I'm that I'm bad of the ball, bad of the bone, bad of the ball. All right, Bully Cunningham, the great American Rob Sanders is in court. Let's go to him quickly so that we find out what's going on with Joseph You Bank and also the murder which is a terrible case of south Burns. And once again, Rob

Sanders, Welcome to the Bill Cunningham Show. And Rob, how are you Willie doing fantastic? Thank you for having me back on in this Thursday. I told you that I would be back for an update on the Joseph You Bank case just as soon as we have Judge Malloy's ruling. And luckily that ruling came down late yesterday afternoon. She didn't make us wait till Friday,

which was herself imposed dead line. But yesterday afternoon I got the email straight from the court that Joseph eubanks latest third attempt to get out of prison on probation was denied. He is now some time between now and Saturday, which is his twenty first birthday, is being moved from the juvenile facility where he's been housed with children despite being a twenty year old serial rapist. He's being

moved to an adult prison where he belongs. And the six young women that came forward and gave their testimony against Joseph Eubank, they can now rest easy and finally get some of the justice they've been waiting so many years for. And Rob Sanders, when you look back on the history of this matter, I suppose he began his serial rapes as an eighth grader, and he was a cubcat of course in high school and Notre Dame Academy across the street.

If you had to give us a paragraphic capsule as to why and admitted serial rapist could have done what he did beginning of the age of fourteen. He's now about to be twenty one on Saturday, which is seven in your period. How in the hell is it possible that a serial rapist could get all the breaks that he received, including being in kitty Court and kitty jail with a lot of passes to walk around the community for the last several months and

years. How was this possible because I can't imagine this is legal, but you're telling me it's legal because of Densmore and shul their great law firm was hired by the Ubank family to keep this matter pending, hoping to get him out of serial rapes. How was this possible over the last seven years, Willie? You know, normally I hate the term privilege because I think it's

overused and abused and over politicized. But you know, this is one example where I can't argue with the claim that privilege is to blame when it comes to Joseph Ubank. The only reason that he has been kept in the juvenile facility is because his family had the money to pay three or four hundred dollars an hour or whatever the Densmore lawyers charge for them to file a lawsuit against

the Department of Juvenile Justice and basically back them down. Not here in Kenton County, of course, where everybody knows what Joseph Ubank did, but dan in Franklin County, Kentucky, which is Frankfort, our state capitol down where nobody knows Joseph Hubank, nobody knows who his victims are. That's where they filed their lawsuit, and it was a lawsuit that the Sheer administration baffled me

by discowering from the judge down there, said I need a record. The Department of Juvenile Justice hadn't made a record, So I'm sending it back there for you all to make a record, and I can review that record and see why you made the decision to ship him to adult prison where he belongs. And rather than go back and make the record and litigate this case and fight their way through court on behalf of those rape victims, instead they said, okay, we'll keep him till he's twenty one, not a problem,

just don't take us back to court. And so that's what they did. But money is the only explanation as to how he stayed there. Fortunately had to prosecute a number of different juveniles as adults over the years, and not a single one of them has been kept in the Department of Juvenile Justice custody until they were twenty one. But then again, not a single one of them could hire Densbourne sold to go sue the common over Kentucky. Well,

what lies ahead here? We said at twelve fourteen pm the day before he's going to be transferred I think to adult prison. Is that Eddieville where he's going to spend the next I don't know twenty years, but probably four or five years until he's up for parole. But but nonetheless, what's the next step that Densmore, by the way, a great law firm, the largest, the most politically influential in the dry state. What's their next move?

Because I would think as long as the client's paying Densmore is going to keep filing lawsuits. What's next? I'm sure until they run out of their three or four hundred dollars an hour or whatever they're paying these high powered attorneys, that they'll still be filing law suits and appeals and anything else they can think of, who knows, wryting letters to the governor and rating letters to the

presidency, and if they can get somebody to let him out. But meanwhile, Judge Malloy's order says that he shall immediately be transferred to an adult prison. Now, for security matters, the Department of Corrections doesn't inform the public of when inmates are actually being transferred, so that nobody can try and hijack the transport and escape him or break him out. Of custody or something like that. So sometime between yesterday afternoon, when this decision came down, and

Saturday, when he turns twenty one. In Kentucky law says, once you hit your twenty first birthday, that's the drop of deadline where you have to go to adult custody. Sometime between yesterday and Saturday, he will be transferred. He'll go to Lagrange, Kentucky, which is one of fifteen different adult peno institutions in Kentucky, but it's the one where they do the classifications. They'll take them in, they'll evaluate him, they'll decide what facility they want

to house him in for the remainder of his sentence. He could end up in Eddieville, which is our maximum security state pen attentre done in the far western corner of Kentucky, or he could end up in any one of the other fourteen institutions that we have. When's his first eligibility for parole because he's already done, I guess if he gets credit for time served in Kitty Court,

he's going to get credit for about three or four years. When's his first parole hearing, Well, he's going to serve eight and a half years before he's eligible for parole. Willie and the victims knew about that. They thought that they were not going to have to fight this fight four eight and a half years. They thought they'd all be able to come back as adult

women before they had to deal with this again. They didn't know that they were going to have to fight this probation issue three times in the first four years of his sentence. They didn't know that he was going to be housed in a juvenile facility with children. That's why it's been a manifest in justice this far. That's why we've been fighting it so hard to try and correct

that manifest in justice. But they will have about another four to four and a half years before they have to go before the parole board and tell them to keep Joseph u Bank behind bars and he belongs. And as John Drought, the Kenton County Commissioner, it's going to be on the side of letting him out again. Because John Drought, which is a big name in northern

