Politically free, I believe, But nonetheless what happened yesterday is one of those break the glass moments in American history where because of a paperwork mistake, the leading presidential candidate of the opposition party was first indicted on thirty four counts in New York City, and then over a seven eight week trial, you add up the hours of deliberation compared to the thirty four counts, that means the juror
spent fifteen minutes on the different parameters of each count, and no one believes that is a fair process. And when the Attorney General of New York State, Letitia James, runs on a campaign platform of getting Donald Trump and then seeks to take a half a billion dollars of his money, and then Alvin Bragg runs on a campaign platform of going after Donald Trump, and he's successful from his perspective, when his previous Prosecutor Cyrus Vance said, you know what,
I looked at it for months and there's nothing here. So this is all political. A paperwork mistake may send Donald Trump to prison for many years. A Manworth's perspective on this, and also whether Joe Biden's going to be in the Ohio ballot, which is very likely, and or the foreign money flowing into Ohio which the Democrats want to keep coming. Is our Attorney General, David Yost. David Yost, welcome again to the Bill Cunningham Show.
And first of all, David, as a attorney general and as a former prosecutor, you spent years prosecuting felonies in Delaware County. Give me your reaction when we had the verdict yesterday about six pm. Well, I wasn't surprised, simply because the prosecutor and the judge steered the jury into this verdict, and it wasn't going to be a favorable jury for Donald Trump. In any event. You couldn't find a Trump's supporter in Manhattan with a search warrant,
So in one way, I wasn't surprised. But this is a dark day for the American justice system. Criminal penalties have been leveraged against a political opponent during a political season, after years of action for the purposes apparently of having a political impact. I think that this is likely to be overturned on appeal on several grounds. But bad day for American justice. David jos You spent years as a county prosecutor like a Joe leater some Melissa powers, and you
spent many many years doing that. Now you have some criminal responsibility but mainly civil responsibility in the state of Ohio, and you're also supervised BCI, etc. Can you imagine David Yost running for re election saying, if you liked me, I'm going to indict Joe Biden. I'm going to try to put
him in jail. And you're repeatedly saying that all of the state of Ohio from Cauayhoga County to Marietta to Cincinnati up to Toledo, and you run around the state saying, you know what, if you like me, I'm going to jail Joe Biden. How would that put? Number one, you wouldn't do it, But number two, Letitia James did that, Fanny Willis did that, Alvin Bragg did that, and now they're successful from their perspective, how unethical is it for a prosecutor to run a campaign saying I'm going to
focus my attention on one person to lock him up. Well, it turns with the entire justice process upside down. Usually, you conducted investigation first into a crime that you know occurred, and that leads you to the purpose person who committed it, and then you make a prosecution decision. This is exactly backwards. They targeted somebody first. It's shameless and unethical political targeting. I
just I can't imagine any analogous situation. And it's just long. It's a sad day it is, and can you imagine on sentencing July the eleventh, this Judge Mershawn has the power and the ability to demand that he stayed for six months and home incarceration or put a bracelet on him instead of sending him to state prison. He could say, you know what, Donald Trump, you have to stay in Trump Tower. We're going to have home incarceration for
six months. That would eliminate the campaign against Joe Biden and by the time he gets to the pellate level, we're one expert in a New York appellat law said normally it's two to four years. Two to four years will find out this thing should be reversed. How ridiculous would it be if Judge Mershawan took away off the campaign trail which has done for the past seven or eight weeks anyway, the leading candidate of the Republican Party and said you can't campaig.
