Hi, Billy Cunningham, the great American. Of course, this Thursday afternoon at the final day of the RNC, many say it was the greatest RNC of all time. And then waiting for tonight for the political messiah Donald J. Trump to appear on stage in bandages having survived in the assassination attempt,
loud Proud and Sassine. Of course, Governor Mike DeWine's been there. The first convention he attended was eighteen sixty with Abraham Lincoln, which is a very important one from Springfield, Illinois. And Governor Mike Dwine Welcome again to the Bill Cunningham Show. I'm sure you've been to dozens and dozens of these conventions. How would you rate this one compared to the other ones that you've attended.
Yeah, Bill, our first convention the frand I went to. I was in the United States Congress and it was Reagan's second second convention, nineteen eighty four, so it was you know, we've seen a lot of conventions. I would say that, you know, this is a very unified party that's come out of this convention. I think the fact that you know, the president President Trump had Nicky Cayley there had a lot of the other people who ran against him in the primaries. You know, he invited them to
speak. They came and spoke, and everybody just had a good, I think, a unified feeling about this this election. So that to me is the biggest theme to really come out of this. I think. The other thing, of course, is, you know, this convention started literally, you know, right after the attempt at assassination with the president. So we've
never seen, you know, anything quite quite like that before. Well, I have coming up later in one of the head of the Secret Service agencies a few years back, and more and more is coming out about this assassination attempt. This morning, I try to watch everything, especially MSNBC, so you don't have to. And even though you appear on MSNBC, I thought last by a mistake. I'm thinking, what the hell I watched Donald Trump Junior say, you're not a real news media organization. I don't talk to
clowns like you. I thought, But you're a kindly gentleman from Cedarville. And the thing that's come out and you've been an attorney general, you've been you have secret Service detail called the Highway Patrol in the state of Ohio. You've been a prosecutor for a long time. You've seen it all and done
it all. Could you have imagined that the Secret Service would be the management of the Secret Service, not the rank and file, would be so inept that they knew the Iranians were planning to kill Donald Trump because of what he did. Is Suleimani. That they knew ahead of time there was a security
breach with this guy walking around the building. They had the unguarded building about five hundred feet away, which is like a two foot putt, And they knew as Donald Trump took the stage that there was a major security breach, and they led him to take the stage. And sadly today this morning was the funeral of that fire chief and it was I watched some of it on YouTube and it was so sad to watch his family and watch his children, and to have his friends and what we miss and all this the death of
a fireman who was simply there to support Donald Trump. And could you have imagined, and you spent twelve years in the Nur States Senate, could you have imagined a security breach of this consequence and this ineptitude? No, it's it is shocking. You know, I think this investigation has to move forward very quickly. You know, how in the world that rooftok was not covered?
I can I can't conceive of how that that happened. You know, Bill, You've been to many rallies, and I've been to a number of rallies over the years with Donald Trump but with other people as well, presidential candidates, and you know, you look around and the security is always very very tight. You look on rooftops and you see that those are in fact covered. You know, when the Secret Service comes in, you know,
the first thing they days in advance is to go into those businesses. Uh. You know, they secure access to the roof they do all the things that you would expect them to do, and they're very very very good. So I don't know what happened, but there's got to be seriously some reckoning here. H And you know, something like this can just not not happening again. Again. It's just hard for me to understand. You know, these people are very good, they do this every day. They know what
they're doing. But this is clearly a major major security breach of of horrible magnitude. And yes, you know, we we are so happy that the president, you know it is alive and that was just a matter of an inch er who knows how much. But as you point out, you know one person killed too, seriously injured. Just a horrible, horrible tragedy. People who go to those rallies, you know, they take their family,
they take their kids. You think also about the people who were not kids, were not shot, but you know they had their kids with them, and for the rest of the life those kids will remember that and not a good thing to remember. If you put together four or five years ago a list of Ohio politicians that would be the vice President of the United States in twenty twenty four, four or five years ago, jd Vance would not have been in the top fifty four or five years ago. Are you shocked and
amazed? I think Ohio is the breeding ground some pretty damn good politicians and the bench is deep just in the state of Ohio. How is it possible that a politician that I would say, three or four years ago you never heard of named jd. Vance out of a dysfunctional family in Middletown called Tony Bender calls it Middle Tucky. I don't show it that kind of disrespect. It's Middletown, Kentucky. What would be a heartbeat away from the presidency.
