerrymanders. And I'm going to tell you something. If you look at the last decade, Ohio is trending more and more to the right. And so again, our state lines are not jerrymanders. Okay. So there's that people can show up obviously and vote for this. Right now, it's fifty percent plus one, and that's how you can amend our constitutions through a ballot initiative. Again, we want to make that sixty percent because it

should be hard to again come in from other states. You're totally right, Blue states coming into our red states because they don't like how the representatives who are you know, we have a supermajority here in Ohio again thanks to our voters who send us to Columbus to cast votes. And you can't forget that there's these again special interest from out of state and let's not forget the out

of state dark money groups. Again, that's what's behind see that, and if it passes that, for example, if if you don't make it sixty percent, that means that let's play ahead. Let's say they get the signatures. With enough money, you can get the signatures, and it's on the ballot, and let's say it's about women's health, and the average ohiowen reads the amendment, Well, this is about women's health. I'm in favor of women's health. Heck, my sister is a woman, my granddaughter is a

girl, my mother was a woman. I love women, and I think women are better than men. And it's going to be about women's women's health. It won't be about abortion on demand. And so if that passes in November, can you and the lawmakers in Columbus change that in any way? Well, that's the thing. Once it's in the constitution, I mean that there you have it. So that's why, again we have to have people

read what they're voting on. That's what I'm stressing. You can hear in my voice, you know, as we vote on different bills, you know, people are calling our office and emailing us and whatnot, especially on this resolution, and they're saying, you know, look, you can't do this. You're silencing people. We're not silencing anyone bill. We're letting the voters vote on it. So guess what if you don't like this, then go

to the ballot box and vote on it. That's what I say. Read what you're voting on, understand it, talk to your representatives, talk to people that you trust about what this actually means, and then go to the ballot box. That's why we're the best country on earth. We can go and vote on things. It's a career politician who's been in office since twenty nineteen before that, a police officer, as a wife and a mother. Some consider that to be evil, to be a wife and a mother,

some consider that not to be good. I consider it to be. A person's highest calling in life is to be an organized family structure. But at this point, how confident are you that the Republicans in the House will vote to make it sixty percent? But if that happens, that doesn't happen automatically, and then it has to go to a special election in August. Is that correct? Yes? So the General Assembly I believe at this moment, I'm not I've not been ordered to whip votes, but I understand from the

Speaker's office that we do have the votes today on the floor. We also the General Assembly decides the time, day and manner of the election, as you know, and so it could be it could be August. Yes, that's what I understand. It's going to be on the floor today. As you know, things changed by the minute here, so who knows when it will be, but yes, it will be at an election, you know. Some say it could be August, some say November, some say next

March. Who knows. But today, from what I understand, at least from an hour ago, it's going to be August, all right, And what will your vote be? My vote is yes. Are you confident there's enough Republicans on this. That's what my understanding is as I've talked to my colleagues there is, and I will say, the calling to be a mother and a wife is the best job on earth, right, that's for sure, I think. So. Lastly, about a minute remaining as far as

other aspects of this planned Parenthood bill. If it passes, and you have a son or a daughter who's a teenager who wants to change genders, well this take away some of the ability of a mom and a dad to counsel and to be with a teenage boy or girl who wants to change genders. Well, listen, I'm going to be very firm on that. I believe that parents, ultimately number one, were our children's first teacher. And you know what, parents have to be involved in their children's lives and step up

and be parents. And you know what, sometimes it's a fabulous, wonderful, positive job, and sometimes it's hard and it's negative, and the kids certainly test us. But you know what, we as parents need to be there with them and walk them down the road in life and get them the help they need when they're struggling in life. You know, we don't want

to talk about mental health. I do because it's to talk about So one more thing I want to mention, Hey, the US Constitution, just to let everybody know, requires three fifths okay of the votes there, which is well over sixty to change the US Constitution. So just to be very clear again, Ohio is going to be sixty after this vote today and then we

take it to the voters, let the voters decide. And Ohio as an outlier, it is uncommon to have constitutional amendments requiring approval by fifty percent plus one. Ohio as an outlier, it is not common to have this happen. Once again, Cindy Abrams. Good luck. It's unbelievable and it's always done by special interest groups want to take away the right of the people through the legislature to pass laws and so if and when this abortion on demand happens, in Ohio, the lawmakers in Columbus who have nothing to say about abortion and all

of its numbers, because it's in the Ohio Constitution. So there's a US Constitution and an Ohio constitution. There's a Kentucky constitution. There's an Indiana constitution. It should be very very difficult to amend a state constitution, and presently it is quite easy with enough money, and God knows Planned Parenthood has enough money. Let's continue. And the daughter has visited with her father, who does not take responsibility. In fact, the father, the murderer, blames his wife for her death. One case a daughter who's now approximately thirty eight years old. She's now thirty eight, her father killed her mother when she was five years old. Now she's fighting to keep her father locked up in jail. The parole board says, we're gonna let