Well, that would that would be a travesty in and of itself. And you know, also there is an appeal. There are multiple appeal issues here. If this judge orders the sentence to proceed on an old paperwork crime with no a fraud with no victims, I think that that that that in and itself is a problem. He should grant a stay of judgment on whatever it is he sentences pending that appeal, particularly even the fact that this man
is the nominee of one of our two major political parties. It's it's an amazing position that we are in here, but we're in it, make no mistake about it, because the Democrats have politicized our justice system. If Cyrus Vance Junior had thought that there was a crime here, they could have prosecuted this several years ago. They waited until this moment for the precise purpose of affecting the election. And I want to add, I am not saying that
Donald Trump as pure as the driven snow. You know, there are things I went. I support Donald Trump, and I'm a Trump elector I see him for all the warts that he has, but I also see Donald to see Joe Biden for all the warts that he has. And I can tell a witch hunt when I see it. Well, they got Cyrus Vans did
an interview about a week ago, and they went over. He went over and Cyrus Vans and his dad have controlled prosecution in New York for decades, and he looked at it repeatedly to try to find some criminal intent to violate election laws and or the I R. S. Tax Code and or the a Election Commission. And he couldn't find it. And he said, you know, it's not that a close call, and that I don't think is
the right thing to do. And so he retires. And they got Alvin Bragan there and he ran on a campaign doing dict Donald Trump, and he's been successful. And I had hopes that might be one or two jurors that would say this is BS, we can't do this, But that's not the way New York City works. It'd be almost as if Joe Biden was on trial in West Virginia. I can tell you the result, give me the judge, give me the jury, and I'll tell you what justice looks like.
And in this case, for a seventy seven year old man who has no previous criminal record to send him to jail. And normally in New York City you can kick a cops head like a soccer ball and it's no big deal. But this is a paperwork mistake of someone heading toward the age of eighty with no previous record, and they're acting as if they got al capone. Well. As you and I talked about this six months ago, I was hoping for the same thing, that there would be some juror and I
have confidence in our jury system. In this case. I'm not really blaming the jurors because the rulings from the judge and the way the prosecution brought this case, they herded the jury into a corner where this was not a surprising verdict. This is a process failure more than it's a jury failure. It's a legal problem of a manufactured crime. The statute of limitations on the business records falsification ran years ago. They're making up an enhancement. There's enhancement of
law. If you do the falsification in furtherance of another crime, you get a longer statute of limitations and it enhances to a felony. But Alvin Brat doesn't have the authority to bring the charge that he says that this was in further itself. That alone is enough to get the Supreme Court to overturn and say you didn't have authority to bring that. It can't be the basis of your indictment. And how many years we're talking about if you have to exhaust
your state remedies. Exhausting the state remedies may take two, three, four years. Then you jump into the federal system at the lower levels to go up a deprivation of fifth or sixth Amendment or fourteenth Amendment rights. That could take another two to four years. But the Democrats got what they wanted because they want this done before the election, and they rushed it through to get it done before the election, even though after appeal almost everyone says this thing's
going to be reversed. By the time it's reversed, where would Trump go to get back his character. Where would Trump go to get back his electability? So take off your Attorney general hat, David Yost. Politically it is a good or bad Tony bender, and others tell me it's very much. It's good for Trump because it gets the occasional voter to say this is wrong.
Does it help politically or not? You know, I've had a number of conversations with regular voters over the past few hours, and what I'm hearing out there is people saying, I, you know, I don't like waiting Donald Trump handles himself. But this isn't America. This isn't the way we do it. You don't prosecute political opponents and wait for the opportune time during the election season to get your verdict. This was delayed over and over again.
It was passed by you know, they didn't bring the elections violation at the federal level. Cyrus Vance didn't bring it when he was in office, but Alvin Bragg aptly named you had the humors to bring it. I think people are going to see raked through this and they may have just handed the election to Donald Trump. So second issue is Biden on the ballot in Ohio. I thought this was a made up crisis to begin with, because obviously
Joe Biden. I don't want to act like the Democrats act much like in Colorado and Maine and say Trump can't be on the back Trump can't be on the ballot. And now I say, put Joe Biden on the ballot. As we said here this Friday afternoon, about twelve fifteen, twelve twenty in the afternoon, is Joe Biden going to be on the ballot? Well, he was always going to be on the ballot by one of several routes, including the one that the Democrats announced on Monday that they've just held in their
back pocket. They're going to they could do a virtual nomination ahead of the deadline actually comply with the law. But the Ohio House yesterday passed a bill that will move the deadline and allow him on. It's my understanding that the Senate is likely to concur. Governor's been very clear that he thinks that you know that he ought to be on the ballot, and frankly, I agree with you, Bill. I want I want to kick Joe Biden out of the White House in a fair fight. I want to kick his tail.
