Before we get into thinking some producers for tonight, we didn't we I think we brought it up on the post show. But recently I worked a Ben Folds concert. And I happen to know for a fact that there's some big, big fans of his hanging out in the green room. And huge fans huge fans. And I kind of say as a raw entertainer, I was very impressed with Ben Folds. And I would go see him again. I would pay a ticket or buy a ticket. I would pay for it.

Yeah. I thought, you know, he had a very natural charisma. Just telling stories, you know, kind of cordling with the band back and forth. They did sit around and fucking, I don't know how long. Four hours, five hours, nothing going on. They did sound check. Everybody walked away. I don't even think it was like a true sound check. But, you know, tomato tomato. And came back and the opener went on to perform. I actually bought one of their CDs.

They had a rough cut release of some songs they were working on. Kind of like a funky electronic acoustic duo. If that makes any sense. That's cool. I've seen those are hot on the circuit. The funky electric duo. Yeah. What's the name of the group? Do you have the album? It's in a jacket. And I don't remember which jacket and slash wear. Set jacket. It's. If I'm lucky, maybe they put it on the set list here. No. No. I'll say if I can find that. Pull it up later in the episode.

But yeah, so they went. And Ben's made his entrance with the band. They were getting ready to start. And he was like, oh, wait, do you all hear this? There's like a super hardcore come. I think it, I think it would be a big moment. Big, big moment. Almost a moment like Steve Jobs playing some podcasting there at the, uh, Apple, uh, reveal thing. Apple Expo, whatever the fuck they call it. Yep. And, uh, bringing it to the world, being fire. As long as someone's talking about it, it exists. This is true. So, well, uh, definitely, you know, we're going to be talking about this. We got a long while, but, you know, a year can also pass by like that.

And so I'm hoping that we get to get a chance to do that. Yeah, we'll definitely have to make it a make a night and hit some of the strip. I mean, it's, it's certainly very touristy in the one major vein that runs through Nashville. But there's some really cool bars that are kind of off the sides that, uh, definitely take it to. Oh, yeah.

Oh, yeah. That's it. I mean, you know, just run through it once just to see it and then you go to the cool bars. Mm hmm. You never go back there ever again. Yeah, and it's, yeah, without necessarily a video cast. I, it's hard to say because I, I feel like we're at the point.

If we were to do a video show, we would take it as hard as we could do something really weird with it. Um, oh, yeah, definitely. But, uh, yeah, just kind of having this like congruent theme is ish for all the stuff, you know, some sort of like trashy news stand, uh, zine. It really works. I mean, it's, it's just something that kind of fucking came together. I don't think we ever like sat down like, oh, yeah, this is going to be our plan. But we were like, no, this is what we both read.

So this is what this is all I know how to read. This is what I wish was around all the time except for, you know, except for what is around all the time. Let me just tell you this. Paraphrasing it. Um, because there was a, you just did the, the, the two diligence that so many of the, just of the outrage media in general. And my eyes, there is no difference between CNN and Fox News and all of them. They're all the same.

And, uh, it's just, it really, it's good stuff to know that there's people out there who, who very much are just wanting to present the facts. That's all you got to do. You don't have to, you know, form some cock and my main ebes sort of, oh, you should be outraged about this. This is why you should be concerned. Yeah, you don't have to bring the emotion into it in that way. You can be emotional just to bad bring the, the facts, the evidence, uh, having people to determine for themselves.

Daddy's A Lawyer

Uh, cool. What do you got for tonight? The news, which is something that we very rarely ever do. We rarely do the news, but I was in Central California this weekend. To attend a wedding. And I was in a coffee shop and I grabbed a newspaper. And I was reading the front page article here. Former Cal Poly student. Sues the university and the county. For suspending him for COVID. Oh, oops. That's right. So I was going to read a little bit of this article here. It was very interesting.

And we don't often do a COVID stuff. Is it's kind of a, a played out topic. Yeah. Um, yeah. It's. Unless there's some like new hot information coming to light. Like, what more do we need to Fauci lied? What? No. Yeah. Oh, big farm is evil. Okay. Great. It's all a racket. They fucking took my career of 10 years. What? Yeah. Come on. So. It's all. And everybody has to deal with it. That's the main issue with it is that everybody has to. That should sandwich.

Yeah. Um, so COVID is just that one of those things that you know, I'm talking about, but this article struck me because it. It was an event that. Somebody actually did something about it. Somebody was in a position to do something about it here in California, where it's been some of the most intense, you know, COVID mandates and suspension and things like that. Firing. I have been happening here and for the longest.

And in a ways, sort of still do, but about six months ago, everything kind of relaxed, even San Francisco and Oakland, where it's the worst. You can now work again. And, um, and not be vaccinated. It's not part of the, you know, the rigor. You don't have to provide papers. Any longer. And so now we have a situation where people are starting to fight back for the damages that have been done because a lot of damages were done. People were fired. People were expelled from school.

It was a very ugly thing that happened. And it is in our. And the constitution, uh, the ability to sue the shit out of each other, ultimately, as the Supreme Court has found to see. This country was founded on lawsuits. And on law and on courts. Uh, you know, I watch John Adams and I realized that. Very early on before the revolution, he defended the British soldiers who fired on the Boston massacre. He defended the British soldiers in court. And he won and saved them from being hung.

And, uh, it built his reputation early on in the movement as somebody who was impartial. Somebody who actually was a true lawyer who. Who didn't, you know, wasn't caught up in the fervor of revolution and all that. And, uh, feel like that's something that isn't taught ever. But, uh, the nation was founded on law. You know about the Boston massacre. Everybody knows about that one. Oh, yeah. It was one of the events that, uh, sort of was utilized. You never let a tragedy go to waste.