him go, oh boy. And so the daughter is going to ask your help as an American to keep her father locked up for murdering her mother. Seg your reaction, William, this happy National Nurses Week. One is a terrible incident on of Wyoming High School. And Wyoming High School is probably one of the top five or six high schools in the Tri State when it comes to educating kids, tak care of business. Wyoming's a great community, no problem whatsoever. But individuals may perform criminal acts at times which are terrible. Plus story last night that daughter wants to keep her father locked up in prison for murdering her mother. But nonetheless, Melissa Powers as our

prosecutor, and Melissa Powers, welcome again to the Bill Cunningham Show. And what can you tell us about the facts involving this fifteen year old at Wyoming High School. Well, the lunch victim, actually, all actors in the incident that occurred in Wyoming were fifteen year old freshmen. They were all members of the junior varsity baseball team and after practice one evening, there were a group of kids that targeted a teammate and drug him into the locker room and

committed acts of touching inappropriately. And as a result, there are three kids, also fifteen years old. These are his teammates that were charged with One was charged with rape, All three were charged with kidnapping, all three were charged with hazing, and the other two were charged with gross sexual imposition. And because they're juveniles, I guess the names cannot be used as far as

the main perpetrator. Are there different graduated levels of criminal culpability for each of those three fifteen year old boys, Now, they all would be at the same culpable level as far as intentional acts being committed against another or reckless behavior on the hazing part. But you know, they're all charged in the same way. It's just one one was more egregious than in the rest, although it's hard to separate the that other than that, one was charged with rape

and the other two were charged with gross sexual imposition. And as far as the charges, does it involve penetration or just an illicit touching or both? Well, the rape charge does involve penetration. The other two were charged with gross sexual imposition, which is having contact with another that wasn't their spouse and

it was a sexual contact. And Melissa Powers, as I recall, isn't the victim a special needs boy, he's autistic as my understanding, So did that come into play when the other boys and if this went far beyond bullying, I just I want to say, UM, definitely acts of aggression against informer another teammate. UM. It was so abusive, has long term effects on the victim that can last his entire life. So as a parent, all of us, it would be our worst nightmare something like this would happen

to our our our son. UM. You know that was hurt. It was so cruel emotionally and physically that you know they need to be held accountable and treatment needs to be involved here as well, to get to an understanding of the bottom line as how could something like this happen? And you spent

many years as a judge in juvenile court. There's a procedure of a bind over, which means someone fourteen and over who commits a felony that would have been committed by an adult is eligible for bind over plus not amenable for treatment the juvenile court system. Have you made a determination yet it's whether to seek a bind over that's still is being made by the Juvenile division. There's a specific statute that you have to comply with since they're at the age of fifteen.

There's a lot more, there's more requirements statutorially by law that is required before a case would be presented to the grand jury for a bind over. And as you mentioned, there's a second piece to that is can they receive rehabilitation through the juvenile system and which is the amenability hearing that you referred to. So it's yet to be seen. There's some hoops that would have to be jumped, you know, go through and the facts you need to fit

that I don't do not know. Obviously, a mental health assessment involving those that were the perpetrators of this and that those that were charged is going to need to be done. So there's quite a bit involved before a determination by a judge would be made. And as far as the three Wyoming High school boys charged, are they free on bond or are they locked up? At

twenty twenty and I didn't get an update today. The two that were charged with gross sexual imposition hit no prior history and they are released on EMU as my understanding, which is the ankle bracelet and the individual charge with rape. The last I heard he was being held at our detention facility at twenty twenty Auburn. And if those boys, especially the one charge with rape, stays in the juvenile court system and is not bound over. What is the maximum

punishment that boy can receive in the juvenile system. It's an indefinite sentence if if the charge remains and he's adjudicated at delinquent on the rape charge, the it's an indefinite sentence of one year up to the age of twenty one.

And the other two boys, if they're not bound over, the same thing would apply to them on GSI or not gsislower would be an indefinite sentence of a minimum of six months, with the maximum being their twenty first birthday, and that would be at the detention you excuse me, the Department of You Services is where they would be incarcerated. How cooperative is Wyoming High School been they It's my understanding that they cooperated fully. They took all the appropriate steps.

The alleged victim contacted and told immediately reported it to the coach. The coach then got in touch with the school officials. School officials got in touch with police and a thorough investigation was completed and as a result, the three kids three kids were found to be culpable and charged. Is proof going to be a problem in this case, the victim, I don't believe so.