I don't want to forfeiture. No, no, no question the way to win a pennant, No, you have to play the game on the field. Now, lastly, foreign money in elections. The Democrats are claiming there's no reason to bar foreign money into Ohio election because it's already against the law. I'm not sure that is correct. Can you explain to the American people the differential between candidate foreign money and issues foreign money coming into Ohio? So
right now it is against the law. I mean, Governor Dwaine, if he wanted to take a donation from an Irish citizen, he isn't allowed to do that. That's against the law in Ohio. But there's a loophole. And because nobody ever thought anybody would ever care in a foreign country what an initiated statute or an initiated constitutional amendment in the state of Ohio would be.
But what the left has figured out is that they can go overseas and some of these people that are aligned with the progressive left will be happy to write very large seventy eight to figure checks and funnel it through, you know, not for profits and what not to support outcomes that they want, Leftist outcomes that they want. So the wants to stop this and saying, you know, for you don't get to invent our constitution. They don't get to say
in how we run our society here in Ohio, our state government. And somehow the Democrats seem to think that that actually is a matter of freedom. I think it's a matter of sovereignty and that we ought to protect our system
from outside influences. Let Ohio be for Ohioans. And you know, I want to call out Alison Russa, the majority leader there in the Senate, Explain to me why it's a good idea that a Chinese, somebody from China or Russia or Switzerland can write a million dollar check to try to buy an outcome on a state issue, to a mentor constitution, or to put a statue in place. I don't get it, and I don't think that you can. I don't think you can convince the people of Ohio that it's a
good idea. Mister Attorney General. I don't think many Chinese or Saudi Arabians or Europeans can know where Ohio is compared to Iowa. They probably think it's the same place. Nonetheless, Lastly, the Ayatola Komani in Iran has endorsed the activity of college students in favor of Hamas. And I would think if you get endorsed by the Ayahtola that your behavior is acceptable to the Ietola in Iran. Is that a clarion call to college campuses? Don't work on behalf
of a moss am I right or wrong? When the istola endorses you, maybe you might be doing something wrong. I can add nothing to your logic, sir. The Iotola endorses Ohio State students protesting is in favor of a mass and the eye Toola is on your side. Keep going. Then you got Putin issuing some sort of statement or press release that he thinks it's wonderful that Trump was indicted because it means Joe Biden may stay in office. I'm sure give me your reaction is more or less a non politician about what you perceived happened with the Trump verdict.