And this is a certainly true pre-amer or pre-1776. Mm-hmm. And it was largely facilitated the response to it by Sam Adams. Samuel Adams of Beer Fam. And, uh, he was his cousin. Small country back then. Small country. Small country. So anyway, uh, reading from the article here, we have the Etesca Darin News. California Polytechnic State University or, uh, Cal Poly, as it's popular. I'm down in San Luis, Vispo, which is one of the finest institutions in the land.

Uh, could be entering and the county of San Luis, Vispo, uh, in general. Is entering court as a former student as filed a civil lawsuit against the university and several administrators, including the Slow County Health Officer for violations of his federal and state rights. Elijah Barenger is challenging the university and the county against the legality of their COVID mandates. They're resulted in his suspension as a student there in January of 2022.

Barenger, an electrical engineering student from San Bernardino County, attended Cal Poly for two years until the school denied him access. Uh, and then it continues on. Hey, son. Uh, to class University of facilities in January 2022, he is represented by Barenger Law and his name is Barenger. So, I think they fuck with the wrong student. And daddy's a lawyer. Uh, a Coral's bad base law firm filed a complaint.

According to the court records, the defendants include the included in the suit are Cal Poly, Cal Poly president Jeffrey Armstrong, Cal Poly assistant vice president for campus health and well being Tina had away. Cal Poly leader coordinator for COVID help at campus health and well being by a hearty.

Cal Poly assistant director for the disability resource center army, good day, the Slow County, San Luis Obispo County, political subdivision of the state that provides municipal services, including law enforcement and public health services. Everybody's getting a piece of everybody. This guy's going over the whole ground and then he's going after the county director of public health, a penny, born steam. And file documents provided in the complaint Armstrong issued a presidential order.

And that is Cal Poly president Jeffrey Armstrong issued a presidential order to go into effect on October 14, 2021. And ordered students to adhere to the COVID-19 requirements, such as wearing a mask undergoing vaccination, testing, all of which bearinger refused. In September 2021, bearinger skipped enrollment with the intentions to return in January of 2022.

However, court filing say that in December of 2021, he received an email from headway, Melis, me, as Melis, who is the vice president for campus will. Health and well being. Who said that they demanded that Elijah participate in ongoing COVID-19 testing program to programs to attend class or be banned due to non compliance. Non compliance. There it is. Elijah refused to be injected with the COVID-19 vaccine, wear a mask over his face or submit to testing.

Bearinger requested an exemption, which says that he was said that he was denied. And then he was suspended. The news reached out to Cal Poly for response, but no response. See, here's the thing. Here's the thing. If he didn't want to get suspended, he would have taken the medical intervention. It's as easy as that. You pay the paper, you follow the script, you get to be in the play. Otherwise, no work in this town. You'll never work in this town again, kid.

Looking the whole world turned into Broadway all of a sudden. Yeah. And then no one did it worse than Broadway. That's why Broadway sucks now. It's just a bunch of fucking ass suckers left. You know, they didn't, well, I don't think at least they followed up on this. But when I was negotiating a potential tour back in 2021, I guess, there was never discussed as far as what my status was at that time. And all that I learned, because I knew that they were going to try and do something for sure.

But there was a stipulation that they were discussing. I was like, oh, well, you know, perhaps if someone's not vaccinated, then we can just make them start paying for biweekly tests that we're not going to reimburse. So you're going to have to pay out of pocket twice a week. Great. They go get your shit spun up so they can count the virus particles. Oh, you got too many. Oh, you're going to like you in the hotel for a week.

And you want to take it the shot. Yeah. It sounds so callous. I'm so jealous of people that think like this in a way. I'm thirsty. My final thought is it's no wonder that people are discouraged when things like this happen. Promises that were made are broken by institutions.

Water conservationist group out of Denmark. I want to say that was doing things like the urban sun, which was these giant lamps that they would drop in public areas that were supposed to be these disinfectant lamps. That would help cure COVID. And. Oh, shit. What else did they have? They had this other thing where they were projecting what. It's terrible. You panic street lamps. Yeah. Oh, yeah. It's very spooky. It's super weird. Yeah. And the. The. There was this other one.

They were under underpass. And they were projecting what the water. And they were projecting what the water levels were going to be in these things are like 30 feet tall projections just you know right up to the edge of the bridge and just showing this whole area is going to be underwater. And. Anyway, we were. There was around that time that that all came together and. Before that I was just a troll. A trolling around. I wasn't a podcaster. And this guy, you know, he, he, he, honey potted me.

He just asked me on for the one episode. And he's like, oh, hey, by the way, you want to just like do this forever. Like, uh, like, all right, fine. Yes. Basically what happened. And at the time, I just have to say we didn't have all the. I mean, we did have the show notes, I believe, but it wasn't what it is now. And we didn't have spooked that social and we didn't have the shop and we didn't have. Like a lot of the podcasting 2.0 features that we've got going now.

It was, it was very much, you know, back then in its infancy. I did not at the time imagine that we would be. Or rang into all the fields and things that we are doing now. Simply just from the show itself. Is it's not just the show that we do. It's all this other stuff as well. It's that helps the show that's that's born from the show and returns to it. It's it's just interesting how this has grown in our time. You want it, which is almost three years. I know.

I'm excited to see what happens after 30. After 30 years, yeah, as if we're either one of us are going to make 30 years. I think I'm going to get stuck with the curse of actually making. Oh god, it'll be even worse. Just like some crumbogen like god damn it. They're carting your ass around. Breathe in out of a fucking tank. Take me to Canada. Take me. Take me. Mercy on me, please. Oh, fuck. Oh boy. Yeah. That's that's good stuff. It's been fun. It's been a good time and. Yeah, not wrapping.