How shocking is the arrival of Jdvans on the scene when it was completely unknown, say four years ago, Mike de Wine probably never heard of the guy. Well, yeah, Bill, you're absolutely right. I mean, if you think about it, you know, I first knew about him when I read his book right after it came out. I think I read a book review of it and said, hey, that'd be an interesting book. I
got the book. I read it absolutely fascinating. So what I did is I called him up, and you know, I wanted to meet him because it was just a fascinating book about his growing up and have some I think, some real insights into some of the problems that we have, some of the drug problems that we have in our society. And so fran I have gotten to you know, gotten to know him. We had JD and Usha over to the house of the Governor's residence for dinner one night and just you
know, got to know both of them very well. But you're right, if you go back, uh, you know, I know you're not a betting man, but if you'd gone on you know, the early morning the line you know, even two years ago about who might be on on the ticket? Uh, you know, you could have made a fortune if if even if anybody was taking a bat, anybody would have even taken a bat, his name might have not even been listed. Bill Cunningham would be rich today. Now we are rich, I know that, Bill, you know,
but you'd even be rich. Let's put it that way. Why And let me ask you, because you're a you've spent your life in politics, maybe as long as Joe Biden. Uh. In fact, uh, JD is only thirty nine years old. What is it about JD. Vance that has caused him to leap frog hundreds or thousands of other office holders and politicians to get what is it about him? Well? I suppose that there'll be books written about this, and when they recount the presidential campaign, this will
be a major major section in the book. You know, if he quite used to have the series of making of the President started in nineteen sixty and whatever the newest version of that, he's long gone. But whatever the newest version of that will have a whole chapter or two chapters on JD. Vance. Look, you're you're absolutely right. I think you've got a couple of things. You know, First of all, he was able to win win a highly contested primary. I don't think there's any doubt that the main reason
he won was that Donald Trump did in fact endorse him. And you know that he was elected to the US Senate. Been in the United States Senate for for a little bit. But if you look at back the last two three four months on the cable talk shows on sometimes on network, you know, the person who's been probably the most most articulate in defending the Trump agenda has been JD. Advance. You know, he puts a very he's just
very, very eloquent. He understands it and explains it exceedingly well. So my guess is that you know, I don't know what all went into the President's mind, uh, President Trump's mind, but I think having someone with that life story, uh, someone who the president has gotten to know. Obviously the President likes him personally. Uh, but some of this in politics,
bills, you know, is personal. You know, it's we take that for granted sometimes, but a lot of life is personal and personal relationships. But I think also that he looked at him as someone who's from the Midwest. If you look at the battleground where the battleground is, it's not going to be in Ohio. Uh So it doesn't help him, really hear that much. It helps, but he's going to win any way. But you know, if you look at the other battleground states, whether it's Pennsylvania
or Michigan, there these are Midwestern states. Jd Vance's story I think resonates with people. So a lot of different things coming together. I mean, what what, what what do you think? I met him seven eight years ago. I got a call from the Butler County GOP and they said they had a Lincoln Reagan Day dinner and that they wanted jd Vance from Butler County to be the keynote speaker. And he didn't want to speak, and he said, I don't feel well doing that in front of a crowd. Could
you get Cunningham to come here and interview me about my book? We go back and forth. So I get a call whoever was in charge of that point. It might have been Dixon, I'm not sure who was in charge. It wasn't Jones, it was somebody else. And he called me and I said, you know, I've heard about this book, and then I talked to JD and then I put him on about the book, and then
I went to interview him and we about two three hundred people. It's a nice facility there in Fairfield, and back and forth about the book, develop relationships. Met him at five guys and nor would there a couple of times get burgers with the kids and uh, And he wasn't. He didn't want to speak in public. So I reflected on that conversation last night here you got ten million people watching the hall is just you know, I don't know how many twenty thousand people. And I said, he's come a long way.
And because you know, you and I maybe not Tony Bender, because we're kind of geniuses ourselves that we when I'm with someone that I say, you know what, that guy's really smart. You can't have a conversation with ady Vance not coming away with those pale blue eyes looking at you, thinking this guy Sumac c come loud from Yale. He went to Cambridge for a degree in philosophy. And then he and I'm thinking, this guy's really smart.