Well, thank you for having me, Bill, And the reality is, as you know, I came from Columbia, South America, and what we've witnessed is a Banana Republic, third world judicial system here in America where you have a George Soros FUNDID prosecutor, a heavily conflicted judge, the number three guy at the Biden administration that went in to try the case. Basically, the leading candidacy the president is being persecuted by the sitting president of the
United States. This is the kind of thing that had happened in a country that we were giving four and eight, we would cut off that four and aid because of the assault and democracy. It's a dark, dark day for America. And you know, if Jimmy Carter was still functional, he likes
to go to foreign countries and tell them how to conduct elections. Can you imagine Jimmy Carter and his prom about twenty years ago going to Columbia and saying, well, the leading candidate for the presidency has just been indicted and maybe jailed by the opposition party. That's the kind of work that Jimmy Carter twenty years ago would fly around the world to try to correct. Maybe he's not capable of Hey, maybe you should fly to New York State. No,
absolutely, one percent. I guess say, it's a dark day for America. But to your listeners, Bill and I say this to you, we're going to have our retribution on November fifth. We got to go out and register our friends to vote, make sure they turn up at the ballot box. If they have to vote early or vote by mail. Let's encourage him to do that. We have to send a message to these lunatics that are trying to destroy this country and get our country back. We have that opportunity
in November fifth. Bernie Marina, what was two or three aspects the Trump trial you found particularly offensive? Well, I mean the first one is the judges so insanely conflicted. His daughter is a major fundraiser for the Democrat Party. He's a big donor to the Democrat Party. The number three person in the Justice Department or Biden, went there to try the case. Bragg ran an idea of taking down Prensident Trump. But most of all, nobody can
tell you what the crime is. Think about that for a second. They've just charged this guy with potentially jail time and can't even explain to you what it is that he did wrong. Well, and the verdict forums you would think to make all these thirty four so called paper offenses of felony and had
to obscure the commission of some other crime. And it was either Federal Election Commission or the i RX Tax Code or State of New York Corrupt Practices Act, And there was no delineation in the verdict as to which of the other
crimes which constituted offense. And so because the defense did not know which one to present arguments against, because the judge didn't tell them and the jury Verdict Forum didn't say Also, so they wanted to present three witnesses, One that it didn't violate tax law, Two it didn't violate federal election law, and three it was not a correct practice under New York state law. And Judge Murshawan said, I'm not going to permit you to put on testimony about the
critical aspect of the case. We don't want to confuse the jury. And then I downloaded the fifty five pages of jury instructions. And I've tried one hundred cases. I've seen jury instructions two thirds of boilerplate. But the one third not boilerplate would lead the jury to one conclusion, that is, can you beat Mike Tyson in his prime with your hands handcuffed behind your back, get in the ring and fight him? And the answer is that trump defense
could not put on witnesses. They did not know which crime which statute was violated, which crime was committed? And second when asked to do all three, judge Mrshawn said no. So imagine on trial. And there was one aspect of this, Bernie Marino, where the judge turned to the defense council and said are you ready, and the lawyer stood up and said, yes, you're on e were ready. He then turned to the state and said
are we ready and the answer is yeah, we're ready to go. And so imagine imagine having a judge on this side of the prosecution do what they want to do when the Mershawn family is making millions of dollars from this prosecution and Democrats and liberals don't see a damn thing wrong with it. No, it's it's it's outrageous, it's disgusting. But you know what's even worse here in Ohio is our city senator, a guy who's been in office, as
you mentioned, since Nixon was president, won't even issue a statement. This guy should immediately retract his endorsement of Joe Biden. He should condemn this, but he's such a coward. But it doesn't it shouldn't surprise us. He votes with Biden almost one hundred percent of the time. He's part of the extreme less liberal group that has destroyed this country. He does not deserve six more years. It should not be representing Ohio and imploring your listeners, let's
get him out of office. On November fifth, Bernie Marino. At the end of the day, Shared Brown has been running for political offices now for fifty two years, is running these commercials. Number one, he's your diabetes. Number two, He's cured cancer. And number three he works with Donald Trump all the time. In fact, he's running this win commercial where Donald Trump in the Oval Office is handing Burniemer is handing Shared Brown a pen.
And I'm thinking, well, assuming that Shared Brown endorses Donald Trump, it would be interesting to have Shared Brown come forward and say yay or nay, what do you think? And secondly, I'm glad you brought that up. Lots of commercials are being run that they're criticizing you for working, in other
words, working in a real job in a private business. So can you tell the American people from the time you arrived in Columbia, these commercials are being run against you by Sharon Brown saying you own car dealerships and that you wanted people to get undercoding or free car washes, as if that's a negative, and so explain to the American people. I answer the question about a little bit of your business background and whether or not you're ashamed of working for
a living. I am so proud of the people who work in my company and the company that we built, incredibly grateful to the amazing clients that we have. But what Sharon Brown thinks is honorable isn't getting up every day going to work knowing that you and you alone determine your success. What he thinks is honorable is living on the taxpayer dollars entire life, never having ever had
a job. He talks about the dignity of work. How would he know what the dignity of work is. He's never worked outside of being an elected official. This is exactly what's wrong with our political system. Our founders never envisioned creatures like Sheer Brown and Joe Biden. They wanted citizen governments. They wanted people who did something in the private sector would go to DC and then bill come home and live under the very laws they passed. We are being
ruled by these political lifelong career politicians. We got to get rid of them.
