Things change tonight, Tomorrow, Wednesday and Thursday afternoon. Giants intown. Red's now two games out of first place, and more important things are happening, maybe in the world of politics here in the state of Ohio, and that is that David Yost, our good Attorney General will send a missive and email letters and c to colleges and universities kind of reminding them they have to follow

the law, which hopefully that will not be required. But it appears as almost an incipit protest happening against the US Supreme Court decision on getting rid of racism also known as affirmative action when it comes to picking students or staff joining us. Now is that same? David Yost and David Yost, welcome again to the Bill Cunningham Show this Monday afternoon. And mister Attorney General, what did you send to the colleges, universities, etc. In relationship to the

US Supreme Court decision. It's a letter and I'll tell you about it just a second. But I got a bone to pick. I can't believe you're just told the listeners of the Tri State area and Ohio that there's the politics is going to be more important than Major League Baseball in August at Racey. I'd love to have one in August or September. Not had one for about ten years. But you know how I mean, for those of us who listened to the Reds all weekend long, the entire team simultaneously went into a

power outage. Let me give you two factoids. This is off the subject, of course, but in the history of baseball, there's never been a team that it has lost three games in a row by a score of one to nothing, having struck out at least thirteen times in each game. Now that's a record the Reds have set. Also, they set a record that that may never be broken again. As far as the Reds are concerned that they had starting pitching problems, now there's no starting pitching problems at all.

Never before in baseball history as a team lost three games in a row one to nothing, one to nothing, one to nothing, and fail to hit at least eight total hits in all three games. How about those records? Item amazed that you know those things, But I would argue that those are consistent with randomness and are simply the far end maybe two standard deviations out on the distribution curve. I'm looking at the longer the longer arc This is an

exciting year for the Reds. I think this might be this might be the year for that race. But they're gonna have to before we talk about the issues. These ten games and then the three in Milwaukee at the end of the ten games are absolutely critical to the success of the team this year. And this is also just before the Bengals starts summer camp in which Joe Burrow

is going to dominate. So these ten games at home, then the three in Milwaukee, then the three in the Los Angeles were the Dodgers critical. And at this point there's zero in three and they can't score runs. They're bringing up in canarcion. We're told, let's talk a little bit about politics.

I consider sports the funny pages of life. But nonetheless, the lot of youth sens in the colleges and universities in relationship to do a Supreme Court decision, well, you know, there were two companion decisions that said that you can't use race when you're deciding who gets into college, private college or public college. Both of them are illegal. So one of the things that concerned me is in the days after this, in the circles that intellectuals in

habit. I saw that they're talking back and forth about how they could get around the Supreme Court decision and still do affirmative action by secret code or something. And I was alarmed by that because freet Court was very specific and pretty firm and fairly broad in its language six three decision. And so I sent him a letter that said, don't do this overtly. Don't do it covertly, and just follow the law. And there's potential consequences if you don't.

You know, mister Attorney General, in nineteen fifty four, before you were born, the US Supreme Court ruled that separate but equal plusy versus Ferguson is not the law of the land that black kids deserve the same quality education as white kids. Now, what happened in relationship to nineteen fifty four is that Southern governors from Arkansas to George has said we're going to ignore the law. We're not going to allow black kids to come to grade school or middle school

or high school. In fact, one Governor Wallace, a Democrat, stood in the our way and would not let in any black kids. In Mississippi, a guy named James Meredith was not permitted to go to high school, and Arkansas you had the National Guard was sent in by Dwight D. Eisenhower.

Here we are about seventy years later, and the same Democratic Party that in the nineteen fifties and sixties said we're not going to educate black kids, we're going to ignore the US Supreme Court are now saying exactly the same thing. And let me give you a more specific example, with your permission.

There's the dean of the law school University of California, Berkeley, a guy named Edwin Schemerinsky, that I've had on my show twice, by the way, years ago, in which he said, on the Friday afternoon of that decision, he told his law school class addition to be a professor, he's the dean of the law school and said, in the future, we're not going to write emails to each other. We're not going to exchange text messages,

God forbid, send a letter. What we're going to do is simply continue to enforce affirmative action and not tell anybody not put it in writing. And then he went on to say that if I'm put in a deposition under oath, I'm simply gonna lie, And so that is the dean of the law school teaching constitutional law. How do you get around that one, Well, the man ought to be disbarred if he actually said that. It's on tape. I got it, I got it. I'll send it to you.

I believe I just haven't heard it myself. Uh. Look, an officer of the court is not allowed under sanctions, as you well known being a lawyer yourself. The disciplinary Code, the code of conduct now just expressly prohibitaid. I'm a gas that somebody would say that, But as a precichool matter what he's proposing won't work. I'm not going to borry your listeners with

how the legal intricacies of discovery work. But there's ways to get around lying witnesses, ways to find out the truth, ways to show up their deceits through not just records. But the leftis loved, to my horror, this idea of disparate impact analysis. For fifty years we've been dealing with this in court, which shows nothing more than correlations, shows no causation, but it's

treated as though it does. It's a poor gun that doesn't point both ways, and I wouldn't at all be surprised to see some of these very clever people see disparate impact analysis turned around on them. Yeah, I hope. We also have the situation locally, David Yost, in which a constitutional law professor at Ohio Northern University in Ada, Ohio, not exactly a hotbed of