And I said, he can't get into politics. He's smart and he doesn't have that you know that conversational and the last eight years my god, and now you get him on and he's slicky, knows what he's talking about. I want to talk about something else. I know. The political answer is going to be, well, you know, Willie, you we're gonna have to you have a failings of individuals chewing on your ear. You have the power to appoint the next US Senator, assuming the ticket is successful.
To remember fifth and some of the names. Franklerosa is interested for ak Ramaswami, a classmate of JD. You're going to be chewed on. May you take the approach as the California governor did, which was there was three or four really qualified Senate candidates from a California perspective to take over the seat, and he appointed a placeholder until until the until the election or until a primary so that people can vote on one category, is you can ordain Frank Lerosa
avank Ramaswami. I don't know. John Eusta just named the name. On the other hand, you could do a placeholder and let the people decide who the next senator to be. What is your thinking in each category without telling me the conversational answer, Well, Bill, you know, we don't know yet. Can you just tell me you're thinking in those two categories. Sure, My thinking is that I would not do that. I would not put
a placeholder in. You know, I suppose there's a possibility some circumstances may come up I would do that, But you know, look, the person that I would appoint. Here's the way it's going to work for our listeners. Assuming that Trump and JD. Vance are elected. Obviously Vance will have to resign from the US Senate. When he resigns, then the law says that I will appoint his successor, and that person will be in office basically
for two years, and then they go. They will have to be on the ballot again in twenty twenty six in a primary, and then in the general election. That person who's elected in twenty twenty six will only serve two years. They don't have to run. If it's the same person, they're going to have to run again in twenty twenty eight. So the Senate still operates on some level of seniority. Seniority is important. Having someone who has committed to go to the United States Senate to stay there, you know,
for a significant period of time, I think is important. Any United States Senator. The day they walk in they're important, they have the ability to do things. But the longer they're there, frankly, they're committed. Assignments get better, they move up, they get the opportunity to be a subcommittee chairman and then committee chairman. All of these things are important to Ohio.
I look at this from Ohiles point of view. Who do we want that can represent us and you know, be are our person there and be helpful to the state of Ohio. So what I'm taking Bill is I should appoint someone who really commits and says, yes, I'm not only going to serve two years, I'm going to start running and try to try to get re elected and then try to get elected again, and and and sir, second, we need to have someone I think who fits kind of my understanding of
what a United States Senator should do and should be. One of the things you saw about JD. Vance that has not been talked much about. He has tried to put coalitions together and get things done. You know, I want a senator who's going to go there and be a workhorse, not a showhorse. I want someone who's going to go there maybe be a showhorse, too, but I want mostly to be a workforce and someone who's focused on has an agenda, conservative agenda and says this is where I want to go
there and get accomplished, and then work to get those things accomplished. That's to me, that's the main thing. They've also got to be able to win a primary, and they've got to be able to win a general election. Then they've got to be able to go back and do it again in two years later. Yeah, got to run, run and run now. Secondly, as you know, because you hold the job, that there's two or three stalwarts wanting to take your position when you leave, which are John
Houstead and David Yost and god knows maybe two or three others. I'm not sure. Have you considered endorsing in the gubernatorial primary next year, Well, there hasn't anybody announced that they're running. Yes, that's a little premature, but I think you know my relationship with John Houston. John Houston has been an excellent, excellent lieutenant governor. He's focused on technology, bringing trying to bring technology to government, technology to Ohio. He's someone who's really focused on
economic development. But it's really been my right hand person in just so many many areas. So he clearly is very very well prepared to be the next governor of the state of Ohio. Sounds like you're endorsing Houston. Lastly, about a minute, remaining public life is difficult. The odds is some kid from Cedarville, Ohio could have your career as almost impossible. The odds of jd vance heartbeat from the presidency impossible. With all the violence happening in America,
do you fear for your own life? No? No, you know, look I don't. This is something that you know when you get into a big crowd like you see at one of the rallies, then you think you know something. You look around, you think, well, something could in fact happen, and tragically, of course, it did just a few days ago with President Trump's rally. But no, I don't. All right, Governor Dwine, thank you, good luck tonight. We'll see what happens

And some of the stuff going on now is truly unbelievable. Number one, how do you tell Grandpa it's time to give you the car keys? And the speculation now, as yours truly have been saying now for months, is that Joe Biden will not be the nominee of the Democratic Party because he
can't hide this time as he hid in twenty twenty. He was permitted to hide in twenty twenty by the mainstream media using COVID as an excuse, but
he was only in a little bit better shape four years ago. And a week after week, month after month, year after year since then, Dave and others have put together cuts of Joe Biden speaking and stumbling, mumbling and fumbling, and it was called deep fakes, that Ai was involved, that the so called conservative legitimate media is not telling the truth about our vibrant president. And of course the biggest megaphone was mourning Joe. Joe Scarbage and Zeka
Brazenski, both of them have lost their minds. About a month ago they were talking about this is the best version of Joe Biden. Ever. He's more conversational, bright now than he was forty years ago. And I'm thinking, you know you, the American people have figured out that lies don't work and that the truth eventually, it may take four years to break through. He's no more mentally competent now than he was a year or two ago.