Kentucky, it's a prominent name. For some reason, the families enlisted him to try to get their rapists son either not go go to jail or get out early. What's the position of Commissioner John Drought at this point to free Joseph Drought, Well, I can't imagine he's runs the election. Really, I'm assuming that because no elected official in their right mind would come to the defense or advocate on behalf of a serial rapist over the six victims that came

forward and gave testimony against him. I can only assume that mister Drought is about to retire as a Kenton County commissioner, and if not, if he does decide to run again, I will be one advocating for his retirement and whoever foss to run again. And I think after this Willie there's enough pissed off people in Kent County had the letter he wrote that somebody will file to run for his seat, and now second lay a big headline today, Prosecutor,

that would be you. Social media feud over parenting skills led to the shooting death Northern Kentucky man twenty three year old at Seth Burns was gunned down outside of his home and independence and I suppose over social media a man to Turner, thirty eight years old, doorbell cam shows that she's leading and this is mom thirty eight years old over social media flap, led her four children and Xavian Turner's new girlfriend down the street while screaming threats and insults, and

out pops a seventeen year old boy whose name not yet to be used. I imagine he's not been indicted or tried as an adult yet. It came out out of a door and listened momentarily to these arguments from a man to Turner, and he gunned down, you know, the Seth Burns killing, twenty three year old Seth Burns. Then the family left, and so when I see the doorbell cam, it's unbelievable. It looks like a scene from Gunsmoke and which there's mom. They here are these adult these are children of

hers that are teenagers, et cetera. They're yelling insults, explained the social media few that erupt at the cause literally the murder of Seth Burns. Willie. If there is ever going to be a downfall of our society, I am convinced it is social media in the Internet. This is the third person,

well not this year, but the last twelve months. Third person the last twelve months that's been shot over insults that started on social media where one person has insulted another person's child, where their parenting skills, or insulted them as a mom, And that's what we had here. It didn't even have anything to do with Seth Burns. He didn't even live on that house or in that house. He was a guest at that house with his girlfriend.

They were over visiting a friend of theirs. The female resident of that house was in an online dispute with Xavion Turner's new girlfriend because she was his old girlfriend, and they got to insulting each other's children on social media, insaulting each other's mothering skills on social media. Next thing you know, the Turner family is parading down Archer Court and independence going to fight these women in the

house. At the end of the call to sax and Seth Burns was one of the people that saw this about the half in this fight about to go down. He tried to intervene stepped in between, and that's when one of him is Turner's sons, the seventeen year old whose last name is also a

Turner, but his first name has not been identified publicly yet. He stepped forward and shot two shots, one of which suck struck Seth Burns and the torso killing him unbelievable, and then they laughed crazy, brilliant, stupid and unnecessary. Well, I'm thinking of self defense. I would imagine the seventh General boy's gonna say he was defending him sell for others against the verbal threats?

Are you prepared to defend against the self defense argument that I was defending my life and those around me by the seventeen year old boy, we are Willy. Seth Burns was unarmed. He was a guest in the house that the Turner family was marching towards and screaming threats at and presumably preparing to invade or at least trespass upon their property in order to engage in this fight.

And that's where the riding charge that they're all facing comes from. That as a felony offense as well, obviously not as serious as murdered, but still a serious charge that carries real prison time. Because five or more of them went over there to engage in a melee in front of God and everybody on Archer Court, and it was this juvenile and his older brother's Davy on the

both hit guns and produced the guns. Seth Burns was not armed, He didn't have any weapons, much less a gun, and yet he was the one that was gunned down. So we're prepared for any self defense claims and we'll deal with it when we get to try in the seventeen year old boys. Of course, at juvenile maybe he should get DENSMOREL. Densmore and Shoulder represent him. God knows what will happen then, But nonetheless, is he

going to face charges as an adult? Yeah, he will. It starts in juvenile court, like every case does in Kentucky under Kentucky law, no matter what you charged with, it has to start in juvenile court. If you haven't obtained the age of eighteen yet, and this fella hasn't said the case is there now. There is a process to it. It takes some time, but I've already talked with our County Attorney, Stacy Tapk in her office. They will be seeking transfer based upon a number of factors that qualifies