liberalism. I would think his name is Scott Gerber, who was perp walked out of his constitutional law class, taken into law screen law school dean's office, and fired because of lack of collegiality. And it turns out that he issued an opinion for The Hill dot Com that was run in the Wall Street Journal in which Professor Scott Gerber said, we need diversity of opinion when it comes to colleges, universities, and law schools, that conservatism and those voices

of libertarianism must be heard. And this is Ohio Northern University, this isn't Berkeley. And so from that you may have a ten to twenty year fight to get racism out of law schools and racism out of college admission. Because if Ohio Northern is perp walking a law school professor for talking about different viewpoints, David Jose, we got serious problems. Well, you do. Although

private institutions, Bawwy's been a little are there a field? Look the rest of the letter that I sent to the public universities of Ohio that qualified immunity goes away if you knowingly violate somebody's constant, clearly established constitutional rights. After the Supreme Court's decisions, these are clearly established constitutional rights. What does qualified

immunity mean. It's basically just a doctrine that says, if our employees, we the people, employee cops and school teachers and street sweepers, if you do something while you're working for us that goes south, you make a mistake, there's a negligence, an accident, whatever happens. You're not personally on the hook for You're not You're not going to be sued and lose your house

and your kids college fund and everything else. You know, the government might have to pay damages, maybe not, but you are okay, you're protective. You have qualified immunity. But when it comes to clearly established constitutional right, you don't get that pass anymore because you're not doing what we told you to do. We didn't tell you to go out and finalate constitutional rights.

So the thrust of my letter is be very very careful here, guys, because whether you do it overly or covertly, if you violate this Supreme Court decision, you're operating outside the parameters qualified immunity, and you're personally on the hook for that. If somebody takes you to court, I think that's going to have a little bit of a chilling effect on some of the bombast we're

hearing out of the court or as of progressivism. Have you got any feedback from the boards of trustee of Ohio State or University of Cincinnati or High Northern, or from presidents? Have you gotten blowbacks saying wait a minute, we don't agree with You can disagree with the decision, that's fine, but you

have to follow the law. When you have a president Joe Biden who promised to return to normalcy, you might recall when he ran for election in twenty twenty, he said, too much weird stuff's going on in the White House, and so I'm going to return normalcy to the White House, which I guess is pouches of cocaine and other drugs being found all over the place.

But nonetheless, Biden said, I'm going to return normalcy, and so didn't he send the message to all bunch of liberalism all over the country that I got your back. If you violate the law, the president and the Department of Justice, headed up by Mary Garland is going to take care of you. It isn't the message from the president about violating the law and work around and ignoring it. Isn't that corrosive of the norms of democracy. It is

and it's important to look at how important leadership is. And if you'll indulge me for just a second, you brought up Little Rock and Arkansas was kind of ground zero for Brown versus Board of Education because of the Little Rock resistance. But unknown to almost everybody is the fact that another town in Arkansas the year before had successfully followed Brown Versus Board of Education and desegregated their segregated schools.

Why did this happen Because the school board and particularly the school board president went to the community, They explained the Supreme Court decision, They talked about what they were going to do, and they followed the law. They exhibited leadership instead of going out and trying to whip up the locals to be angry. And what Orville fathers did in Little Rock the following year, they actually went out worked with the community, and we're successfully integrating. When things blew

up, it makes a big difference who our leaders are. I tell you what, if the boards of trustees or the colleges universities would get together, I guess there's some group in Ohio in which they must form some alliance or partnership and say, we may not agree with this decision. Being liberals and reactionaries, well, we're going to follow the law and we're going to implement policies that get racism out of our colleges universities masquerading as affirmative action. Is

that public get together. Has that happened yet? Unbeknownst to yours truly? Well, there's only three, as far as I know, three university public universities of Ohio that still use race as after and admissions. Unfortunately, one of those three is University of Cincinnati. But I haven't heard a word about my letter. Nobody has called me and said we think you're wrong, or

we've got different legal counsel, or we're going to disregard it. So I'm hopeful that, Yeah, this is America and Bill, We've had decisions right and left out of the Supreme Court, at a congressif of the president for years and years, and at the end of the day, Americans buckle down and recognize that our system gives us the rules to live by, live with each other in the middle of all of our disagreements. I hear what you're

saying. You're optimistic. I'd like to ask you one political question. Frank LaRose, Secretary State, has announced this morning that he's going to run for the US senency currently held by Shared Brown. There are some told me that one attorney general is going to announce named David Yost to run for governor. Can you put some meat on those bones? Or you want to delay that

decision to later? Well, he cually haven't made a decision. We did, and it's probably coming from an obscure filing and campaign finance area called the Form thirty D, which is a designation a treasurer you're required to put on the officers seeking in the year, and I had to update one because I can't win for attorney general again. We need to put the Senate, we need to elect the president. There will be time for us to think about

the governor's race in twenty twenty six after we take back America. But I'd be wrong if I didn't tell you. I'm getting a lot of encouragement from every corner of the state to consider doing it, and most of the board, of the dash lights on the board are turn it up. Three. All right, let's well, thank you, David Yost, and let's do this. We'll touch base with you, I'm sure between now and then,

but this decision has to be after twenty twenty four. And once again, David Yost, thank you for coming on the Bill Cunningham Show, and with your permission, will do it again. I find it illustrative that one of the three public colleges universities that still practice racism called affirmative