And how does he serve as president? If the speculation is right, as I predicted, he's going to leave the race, how does he service the president Tonight, tomorrow, the day after tomorrow, next week, next month. He's got almost five and a half months to go, and we have problems all over the world, and we don't have a we don't have a functioning presidency at all. And who's making the decision. We find out that
Joe Biden is making most of the decision for her husband. She's the one that's selected that this clown, this fool, Kimberly Cheatle to head up the Secret Service. That's one thing to have these genitelia and skin color requirements for certain positions, such as Secretary of Transportation Rocky Boyman's good friend from South Bend, Indiana, Pete Budajedge, But that can have deadly consequences too. Look at that incompetence. Same thing with appointing the Supreme Court Catanji Jackson. I
mean, that woman doesn't know what a woman is. And there were other If you wanted to pick a qualified African American female, you would judge Janis Rogers, who's black and competent. But she's of the wrong political party, so of course you had to pick a Democrat. And when it came time to pick a vice president that to serve with Joe Biden, he promised Cliburn of South Carolina and others. He was going to pick a black female,
which provides the Democratic Party lots of votes. So color and Genitelia trumped everything else. There are competent black females out there could have served, but none as radical as Kamala Harris. It's unbelievable. And I don't care. And when you come to the police Department, when you come to the Secret Service, when you come to us Marshall Service, when you come to those positions of life and death, I don't care if you're a black, white,
brown, or polka dot. Give me the most qualified person. No one could look at the resume a Kimally Cheatle who was guarding Quaker oats at the time when picked by Joe Biden to become the head of the Secret Service. She was the one in charge ultimately of the security of President Trump in Butler County, Pennsylvania. And now we know that the president came within a quarter of an inch half at an inch of losing the right side of his head.
Unbelievable, one might say, how did the gunman get that close? Well, he hid the AR fifteen previously. When you see the granny photos of him and video walking around the building where the shot was fired. From the shots. He didn't have the AR fifteen with him. It was hit previously. He planned this out. The Secret Service knew there were Iranian threats
to kill Donald Trump, which by the way, still exists. There's teams of assassins coming through the southern border because of Biden's policies that could easily find a circumstance to take a shot out and use militarized drones to kill Donald Trump. They knew that ahead of time. They also knew or should have known, that this murderer, this coward, had told friends, quote, I hate Trump, I really hate Trump. But the FBI now says, well,
we don't know what a motive is. How about a mentally ill, mentally sick guy who expressed feelings expressed I hate Trump, but the FBI, the Secret Service can't figure out a motive. The parents called nine one one a couple hours ahead of time, saying they're concerned for their son. There's not been reporting whether they were concerned because he was armed. But normally if you have a twenty year old son who's working, he worked in a nursing
home. Why did the parents call uh nine one one and say we're concerned about our son's safety. Unbelievable. And why was Trump allout on stage at all when the Secret Service had determined there was a security breach and a security threat because the snipers on the other buildings working may I use the term working
with us. The snipers working with us had them in their head, the murderer in their crossairs for several minutes before the shots were taken, and they were questioning whether or not, by the way, is he a friendly? Is he with us? Because Butler County, Pennsylvania, had seven cops out of a twenty one cop unit. Having cops were there to provide security. But when I watched the administrator, the county commissioner talk about moment, don't
blame us. Our role here was to provide traffic security. That's what we did well. We were directing cars. We weren't in charge of the presidential security. That'd be like the president of appearing in Butler County and Richard K. Jones is told you're in charge of presidential security, he would say, wait a minute, that's not our job. We don't do that here.