Well, what occurs on July eleventh, which is the sentencing date, And Judge mershawn I said, the last few weeks, as the evidence came in, many said, well, there's going to be one or two jurors that won't go along with us, I said, bs, those twelve jurors are being led to a defined conclusion by the admission of certain evidence, such as the kind of sex that Trump supposedly had with Stormy Daniels, whether a condom was used or not, has completely irrelevant to any element of the offense.
Irrelevant. Stormy Daniels had nothing to do with it. Karen McDougall had nothing to do with the offense itself, but the judge led them to a defined conclusion. Wrote the instructions to make sure Trump was convicted. What happens on July eleventh. This judge, because of the felony convictions, have great power over any criminal defendant. He could order home incarceration. He may require that Donald Trump remain in Trump Tower for the next six months or a year.
And people say to me that's not possible. I said, you want to bet, of course it's possible. The object of this is to win the presidency for a fail, utterly and demented Joe Biden by any means necessary, a threat to justice anywhere, said threat to injustice everywhere. I'm telling you that this judge would do that. What happens if this judge Mershon, whose family's made millions of dollars off this trial, would say, you know what, defended Donald John Trump? I send you to six months of home
incarceration and Trump Tower. You can't travel without my permission, which I'm not going to give you, and secondly, if you violate that, I'm going to put you in Rikers Island. What happens then, well, first of all, I agree with you one hundred ten percent. It is not only possible, it's probable. They will burn this country down to stay in power.
That's the reality. They have a senile idiot, let's just be clear, and Joe Biden running this country into the ground, and they will do anything they can to prevent President Trump from going back into the White House. What will happen is that he will. President Trump will win by a wide margin. Because that's what we get to do as voters. We get to decide who our leaders are. And on November fifth, I can't say it enough. Show up at the ballot box. That's where your anger should be
driven. Get your friends to show up at the ballot box. Let's send a clear message. Let's wipe these guys out in a way that's never happened in this country before. That's how we get our country back. Everybody's got a step up, Bill. We can't just sit in a sidelines and watch this country meltdown. This is a sad day. I'm actually in a way happy that my mom and dad aren't around longer than my mom passed away two
years ago. My mom loved this country so much as she would be absolutely beside herself to think that the country she brought me, my five brothers, my sister two almost fifty two years ago is gotten to this place. It's a paperwork it's a paperwork issue that's irrelevant. Can you imagine if the same standards were applied by a Republican prosecutor to Bill Clinton or Hillary Clinton or Barack
Hussein Obama or Al Gore or Joe Biden. What if a Republican prosecutor would say, you know what, that's a good approach taken by Alvin Bragg. Let's find some excuse or reason, some paperwork mistake, and let's go after him. I had on a prosecutor from Kentucky named Rob Sanders, who said, about six months ago or a year, Joe Biden showed up and gave a speech inside his jurisdiction in which obviously lies were expressed and misstatements were made.