for trial as an adult under Kentucky law. The seriousness of the offense, the fact that a juvenile was using a handgun to commit defense, and the fact that this juvenile is not going to be a juvenile too much longer. In fact, he'll probably be eighteen before we get him to trial, so that's three different basis. We have to bring him to adult court, and that's what we plan to do lastly year in court. Right now as I speak, can you talk about what's happening right now because you're in your lunch

break? Well I can't. I could, Willie, but I don't want to poison my Churi. I'll be happy to call you back and tell you about it, because this is a doozy of a case. But we've got twelve good jurors actually thirteen counting our alternate right now, and they're all out to a lunch break and they're all good people, so they're probably listening to your show because I'm sure they're great Americans. So I don't want to talk about the facts of the case. But maybe you and I can take this

up next week and I'm sure it'll be entertaining for your listeners. Hi, Rob Sanders, thank you, good to be there, and good luck staying on the Joseph you Bank matter until he's locked up. It should be today or tomorrow because he turns twenty one on Saturday. And Judge Malloy said she said, get him out of here before that, so he may already be

on his way to Lagrange. We'll see what happens. But in four and a half years, when these teenage girls or maybe in their early twenties, they're gonna have to once again fight the good fight to keep Joseph you Bank locked up for decades for what he did to these girls from Notre Dame Academy. You hope adults will help younger folks behave in a fashion. But when mom a man to Turner thirty eight, drives her own teenage son to and from the scene, and when the doorbell video shows that Turner enter, four kids are marching down a street and broad daylight, shouting epithets and other threats against the family of the seventeen year old boy last name is Turner. And then someone seventeen year old had a gun, pulls it out and murders in

cold blood twenty three year old Seth Burns. All lives have been negatively affected by this, including the rioting charge, and I can't imagine how this has shaken up the independence community. I'm sorry, and we're going to discuss what's happening with that case. It's a terrible circumstance, but as indicative of what's happening, the decay and

the cultural collapse that's happening all over the country. You see it not based upon race, but social situation. You see it in Independence, Kentucky, and you see it on the Purple People Bridge. You see it basically everywhere. Then after that, Chris Simlinski will be here from Numbers USA. That's

after two o'clock. No Reds Baseball today. As you know, I listened to Tommy Thrall and Jeff last night and at the end of the game they related the fact that the Redds players themselves in the dugout look like they lost their last dollar, and they just the players knew that after a fight that's taken about one hundred and fifty nine games that they were done and that something

spectacular has to occur. But this team has been so resilient. Maybe the least likely event will happen, which is tonight, two teams are playing, the Marlins and the Cubs are playing The Cubs are in Milwaukee, and the Marlins are playing in the Mets, and if both those teams lose tonight, the Reds would be one game behind, and that would mean in Saint Louis

they're going to keep playing consequential games. Now, how hard will Milwaukee play against Chicago when they're in and they got to rest their pictures for Tuesday, Wednesday and Thursday. I don't know, but the Brewers want to beat the Cubs, So we'll see what happens tonight. If tonight both teams win, or one of the two teams win, then the Reds would be two games back with three to play, and that means they can't lose a game in

Saint Louis, which is possible but unlikely. But they have among the best records in baseball when it comes to winning away games, so it isn't over yet. If somebody had told you to start the season way back on March thirtieth that the Red Legs as we approach October first, would still mathematically be in it. Nobody would have believed it. They have done much better than teams that have spent two and three hundred million dollars more in payroll, and

the future, unlike in years past, is bright. So we'll see what happens tonight with those two games, and then certainly there's a possibility. USA today today said there's a three percent chance the Reds make the playoffs three percent, So it's possible mathematically. And so we look forward to both teams losing tonight, the Marlins and the Cubs, and the Reds are one game back with three to go, then anything can happen. Secondly, you heard Rob

Sanders. I love lawyering. I love what we lawyers have done. The great William Shakespeare had written that for a evil to triumph, first, let's kill all the lawyers, because we lawyers are the guardians. We lawyers are the differential between chaos and law and order one properly operating. I have great respect for Dinsmore. Densmore and schul have done legal work for me and for most individuals in the Tri State it's four or five hundred dollars an hour,

but it's done well. They develop a strategy a few years back of keeping Joseph Eubank out of adult prison. They struck a deal. They sued repeatedly juvenile court, and they sued the state of Kentucky and Lexington Slash, Louisville Slash, the capital of Kentucky. And as a consequence, what they did was keep this case pending for a long time and they would have been successful.