That's your job. And we find out now that I made notes of some of the some of the feelings about how come it was so little there, And we find out that the speculation and conspiracies right now are in overdrive because Secret Service resources were diverted from the rally with Trump to Joe Biden, who was appearing in Pittsburgh, and that Trump's normal detail had not had been so overworked that temp rare replacements had to come in, and that a lot of
the regular may I use secret Service agents with the Trump star and they loved that guy. They were diverted to Pittsburgh. The perimeter was not protected. Local cops are being used as scapegoats when they were there just to handle traffic matters, and it was known ahead of time, according to Christopher Ray, who gave a briefing dissenators yesterday, that there was a heightened security alert outside
because of the Iranian plots to kill Trump. And on top of all of that, when you look at the most impressive photo of all the agents, cannot fix being five foot five. Some of the agents were five foot five and female, and you can't grow them up to six foot three. The tall agent to the right of the president and male agent protecting him shows very little emotion, and the story is written that after Trump has hitded in the
suv. There's a small female agent who looks terrified. She's attempting to show to Holister her her weapons. She can't do it. She misses and misses and misses her holster and finally gives up. There are many tough cops and tough deputy sheriffs and sheriffs and US Marshall Service who are females. But you need a certain mentality at the president's side who can protect him. And you
can't protect him if you're five foot six and can't shoulder your weapon. So and at the r NC when the Trumpsters showed up, a completely different detail was present, and they were all tall, and they were male. You can be a six foot three inch tall female and damn it, if you can do the job, you got the job. But political correctness, firmative action calls this to happen. And now the bucks being passed by this cheetle character who's she's going to be fired soon. I would think that she took
no ownership of what happened. She's refused to resign. It looks like the Keystone cops are involved in this. In Barney Fife, she's the captain of the ship. She's in charge of the Titanic and just went down. Fortunately Captain Smith went down with a ship. But Chetle doesn't want to move it. All this all may change. As I predicted months ago, Joe Biden
will not be the nominated the Democrat Party in this cycle. And according looking to my left and looking to my right, the speculation he's going to announce it this weekend when he recovers from COVID. And by the way, if you got COVID, you shouldn't appear in crowd, shake hands, kiss babies, which Biden did after he knew he had COVID. But that's a secondary matter. And so right now he can't serve as president. Is it the
nightmare scenario that here comes Kamala Harris. She's less popular than Trump, but she is the capability of uniting that democratic coalition which is strong and brave, courageous and elects presidents. And Kamala Harris, I predict again, will take over the presidency in the next week or two as the acting president. And if she doesn't, it's her constitutional duty to get half the cabinet to agree with her to remove Joe Biden from office. She doesn't want to conduct a
bloodless coup and take over the presidency. She wants Biden to step down immediately, let her become the president. Then she runs for the presidency as the president from the Oval office. That's the nightmare scenario. I know what you're thinking, if you're normal, Might she can't win? The hell? She can't win. She can win because she will unite the Democratic coalition, which
is an incredible monster. Seven of the last eight presidential elections popular vote have been won by the Democrats, going back to Night eighteen ninety two, and is extremely rare for the Republican candidate to win the popular vote, which of course is important but not critical. That means every time the Republican wins, he's got to thread the needle through certain precincts in certain states. Is the Democrat rolls up, all the support from the tech billionaires, from all the
newspapers are going to go nuts supporting the first female black president. They're going to be with her. Most of cable news one hundred percent with her. The college kids are going to be required to vote. With all the ballasts flowing thither and fro. You have all the late night so called comics. They don't make me laugh. The morning talk shows the View going to have an evening news that that monolith of democratic power is hard to beat, very
difficult to beat. The last time a Republican president won the popular vote was two thousand and four, when Biden after nine to eleven with the twenty h three invasion of Rock still ongoing, and he beat John Kerry by about one hundred thousand votes out of one hundred and fifteen million. It is rare for the Republican to win the presidency. It's difficult. You have to thread the
needle perfect ways, the only way it gets done. And so of course the Democratic Party used and abused this old man for a long time until he was exposed. But they knew the facts well ahead of time. What did Kamala Harris know and when did she know it about the mental incompetence of Joe Biden. The answer is very long time. And they all lied repeatedly because it fit their purposes. And now that the whole party's been exposed as a fraud, they don't know what to do other than say, you know what,
he did a great job. I kind of watched this crap and I can't take it. The most consequential president since LBJ, he's done great things, is entire. This guy's a liar, and he's a thief, and he's a crook, and he's in the presidency as I speak. And the number of girls that Joe Biden is sexually molested and been charged with and having showers with his own daughter, any normal politician not protected by the media would long since be out of public service. So this deification of Joe Biden sickens