After one o'clock today, as moe Eger, he and I were together on Friday of last week predicting a great weekend of Red's baseball Friday, Saturday, and Sunday that did not work out exactly

as we planned. You might recall the Threads counting the last game of the of the major league schedule before the All Star Break, lost one to nothing. So the Reds lost three games in a row one Zip, one Zip, one Zip, getting unbelievable starting pitching. And they're the only team in baseball history anyone's aware who lost three consecutive games one Zip, one Zip, one ZIP and in each game had at least thirteen strikeouts against them. Not

good. And on top of the fact that no point in Major League Baseball history as a team gone one Zip one Zip one ZIP lost all three games with a total of eight hits in those three games. So you talk about the white House to the outhouse from a chicken soup, chicken excrement. It's unbelievable what the Reds did. Maybe they weren't that good and they can't be this bad. So there are only two games out of first place, and Ellie did not get on base at all. Over the weekend. Zip zip

Zip. I don't know. So we'll see what happens. Giants in town for four and then three more after that here at home against the Diamondbacks. Then it's on to Milwaukee for three there. I think the Reds have beat Milwaukee twice this year. Then it's on to Chicago and then on to the Los Angeles Dodgers come back home the first week in August. All I can say to you is a long suffering Red Span as I certainly am. Also,

keep hope alive, Keep hope alive. This thing could turn on a dime and suddenly the Reds get good again by simply getting runners on base, Steers and Ellie and the India. No one's hitting at all, Votto, so hopefully Canassien Strand coming up might help. We'll see what happens tonight. Section of the lineup by two two thirty today, we'll see what occurs. Secondly, you heard from David Jose, the Attorney General. One of the things we have to be is a society that respects the so called rule of

law. We have three branches of government federally, and each state has three branches. You have the governor, you have the General Assembly, you have a court system, and you can have chaos by having one or more branches of government ignoring rules, regulations, and orders from the other branch. When the United States Supreme Court issues a ruling saying this is the law, you really can't have a president or a Congress saying, well, we're going to

ignore that. We're going to do a worker. We're not going to pay attention to what the US Supreme Court tells us to do. You're gonna imagine as an American if judges, much less six of nine judges US Supreme Court says you are to do this. Bob the Bricklayer, you must do this. Tom Ashmore, you must do this. Rob Sanders, you must do this. Steve washing Machine, you must do that. And I can only imagine the reaction if any of those individuals against him an order is directed saying,

you know what, I don't agree with that. I'm going to ignore that. I'm gonna work around it. I'm gonna do something different. Chaos would reign. Supreme how many times has yours truly over the years said I disagree with that judge's ruling. I disagree with the verdict, I disagree with the APPEALA disagree with the outcome. I disagree with what the Health Department says you must do. I disagree with the Secretary of State. I disagree,

But that doesn't mean I can avoid my known responsibilities as a citizen. Doesn't work that way. It's awful when the day of a United States Supreme Court decision, the President of the United States, who promised to return the White House to norms, simply stands up in a news conference late of course, and says, I disagree with that. We're gonna do something different when it comes to student loans. We're gonna come up with this new rule, this

new regulation. I want to work around the ruling of the Supreme Court that says the president cannot spend money. In fact, the president's got to follow the law. He's the one guy in the country that took the oath of office to say, you know what, I'm going to execute the laws of this country faithfully. He's the only one. So he ran for election in twenty twenty promising to return normal activities to the White House. He kind of

promised to have the regular rules. In effect, he was like everyone's grandpa. It was friendly Joe Biden, We're going to return to normalcy in the White House, my lordy. Since then, cocaine and pot parties are everywhere. Half nude women are running around, certain flags are above the American flag. And when he's ordered to do something by the United States Supreme Court, he says, we're not going to do that. Are you kidding me?

And now it's melting down into the states. Here in the state of Ohio, we're going to have an important election in August. Almost every constitution of the States, or the FEDS or private organizations say you need a supermajority to change the constitution. You can't have fifty percent plus one changing the constitution. Then in a year or two fifty percent past one go the other direction. We don't vote on the freedom or practice or a legion. It's in the

constitution. We don't practice. We don't vote on freedom of speech, freedom of assembly. Well, we don't do that because it is in And to change the Constitution in Washington takes two thirds of the House, two thirds of the Senate, and three fourths of the states. For those who don't pass the eighth grade math test, that means sixty six and two thirds percent of the House and the Senate and three fourths, which means seventy five percent of

the states. The League of Women voters in Ohio, it takes sixty percent to change their constitution. High Democratic Party takes sixty percent to change this constitution. It's the way it is. So because the leftist cannot tell the truth about the August election, they come up with silly commercials and Dave, if you're ready, this is an ad urging people to vote no and in August, having never mentioned the constitution, hit it. Do you have a condom?