And finally, after all that's been done, now the Joseph Ubank, who was an admitted serial rapist who began raping girls, according to the prosecutor Rob Sanders, in the eighth grade, six came forward. But there's fears there's many more. It is difficult for a teenage girl who's thirteen, fourteen, fifteen, sixteen, seventeen years old to come forward to police and prosecutors

and talk about the violation of her body by a serial rapists. But six brave young women girls came forward with the support of their parents and told the story. So he pleads out. It's a twenty five year admitted sentence. He agreed to the sentence, and away we go. But they've kept him in kitty court, in kitty jail with a lot of furloughs for the last four years, and so now he's going to end up in adult prison at least for the next four and a half or five years. And at that

point we'll see what happens. But at least it'll get these victims into their twenties so that they'll have more worldly attitudes and maybe not be as damaged as they were at the age of fifteen and sixteen. So congratulations to Rob Sanders, also to Judge malloy, and she issued her order I think a day or two ago, and tonight or tomorrow he'll finally be transferred to an adult prison and he'll be twenty one years old serving a sentence. So that's I

think that's a good thing. And secondly, the debate lasts not had some friends of mine send me some emails in Texas what anything about the debate. I tried not to watch because I always think of Charles Crownhammer's book Things that Matter. Last night debate was in the category of things that don't matter. None of them are going to be the nominee of the Republican Party. None of them has a chance of winning because they're not going to be the nominee.

We all know it's going to be Donald Trump. No matter what else goes on. He will not be barred from taking office or barred from running because the Constitution doesn't say he would be barred. And as a result, he's going to be the nominee of the Republican Party. Come hell or high

water, it should be absolutely Donald Trump. And now to my left, the impeachment inquiry is underway with the Republicans and Democrats completely on different pages because everyone knows that he's not going to be impeached and he's not going to be removed from office because the Democrats don't want Kamala Harris to take over, the Republicans don't want her to take over. Nobody wants her to be the president. So this is a kabuki dance in which the outcome is known and how

to get there is for theater purposes. What happened last night with the Republican debate didn't matter. I thought Nicki Haley did find vivek Ramaswami. I like that guy. But what difference does it make? Because Donald Trump is going to be the nominee of the Republican Party, despite the efforts of the Democrats to keep it from occurring. I could not imagine anything worse as a threat to democracy or political interference in an election than one party indicting the leadership of

the other party during the campaign. Sea when if these were serious matters, they could have done this about two years ago, in the summer of twenty twenty one. All these actions have been completed, except the Marlago piece, and could have been indicted then, and then the trials would have taken place about a year ago. We'd be well down the road. But that's not what the Democrats wanted. They wanted to smear Donald Trump and politically interfere in

the election without consequence. So that's why it's all a farce. What's happening with the Donald. Why not let us decide as Americans who would have voted for And I think Donald Trump has problems getting elected much as sitting in office. He didn't receive enough votes to win the four or five states legally to maintain the presidency. And now the Democrats know in their heart of hearts that Joe Biden will be the nominee as long as he's breathing and not falling down.

The next time he falls down or does something really stupid, maybe the mainstream media would cover it, which make it look even worse for the Democratic judgment putting up someone who's not doing the job as president. He's not doing the job as president any more than John Fetterman or Diane Feinstein are doing jobs. As in the US Senate, everyone knows they can't function. I don't

think Mitch McConnell should be in office. I mean that guy phrases up and obviously has some mental difficulties, not to the extent of the other three, which is Biden, Fetterman in Finstein. But nonetheless, you would think the Republicans in the Senate would find somebody more mentally alert than Mitch McConnell. But they haven't. And so all that's happening is one in the category of things that don't matter, because as long as Joe Biden is upright controlled by Barak

Husaint Obama. And make no mistake about this, everyone in the Biden administration worked for Barack Husain Obama, and so he's the puppeteer behind the scenes controlling the executive branch of government. Anyway, including Joe Biden and the only fear I have and a Rocky Boyman mentioned this yesterday that if Michelle Obama, the media just their eyes glaze over and roll back on their head like a great white shark eating a tuna. If Michelle Obama would announce the new it's over,

she'll get sixty percent of the vote. Suburban eights go nuts. She's accomplished little or nothing in her life, But nonetheless, the media just loves Michelle Obama. I remember a scene from the Tennis US Open and Flushing Meadow when they kept under wraps that Michelle Obama was going to read a little speech about fifty years of equal pay and how honored everyone was just to see Michelle

Obama on a tennis court, and they just fell down in adoration. So the suburban eights go nuts about the Obamas, who accomplished so little and damaged the country in serious ways. But nonetheless, if she announces then it's over, then we're gonna have I don't know, twelve to sixteen years of Obama rule. We had the eight years he was in office, then we have the four years with Biden, and now we're gonna have four to eight with

Michelle, in which case the country on the southern border cannot survive. I have a guest coming up, Christian Malinsky later, who talks about the number of real coming over the next ten years, about about ten million a year over ten years would be one hundred million more people. One hundred million more are going to flood it in this country due to the policies of the Democratic Party being a sanctuary city, sanctuary state, sanctuary nation. One hundred million

coming. Currently, we have about forty to fifty million living in this country who were not born in America, and America is an immigrant nation. We admit legally about one million a year. We admit illegally something like five to seven million, with many more coming. So God knows what's going to happen,

but it's gonna be very difficult. Donald Trump. I would love for Donald Trump to be re elected president, but he didn't win the presidency while the president, and since then, the Democrats have worked actively to destroy his candidacy by indicting him on ninety one counts and now in New York City, New York State, the Attorney General is about to seize the financial assets of Donald Trump and his family and disperse them after sale the proceeds to the State