me to my core. So to my friends on the right who say, you know what, this is going to be a cake walk with a wounded president and JD vance o contrere mon frere. This is going to be a fight because Democrats know how to fight, and they know how to get elections won by millions of ballots flying around new registrations, no voter ID boxes that are not guarded, quick count of ballots, put them off to the side, and then we can contest these things later. Court's rule, it's this
point is not right because we don't have a declared winner. And then when it declared winner is made in December, well the whole issue is now moot because we can't give you any relief, can't have a trial before January the twentieth there or accept all these ballots that are questionable. And so that's what we're going to face. As I said, yet last night, well afternoon, with the with the Eddie and the rock there, they're not done with
Trump yet. The mug shots, the investigation, the arrest, the pre trial motions, the trial taking away half a billion dollars of his money supposedly, the convictions, the assassination attempt, the states of Maine and Colorado saying you can't be on the ballot. It's it's all out there. So for those who think, may we got this thing, one o contrere monfrere. The fighting has just begun. The Democrats are not going to give up on
this damn thing. They're not going to do it. And for political purposes, they're going to lie, cheat and steal to try to make sure that Kamala Harris is the next president. And I think she'll be the president in office once she runs for office, because that's the way things work. This November is the race for Haminy County Prosecutor, because the prosecutor determines who is and who is not charged with an array of criminal offenses, only the serious ones. If they're misdemeanor offenses. A lot of times they stay in the suburbs or
they might be in Hamlin County Municipal Court. And I often say to Haminy County Municipal Court judges, if it was important, it wouldn't be here in the first place. Although dui passing bad checks, trespassing, minor thefts are important, it's not like a matter of life and death. So on Wednesday morning, the Democratic candidate for amNY County Prosecutor, by the way, we've not had one for like one hundred and fifty years, issued a press release
with the headline, an elderly couple was violently assaulted. Why hasn't the politically connected suspect been charged? This is the case you've seen in the media of Steve Raley's family was at Montgomery Inn and not Steve Raleigh, but elements of his family got into a fracas with another group. Allegedly a car driven by Steve Raleigh's son backed into a vehicle and then all hell broke clues. And as you may know, Steve Riley's son is the grandson of the legendary Simon
Leees. So Connie Pillage is putting out this message accusing President Hamony County Prosecutor Melissa Powers of acting improperly. When Hamley County residents have their skulls fractured and are knocked unconscious without consequence, it means all of us are less safe.
So Connie Pillach, who the way in her life she's sixty years old, has not prosecuted one case in her life, is calling upon state officials, whoever the hell they are state officials, to investigate our prosecutor for not filing criminal charges quickly against the perpetrators of the assault and the parking lot of the Montgomery in Now on top of that, believe it or not, that afternoon,
the Assinstanati Inquiry said, well, this looks serious. If somehow Melissa Powers, the local county prosecutor, is not prosecuting someone because of quote political connections to Side Lease and or Steve Riley, well that's serious. So the Inquiry, to its great credit, Cameron Knight said, well, let's look into this to see what the hell's going on. And it turns out that the family injured said through their lawyer on Wednesday yesterday, they have no concerns
about the investigation proceeding. They said they're satisfied with everything that's happened, meaning everything that Connie Pillage is saying is a bunch of bs. Jonan, you and I now is James Bogan and I am in a criminal defense attorney who knows all the characters involved. James Bogan, how do you process what's been going on in this particular case. Well, simply put, the Hamilton County Prosecutor does not direct investigations by any police department, San Sinnati Police or anyone.
They can't sit there and call them up and go hey, I want charges now. That's completely improper and that's against the special responsibilities of a prosecutor under the ethics rules that govern lawyers. Under this rule special responsibility for a prosecutor, a prosecutor has the responsibility of a minister of justice and not simply
that of an advocate. This responsibility carries with its specific obligations to see that the defendant is a court of justice and that guilt is decided upon the basis of sufficient evidence, and failing to follow this would be misconduct under the ethics rules, which would lead to barred discipline and demand prejudging a case based on what little is known publicly and publicly demanding charges that's ignorant and improper and just
quite frankly frightening, And both from our experience Buil doing this stuff, we both know that there's always a lot more to it than what little bit you see on television, that short video or so on. Now, has Melissa's opponent talked to the Moros or any other witnesses or gotten details in the investigation? Apparently? And you know the Moral family's lawyer, Conrad Kircher, he's
a very sharp lawyer. He knows what he's talking about. I mean, does Melissa's opponent want to tell him he doesn't know what he's talking about when he's the one speaking for the family at this point. The Prosecutor's office in felonies don't sit around saying, you know what, Let's order the CPD. Let's get Teresa Thiji on the line. Hey, Chief Thiji, this is Melissa Powers. I want you to go out and arrest Steve Rowley's family.