Yeah? Sorry, you can't use those. What are you talking about? Who are you? I'm your Republican congressman. Now that we're in charge, we're banning birth control. This is our decision, not yours. Get our bedroom. I won the last election. I'm not going anywhere. I'm just gonna watch and make sure you don't do anything illegal. So, because the truth doesn't work, you erect these strong men easily knocked down, acting as if quote Republican congressman want to be in your bedroom? Are you kidding

me? Just tell the truth that the Constitution of Ohio is not subject to a fifty right now, it's subject to a fifty percent, and we've amended it now one hundred and fifty times. Who knows, in the next fifteen years it might be amended another one hundred and fifty times. In America, it's been a minute twenty seven beginning in seventeen eighty nine. And the reason this is happening is huge amounts of money coming from out of state sources.

And the last is the last election twenty twenty, Mark Zuckerberg spent out of his own pocket five hundred million dollars to change election rules in Michigan, Pennsylvania, Georgia, and Arizona. They did not target Ohio because it's harder to cheat in Ohio when it comes to elections more than other states, because of because of a number of Secretaries of States that we've had. So Mark Zuckerberger took advantage of COVID nineteen by paying individuals to sign up literally millions of brand

new voters to get their personal information. Today have US absentee voting to have dropped boxes everywhere, and compliant Democratic secretaries of states accepted all these rules changes, which gave US Joe Biden in office five hundred million dollars. And so

now the tech world is flush with bucks. They can come to states like Ohio, in which we regularly support the election of conservative libertarians to Columbus, and they want to override your vote in voting for state representatives by saying, you know what, let's directly change the constitution in Ohio, which the lawmakers in Columbus cannot effectuate. They can't say, now, wait a minute, that we need to tweak this law, tweak that law, take out this

provision, put in that provision. If it's quote in the constitution, one is barred from doing so. So this is the first abortion on demand through the ninth month of pregnancy. What's being proposed here is much more leftist and liberal than Roe versus Wade ever was. Roe Versus Wade said, in the first trimester, the state has a great interest in the outcome of the life

of an unborn baby. And this but basically, a woman in the first trimester could get an abortion for any reason, a good reason, a bad reason, or no reason. You had essentially ninety days in order to make up your decision. About fourteen weeks. Then the second trimester, there was a state interest that could be overruled by a woman's doctor for all kinds of reasons, and the third trimester, like partial birth abortion that was more or

less outlawed unless the life of the mother was at risk. Roe versus Wade was the law of the land since seventeen. Since nineteen seventy three, the current law proposed in Ohio would take away any of the first and second trimester and allow a mother to kill or unborn babe be up through the ninth month. Also, when interpreted, it would also mean that parents would have no say whatsoever, and a teenage boy or girl who wanted to have a sex

change operation or go through hormonal therapies of one type or another. And so liberalism will infect the body politic in the state of Ohio if this thing passes, and it's being marketed in a silly goofy way, as if Republicans are the ones who want to make decisions instead of the government the Democratic Party. They want Washington, d c. To be its own state only because they would elect two Democratic senators. They wanted to pack the United States Supreme Court.

They wanted Puerto Rico to become a state. They wanted the George Floyd Police Reform Act, which would federalized police so del High Police, Green Township Police, Madera Police would be under the heavy boot of Washington d C. Politicians. They wanted to federalize elections. So the party that wants government control is not the Republican party, but because the opposite is true, that is,

the Democrat party wants more agencies of government controlling your life. They run commercials the opposite of what they intend, which as Republicans want to be in your bedroom. No, Republicans want to generally protect the lives of unborn babies. And almost all these states have rules and regulations now that prohibit killing your unborn baby after six weeks or in some cases twenty weeks, in some cases eighteen weeks. It gives a mother time to consider the consequences of her behavior,

the consequences of her actions. And we live in a time because of birth control, pills in condoms, and plan b day after there's many circumstances a woman, and yes, women have babies, not men, can determine not to get pregnant. And for those who exercise terrible judgment and don't do one, two, three, four, and five, you still have the right, even in red states to kill your unborn baby. In the first

six weeks. Some cases it's fourteen weeks. But that's not enough. So the radical left wants to infect the body politic and the state of Ohio. What they can't win at the ballot box, they want to run commercials and trick you into believing a lie. You're being played And I hope enough Americans figure it out when I see these stupid signs that say democracies at stake one man won vote. That is the last thing liberals, a leftist won.

They want governed in control of your life in every aspect and raise big bucks in the process. Let's take a short break. When we continue, I'm going to poke the minds and the intellect of one moeeger to find out what the hell happened the past three days with our reds? And do you keep hope alive? I say, absolutely, keep hope alive. Then after two o'clock today, is Frank lose about these issues? An informed electorate is democracy's

best friend. And so when they run silly ass commercials like you just heard, you know the entity running it cannot tell you the truth. Almost every constitution anywhere has a supermajority to change the constitution. You have their right, through your elected representatives and through the initiative process, to propose any law that you want to propose that the General Assembly of the Congress can affect and change

to make it better or make it worse, whatever it might be. But in this case they have to tell lies to trick you into voting no in the August election. They cannot tell you the truth. They have no respect for your intellect and no respect for your ability to discern complicated materials. And maybe they're right because the government schools produced kids. We're only eighteen percent say

they're patriotic. Having been indoctrinated with leftist propaganda for most of their life, it is hard for a young person to stand up and think for themselves. Let's continue fifty five minutes after they are built. Maybe we should have tapped the brakes on the comparisons to the big red machine, that was you, that was not me. Uh, it's a young team that suffered a hiccup this weekend. Machine. Yeah, I mean I was. I was hearing a lot of that. I went to an events last week. It was a great event, and a guy came up to me, and he's probably closer to your age, and he's like, this is the best team since the Big Red Machine, and I go, Okay, Well, at least you're not saying they're quite as good. There's

a ton of young guys. Matt McClean is suddenly struggling, Ellie Dealer Cruz is suddenly struggling. Uh. Yeah, So you hate to say that this was inevitable, but maybe getting shut out three straight games wasn't. But at some point, at some point, they were going to dip a little bit offensively. I kind of look at this as a little bit more glass half full. Starting p is held up quite nicely, how about that? Yeah,