of New York. They're going to destroy him in every means necessary, which

is disgusting. Imagine you have a business and Donald Trump is a small business owner that you've built over about a forty to fifty year period, and the State of New York without a victim, no bank, has said he didn't pay us back, without a victim, steps forward with democratic judges appointed by democratic governors and a democratic state and says we're going to seize the businesses of the Republican nominee for president, so he has no money to rely upon on

his own part to run for the presidency. And by the way, let's indict him and lock him up as quickly as possible because the American people may want to select him as the president. Are you kidding me? No, I'm not. That's what's going on as our cities largely collapse. Story in the New York Times, Major retailers announce hundreds of new store closures due to mounting crime in American cities. Did you see what happened in Philadelphia the last

two nights. Now, small store owners are out of business, inventory of stolen McDonald's and Whole Foods and Nordstrom's and foot Locker and Target and CBS, Walgreens and Starbucks and Kroger are all shutting stores and our magnificent major American cities because of massive lawlessness, and employees don't want to go to work because they're being robbed and beaten, and the stores are losing millions of dollars every year

that they're open. And so once again Philadelphia is going to be affected by dozens of store closures, so that not just a food desert, it'll be a retail shopping desert and all basically every American city. And it has nothing to do with race or class structure. It has a lot to do with the fact that employees in these stores are not safe and that inventory you cannot ensure against loss because the premiums would be confiscatory. In the case the cvs,

they're going to shut down in major cities, nine hundred pharmacies. Walgreens is shutting down seventy to one hundred major stores and major American cities over the next year because they can't afford to operate. Fortunately, in Cincinnati, the downtown in Cincinnati is functioning and many stores have shut down because it's hard to park. Crime is rampant. Cincinnati has a lot of crime compared to the surrounding areas. And fortunately we have a functional police and sheriff's office, and

we have a functional prosecutor's office. Melissa Powers, imagine if we didn't have a functional police department and a functional sheriff's office in a jail and a functional prosecutor's office, where we would be, well, we look like Philadelphia's, Chicago look like New York, which used to be a great American city. Monuments to American capitalism were the great, magnificent downtown areas. That is a kid, I would go down to the Times movie theater. It was a

big deal to go downtown. But Tula Clarks sang about it, it was wonderful. Now, whether it's the top twenty American cities, the city of Cincinnati's about thirty fifth on the list. No one goes downtown because it is Dane Duriss and employees don't want to work there, which means magnificent retail and marketing centers are going to shut down because of the policies of the Democratic Party. And guess what Cincinnati if we don't watch ourselves are going to follow other

major American cities, including Austin, Texas, for example. Read the stories out of Austin. What's happening there? It is disgusting. The schools cannot be attended, the jails are packed, police have there been castrated. Liberal judges are elected, freeing murderers, and massive lawlessness and looting occurs on an industrial level, which makes living in many American cities impossible. Let's continue with

Of course, in Tennessee it's the Bengals, and we pray to God the Bengals begin to stretch because the next three games and Nashville's should not be that difficult. Allen Junior. Several legal issues are percolating. A couple of days ago, Judge Magan Shanahan ruled that that A. D Deshaun Brown was and was sane

enough to stay in trial and the murder of Nilo and Natitia Lattimore. This is the case where the mother seemingly was stabbed on the Purple People Bridge and her body was taken back to her own apartment, and at the same time Nido, the little boy, was in a stroller, And it appears that defended Deshan Brown killed a woman and then kills the child who was not his child, but she was pregnant allegedly with Deshaun Brown's child who had then she

had a miscarriage that may have triggered something. Joining You and I Now is Mike Allen Junior and Mike Allen Junior First of all, for those who may not recall the facts of this case that began in December fIF twenty twenty, tell us what happened with the facts. Well, Bill, it's Cincinnati police say that on December fifth, twenty twenty, mister Brown killed Nititia Lattimore.

He actually obtained a body bag, apparently from eBay. He left the body in her apartment for about five days, then subsequently tried to dispose of that body, and sometime in between there at that time, and I guess a few days later, apparently took to her young child, Nilo, and disposed of him in the river. While apparently this child was still alive. Apparently a security guard found the body of Nititia Latimore in a body bag down there. I think it was down near Sawyer Point. But Bill, I can't

think of a case in recent memory as heartbreaking as this one's. It's awful, it's terrible, and yeah, the allegation here by Deshaun Brown's lawyers is that number one, he's mentally ill. Serious mental problem is a bipolar disorder, but that necessarily would not render him not guilty of a reason of insanity.