On this situation, Connie Pillage seems to be saying that she wants to and arrest to take place, not knowing what the investigation is. In fact, you bring up Conrad Kircher's name. He's a fine attorney and he said in this inquiry article, We're very satisfied with the investigation you being conducted the way it is so Connie Pillage, who wants to be the prosecutor. Imagine if she's in office and someone politically unconnected to her or connected to her, she
thinks it's the prosecutor. You can call up police departments and say, hey, I want so I want this guy arrested, go get them. How frightening is that? And yet one thing to keep in mind why the investigation has taken so long. Remember the Cincinni Police has what I call the Joe Mixon rule. If you remember this their policy. This is stated by Chief
Fiji when a particular case involves a high profile individual. Under their policy, the case investigator must submit the case for a cursory review before any possible charge is filed to ensure the completeness of the investigation. If you recall the original detective on the Joe Mixon case, who filed those initial charges was disciplined and
reassigned for not following this policy. Again, the Hamilton County Prosecutor does not make policy for police departments, north should they where a prosecutor is supposed to
come in. Now, during an investigation, the police will sometimes call up the prosecutors for legal advice, but the prosecutors only involved with charging decisions after the police have presented them with all the information they're investigation is done, and at that point, based on that information, the prosecutor decides what charges are appropriate, applying the law to the facts. How about that idea? And so the way it works is if Fiji's office, who's ever's in charge of
this? After about it's only been about three weeks and it might be another week or two according to the inquiry, and the inquir did great work in this case, and the police department said, we're about a week away from completing the investigation. Then what happens is a commander of a division or maybe Fiji or somebody calls up Hamiley County Prosecutor at the grand Jury's in charge of Steve Tolbert and they say, hey, we didn't need a presentation of the
grand jury. What slot do you have, Well, how about next Tuesday at ten thirty. Okay, we'll be there and then the cop walks in with the file, have them be completed with the statements from the witnesses presented to the grand jury. Then they decide whether to charge or not charge. Isn't that the way it works. Yeah, you don't just follow popular public opinion like a winchman. And you know, quite frankly, you know,
I've seen the video. It's pretty disturbing. It was actually interesting seeing Kevin Euclis on there too, helping, stepping in help break it up. I went to school with him. But anyway, you know, I did form some opinions. But more importantly, I realized, from my experience twenty one years of doing criminal law, that the police know a lot more than we
do. And in fact, what was on the videotape shows a part of it, but what happened before the videotape of which there's no tape, and the Montgomery and Dean Gregory has said, there's a couple of cameras on our building, but they're maintained by Homeland Security and they're looking toward the Ohio River and they don't work, and he's told at Homeland Security, Hey, the
cameras don't work. But even if the cameras worked, it would not have picked up what happened before what we see on the videotape occurring, and it's a snippet of what occurred. But I would imagine, because it's a high profile case involving side Lisa, his grandson, I would think they want to be extremely thorough before recommending charges to the prosecutor's office through the grand jury. Or maybe they're misdemeanors, in which case prosecutor's office would not be directly involved.
It might be a City of Cincinnati matter. On the other hand, if they recommend charges, it's up to the grand jury to say yay ornee. But to have a prosecutorial candidate, Connie Pillach, who's never prosecuted so much as a traffic violation, to jump in the middle of this thing and tell state officials that you have to investigate the prosecutor, How ridiculous is that?