I'm pitching, and if the starting pitching they do. But if the starting pitching quality is as good as it's been over the last week or so, this team is gonna be fine. It's still a two team race. Milwaukee should be and I think all along has been considered the favorite. It is extraordinarily frustrating that they have lost eight out of ten to this, to that team, that there are two games behind now, But this franchise's trajectory

is pointed upward. So you're optimistic despite setting Major League records. I think the franchise is going in the right direction. I think you are being fair if you are wondering if they can actually make the postseason, because it's gonna be hard. It's a really, really young, inexperienced team. Matt McLean has been in the big leagues for two months, Ellie deler Cruiz has been in the big leagues for six weeks. Andrew Abbott has been in the big

leagues for about two months. Uh, they have they have one established every day, established player. Now some of these guys will be established that players. Joey Vado, who's going to be forty years old here, he's not been very good either. Youth is unpredictable. Youth can be frustrating. This team is really really young, and I think that showed this weekend. So you're generally in the category of saying giants in town. That's good. They've

lost six games net net net to the Brewers six games. Except for those six games, the Reds are four games in first place. Is that looking at it optimistically? It's looking at it unrealistically a little bit, because you can't do that in the standings. But it's a two team race. What about Encarsion. What position does he play? Christian and Carnossi on Strand is mainly a corner infielder. They have worked him a little bit in the corner

oilfield spots. His prodigious power has been almost impossible to escape, and given this team's offensive issues, they needed something. Hopefully, like so many of these other rookies that have shown up and provided an instant burst of production, don't get too high, mo and don't get too low. Yeah. Look this. I feel exactly the same way about the Reds this season as I did a week ago on Friday. I think they've got a shot. I

think they're ahead of schedule. I think they're extraordinarily fun to watch. But if you were putting this team in the category with the Atlanta Braves, you were being a little bit premature. People did that here, Some did, some did some compare them to the Big Red Machine. Yeah, position by position, I heard this team would beat the Big Red Machine. No they wouldn't. And that's okay. But there are two games out of first place.

What's today the seventeenth. They're two games out of first place on July seventeenth, If I would have said to you in March. You and I'll be having a conversation the first Monday after the All Star Break. The Reds are two games out of first place. You would have said, what what said? What? Sign me up for that? Right? Sign me up for this? But we need something. This is the most important ten games of the year because to begin Joe Burrow, all home games, all tough

opponents. Then they play in Milwaukee, Chicago Cubs, and then the Dodgers, a tough stretch. Get through this, I said on the homestand go go five and five, six and four, four and six, and they're okay. Now the seven games remaining, they've got to they gotta win. Go five and two. Yeah, I mean to me, it's all about winning series. So when the San Francisco Series, when the Arizona series, those are two good teams. If that happens, there are two good teams.

They're back on track. Then they're got to Milwaukee again next week. So to me, here we go. I think you and I talked about this last week. I still think it's a race to eighty eight to ninety wins. So let's put it on the low end. Can the Reds get to eighty eight wins? Yes, okay. One thing I sold it up. So if they get to eighty eight wins, I think they're gonna be playing in October. One thing that upset me. As you know, I played for Gordon Veterino, of course, yeah, center field, catch the

ball. Freedo has the ball runner on third yesterday, no chance, yeah, zero of throwing him out at home? What is he to do? Rainbow the ball, throwing the ball a second, the single doesn't score the next run. I say, right now, someone needs to take Freedo off to the side and say, don't be a hero. I don't know. Way to throw that guy out would be if he tripped and fell going home. Why did Freedl throw that ball home when he should have threw at the

second base, as Gardon Veterino said he had to do. It's a fair question. I was at the game with my daughter yesterday, and I tend to watch my language around my daughter. But I let loose say what the bleeper you doing? TJ. Friedel explain that to him. He I guess he thought he had to play at the plate. It doesn't make any sense anybody, anybody who knows anything about situation situational baseball knows. You hold the guy at first base, you don't let him go in the scoring position.

You let the lead runner score. It's a tie game. He was trying to tell him not to do that. Well, David Bell was out of the game, David Bell. David Bell was probably watching on TV in his office. He was sending orders, and he would like to think that after the game he had a conversation with him. But the margin for air for this team is really small right now because of their off sensive issues, because of their youth, and you can't make plays like that that puts you in

a situation might have cost him the season. You never know. You could have gone extra innings. You know what would have happened, and I would have taken part. I think what you saw this week is a Milwaukee team that has, first of all, an excellent bullpen. An excellent bullpen.