Kind of described to the American people, what is the standard on an n GRI well, essentially, Willy an NGRI, the standard would be that the defendant did not know the wrongfulness of his actions due to the severe mental disease or defect. Whereas what the attorneys in this case, mister mister Brown's attorneys are trying to do is they're saying, well, yeah, he may

he may be you know, not eligible for an n GRII ruling. However, and it's a recent law how spill one thirty six from January that is now saying essentially that it allows for a person who doesn't meet the criteria of a not guilty by reason of insanity or incompetency, it gives them another mechanism to challenge their eligibility for the death penalty. Now, what that law says essentially is if somebody qualifies as what they call a serious mental illness and that

those are including schizophrenias, getso effective disorder by polar delusional disorder. Now mister Brown's attorney saying he suffers from bipolar disorder. The issue here is is that the House Bill one thirty six law, which is I think it's RC twenty nine nine two five, that's a lower standard than the n GRI I think. So essentially, n GRI is I didn't know the wrongfulness of my actions

due to this severe mental disease or defect. This new law specific to the death penalty is a significant impairment essentially, So it's a lower burden, and it's basically saying that that mental illness at the time of the offense impaired their judgment, rather than they didn't even know the wrongfulness of their actions. So

it's it's a lower standard. The defendant's got to show by a preponderance of the evidence that he's been a diagnosed with one of those disorders and be that second part, which is essentially that their judgment was impaired because of that disorder. Well, at this point, the judge, Megan Shanahan has ruled that even though he had a mental illness, he could stand trial. Let the jury decide. And your father would know a lot more about this than many

others because he was the prosecutor. But no one can recall a time in Hamlet and County when a jury has found someone not guilty by reason of insanity. It's probably happened once or twice in the past fifty years, So why is it so difficult for a jury to accept us to accept an NGRI. Is that is that what you're asking? Yeah, truly, I think it's it's they're not you know, they're not equipped to really understand that unless you've got a jury you know, full of psychologists. You know, they're not

able to die. And what I can't say is this bill is even even before getting into a jury, you know, whether it's competency, whether it's n GRI or anything that has to do with sort of you know, a mental disease or defect playing a role in the commission of a crime. Those

are very difficult things to prove somebody. You know, I've had clients where it's like, this person is affected by you know, X, Y and Z disease or defect, they have bipolar, they have schizophrenia, but if they're able to comprehend the wrongfulness of what they're doing on on top of as far as a competency thing goes, it's not just is this person, you know, suffering from a mental illness, it's do they understand what's going on

in the courtroom. So it's an unbelievably high burden to me, and in this case, Uh, you'd have to assume that de Sean Brown knew what he was doing. He used a knife to kill this woman, so he had to grab the knife, had a director toward her body, stabbed her repeatedly. He then wanted to secrete evidence of his crime by getting a body bag delivered and then putting her in the body bag, taking her down to

the river where it was finally left. But these are all mental processes that were formed on such a way to show that he could conform his behavior to reasonable acts. Absolutely, Bill, and I think that's that's part and parcel. You know why why this is a defenalty case, because you know he just again you and I talked about this. I can't remember a case with more disgusting and devastating facts like this one. On top of the substantial steps

that he took to carry out these murders. This was This was not a fly off the handle thing. This was not I'm hearing voices where somebody was schizophrenia or something like that. This was a planned, premeditated murder, which

is which is why he's facing the death penalty right now. And the police may speculate that she had suffered a miscarriage seemingly of Deshan Brown's child that may have triggered this rage that resulted, and and and the murder of Natitia and also Nilo, and the most sad all it is sad, but to have a little little baby like Nilo and a baby stroller and Joe Dieters at the

time thought the baby was thrown into the Ohio River. And I know Search and Rescue went through the days and days and days of trying to locate their remains and failed to do so right right, And like I said, I just it. You know, anybody who's in the criminal justice system, we don't really deal with with the most uplifting fact a lot of the times. But I, like I said, I just I cannot imagine a more nightmare scenario, especially for the police officers that had had to deal with this.

But the death penalties there for a reason, and it's for cases like this. A couple of months ago, on July fifteen, twenty twenty three, Ched Dorman and Claremont County lined up as three little boys Clayton who was seven, Hunter who was four, Chase Dorman who was three, and killed them with a rifle execution style and previous to that horrible mass murder, there was

no medical medical slash mental defect that Ched Dorman had. Some have testified he acted in a peculiar fashion at times, but I would assume he'd be subject. Does this new law helped ched dormant at all or hurt him? So, to be honest with you, Bill, I'm not as familiar with that

case. What I can say though, is is if there is that diagnos if you get that diagnosis and that you can show that that's severely impaired your your ability to essentially, you know, determine right from wrong, or if if it played a role, yes, And that's the thing builds is you

know, it's sort of built into these death penalty cases. Is you know, I think a lot of people's logic is for anybody to do something like that, they'd have to be totally out of their mind, you know what I mean, for anybody to hurt a five year old like that, to murder the potential mother of your child, you know, all that kind of stuff, you'd have to be out of your mind, so to speak.

But again, it's that's not the standard. The standard is is are you was your judgment or ability to to to realize the wrongfulness of your actions significantly impaired by one of those four or five you know, diseases or defects. So I would imagine in a death penalty case, any death penalty case, any defense attorney is going to raise every single issue humanly possible, which is again, it's it's a lot of times why death penalty cases takes so long.