I think that from what I've seen, and again I have not reviewed the entire file, but what I've seen it looks like a pretty strong case and should have no problems. Would prove as long as you have the cooperation of the proscue witness, I think the proscuye witness can definitely be able to testify us to what occurred. How is the autistic victim doing? Is he doing? Okay? I have not Again, I'm sorry, I don't have information on that. Our victim advocates would be in touch with the family and the

victim himself. I have not received a report from our advocates regarding this case specifically. Now, Melissa Powers an interesting story. It's a sad story. A daughter is trying to keep her father locked up in jail and the parole hearing is this summer when he is charged with killing her mother. She's fighting to keep her father behind bars thirty three years after he played guilty to murdering

the mother. Daniel the defender's name is Daniel Johnson. He's eligible for parole later this summer, and Jennifer Johnson is doing everything she can to stop him from getting out. This is her own father charged with beating to death her own mother. At the time of the time of the murder, she was

somewhat of tender years. The day after Christmas in nineteen eighty nine, the daughter, who's now a course an adult, said, my father kidnapped my mother from work, drove her to his work on River Road at Cosmos Cement, and beat her to death while the children were at home. An awfully

sad story. And what can your office do? You came on about two or three weeks ago about some other vicious murderer and Hamlety County Deputy Sheriff's arrested Daniel in a capitol charge of aggravated murder following a confession that he gave. And he's due to get out this summer. What can you do, if

anything, to stop it? Well, one thing, and obviously the victim is doing as much as she possibly can for this horrible circumstances, not only losing her mom, but to be at the hands of her own father. And I can understand that these emotions that she's going through are very very we're all very much at the surface, and something that she has spent most of her life dealing with is. Like you said, she was very young when

this happened. But what the people can do on is I would encourage any of your listeners to go to the Hamilton County Prosecuting Attorney's website and on them you'll see the banner on our website that says Parole Watch, and I would go to the click on that and then click on Daniel Johnson's name and you'll get more of the facts that have been reported, and then you can respond directly to the Parole Board after you read through the summary of the facts from

our web page and then put in the comments that you oppose his release. The Parole Board has already made a preliminary decision to recommend Johnson to be released for that brutal murder. And however, the Prosecutor's office has been fighting to keep him in and advocate on behalf of the daughter, and we believe that

he deserves to spend the rest of his life in prison. He received a life sense and the parl Board is now considering release, which we do not want someone like him to come out and come back into one of our neighborhoods here in Hamilton County. The prol board has become a very lenient more often releasing and I would say about ninety percent of the cases they're releasing violent criminal offenders and murder charges. No matter how hard we fight, they're releasing them.

We do believe that not only the victim's input, which he has a right to provide any input she wants to the Pearl Board, but we also believe the community. They will listen when the community responds that someone like this does not deserve to be released. I'm certain that the daughter is in fear of her life if he's leased, and I would have those strong concerns myself if I were in her shoes. So I would encourage any of your listeners

to go to our website and follow up for real watch. You can have a say so. And basically, the prosecutor's office in the community is the last line of defends to keep violent criminals behind bars because the system so far has been stacked against us from and is changing. The culture is changing, right, and it's just unfortunate, but law buying citizens still want to feel safe in their communities and releasing someone who's still very young, who still can

commit crimes shouldn't in particularly violent crimes. I don't think any of us are safe. It's just Daniel Johnson's release. No, And in fact, the daughter, Jennifer, was five years old. She's now thirty eight, and she said, quote, I've asked my dad many times, why did he do it? He never once apologize. All he's done is threatened me. And he's blaming my mother for her murder. And so he says, I can't she's a I don't want to run my entire life. I don't want

to live in fear. I'm gonna do have anything. I can't keep him in. So knowing all this, the parol boards still said it's time to release him, right and he received and he received a sentence in nineteen ninety twenty years to life. So he's only been in um, well you do the math for me, but he hasn't been in long And yeah, he still hasn't served his life sentence. And I don't know where the Pearl Board's coming from, to be honest with you. And this just this our community.

This is through the entire state of Ohio, which is just making us less safe of you know, the state, each community which is less safe when these people are released. I cannot imagine a Jennifer and the other There were three members of the family that they deal with at tender ages like three to five and seven years old, that their mother was beat to death.

Their father is charged with the murder, and their lives have and I've been forever and now here we are thirty four years later, and he's not apologized. He said he's coming after her, the daughter, and the parole board says, well, it's time to let him go. Well, I'd like to have that guy, Daniel Johnson live next door to the parole board members. That'd be a great thing. But Melissa, we gotta go and we'll

continue to follow these cases. And once again, it all begins with citizens going to your website and doing the prompts to say, we don't want this guy back in Hamilton County and Melissa, but we would love that. We would definitely love to have that and the community get involved and the more the better, and to help us fight for law and order and fight for accountability and for fight for the victim.