Devin Williams in the ninth inning terrific. It looked like he didn't break a sweat in the ninth And I still don't think that team is capable of running away and hiding in the central because except for the Reds, they're second place. They want to play the Reds more. I'm sure they do. They won five out of six of it the last two weeks. I don't think offensively they're good enough to run away and hide. I do not think the Cubs can play themselves back into this. I do not think the Pirates can

play themselves back into this. And the Cardinals are done. So the good news is this, the division is still I think up for grabs if you are the Reds, because I just simply do not believe the Brewers can run away and hide. And if they, if it happens, happens. But the Reds have been the story of the year in all a Major League baseball and Ellie didn't get on base over the weekend. You can't steal first base. And as a consequence, Ellie wasn't as good as you said he was.

It is not as bad as you say he is. Ellie Dela Cruz is a generational talents who has been in the big leagues for six weeks and had a rough weekend. Offensively, did David Bell get kicked out on purpose? I think he might have. The strike zone was shaky all weekend for both teams. Craig Counsel was upset as well. There's a part of me that thought, when David got kicked out, this is the proverbial trying to get your team going. I'm sure it had been a very frustrating Friday and

Saturday for David and so maybe all that came to a head. But I think he had a beef with the strike zone. I think Craig Counsel all weekend had a beef with the strike zone. That was if you watch those three games, horribly inconsistent umpiring. And but I'm gonna guess had the Reds one Friday and one on Saturday, that David Bell's demeanor yesterday would have been at least a little bit. I'd like to see Randy marsh is he still

in charge of the umpires. Was he was, I don't know. I don't know to get the umpiring crew after the game and say, let's go after the strike zone, let's show what happened. Yeah, the umpires do that in the secret enclave of their little office off to the left there. Uh. There is a performance review done on a periodic basis for the umpires on the churches after every single game. I know after postseason games, there's usually a brief meeting with the folks in New York about balls and strikes and

different things that it might have happened within the game. My issue with umpiring people are going to say, well, get the robot umps. I just want bad umpires to be held accountable, and that doesn't happen in that sport. Bad umpires aren't held accountable. But the fact that Angel Hernandez, who has sued baseball twice, Angel Hernandez, is still an active Major League umpire

is astonishing. It's it's one of the only it's one of the only jobs in which you can be proven to be bad at it and you hold onto the gig for years. We have that job too, But the fact is, why not have the robo ump not actually make no I am a I am a fan of the human element mistakes. I'm a fan of the human element mistakes. I just want the humans who repeatedly make mistakes to be held

accountable for them. And they got the same score. You're gonna be six foot six or five foot six, and the robot ump has the same strike zone, which is false, correct, Benson, Yeah is six six. There's some five foot six inch players. Yeah, are going to be Lain's strike zone is different than than it should be. But Will Benson's yeah, I would change it. I just think there needs to be more consistency and

more accountability. There needs to be better umpires. And you know, we keep introducing replay, we keep introducing all sorts of technology to help achieve satisfied results in sporting events, and yet there's just more and more grumbling about how the technology is used, how it's implemented, the way it works, how it malfunctions. It's limitations. I'm not a pro replay guy. I believe games played by human beings should be officiated by human beings. So I don't

want robo umpires. I just want the umpires who are proven to be bad on a consistent basis. And that's the key verbiage there, on a consistent basis to be held accountable. For one study indicated that the one percent of baseballs thrown that are arguable, of course, you know in the dirt over the head, you know, encount those thirty percent of the time the umpire

is wrong on close calls. You can get that number down to one percent with robo umpires, and you won't do it because you want incompetence behind the play. Oh I want the incompetence. I want someone to do something about the incompetence. If someone's bad at their job, they should be held accountable. I think the majority of balls and strikes are correctly. Eric Greig was a great guy, funnier than could be good to be with. That guy

had no role being a good Major League Baseball umpire. Eric Greig was ridiculous, but he was a great guy. Angel Hernandez maybe a fine human being. But it shouldn't be an umpire. So you're saying, well, I wouldn't. I wouldn't recompense I when people held accountable, Well, guess what if they're not held accountable? That they're not. And to me, that's

the issue. If you have an umpire who is on a consistent basis calling incorrectly ten to fifteen percent of the pitch's throne in the game, that umpire shouldn't have a job anymore. You know, put him at second base and don't let at all. How about not being an umpire? So to me, it's it's not replaced them with technology. It's not even introduced technology. It's used the technology that you have right now to show us which umpires are good or not. And then the ones who aren't get rid of them.

Let me be the voice of long suffering Reds baseball fans. Please. In the beginning this year they had a tenant in some games announced of about six thousand. I think it was half that number. Now they have packed houses. Lead me on where there's nowhere to take me. This is Let me be the voice of unhappy Reds fans. This is typical of the Reds. Create false hope and then destroy us. It's been decades and decades since they won the World Series. We had hope. Some compared this to the big

Red Machine. Some said they're gonna be go deep in the in the playoffs, and now you packed the joint on Friday, Saturday and Sunday. One hundred and twenty thousand people show up. Did you come down? One hundred and twenty thousand people show up and they lay an egg? By any fair estimate, how bad was that? Mental airs, physical airs don't hit the ball zero for zero of the runners in scoring position. This is typical of the Reds. False hope created, then destroyed. Your comments, that's what

many Red spansers feel familiar. I can't refute any of that. I think you know, if if you thought on Friday morning, God, I really like this Red's team, three games change that. If you thought on Friday morning, yes, the Reds are a little ahead of schedule. Yes, but they're going in the right direction. Yes, these guys are going to be really, really good soon, but they're not quite there yet. Did you think that on Friday morning? I thought Friday morning they were marching for