Yeah, And I had a lawmaker about a week or two weeks could Representative Jeanie Schmidt that talks about eliminating the death penalty because number one, it takes forever to execute anybody. Number two, during their DeWine years, no one has been executed because of problems getting the right drugs, as if a

load of fentnel wouldn't be good enough. And the other thing is and I think that's a good argument that it's it's worse to spend the rest of your life in prison without possibility of parole than it is to go to sleep and not wake up. Yeah. Yeah, and you know that's getting up every day in an eight by eight cell. I mean, I got to be honest, if I had the cholice, I'd say give me the needle. But but yeah, I mean it. This is the death penalty exists for

a reason. In the two cases that you're talking about. I just I cannot think of facts that would would would would warrant the death penalty more than than the dormant case. And this this Seawan Brown's case now, and it is up to ries to decide those things. And when juries are shown, the pictures and this is the way Nilo Lattimore that this is a picture of Clayton and Hunter and Chase and it is so awful and so terrible that the

person that did that should forfeit their life. The difficulty is, as you know, is how it takes fifteen to twenty to thirty years, and the millions of extra dollars that are being spent, and the fact that being in a concrete cell until you die, I think is a worse punishment than being executed by simply going to sleep and not waking up. But I do, and Mike Allen Junior, I don't know what to say, but these are

difficult cases. But if we had a death penalty that was functional so that in one to two to three years after the event, all the appeals were heard, and that's it. I'd be in favor, but this is not. It doesn't work that way, absolutely, And that's the thing, Bills, when you look at you know, the main policy behind the death penalty one of you know, two of the main things are deterrence and and punishment,

and you stop and think about it. Well, anybody who's going to go out and commit heinous murders like this that you know they're not thinking, Oh, I might get the needle if I know this, And as far as punishment goes, again, if I had the choice, give me the needle rather than the eight by eight concrete cell. You know, all you do is go to sleep and don't wake up and hopefully in hell when that does happen. All right, Mike Allen Junior, we gotta run, but

thanks for your input on this. We'll see what happens in both cases. But they're awful. But to get a successful and not guilty by reason of insanity, damn near impossible, be goes. Jurors don't buy it. And if you engage in cognitive behavior that makes sense to a sick mind, before, during, and after the fact, it's pretty hard to say. At some point in the process when I was killing Clayton Hunter and Chase Dorman or de Sean Brown. As I was killing Nilo and Natitia, I kind of

didn't. I couldn't conform my behavior to the law. I did know the difference between right and wrong, especially when you secrete yourself and you secrete the body. That demonstrates some men to process without question. It demonstrates intent, It demonstrates calculation, and it just it all shows that this was a premeditated double homicide. YEPA. The numbers are beyond unbelievable, But first we must describe the problem before we can seek solutions. Chris Schamlenski has been with numbers USA for a long time. It's a great website when it comes to discovering what is happening at the southern border. And Chris

Schmalinski, welcome again to the Bill Cunningham Show. As we get started, can you describe to the American people, just generally speaking, the scope of the problem on the southern border and to a lesser extent on the northern border. Yeah, well, it's probably a lot of folks have seen the images on their TV screens or across social media, so they probably have a good

idea, but just to tap some numbers to it. And in August, the administration reported that it made four thousands encounters of unauthorized migrants, in other words, illegal aliens trying to enter the United States, whether crossing the border illegally or coming through ports of entry. That's a record. We haven't seen

that number. We haven't seen a number that high. And the scary thing about this is that we did see a temporary dip in the numbers in late mayor early June after the administration wind down type of forty two, but it's ramps back up to these record level numbers. And what it just you is that in all likelihood, the drug cartels are really kind of orchestrating everything that's happening down They're probably sat back to wait and see exactly what the new administration's

policies were going to be. And once they saw that the US was still going to welcome people into the country illegally with open they started to lamp back up the numbers again. So that's the situation work currently in and Chris, you talk about a big business. It appears according to HHS, the drug cartel, Sinaloa and others make about a something the range of a billion dollars a month from their activities. It's either three thousand, five thousand, or

ten thousand per person. If a mother comes across with three children, one must be turned over to the drug cartel for human trafficking and get the other two inn You can walk up to border patrol entry site and register in a sense, claim the magical words needing political refugee status or go in between.

Even if they are successful in getting some

anything meaningful through the Senate. Uh, and then you could always risk a Vito from from President Biden. So unfortunately, I hate to take the pair of that US. But I don't think things are really going to change until we have a new administration in the White House. on their southern border, there's nothing to stop one hundred million. And so if in ten years from now, I would have Chris Shemalinsky on and this continues in the range of ten million a year coming into this country, and we have one hundred million more on top of the twenty to thirty million already here. Can you give us some prediction what America looks like then with an additional one hundred million people for the schools and the hospitals and the roads and

the bridges and the usage. Can you tell me what America looks like with one hundred million more coming into this country over the next ten years. It would be devastating for the United States. But I would think that if we start to see quantity it's about five I think something would change at that point in time. I think you're starting to see Democrats, especially in Pulling, they're starting they're starting to move a little bit on this illegal immigration issue.