He could indict him for obstruction of justice, or could indict him for this totally conduct and caused Joe Biden to come back to a small town in Kentucky in order to be prosecuted by a local prosecutor in front of Kentucky jury, and he would be convicted. Do you think this is a break the glass moment in politics and that it is now time for Republican prosecutors to take their cues from Alvin Bragg and Latitia James and Fanny Willis and to go after
Democrats in the same way they went after Republicans. No. I think what we do is our retribution is to win on November fifth and on January twentieth, take office and do get the agenda completed, secure border and sure American energy dominance, have pieces stability around the world, massively cut the size and scale the federal government, get rid of things like the Department of Education, make certain that we have low interest rates in low inflation, reindustrialize this country,
rebuild our middle class, and bring the country together. We have to free the Democrat Party from the shackles of the lunatics that control them, like Sheri Brown, Elizabeth Warren AOC. We do that by succeeding and bringing this country together. We don't want to be like them. Bill. We're going to win, and we're going to get this country back, and we're going
to be the beacon of liberty and freedom around the world. That will happen, but it's because everybody listening to the show is going to redouble their our person whatever they can to save this country. And vote early, and vote often. Vote early, don't wait till November the fifth, vote early. Lastly, I would say this, I would call upon Democrats, and there
are good Democrats. There's good liberal Democrats. The classic liberal Democrat was Robert F. Kennedy Junior, who said, a couple days ago when the who said, when the verdict came out, this is wrong. OURFK Junior said, don't do this. More Democrats got to come up and say, you know what, this is a break the glass moment and we can't go down
this route. Would you call upon Democrats to say to their own party, don't do this, this is a mistake, let him campaign, put him on probation, let the appeals take place, in which case it'll be reversed, and so point at the appellate level, either state or federal that'll be two to five years from now. And would you encourage Democrats to rise up against their own party? Absolutely one percent. In fact, I would call
in Sharon Brown to do the right thing. Condemn this, recind your endorsement of Joe Biden, and make it clear that you stand with American democracy and against the weaposition of our justice system. That's what share Brown should do. Unfortunately, Ability doesn't have the courage to even make a comment. I very
much doubt it. But lastly, I would say this, the idea that the Democrats can weaponize our criminal justice system, which is the envy of the world, and prosecute a citizen politically inconvenient to them is kind of the stuff of dictatorial governments. And I see the Aetola Kolemany came out a couple days ago complimenting the hamas protesters on college campuses. Putin issued a statement complementing the
American judicial system. Hijauping issued a statement the American judicial system because none of those characters want Trump back in the White House. They like it the way things are right now with the frail, mentally disabled, diaper wearing president who is not in charge of anything, not even these traps on his diaper. And as a consequence that when the Ayatola, Jijo Ping and Vladimir Putin endorses the Democrats, is that a message. Oh absolutely, it's a message.
And that's you know, Reagan called America rightfully. So the shining city in a hill, that light's not shining today, Bill, It's not shining at all. We look more like a third world been in a republic than we do to the country that my mom and dad brought me to. And that would change. But we have to vote. Use this anger to vote on November fifth and get these sons of guns out of office. We get the
government we deserve and the times that worries me. Bernie Marino running against Schriff Brown, if you win this race, the odds of the Senate being repared publican is almost one hundred percent. And even though Sherit Brown is running as a Trump supporter, no one believes it. He's to the left of Bernie Sanders, He's to the left of Elizabeth Warren. He votes with Joe Biden more than ninety nine percent of the time. You know, and I would

The New York Supreme Court is called the New York Court of Appeals, but it is the Supreme Court. And there's seven justices on the New York Supreme Court. They're all appointed by Democrats, all liberal Democrats. Shirley Troutman, Madelden Singis, Jenny Rivera, Rowan Wilson, Michael Garcia, Anthony Counetero, and Caitlin Halligan, all
Democrats and all Liberals are sitting on the New York Supreme Court. Now, if that goes against the Trumpster, he can then jump into the federal system. We're talking maybe three to four years down the road. And at that point you can file a special rit in the US Supreme Court, which is likely to be returned to a district court to build a better record. Then that will work, and say you go from the Court of Appeals in New York Supreme Court in New York. Then you jump out of that system like

Now you go to the federal system, beginning in the District Court of Appeals, to the Second US Court of Circuit Court of Appeals, then to the US Supreme Court. That'll take anywhere from four to six years from now by the time that concludes, by this point it's going to be the year twenty thirty. And don't get a resolution.