Gloria. Did the judgment seat of God? I feel that way right now. I thought on Friday morning, Red's got a shot to win the division. Today I think the Red's got a shot to win the division. If you were to ask me on Friday morning, who is the safer bet to win the division and Vegas, by the way, agrees, I would have said Milwaukee. This team should be judged based on what it does and what it doesn't do. What they've done so far is put themselves in a

position to play some really meaningful games here. It would last two and a half months. Are they a finished product by no stretch of the imagination? Tonight? Yeah? If if you want a turnaround, it would help to win a baseball game this evening, right, and what hell? What help? Is it gonna happen? Sure it will? Yeah? Are you putting your credibility on the line. and may I quiz you on other matters before we get to the announcement. Okay, yes, sir. When I drive around the highways and byways, I see these silly signs about voting no on the August election because it's one man, one vote, I'm not sure what that means. One man, one vote. Also, we have to save democracy, so in a sense

if you're voting, that's antidemocratic. So when you travel outside of Hamlet County in southwest Ohio, it's the same campaign being waged about the constitutional amendment requiring sixty and not fifty percent throughout the state of Ohio. You know they're trying to but Ohioans will not be fooled by this. The left is in a full scale freak out at this point. They are losing their minds about this,

and they're telling a lot of lives. One of them is that somehow, passing Issue one does away with so called one person, one vote or majority rule. No such thing. After Issue one passes majority rule, one man, one vote is still alive and well in Ohio. You can still change the law with a simple majority vote on an initiated statute or a referendum,

or by working with the state legislature. All this is doing is elevating the threshold to change the foundational document of our state, the Ohio Constitution. And so to say that this is a harm somehow to democracy is a complete outright lie, and Ohiolands aren't going to be cooled with it by it. They're gonna vote yes on Issue one. You know, frank An informed electorate

is democracy's greatest weapon. And I'm just concerned that the average American rolling around the tri State thinks somehow democracy is on the ballot one in is not. You quickly went over the initiative, the referendum, and the constitutional amendment process.

And for those who may not know citizens, groups of citizens for years and years into the future, no matter what happens in August or November, can propose and ordinance through the it's called the initiative process, and that would be on the ballot and then citizens can propose a law and pass it. That's the initiative and the referendum is when the lawmakers and Columbus do something that we don't like, we have the ability through a referendum to get on the

ballot and to reverse that law. And that is a different process than what's going to happen with the constitutional amendment. Can you put more meat on the bones to explain to someone living in Sharonville how the constitutional amendment process is different than the initiative process. Yeah, And it's important to start with why do constitutions exist. Constitutions exist to establish the basic rules of government. Three branches.

How a bill becomes the law. Constitutions also exists to establish fundamental rights, things that we all broadly agree on, like what's contained in the Bill of Rights of the US Constitution, the Ohio Constitution as something very similar. What constitutions do not exist for is day to day policymaking, changing the rules about casinos or marijuana, or abortion or any other banner of things. That's not what constitutions are for. And we still have the ability to change the

law through initiated statute. As you mentioned, that's a bare majority. A bare majority can make policy, but you shouldn't have a bare majority changing the constitution. That's the rules of the game. If you will imagine if the US Constitution changed every year, think about the chaos that would be unleashed by that. They took the ten seconds out of it that they wanted, trying to tell people that this is exclusively about abortion. Here's what in the pipeline. If we're not careful. If we don't all get out and vote yes on Issue one, next year, we're going to see a massive increase proposed to the minimum wage in Ohio that would kill small businesses. That's

why the Chamber of Commerce and the Restaurant Association is supporting Issue one. Maybe the year after that it'll be restrictions on livestock agriculture. That's why the Farm Bureau is supporting Issue one, because they know what's at stake here. Who knows what next they want to legalize or decriminalize. Maybe they want to get

rid of qualified immunity that protects our police officers. Maybe they want to put some group of liberal professors in charge of our redistricting process or chip away and our election integrity. For visions, we do not need to have a separate constitutional amendment on the ballot every year for whatever pet project has been dreamed up. In California, a yes vote on Issue one will cut them off at the past. That's why they're freaking out about this, and to put more

meat on the boat owns. The Ohio Democratic Party itself requires sixty percent to change its constitution. The League of Women Voters in Ohio requires sixty percent to change its constitution. Washington, DC requires two thirds of the House, two thirds of the Senate, three fourths of the states to change the US Constitution.

We're completely out of whack when it comes to changing constitutions. And so if it's good enough for the League of Women Voters, and good enough for the Democratic Party, and good enough for the United States Constitution, it is not unusual to have a supermajority to pass constitutional amendments. It takes away the

ability of the legislature to tweak legislation. For example, when casinos came into effect or marijuana, there were numerous revisions to the original law because after one or two years we had to change the hours, had to change, the type, had to change, the three kinds of marijuana cultivation. When casinos came in, the sports betting came in. The lawmakers are in Columbus to

tweak the law. If this becomes to quote the constitutional amendment and people vote no in August and then vote yes in November, it means the lawmakers in Columbus have no say whatsoever. And changing abortion and can you tell the American people on this one subject of which will be many why the status of abortion, if the liberals have their way, will be much more injurious and much more liberal than Roe versus Wade itself that was overturned with the Dobbs decision.

the most extreme state and the nation. They're gonna say, oh, it's just about women's health, that's just about reproductive freedom or whatever else nonsense. This takes parents out of the decision making process. Some scholars believe that it would open the door to gender change surgeries for children without parental involvement. It would be abortion all the way up to the end of the third trimester.