You know, for the Mars part say, they seem to jump onto the company line that Democrats have impreshments for such a long time, that we need comprehensive immigration reform, which usually means amnesty for everybody hears illegally, and then just pretty much expand legal immigration to a point where nobody would have to come illegally anymore because there will be green cards for everybody who wants to come.

So that's that's sort of been the company line for the Democrats. But you're starting to see voters, we're starting to see that in the Pulling that voters are starting to shift, and I think you know, some of these national polls from you know, Washington Post, ABC News finding that Trump has nine point lead over Biden, and a large part of it is one because of

inflation, but number two because of immigration. If the Biden administration believes said it will be impossible for them to win in twenty twenty four unless they make a change in their border policies. You know they're not going to change, but I think we could get to a point where it's just that the numbers are so devastating for Biden that if he wants to continue to be an office and remain in power, he's going to have to stop the flow, which

he can. He can do a couple of things that will immediately turn off the flow of Billy commigration into the country. Let me write them down. Give me one, two, and maybe three. If Chris Simlinsky's the potus and you see what's happening, the rapes, the robberies, the kidnappings, the drug importation, the destruction of the rule of law, schools filling up with their legals. You have hospitals, et cetera, jobs, etc. It's awful. Give me the one two and three of numbers USA to stop

this. If you're if you're Biden, what do you do now? Yeah, I think number one has to be remained in Mexico. We saw the Trump administration do that. They came up with the concept, it worked successfully. It was in place for the first month or two under the Biden administration

before they rolled it back. And essentially what that would do is anybody who tries to enter the United States, instead of the administration catching them releasing them into the United States with instructions to report to an ICE office or to appear before an immigration judge, it would make them wait in Mexico until that court date appeared. So that's powerful. What that's doing is that's telling them you're not going to get to stay in the United States if you cross the border

illegally, because that's the message. Now, if you cross illegally, we're going to catch you, We're going to get your name and information, then we're going to release you into the United States. So I think that's the number one thing that has to happen. Number two, I think we have to strengthen our our asylum, our asylum laws here that the asylum law is

actually strong and appropriate. The problem is is the credible fear standard that needs to be met in order to enter into asylum is way below the actual asylum standard. So we have a number of people that are entering in asylum claims who aren't actually going to be able to receive asylum because they don't qualify. Third, I think we have to end this administrative abuse of parole. What the Bide administration is doing is they're catching people and then they're parolling them into

the United States. They're allowing them, they're protecting them from the deportation, and they're giving them work permits and allowing them to stay and work here in the United States. That's way beyond the scope of parole that Congress approved for the administration to use, at least in my opinion, So I think you

need to end that abuse. Lastly, I'm going to give you a fourth mandatory verify because eventually, we've got a lot of people in the country illegally already, and a lot of people who have come in over the last thirty months. Some of them have work permits, some of them don't. Eventually they're going to those work permits are going to expire. E verify as a tool that ensures that employers new hires are authorized to work in the United States.

If you have that in case, once they're work permits expire, they're no longer going to be able to hold a job here in the US. What about the issue of declaring war on the drug cartels and tell Mexico that that's a Claire and press and danger to the survivability of this country. The fentanel crisis. The ingredients are brooding communist right China then ship to Sinan Looa

and they brought across the southern border. What about the issue of I hear Holly and CRUs and others talk about declaring war on the Sinaloa drug cartels, et cetera, and to put them out of business militarily. What about that? I think that's certainly an option. But I also believe that you know, if you the cartels have shifted so much of their activity now to humans

monthly because they're making so much money off of it. If the US takes that away from them, it takes that that's herty of business away from them. So they can't make money on monthling people in the US anymore because they're not going to allow people to edge for the country illegally, then the cartels

will probably go back to drug running. But you've freed up order control to try to apprehend them, so we can pull our defenses to stop it coming across the border illegally are strengthened if you do that, So you may not need to take that extreme step of going to war with the drug cartels if you simply stop the people from coming in. But yeah, something have to be done with the cartels down there and the dangerous drugs that are coming into

the country. You know, I think it's both a domestic policy issue. I think we've got to deal with it internally, get people to stop using these dangerous drugs. At the same time, we've got to deal with the source. And there's a number of different ways that you can go about it. But I think the number one thing you do stop the flow of illegal migration in the United States, and that cuts off a huge revenue stream for

them. And of course the big thing is to remain in Mexico because a person who has a credible claim for a political asylum has probably gone through a few countries before they get to this one. And the Trumpster said, well, if that's the case, you must apply in Mexico or you must apply in Nicaragua before you come here, and you can't apply in this country and then wait for your hearing day two to ten years from now. And that

policy by itself to have a significant impact. But what are the odds of the liberal socialistic Democrats, which is really Barak who Saint Obama is the president behind the curtain, it's not Joe Biden.