Beyond ridiculous? Off the charts. And the thing with this, you know the fact that there's not video that doesn't really bother me much because it's not like CSI, where you need video for every single thing to prove someone guilty of something. And at this point maybe there's nothing. And by the way, although a civil lawsuit's not been filed, I would anticipate I don't know, but I wouldn't when you have Conrad Kircher involved, there's a civil
lawsuit that's coming. And many times, if you can't prove beyond a reasonable doubt or probable cause in a grand jury reasonable doubt of trial of someone's guilt or innocence, then it's up to the civil courts. And the standard there is fifty one over forty nine percent, so that this is likely to be a civil matter in which the alleged parties and the victims will go to court
civilly in the next one to three years to determine what justice is. But the prosecutor's office cannot be used to assist civil cases, nor can it be used to score political points or vendettas much like Alvin Bragg in New York City is using the criminal courts to settle with political vendetta against Donald Trump. We can't have a prosecutor who wants to use her office to score political points against her political opponents. Correct exactly, And you know Alvin Bragg is exhibit one
for why you want to be careful who you vote for for prosecutor. At this point, I guess in the next week is going to be determined what happened, and if there's criminal charges recommend it. It goes to the grand jury. Eighteen or twenty grand juror sit there. You've got to have three fourths of the grand jurors decide to indict. And if they indict someone, someone gets indicted, and then they're arraigned. They go to court, might
hire someone like you or Merlin Shiveredecker to represent the various parties. The civil case proceeds off to the side. Nonetheless, it proceeds together. But you can't use the criminal courts to score political benefits in a campaign. That's frightening. Could there be charges filed against I think Connie Pillis didn't for a while have a law license. I think she might have one now. Is she possibly subjected to her own person discipline for doing these kinds of stunts? You
know what, I'd have to look at the disciplinary rules more. But if she was prosecutor doing this stuff, acting prosecutor certainly, and that's in that day, just as a citizen in't the dangerous absolutely frightening. I will see what happens, and hopefully in the next week this thing will be resolved.
If it's not resolved, you have civil courts. If it is resolved, yeah, or I can imagine if someone is not indicted and let the civil courts determine, Connie Pillage may issue another statement saying the fix is in. And you know, here's the thing with that, with the one thing I know the prosecutor's office does in situations as they talk to the victims too. At the end of the day, it's about them and it's not about Connie Pillach or anyone else. And you know what if only the victims and their
lawyers can speak for them. And at this point, what is Kircher, the attorney for the victims, what is he saying he is satisfied with the investigation, with how it's progressing, has no concerns. But apparently Melissa's opponent knows better. Maybe Connie Pillage has interviewed all the witnesses, maybe the victims. Maybe she's spoken to Connie Pillage, maybe she's gotten some other special videotape. I kind of doubt I wouldn't make one of those Sunday bets with you
because we know which way we would go. So scoring political points at the expense of the victims of a crime is not something a prosecutor should be doing. Absolutely not. All right, once again, James Bogan. How's the practice of law today and the bowels of the Amina County Courthouse elsewhere? How's it going. It's going well, it's very busy, but it's going well. Well. The court is of course some open. Can you get juries
in courtrooms? And also absolutely that that's been hasn't been an issue for the last few years, so you're in pretty good shape at this point. No COVID juries, thank you. I mean I actually did one of those with a rape case, rape kidnapping case that was in the news, and we had those plastic barriers up and everything. It was I'm glad I don't have to do that again. And the last election, Joe Eaters got fifty two percent of the vote and his name, idea is ubiquitous, and his respect is unbridled, and he got fifty two percent of the vote. So Melissa Powers, who's got more than thirty years in law enforcement as a great staff around her, is running for her first election as county prosecutors. She's been there about two years.
And if her opponent has such ignorance about the law and it's willing to issue official press releases contrary to the code of judicial responsibilities and lawyer duties to score a cheap political point, that's not the kind of person you want to be the county prosecutor. That attitude continues into office. People will be prosecutor based upon their political affiliations and not based upon their criminal misconduct. And God
knows, we had enough problem with criminal enforcement in Hamlet County. The last thing we need is a prosecutor thinking like Countie Pillage. That is frightening the article in the inquir The victims just pulled the rug out from under Connie Pillage, who represents no one but herself. I hope you understand what's at stake. we couldn't get her to stop driving, we talked to the attorney. The attorney said the quickest and safest thing to do would be to unhook disabled the vehicle. So we had hooked the battery cable so she couldn't drive. Her car wouldn't start, so she couldn't drive. It's very sad to see that
situation, but that's where I feel that Biden is right now. You know, when we had a similar situation, we thought about disabling the battery cable or taking out the spark plugs, and we thought, what she'll call a repair service to come and fix it. What we did we get the title when we sold the car, went through two or three days of hell, but I thought it's worth it to go through that than have her hurt herself