Really for any reason that someone could dream up. It would make Ohio the most extreme state of the nation, and really probably more extreme than most countries in Europe. And this is not something that Ohio wants to see past. This is what they're going to try to jam through in November. If we don't all vote yes on Issue one in August, how about one man, one vote. I thought that was gender exclusive. The liberals love the term one man, one vote. Well, we have that after this, no

matter what happens the next three or four months. We have one person, one vote, no matter what. But they want to change the debate because they can have the debate on the substantive issue of a supermajority change the constitution. They can't have that debate, and they can't have the debate of having the most liberal abortion law in the world because there's no restrictions at all. They can't have that debate. So they have to change and talk about save

democracy. I see these silly signs in Madeira in Sycamore Township about fight for democracy. One man, one vote, save democracy. They can't debate the issue, so they lie about it. Now. Secondly, Frank Lrose, talk to me about the Senate. Why did you decide to run for the

senency currently pod by a Bernie Sanders lookalike named Shared Brown. Well, you talked about the deep dishonesty of Democrats in Ohio, and chief among them if Shared Brown, who has been lying to Ohio and for many decades trying to pass himself off as some kind of a moderate Democrat. No such thing. He is on the far extreme left of his party. And listen, I'm no alarmist, but I've been watching heading in and I can't sit idly by

while the wolf left deconstructs this nation that we love. That's why I believe I have a duty to run. I'm the only person in this race who has school aged children, and Lauren and I refuse to co parent along with the government. We want to decide what values our children are taught. We need to do something about that. There's chaos at the US Mexican border, and a lot of people go down there and pose for their photo op and get their tough guy photo by The Wall. I actually served on the Mexican

border as part of a counter narcotics task force. I saw drugs and crime pouring into this country. I know how to do something about it. And then the most important thing is that we need to get our economy on track. Biden and Brown think that you fix inflation by spending trillions of dollars and hiring tens of thousands of new IRS agent that will hurt Ohio families. It is hurting Ohio families, and we need to turn it around. It starts

with beating shared Brown. I'm the only battle tested conservative in the race. I'm a father, and I'm a fighter, and I'm going to fight for this country as your next United States Senator. Well, that sounds good to me. I think we have a lot of good candidates, and you're one of the one of the best. And I just hope that Ohio wins aren't tricked into believing the lies put out in campaign ads, and they can't. I'd like to have a debate on abortion itself. I want to have a

debate on the issue of changing constitution. By fifty plus one percent of the vote, I can imagine that if the liberals would have a vote on freedom of religion or freedom of speech, I would think that would go down in many blue cities and blue states. They don't want that. And the Ohio Constitution has been amended like one hundred and fifty times, and that's ridiculous.

The US Constitution has been amended twenty seven times, and since two of the twenty seven dealt with prohibition substantively, has been amended twenty five times in the last two hundred and thirty some years. And so now to say, well, it's so unusual to have a sixty percent supermajority to change the Constitution is ridiculous. And a lie about what's on the ballot in August and November is

even worse. So one other thought I want to give to you, and that is that somehow the colleges and universities must not continue to ignore the law when it comes to affirmative action. I had on David Yost earlier, I've had others. The colleges universities, especially University of Cincinnati, want to do workarounds and ignore the affirmative action decision. As a Senate, Kennadate, what would be your idea of making sure liberal institutions follow the law and quite practicing

racism, which is called affirmative action. No, you're right. In a very good decision by the US Supreme Court, we have finally moved back towards a position of meritocracy in this country. We believe that you should succeed or fail based on your merits, and this kind of discrimination that universities have been practicing and want to continue practicing even when it's subverting This decision by the Supreme Court needs to be met with opposition in the US Senate. I would support

sanctioning those universities. I think some of these universities with massive endowments ought to be paying taxes on those I think we need to do something about tenure for that matter. Just because you've been around for a couple of years on a college campus doesn't mean that you should be unfiable. The academia has become the bastion of extreme leftism in this country, and they're indoctrinating the next ration.

It's time that we fight back because what they're doing is not consistent with American values. I would put a sharper point on that by saying the following that the Gallop poll came out about two weeks ago and between the ages of eighteen and thirty years old. Eighteen percent of those Americans consider themselves to be patriotic, eighty two percent to not so. The longer you spend in high school, in college and law school, in medical school, the more you hate

America. And it's garbage in, garbage out. When they're told certain things about this country where that are false. Were in trouble all around the world. People are being taught to hate this country in Tehran, in Moscow, in Beijing. We need to teach our children to love this country. And by the way, when you're seeing problems with military recruitment, it's because of indoctrination, where children are being told that this is a fundamentally flawed, racist

nation. That's not true. We've had our problems throughout our history, but each generation makes this country stronger, better, more prosperous, and more free. Now it's our generation fast.
